There’s a New Sheriff in Town | Christopher Conley, High Sheriff of Carroll County NH Announces Criminal Foreclosure Fraud Task Force

Christopher Conley, High Sheriff of Carroll County NH, holds a press conference at the County complex on 7/2/12. He announces that he is forming a task force to investigate mortgage fraud. Fraud is occurring across the United States. Properties being foreclosed on that are owned outright. Financial institutions that stake claim to a property without a deed. The Sheriff states: "In each case there is no accountability be the financial institution, no one to present a reply, no decision maker to speak with. I bought my house in FL with cash in 2008 and in 2010 I got a letter from Chase saying my mortgage was in arears and that they were going to start foreclosure proceedings on it.  I sent them a registered letter explaining the situation and never heard back from them.  Hope that works in the long run.

Used to live in Carroll Co and 20 years ago there was no shortage of commercial/retail growth. I still drive through it on Rt 302 once a year and it is progressively dieing on the vine. In the next 10 years it ought to resemble the hollow shell that is N. California.

Yeah, yeah, yeah, I know all about the Lopez case.  Worst case scenario, there is a voluntary dismissal, and an assignment of note and mortgage, and presto, chango, problem solved.  At the end of the day, the deadbeat borrowers are still going to lose their house, as they should.  As far as my name and bar #.  I certainly wouldn't reveal it in this forum.  Too many loose cannons roaming around here.  I could send it to you in private, but I don't trust you.  Do a little digging.  Who knows, I might be closer than you think.  Of course, I now know you are not a lawyer, which explains a lot.  Your Chicken Little routine is really getting annoying.  So, how about you STFU?

Thanks for the post 4closureFraud. I was wondering when some sheriff somewhere was going to start investigating criminal fraud by the banks, and it's nice to see RICO mentioned. It's hard to say where this goes though.

Either he was being very cautious about what he knows, or he's in over his head. It seemed like his appeal for volunteers was a sign that probably his office doesn't have the required expertise.

Still, this is one of those cases where doing the right thing is also a political benefit. If he can hamstring banks from foreclosing in the county, there is no doubt the citizens will reward that with re-election. Still, I get the feeling that he's not doing this for political points. I get the sense he has had to evict a few too many families who demonstrated to his satisfaction that the bank action was of debatable legality. And the irony is that he probably threw them out anyway. For anyone with a conscience, that has to be a tough job.

Good for him for having the courage to investigate the fraud; hopefully it's the pebble that starts the avalanche.

Carroll County is the White Mountains, over to the Maine line.  Plenty of Boston and CT ski chalets, but also some real bedrock natives - most of the old timers can remember working in the logging camps in the winter for 2 or 3 bucks/day.  I'd imagine they have one of the lowest welfare rates in the country (even if they'd qualify).

You can check out NH's rate of food stamps here (http://www.fixwelfare.com/wp-content/uploads/Chart-1-part-1.jpg), one of the nation's lowest, though neighboring Maine is one of the highest. I guarantee you it's NOT because they don't qualify - they just won't take it.   Dirt poor - and they'll still give you the shirt of their back.

1.  Foreclosure fraud exists, but it's miniscule compared to MORTGAGE fraud.  If we're going to hang a few bankers, let's hang a few hundred deadbeats along with them.  Nobody held a gun to your head and demanded you sign the PM.  You did that all by yourself, back when you thought you were a fucking financial genius.

2.  Now you want someone to blame.  You bought the F150 and you blame the oil company because you can't afford gas.  You bought the McMansion and you blame the realtor and the banker because you can't make your payment.  It's all so predictable.  There's a reason you keep getting gamed.  It's because you are greedy and you never learn from your mistakes.  It's why you buy lottery tickets, drink crappy beer and spend Sunday's watching the NFL, hoping your health insurer covers the Cialis being advertised during timeouts.

YOU ARE BEING GAMED AND YOU KEEP FALLING FOR IT.  All they have to do is change the fucking wrapper and you act like it's something brand new that you've never seen before. Listen, you want to win for a change? Try this:

1.  Control your emotions.

2.  Learn to think for yourself instead of letting someone else think for you (like this site, for example).  That means spending less time with people who validate what you believe and more time with people who make you uncomfortable.  The first group will make you feel self righteous.  The second group will teach you something.

3.  Do the opposite of what everyone you know is doing.

You won't though, because it's much easier and far more satisfying to your simple minds to rail mindlessly on a message board.  Go ahead.  Just recognize that it's a game, and there is no revolution.  Thank your lucky stars for that.  You'd lose.  You always lose.

He explained in the video that he has been sheriff since 2009, and that it was in the last 9 months or so that he's seen more problems. I'm going to give him the benefit of the doubt, and see where this goes.

The thing that differentiates this from some of the other things that have happened, e.g. MERS cases, is that the sheriff is the person who does the actual evicting. They are law enforcement, not attorneys. So in my mind, this is different because what he is in fact saying is: I don't trust the legality/legitimacy of my orders to evict people. And at the end of the day, who else but the sheriff can evict? You think BOA is going to send goons to drag Mr. and Mrs. Smith out on the front lawn and throw their stuff to the curb?

The other difference is that I don't think his goal is financial settlements. That's a big problem with all the so-called regulation. Who cares if some regulatory agency prosecutes some big corporation and then lets them off the hook for paying a pittance, and nothing ever gets back to the victims. It's nothing more than a bribe. This sheriff started the press conference, and in the first sentence stated this was a criminal fraud investigation. Key word: criminal.

It begs the question that when the Sheriff's office is being asked by the Fraudster Banks to evict the homeowners, and the locals are part of the community--what allegiance is the Sheriff going to have to some Debt Servicing company, in Florence, South Carolina?

The Revolution is Local, and yes, it will be televised, with only one or two participants! Why wasn't the room chock a block full?

Actually California may not crater and here is why:  the statute of limitations on debt collection expires after 4 years in California.  So, if there are any homeowners who stopped paying their mortgages in say, September 2008, then the banks have only until October 1, 2012 to collect the debt (i.e. foreclose the house).  Same applies to credit card debt and all other debt (except oral contracts, which expire in only 2 years).  If the bankster has not collected the debt by then, then that means they are legally not able to collect the debt.  Sure, they may still choose to waste a buttload of lawyers fees to get a judgement, but they can not collect the debt so any such judgement is technically worthless. 

I doubt they would waste the money trying, especially since they generally can't produce documents with original wet ink signatures on them. Deleveraging here we come....     

Oh, and hey Sheriff Conley - NH debt expires in 3 years, except for Promissory Notes, which expire in 6.  So, if your investigations can drag out the foreclosure process for at least 2 more years, then you just handed a huge advantage to your residents.

Wrong again!  The statute of limitations usually begins to run when the debt matures, which is usually 30 years for promissory notes on real estate.  Its not when the debtor stops paying.  Since you mentioned California, here is a link to the applicable statute.  Statute of limitations in Cali could be up to 60 years.  How's that online law degree workin' for ya.?

How else could you explain that most debt clears off of an individual's credit report after 7 years?  You clearly do not understand that the USA outlawed debtor's prison, indentured serivitude, and also (eventually) slavery years ago.  I am beginning to question if you are a member of any Bar in the USA.  You clearly do not understand our laws.

Go look up the legal term "fraud in the inducement". If a corporation gets somebody to sign a contract that they know the other party won't be able to fulfill it's called fraud in the inducement.

When Countrywide used a fraudulent appraisal and then gave a mortgage for an amount way out of acceptable range for someone whose income they tarted up and knew wouldn't actually qualify, that was fraud in the inducement and it happened millions of times over.

The recourse against the borrower was right there in the contract. Take the home. So, take the home . . . using the required legal process.

Now, as to the mortgage issuer . . .

if you actually read the letter before you commented you would have realized that he is going after banks that are trying to foreclose on properties WITHOUT loans. Besides banks were willing participants in accepting fees and commissions from those who didn't fill the forms out completely. Liars loans were good as long as the application fee check cleared (hint hint, wink wink)

@4closureFraud - please do correct me if I am wrong, but is it or is it not illegal to falsely represent oneself as an Officer of the Court?  In this case, would or would not "wareco" be committing a criminal offence if he/she is indeed not a "lawyer" as claimed on this thread? 

I think any reasonable person would agree that somebody claiming to be a medical doctor on a thread, and then proceeding to dole out "medical advice" would be committing a crime.

Have you ever had a mortgage?  A paid up mortgage?  I have two.  I have plenty to pay off both, never a late payment, and I pay off extra principal.  The banks will still try to pull any shit and the regulators are all for it.  Some f*king O-Kenyan AA banking regulator does not like the loan for any reason, they lean on the bank and the bank leans on the borrower.

This is not upside down equity either.  If you have equity, including lots of equity, they will look for any technicality to default the loan to steal it from you.  They will and do "make this shit up."  The banks are insolvent, so many are engaging in Al Capone like BS.

Also blame the Hope and Change politicians and their voters for demanding that everyone who can fog a mirror can get a mtg or 107% mtgs or other corrupt crap.

If I'm a bank and I have 10 million legitimate foreclosures to process, I don't really need to go making more work for myself.  This is a publicity stunt and people on this site are even dumber than I thought they were if they buy into this nonsense.  Of course, you tell a parasite he can have his house for free and see what happens?  If this is what's leading the revolution, we're better off with 4 more years of One Big @$$ Mistake, America which is what we're going to get because these people can't even fart without assistance.

Looked at all your links.  None of those cases involved a bank that was attempting to foreclose on a home IT KNEW IT HAD NO RIGHT TO FORECLOSE.  C'mon, show me some fraud.  Show me some intentionally fraudulent foreclosures.  Show me the smoking gun.  Do the banks and servicers fuck up from time to time?  Sure, with tens of millions of loans out there, mistakes are going to be made, but that ain't fraud, and it sure as hell ain't a crime.  Sheriff Andy Taylor of N.H. is wasting his time.

They don't know anything and don't care. The paperwork is all balled up and lost, so what, they can foreclose on any damn house they want with phony paperwork forged documents and perjured affidavits. That's what the sherriff is trying to crack down on.
