Legal Experts: Even TOTALLY INNOCENT People Should Avoid Talking to Law Enforcement

A law school professor and former criminal defense attorney explains why you should never agree to be interviewed by the police:

We’ve previously documented that there are so many federal and state laws in the United States, that no one can keep track of them all, and everyone violates laws every day without even knowing it.

As such, it is best to avoid law enforcement when possible.

It’s vital to note, however, that the Supreme Court ruled this year that your silence CAN be used against you (the link is to the website of one of America’s top constitutional law professors) … at least until you’re read your Miranda rights.  Therefore, if you remain silent when police are questioning you, it is very important to tell the police that you are exercising your right to remain silent.  As the Atlantic notes:

Basically, if you’re ever in any trouble with police… and want to keep your mouth shut, you will need to announce that you’re invoking your Fifth Amendment right instead of, you know, just keeping your mouth shut. “Petitioner’s Fifth Amendment claim fails because he did not expressly invoke the privilege against self-incrimination in response to the officer’s question,” reads the [Supreme Court] opinion ….

It’s Not Andy Griffith’s America Any More

This is not to say that all law enforcement personnel are bad folks. Many of them are outstanding people.

But our police forces have become so insanely militarized and the fear of terror has become so wildly overblown that many law enforcement personnel have become hair-trigger tense.

People have been severely harassed when they’ve asked for help from law enforcement.  For example, an anti-war website was spied on for 6 years after they asked for help by the FBI.  And the FBI rifled through all of a woman’s electronic communications after she told the FBI that she was being harassed.

Police have recently tasered numerous deaf or retarded people for “failing to follow orders”.

And they’ve shot and killed people who were just looking for help.  See this and this.

Again, we’re not trying to paint with a broad brush; most law enforcement personnel are good folks just trying to do their job.  And police are human, too … sometimes they get scared and overreact.

But it’s not the same ole Andy Griffith show type demeanor among law enforcement today.  So it’s best to be careful.

Yes, they have targeted the next generation. They oppose school choice while their 'schooling' is a 'failure'. I write 'failure' with quote marks because it does exactly what it was designed to do - produce those who cannot think for themselves. (Former NY state and NYC Teacher of the Year - John Taylor Gatto has written & spoken a great deal on this).  They absolutely hate homeschooling and consider homeschoolers as a threat to them - kids taught to actually think. They are pushing Common Core so that all indoctrination ('education') is controlled by them.

Their (the controllers) own children go to private prep schools where they learn using the methods that were common in America 125 years ago. The oligarchs began purposely destroying US education beginning in the 1890s-early 1900s.  See 'The Underground History of American Education" by John Taylor Gatto. Tesla is close, except their USB device gives the taxpayer a colostomy (not the driver), CA just passed an "electricity storage mandate", I think Teslas qualify (as batteries).

Anybody that knows anything about electricity knows it's expensive and energy inefficient to store it, (its far cheaper to just produce what you need) and any mandate creating an electricity storage mandate is doomed to spike electrical rates and of course municipal utility taxes.

These abuses by the po-po really do make me angry. It is right in your face, where you live, where you travel, but I believe it as all be design. Someone is architecting structures here in the US, and they have been for years now. When you start putting the pieces together, there is a method to their madness, and it is one of the reasons I read the hedge. The fact is this behavior is everywhere, all across the United States, hence it would have to been orchestrated, or there would be pockets of community policing. It's the anomaly of uniformity, man, I like that phrase, anomaly of uniformity that betrays its design. But most all people, seriously, keep the love. The more you look, the more precarious things have become. Keep the love and create a paradise around yourself, and teach others the same, no matter what happens.

KEEP THE LOVE, it will be the only way out of this mess, and everyone is guilty, and everyone is responsible. To say otherwise would be cowardice.

Slightly but not too off topic..."no-electricity" practice (say a day, then a week) might not be a bad idea. At least start thinking through all the issues in cases of elderly or infirm living with you. I predict it will be a sporadic kind of thing that no one notices at first but is a good way to keep people a little meek and gives police etc opportunities to be magnanimous...or not... Depending on what they need.....if it is just unexpected for us but they timed just right. It could Alain be unintentional consequence of some of the ridiculous stuff going on. Just thinking would be nice if certain things could become sort of ho hum, so what ... Just another form of that gradual easing out from under so much dependence on the powers that be ... The idea a lot float in various forms on this sight...

Barney Fife has been replaced by a 220 lb goon with shaved head, tats, and juiced up on steroids. He believes everything he's told and doesnt have the brains to think any different. His intelligence is more like that of a trained German Sheppard - focused on obeying commands from his masters for 'biscuits' (pay check & thrills). In this he does well.

Sherrif Andy was a depiction of a peace officer. These guys are enforcers for shake down artists.

Many of them haven't figured that out. Some of them just go along with it.

Even during a custodial interview, where uncooperativeness, insolence and cockiness typically empower them to make things VERY inconvenient for you,  it is not even necessary to answer in the affirmative...

Setting: Interior Border Patrol checkpoint on US Interstate highway:

BP Agent: "Sir are you a US Citizen?"

Interviewee: "Does the 5th Amendment apply to anyone who is not a US citizen?"

BP Agent: "No Sir it does not"

Interviewee: " Then my refusal to answer your question by invoking my 5th Amendment right should provide you all the information you need"

BP EvenAgent:  "Have a nice day, Sir"

a lesson if you are dumb or naive enough to think they are helping you....1982.... Driving slowly.. Police car with no lights turns left in front to rush a drivewayof suspect... Driver has no warning, turn signal or running lights to hint car is even thinking about turning...driver hits side of police car.... 15 police cars show up.. Questioning in car of policeman begins... "so, how fast do you say you were going when you saw the policeman's turn signal.". Teach your children well.

In the subtitle to your heading it says "Supreme Court Rules You No Longer Have the Right to Remain Silent"  but I don't see any coverage of that (having watched the first 2 videos).

And thanks, too.  You've done this before and I hope you do it at least once a year.  It's a real public service.  Most people never have and don't expect to be in situation where they may be a criminal suspect or "person of interest" and, no matter how bright, are totally unprepared.

Thanks for the link: the message is: if you want to assert your right under the Fifth Amendment, you must do it explicitly.  Not in that case the defendant VOLUNTARILY submitted to the interview and answered questions until they got to one he didn't want to answer.  This underscores the message in the videos: don't volunteer anything to the cops, period.

A complex legal system that requires lawyers that needs lots of schooling is upheld by someone who may have just taken remedial classes through out high school...but can at least remember things to pass the test.

After watching this video, now do you understand why taking the attitude "I'm not concerned about domestic NSA spying.  I've got nothing to hide."  is absolute crap?  Domestic spying by Government violates both the 4th *AND* 5th Amendments to the Constitution.  I DID NOT agree to speak to ANYONE in the Government, and I'm not going to get a lawyer to move in with my family to tell me I can't say anything to anyone anymore.

The entire wired world is one big police interview room.  I am this close to pulling all the plugs.

There are a few lone wolf individuals who typically don't last in the department very long due to not fitting in, and a few small departments and units.  Other than that, a "good" cop who does nothing when the others do business as ususal are not really good cops.  In other words, most cops are not good cops.

 

If you want an example of what appears to be a good cop, look up Sheriff Tony DeMeo in Nevada.  The BLM was seizing his constituent's property without a warrant or court order of any sort, and he told them to get a warrant or he would stop them.  It devolved to the point where he told them "Fine, you do it, and I'll send my SWAT team out to meet your SWAT team."

Great post George and thanks for the video links ! A few years back I started to see the local po po cars sporting ' accredited agency' on the sides of their cars. I came to the conclusion that they are now federally trained and equipped storm troopers that serve and protect the empire only. Be safe out there folks , Andy Griffeth quit the force in disgust long ago

I switch my kids over in 7th grade. In elementary school the police are your friends, if you're lost or someone is chasing you the police will help you. Once your in middle school I break out videos like these and say just keep your mouth SHUT!

Seems like that's not good enough anymore ...

I'll be reviewing this with my high schooler and middle schooler tomorrow.

Thanks for the supreme court link. For those too lazy to reas it , if you start talking to the police and then fall silent to a question before invoking your rights the police may testify that you avoided answering the question and the jury may interpret that as a sign of guilt.

I guess the only thing ever to say to the police is "i invoke my fith amendment rights, yo"

Even if all they say is "how are you doing?"

"Law enforcement" now seems to operate like a criminal gang with a monopoly on the lawful use of offensive force, routinely robbing, kidnapping and even murdering people.  If a heavily-armed criminal comes to your compound to rob, kidnap and/or murder your family, do you really care if he (or nowadays, a bull dyke "she") is wearing a uniform or badge?

At least "honest" criminals must worry about getting blammed or incarcerated.  I am not afraid of "honest" criminals, since I can defend myself from them lawfully, but must accept that the police are now the greatest threat any of us face in our daily lives.

Read "The Law" by 19th century Frawg legal philosopher, Frederic Bastiat, to understand why only the use of defensive force to protect individuals' lives, liberty & property is ever justified and also how the law is always ultimately perverted by the ruling elite to justify the offensive use of force contrary to its intended purpose.  It is fairly brief and a good read http://bastiat.org/en/the_law.html
