Supreme Court Upholds Obamacare ... AS A TAX

George Washington's picture

In 2009, Obama said that his healthcare reform bill is not a tax:

The Supreme Court just upheld Obamacare ... as a TAX:

A divided Supreme Court largely upheld the Obama administration's health-care law, saying the law's penalty for those who ignore a mandate to carry health insurance counted as a tax and was justified by Congress's constitutional taxing power.

The fact is, this rule is a claim of dominion equal with Lucifer's war against man and our Father in Christ. This rule declares God, his image risen, in agreement with man as free and indepenedent from the contempt of another, to be so marked and subject to the penalty of prison and death. If anyone objects to the new social fascism, and stands in agreement with the spirit of the Constitution, life, freedom, liberty and indepenedence, they are now exposed to the will of another that has claimed dominion over them by this rule. To hell with everyone that accepts this ''change''. They have forsaken everyone that ever fought and died to protect freedom. May all persons that stand in agreement with this new rule perish. May every last political scumbag die that agrees with this new rule and may the judgment risen as a result of this rule come upon this and every nation that buys sells or trades this lawless market that allows for this beast to live another moment.

I just started playing around with the concept of Obama nationalizing insurance à la GM. Any considered thoughts on likelihood or ramifications? I found some prior art published on April 4, 2010—how does yesterday’s ruling change this thinking?

Obamacare is a wealth distribution schema in a country that, because of the power of Big Insurance and the fear the general population has of the tax bogeyman, will never get Universal Healthcare.

The problem with the 'tax' part of this bill is it is a penalty, if you pay the tax it is because you didn't or couldn't pay for health insurance. You don't get health insurance for your tax money some other poor slob does, you just get poorer.

Fri, 06/29/2012 - 10:28 | 2573142 passwordis

Obamacare is NOT a wealth distribution schema, unless you consider large corporations the recipients of the wealth.   Healthcare is a scam and this new law (written by the insurance companies) is a scam on top of a scam. No health insurance (ever) in this family of five, No checkups, No dentists, No prescriptions  No vaccines. All of this, along with staying away from junk food (which is most food these days) equals NO HEALTH ISSUES in my family and no need to have a family doctor.

To think that the Government is telling me to take money from my family and give it to an industry which seeks to increase profits by destroying the health of my children is maddening. It's insane.  I hope people realize that this is just the beginning. The government/insurance cabal is going to mandate which doctor you see, what tests you are given, what treatment is appropriate, at what time and frequency you must get check ups..... and if you don't adhere to the Government health schedule or agree with their choices for you, there will be consequences.

Exactly...you don't need a mandate with single-payer. Everyone's covered (to a minimum degree, by default). That plus top-up insurance works well in Switzerland and could here too, but as you said Big Insurance swings a bat in all three branches of the best democracy money can buy.

Mandated Unhealthcare for All!

Technically, Congress has limited taxing power.  For example, the IRS is unconstitutional, but when courts were called upon to review the law that was shoved down our throats one fine Christmas Eve and under dubious circumstances, the courts just tucked tail and upheld the law such that case law precedent now supports - sort of - the existence of the personal income tax.

That said, it's all the more idiodic that we've got Obama Un-care justified as a tax.

PS:  After 2 years, to flee might become nearly impossible.

This is the first time I've been really tempted. When you suddenly find that the land of the free, is no longer free, or at least is only as free as the majority lets it be, it makes you ask: I wonder if there are other places out there where freedom is thought to be an inaliable right, now that it no longer is in the US.

Tue, 07/10/2012 - 17:43 | 2575133 honestann

Sadly, we're probably not going to find honest, idealistic people anywhere, at least not in the majority.  However, the predators DBA government in the USSA are vastly more self-consciously nasty thugs than elsewhere.

And also a major consideration is the quantity of resources they have to prey upon everyone.  So as a practical matter, you can try to find less aggressive predators DBA government, but other approaches work too.

For example, you can find a relatively poor, "keystone cop" style government that can't get out of their own way, and doesn't have the resources to hardly ever mess with anyone outside the cities --- and you move into the countryside, if not boonies (like me).

It sounds very strange to hear, but some of the best places may be "run" by self-proclaimed "kings" or "absolute dictators" who just screw around in their narrow little cliche in the capital city... and don't even notice "his" outlying districts or islands even exist.

Also, never forget this huge consideration.  If you live in the country you are a "citizen", that government absolutely, positively, considers you "their slave".  However, if you are NOT their citizen, you are a visitor, which in their mind means you are spending money into their economy and therefore tend to be seen as a welcome guest.  I know, crazy!  But true.

So the Democrats are cheering the decision and hailing the Supreme Court (Roberts) as doing the 'right' thing. But the decision requires that the mandate be called a tax as the rationale, but the Dems cannot not call it a tax because PONTUS said that it was not a tax ... does anyone out there have an argument to bridge the gap

So Roberts said that is was a tax (individual mandate) ... and was not a tax in his written decision. His rationale is as convoluted as the law itself. How can people who are supposed to be so smart can thnk that others are so stupid as to believe that which can't be defended with any kind of logic.

It will destroy itself if this sort of craziness is allowed to continue.  As this ruling gives a green light to more tyrannical powers than King George have to agree with Thomas Jefferson in this one when he said that the tree of liberty needs to be refreshed with the blood of tyrants.  the only difference is that because of Thomas Jefferson and the other Framers that can and should be done at the ballot box. The entire thing needs to be destroyed back to where it started from.  Look at the wealth freedom resulted in.

Everyone who eats is REQUIRED to buy selected foods at Walmart. Poor nutrition corrected.

Obamacare is an outragous attempt to foist a Soviet-style socialist health care system onto the American public.  Romney recognizes the fact that in this country good health should NOT be a birth-right - it is a PRIVILEGE - and a privilege that should only be available to those who are hardworking, wealthy, and smart enough to pay for their own insurance.

We should not try and emulate socialist hell-holes like Australia, Canada or Sweden where every dead-beat can access free public health systems regardless of whether they've saved up to pay for it or not.

This nation got to be great through people standing on their own two feet and taking responsibility for their own health and wellbeing. Not one dime of our taxes should go towards supporting socialized free health care for those too lazy, poor, old, disabled or stupid to look after themselves.

Romney’s pledge to abolish Obamacare is only a start.  He also needs to commit to ending all other existing socialist programs in this country including Medicare, VA, Medicaid and Social Security. These government-run programs are just pandering to people's laziness and lack of personal responsibility.

Medicare in particular is the worst socialist program ever introduced in this country (by another lefty Dem President - Lyndon Johnson in 1965). It's a single payer government run program funded from taxes paid by you and me - to support old sick people we don't even know!

Back in the '60s the GOP fought long and hard to prevent this communistic system becoming law. As Ronald Reagan said at the time the Dems were trying to force this thing through "If you and I don’t stop Medicare then one of these days we are going to spend our sunset years telling our children and our children’s children what it once was like in America when men were free.”

George HW Bush Described Medicare in 1964 as “socialized medicine at its worst” and. Same with Barry Goldwater who said: "Having given our pensioners their medical care in kind, why not food baskets, why not public housing accommodations, why not vacation resorts, why not a ration of cigarettes for those who smoke and of beer for those who drink.”

Social Security is another communist program that needs to be abolished right now. The U.S. Social Security program is the largest government program in the world and the single greatest expenditure in the federal budget, accounting for 20.8% of the total budget?!  And what is 'social security' ? It’s nothing but a program to take hard-earned money from the likes of you and me to allow lazy old people who didn't bother to save for their retirement during their working years to live high on the hog.

Nothing worse than creating programs like this which give lazy people a sense of entitlement.

So good on Romney for committing to the repeal of Obamacare.  Now I just hope he goes that necessary step further and commits to the unwinding the other socialist and communistical atrocities such as Social Security, Medicare, Medicade and VA - which are also totally unconstitutional and anti-American.

HA HA HA. You think you are being sarcastic but you are more right than you know. Social Security, Medicare, Medicaid, and the VA are all going broke, dumbass. So I am just hard hearted when I say unwind the Ponzi schemes? BTW, the entire world is going broke but the Free Shit Army just demands more and more. And those Socialist hell-holes, I mean utopias, you refer to are all also in trouble even though thye are subsidized by us, by our military strength, and our healthcare industry. But the party is going to end soon, my friend, because Math is a Bitch and she don't care. Too bad government is your god and you don't have any real faith or charity to fall back on. And I know the Rethugs did this, too. Reagan-EMTALA, W-Part D, Nixon-HMO.

I have bad news for you... there is nothing communist about healthcare in America... it is crony capitalism / fascism... pure and simple.  Second, Medicare part D was passed by the GOP and pharmaceutical companies wrote that legislation. Third, Romney was in favor of basically the same system as Obama, and he installed it in Massachussetts.

Fri, 06/29/2012 - 04:14 | 2572497 eastofthecosmos

Crony capitalism, fascism, socialism, and communism are all basically the same thing.  Anti individual freedom.  They are all just different words to define the same thing.  Second Medicare part whatever are all part of the four things listed above.  Third great for Massachussetts, that is called states rights.  States are allowed to try things and the rest of the states are allowed to see what miserable failures some ideas are.  People can vote at the ballot box or with their feet and move out of the socialistic healthcare of Mass. The Law should just protect everyone's rights of life, liberty, and property.  Try to take law beyond that and you will pervert it against someone else's rights.
