So holds today’s Obsidian Finance Group v. Cox (9th Cir. Jan. 17, 2014) (in which I represented the defendant). To be precise, the Ninth Circuit concludes that all who speak to the public, whether or not they are members of the institutional press, are equally protected by the First Amendment. To quote the court,

The protections of the First Amendment do not turn on whether the defendant was a trained journalist, formally affiliated with traditional news entities, engaged in conflict-of-interest disclosure, went beyond just assembling others’ writings, or tried to get both sides of a story. As the Supreme Court has accurately warned, a First Amendment distinction between the institutional press and other speakers is unworkable: “With the advent of the Internet and the decline of print and broadcast media … the line between the media and others who wish to comment on political and social issues becomes far more blurred.” Citizens United, 558 U.S. at 352. In defamation cases, the public-figure status of a plaintiff and the public importance of the statement at issue — not the identity of the speaker — provide the First Amendment touchstones.

I saw that after I posted and wondered if it might be taken the wrong way but your post came off the top so I just let it slide, its part of the link. Eugene Volokh represented the defendant, he's speaking of himself. I should have put quotes around it to separate myself, that was my bad.

Karma is not substantiated by science, but anecdotal evidence abounds.  This anecdotal evidence and history can not be all wrong, can they?

Despite claims from the administration that drone strikes have killed very few civilians, multiple independent reports confirm that Obama is severely downplaying the wreckage that these drone strikes inflict. It is ultimately impossible to get exact numbers, but a new study from Columbia Law School’s Human Rights Institute finds that the number of Pakistani civilians killed in drone strikes are “significantly and consistently underestimated” by tracking organizations which are trying to take the place of government estimates on casualties.

There are estimates as high as 98% of drone strike casualties being civilians (50 for every one "suspected terrorist"). The Bureau of Investigative Journalism issued a report detailing how the CIA is deliberately targeting those who show up after the sight of an attack, rescuers, and mourners at funerals as a part of a "double-tap" strategy eerily reminiscent of methods used by terrorist groups like Hamas.

Much can learned about "the content of a persons character" when placed in a position of power.

Would the person of questionable character give preferential treatment to a foreign government (say Merkel's cell phone) and not the same for all of our cell phones?  

Would the person inflame the passions of bigotry by referencing the skin color of a gun shot victim instead of the circumstances involved for his own political motivations & expediency?

Would the same person herd millions toward an unworkable law, costing them billions more of their income, simply because his name & ego are riding on it?

Finally, would this person of questionable character, also allow the IRS to discriminate against his rivals, take four million dollar vacations and then have the "audacity" to give a speech about income inequality?

I think we all know the answer.
