Attorney General Holder: Prez Can Assassinate Americans On U.S. Soil

Attorney general Eric Holder wrote the following to Senator Rand Paul yesterday:

On February 20, 2013, you wrote to John Brennan requesting additional information concerning the Administration’s views about whether “the President has the power to authorize lethal force, such as drone strike, against a U.S. citizen on U.S. soil, and without trial.”

 

As members of this administration have previously indicated, the US government has not carried out drone strikes in the United States and has no intention of doing so. As a policy matter moreover, we reject the use of military force where well-established law enforcement authorities in this country provide the best means for incapacitating a terrorist threat. We have a long history of using the criminal justice system to incapacitate individuals located in our country who pose a threat to the United States and its interests abroad. Hundreds of individuals have been arrested and convicted of terrorism-related offenses in our federal courts.

 

The question you have posed is therefore entirely hypothetical, unlikely to occur, and one we hope no president will ever have to confront. It is possible, I suppose, to imagine an extraordinary circumstance in which it would be necessary and appropriate under the Constitution and applicable laws of the United States for the President to authorize the military to use lethal force within the territory of the United States. For example, the president could conceivably have no choice but to authorize the military to use such force if necessary to protect the homeland in the circumstances like a catastrophic attack like the ones suffered on December 7, 1941, and September 11, 2001.

 

Were such an emergency to arise, I would examine the particular facts and circumstances before advising the President on the scope of his authority.

There’s more to the following statement than appears at first blush:

As a policy matter moreover, we reject the use of military force where well-established law enforcement authorities in this country provide the best means for incapacitating a terrorist threat.

Specifically, Holder did not say “we are legally constrained by the Constitution from depriving people of life, liberty or property without due process of law, and from using military force on U.S. soil”.  Instead, he said that the Obama administration was so far abstaining from using a power it already has as a current “policy” decision.

John Glaser notes:

The concluding legal opinion represents a radical betrayal of constitutional limits imposed on the state for depriving citizens of life, liberty and property. Officially now, Obama’s kingly authority to play Judge, Jury, and Executioner and deprive Americans of their life without due process of law applies not only to Americans abroad but to citizens that are inside the United States.

 

“The US Attorney General’s refusal to rule out the possibility of drone strikes on American citizens and on American soil is more than frightening – it is an affront the Constitutional due process rights of all Americans,” Sen. Paul said in a statement.

 

Holder, along with the Obama administration, is making it seem as if the President’s use of lethal force, as in the drone war, would only be used in circumstances like another impending 9/11 attack or something. Only when an attack is imminent.

 

But that categorical limitation on the President’s authority to kill depends upon their definition of “imminence,” which we learned from a leaked Justice Department white paper last month, is extremely broad.

 

The memo refers to what it calls a “broader concept of imminence” than what has traditionally been required, like actual intelligence of an ongoing plot against the US.

 

“The condition that an operational leader present an ‘imminent’ threat of violent attack against the United States does not require the United States to have clear evidence that a specific attack on U.S. persons and interests will take place in the immediate future,” the memo states, contradicting conventional international law.

 

Instead, so long as an “informed, high-level” US official claims the targeted American has been “recently” involved in “activities” that pose a threat and “there is  no evidence suggesting that he has renounced or abandoned such activities,” then the President can order his assassination. The memo does not define “recently” or “activities.”

 

Holder also insists that in the case of such “extraordinary circumstances,” like another impending 9/11, he ”would examine the particular facts and circumstances before advising the president of the scope of his authority.”

 

Boy, do I feel comforted.

This is not entirely surprising.  As we noted in December 2011, a top constitutional expert confirmed that Obama was claiming the authority to assassinate Americans on U.S. soil.   We reported that month:

For more than a year and a half, the Obama administration has said it could target American citizens for assassination without any trial or due process.

 

But now, as shown by the debates surrounding indefinite detention, the government is saying that America itself is a battlefield.

 

AP notes today:

U.S. citizens are legitimate military targets when they take up arms with al-Qaida, top national security lawyers in the Obama administration said Thursday.

The government lawyers, CIA counsel Stephen Preston and Pentagon counsel Jeh Johnson … said U.S. citizens do not have immunity when they are at war with the United States.

 

Johnson said only the executive branch, not the courts, is equipped to make military battlefield targeting decisions about who qualifies as an enemy.

 

The courts in habeas cases, such as those involving whether a detainee should be released from the Guantanamo Bay detention facility in Cuba, make the determination of who can be considered an enemy combatant.

We pointed out a year ago, the director of the FBI said he’d have to “check” to see if the president had the authority to assassinate Americans on U.S. soil. We reported last October that form Department of Justice lawyer John Yoo – the guy who wrote the memo justifying torture, even of children, which was used to justify torture of innocent people, including children – said that the president has the power to assassinate Americans on U.S. soil in times of war.

And Mother Jones notes:

In a Google+ Hangout last month, President Obama refused to say directly if he had the authority to use lethal force against US citizens. As Mother Jones reported at the time, the reason the president was being so coy is that the answer was likely yes. Now we know that’s exactly what was happening.

It is not very reassuring that the same unaccountable agency which decides who should be killed by drones also spies on all Americans.

Indeed:

You might assume – in a vacuum – that this might be okay (even though it trashes the Constitution, the separation of military and police actions, and the division between internal and external affairs).

 

But it is dangerous in a climate where you can be labeled as or suspected of being a terrorist simply for questioning war, protesting anything, asking questions about pollution or about Wall Street shenanigans, supporting Ron Paul, being a libertarian, holding gold, or stocking up on more than 7 days of food. And see this.

 

And it is problematic in a period in which FBI agents and CIA intelligence officials, constitutional law expert professor Jonathan Turley, Time Magazine, Keith Olbermann and the Washington Post have all said that U.S. government officials “were trying to create an atmosphere of fear in which the American people would give them more power”, and even former Secretary of Homeland Security – Tom Ridge – admitst hat he was pressured to raise terror alerts to help Bush win reelection.

 

And it is counter-productive in an age when the government – instead of doing the things which could actually make us safer – are doing things which increase the risk of terrorism.

 

And it is insane in a time of perpetual war. See this, this, this and this.

 

And when the “War on Terror” in the Middle East and North Africa which is being used to justify the attack on Americans was planned long before 9/11.

 

And when Jimmy Carter’s National Security Adviser told the Senate in 2007 that the war on terror is “a mythical historical narrative”.

 

And 9/11 was entirely foreseeable, but wasn’t stopped.   Indeed, no one in Washington even wants to hear how 9/11 happened, even though that is necessary to stop future terrorist attacks.  And the military has bombed a bunch of oil-rich countries when it could have instead taken out Bin Laden years ago.

 

As I noted in [an analogous context]:

The government’s indefinite detention policy – stripped of it’s spin – is literally insane, and based on circular reasoning. Stripped of p.r., this is the actual policy:

  • If you are an enemy combatant or a threat to national security, we will detain you indefinitely until the war is over
  • But trust us, we know you are an enemy combatant and a threat to national security

See how that works?

And – given that U.S. soldiers admit that if they accidentally kill innocent Iraqis and Afghanis, they then “drop” automatic weapons near their body so they can pretend they were militants – it is unlikely that the government would ever admit that an American citizen it assassinated was an innocent civilian who has nothing at all to do with terrorism.

Read this if you have any doubt as to how much liberty Americans have lost.

Senator Paul told MSNBC:

The response by Holder could lead to a situation where “an Arab-American in Dearborn (Mich.) is walking down the street emailing with a friend in the Mideast and all of a sudden we drop a drone” on him. He said it was “really shocking” that President Barack Obama, a former constitutional law professor, would leave the door open to such a possibility.

 True ... but you don't have to be Arab-American to get in trouble.

Many consider FDR to have been a dictator.  He did steal the citizens' gold.  He also played games packing the Supreme Court.  He was also in there for four terms.  Make of that what you will.

Lincoln suspended habeas corpus while throwing the Maryland legislature in jail so they couldn't vote to secceede.  Johns Wilkes Booth uttered those famous words, "Sic semper tyrannus,"  while doing his dirty work.  (Funny, Obama has supended habeas corpus w/o a war being imminent.)

How about Woodrow Wilson?  From what I understand, if you exercised your First Amendment rights and protested WWI, you disappeared.  Those hippies in the '60s protesting Viet Nam would have been vaporized if Wilson was still at the helm.

Nah.  America has had its string of dictators.

Funny.  People keep talking about crises.  I didn't consider the little financial storm a crisis back in '07-'08.  We haven't had a crisis in decades.  Arch Duke Ferdinand "getting it" was a crisis.  Hitler invading Poland was a crisis.   North Korea invading the south - maybe.  Cuban Missile "Crisis" - maybe.  None of this petty stuff we have seen in the last ten years is a crisis.  Certainly if your metric is the assumption of powers by the US government, then what we have had are major crises.  That is what is so isturbing.  America collectively should have said back in '07 - wake me up whern something important has happened.  Now throw the little bankers in jail, let the bankruptcy courts dispose of the assets, and you - federal government - go back in your little hole.  You aren't important.

  4. uber-wealthy and moving abroad so safer grounds given inside info they have about about the shit storm about to his those who remain here.

This can be dismissed, as can every single action in it of itself, but if you look at the big picture, unless you are a full-time idiot, the conclusions of his goals are neither many, nor good for America or Americans.

Bottom line, this crook has done nothing positive for this nation. To the contrary: has (nearly) destroyed all systems in place, including the medical which was 2nd to none (by no means perfect). Multilingual version of DA Forms 2823 and DA Forms 4137 as appropriate for the location. z Colored, permanent markers and chalk.
Event log (simple Microsoft® Office Word or Microsoft Office Excel document).
Sketch pad (anything can suffice).
Meal, ready to eat boxes, for documents/files.
Voice recording device (optional).

DETAINEE PROCESSING TECHNIQUE 4-33

Upon capture, Soldiers must process detainees using the “search, silence, segregate, speed safeguard, and tag (5 Ss and T)” technique. This technique provides a structure to guide Soldiers in conducting detainee operations until they transfer custody of detainees to another authority or location. Complete the “5 Ss and T” technique as follows:

Search. Neutralize a detainee and confiscate weapons, personal items, and items of potential intelligence and/or evidentiary value.

Silence Prevent detainees from communicating with one another or making audible clamor such as chanting, singing, or praying. Silence uncooperative detainees by muffling them with a soft, clean cloth tied around their mouths and fastened at the backs of their heads. Do not use duct tape or other adhesives, place a cloth or either objects inside the mouth, or apply physical force to silence detainees.

Segregate. Segregate detainees according to policy and SOPs (segregation requirements differ from operation to operation). The ability to segregate detainees may be limited by the availability of manpower and resources at the POC. At a minimum, try to segregate detainees by grade, gender, age (keeping adults from juveniles and small children with mothers), and security risk. MI and military police personnel can provide additional guidance and support in determining the appropriate segregation criteria.

Speed. Quickly move detainees from the continuing risks associated with other combatants or sympathizers who may still be in the area of capture. If there are more detainees than the Soldiers can control, call for additional support, search the detainees, and hold them in place until reinforcements arrive.

Safeguard. Protect detainees and ensure the custody and integrity of all confiscated items. Soldiers must safeguard detainees from combat risk, harm caused by other detainees, and improper treatment or care. Report all injuries. Correct and report violations of U.S. military policy that occur while safeguarding detainees. Acts and/or omissions that constitute inhumane treatment are violations of the law of war and, as such, must be corrected immediately. Simply reporting violations is insufficient. If a violation is ongoing, a Soldier has an obligation to stop the violation and report it. Z

Tag. Ensure that each detainee is tagged using DD Form 2745.

Confiscated equipment, personal items, and evidence will be linked to the detainee using the DD Form 2745 number. When a DA Form 4137 is used to document confiscated items, it will be linked to the detainee by annotating the DD Form 2745 control number on the form.

This is how I think it will unfold, for what it's worth. 

Theft becomes prevalent to point of making living unbearable.  Authorities close down parts of town that are high crime, removing residents and yellow ribboning it (and the burning buildings, blaring home and car alarms and debris and body littered suburbs) and placing those people who cannot to somewhere into FEMA camps.  In these camps, you will be processed and categorized, background checks and those who have been found to be in anyway out of ordinary will be told to step to the side.

I think...that

This will move across the land, when the most valuable sides of the railroad track become threatened, it may become turning point to allow international force in.  There will be years of no help while this process takes place.  A demolition and a mass arrest in the guise of saving you.  Biggest issue is how to move millions of people but that's being worked out.

It's going to be a bloody hell and if people knew what was coming, they'd be on their knees screaming to their higher power for enough money to bribe the politicians to "do it our way"...

MLK comes to mind, but yes, I get it.  The real question is: Is there a leader/dictator that has not used force against thier own people?  I rolled through all the continents and cannot really think of many instances.  Maybe king Arthur, or Desmond Tutu, but I have not studied either period with a fine tooth comb to make that statement with certainty.

 

The list of leaders who have used force against thier own people.  Too easy.

So far, Obama has not droned an 'american' holder of the US citizenship on the US soil.

It is only three years before the claim that a your typical 'american' president is actually a dictator delivers a positive answer.

As Obama is introduced as a dictator (in order to mask for the reality of 'americanism'), in three years, if this guy has not droned down, a positive answer would emerge.

But at that moment, 'americans' will have evacuated that corner of their fantasy land, to take shelter into a new one, inventing new propaganda and fantasy to hide from the reality of 'americanism' and the reality of their eternal nature.

The best action is to boycott so to affect those seeking something, and also letting them know that. Remember those 2 (that I know of) numb nuts who were bitching that business went to shit after they messed with Romney (mexican chew'n'puke joint in Colorado that refused Romney Team's order) and the Florida pizza joint owner who bear-hugged Ohbummer only to watch his business go to shit shortly thereafter? Best examples of the power of the wallet.

When the power goes out, we find out how little we really need to live comfortably, or, we learn to adopt and get by with what we have. So why not boycott ??? Why are greedy bastards trying to rid of competition? So we have no options ... like the cable/phone companies.

Whom do you hate more today? party A or party B? What is the magnitude of marginal hate required to align with someone you hate less?

Clearly, this is a very useful blunt tool. This calculus has always fascinated me though. A hammer that yearns to be a scalpel you might say?

For me, it is about not hating and more about shunning.  The political class must be shunned.  Control is the one joy they have and being shunned is the only control we have over them.  They cause most if not all the problems (war, debt, something shortage) due to this control fetish.  The middle/poor class is not interested in killing people, they just want to make it to the kids game, put food on the table, and be able to make ends meet.  When ones hates, please try to resist and realize the middle/poor class is the same and even most of the rich and beware of the person who thinks he/she knows best and wants control.

As I've said before, remember all of the new shows that came out after 9/11 portraying gov agencies as heros? The show 24, for example started on 11/6/01, not even two months after the attack.
