Liars, Crooks and Thieves | Fraudclosure - Another Accidentally Leaked Email, This Time By Albertelli Law and Wells Fargo

Well, well, well...

Look what we have here. Another attempt by the Fraudclosure industry to steal a home in the name of the wrong plaintiff.

This is almost identical to what happened in the LOPEZ case. See here, here, here, here, here, and here, but potentially much worse.

Could this one be real trouble for the parties involved?

This one goes a little something like this...

From pages 11-14 below... 

 

Wells Fargo: Um, your firm just sent us a rush request on this file, but before we can take care of that for you can you please take care of the request I been waiting for? Been waiting on your sorry asses and we need to steal this house ASAP since there are some issues that need to be addressed. Oh, and by the way, can you send us a copy of the complaint? Something might not be right. 

Albertelli Law: We have no idea what your are talking about, (like usual) could you be more specific? 

 

Wells Fargo: Look, nobody sent me a rush in the LPS system, now get me that complaint. We gots issues here... 

 

Albertelli Law: Don't give me no attitude. I'm going to pass you off to our complaints department.

Wells Fargo: Oops, looks like someone from your office did send a rush request. My bad.

Albertelli Law: Yea, that's what I thought. Going to pass you off to David now. Anything else you want?

Wells Fargo: Yes David. Here is the message I sent over in LPS Desktop:

We are in the process of trying to complete the theft judgment affidavit on this file, however the one that was received has the Plaintiff as DEUTSCHE BANK AS TRUST COMPANY AMERICAS AS TRUSTEE FOR GMAC-RFC MASTER SERVICING. We have the plaintiff as U.S. BANK, NATIONAL ASSOCIATION, AS TRUSTEE FOR RALI 2006-QSB. Once the change is fabricated acknowledged by your office we will forge execute the affidavit received. Your office can assign the bid at sale or the affidavit can be falsified resubmitted to judgementaffidavit@wellsfargo.com mailbox with an amended plaintiff name. Either option to steal this house is acceptable to us - please advise on how your office will proceed to impose a fraud on the court proceed within 48 hours or the file will be stopped.

Albertelli Law: We will leave this "as is" so just execute the affidavit, Linda Green will do. There is no association on this matter so we don't have to worry about paying them any fees.

Oh, and by the way, we should assign the bid after the sale from DEUTSCHE BANK to U.S. BANK right?

Wink, wink...

Now what makes this one interesting is the note is specially endorsed to DEUTSCHE BANK.

Let's see how they get out of this one.

All proper parties, ie First Amendment Foundation, FL Bar, etc. have been notified.

We even cc'd all the emails from the perpetrators as well.

Wonder if Akerman will pick this one up like they did in Lopez...

If this has now happened twice, (that we know about) it is happening in scores of cases...

And to think nearly EVERY Attorney General in America has jumped into bed with these crooks, sorry bankers, and cut a deal with the fraudsters including lining the AG's own pockets with a 'bung' (bribe money: the profits of criminality?) to avoid/whitewash criminal and civil litigation

Which makes AG's party to criminal ...???????

Well they're certainly not party to homeowners who were the contractual party and were left (ever so strangely) out of the AG's (re)negotiations with the banks.

How can you re-negotiate mortgage contracts without the consent of 1 of the 2 main parties? How can you move the goalposts of the entire legal framework under which those contracts were written and not involve 1 of the 2 main parties??

Another thing you can do is close your bank accounts at the TBTF criminal banks. I would've never gotten an account at WellsFargo in 2000 when I first started my business and needed a bank that could set up a buisness account. My Credit Union could not do that. Now I'm closing my business, closing my Wells Fargo account and going back to my old Credit Union.

The thing I don't understand is "What's the rush?" Are they trying to steal property to add to a portfolio on a balance sheet? Doesn't the asset exist whether it's foreclosed on or owed money? The loan is worth more than the foreclosed property, none of this makes sense.

As a laymen who reads a lot, but doesn't get all the machinations of the 'score', this is how I understand it:

 

Banks bundled the mortgages and sold, resold, sold again, etc.; up to 10 times on each of these mortgage bundles that was rated AAA. The investors who bought into them would have a lot of legal recourse, but for one thing- they all were told that the 'loans' were forclosed on.... so sorry, bad investment, better luck next time, (quick, hide the asset off balance sheet so we don't have to declare anything and look worse to our stockholders).

The banks NEED to forclose, or the house of cards (pun intended) comes crashing down even faster, and pitchfork/ torch sales skyrocket at WalMart when people realize that not only were they given obscene credit financing for shit, but Libor helped 'fix' the rates, MERS lost their paperwork, but helped assign the value of the mortgage for the bundles, Wall street sold the bundles to anyone not part of the 'system' and even a few of their compatriots to provide enough smoke and mirrors when it all got caught on to; mostly by sovereign countries up to their eyes in buying the CDO's and CDS for .gov pension plans, etc. And in the end, the last guy holding any type of note that a court ruled on, gets to keep their ass-ets covered, everyone else is OTF.

Not the most eloquent explanation, but then I'm not a 'tails' type of guy. Ask some of the more informed and better reasoned ZH'ers for more. I just gave enough to light your way down the rabbit hole.

Good Luck, oh, and take a tums or two before your journey, it gets sickening the more you find out.

Bear Stern's actually sold some of those Notes 42 times.Then took out CDS

on those 'sales' as well.

However the 'sales' never took place even though the money was provided by

the MBS investors.One reason why,the banks needed those notes as collateral

 in the REPO market.The forecloseures are cramming the  MBS trusts  into ownership of

bad loans that are specifally banned from  the trusts, in their Poolinig and Servicing

Agreements ,and it also destroys their REMIC status.

Needless to say,the banks are charging the trusts for this malfeasance.

Somehere,there are bank accounts sitting on trillions of dollars.

Nobody is following the money.

At some point several thousand bankers and mortgage company execs need to go to jail to maintain the credibility of our criminal justice system.  If this does not happen then all we are is a version of the Mexican Narco State.  Substitute Banksters for drug traffikers and you have the analaogy.

The actions of these players are indicative of just how badly our systems are broken.  Real Estate, Banking, Financial services, legal, regulatory, justice, and the list goes on and on.

Not to sound like a geezer, but if this had been tried in the 50's or 60's, heads would now be on a stick and former CEO's would be in Folsom.  I guess this is what happens when an empire begins to crumble.  Today it seems all the people with any principles or morals, even good business sense, have been layed off, fired, demoted, marginalized or otherwise "hot-tubbed".

For proof, have a look at how the Obama administration treats whistle-blowers.  Bradley Manning, Sibel Edmonds, Gary Mackinnon, Julian Assange, William Millay, (probably many more we've not heard of) the list just keeps on comin'.

Yes, as Americans we should find enough common ground to Join together to save our Constitution, personal liberties,lose the phoney left/right paradym, which these tyrannical bastards play against each other to keep us misdirected and distracted. I'm sure we love our Country enough to find common ground. There is really only 100,000-150,000 who might lift up arms against their brothers and sisters and side with their bankster slave masters. Once they realize that 300 Million plus will not comply they should drop ther weapons- Unless Al-CIAaeda is re-actvated in the USA once again.
