Cloud darkens over Patton Boggs

Layoffs, merger talks and late paychecks have darkened the cloud hanging over the Washington lobbying powerhouse Patton Boggs.

While the leaders of the firm, the longtime king of K Street, acknowledge that they are going through tough times, they deny that the firm is in financial straits.

"We have been through a hard time and we have more work to do, but we are doing fine," said Ed Newberry, Patton Boggs's managing partner.

Newberry said major legal work from prior years has ended for the firm, leading to a drop in revenue. "We have responded to it by adjusting the size and the expense base of the firm," he added.

Interviews by The Hill with current and former lawyers of the firm found anxiety about the future, with some fearing the worst if Patton's merger talks with Squire Sanders fall apart.

"I think people are seeing it through and trying to make it happen. But they [Patton Boggs] are terrified of the prospect of it [the merger] not happening," one former Patton Boggs attorney said. "It is very sad to me. I have a lot of friends there. It's a sad story."...

...Along with the business slump, Patton Boggs is contending with Chevron's fraud allegations. The firm has sued Chevron; last May, the oil and gas behemoth filed a motion for court permission to pursue Patton for its work on the Ecuador matter.

"We are currently awaiting the court's ruling on our motion to bring claims against Patton Boggs and we look forward to pursuing those claims," said Morgan Crinklaw, a Chevron spokesman.

Patton Boggs said it would fight Chevron's move to take the firm to court.

"We oppose that on several different grounds. The court has no jurisdiction; Chevron waited too long; and the complaint has no merit," said Rick Talisman, the firm's general counsel.

In the meantime, Chevron's pursuit of Patton Boggs could hinder the firm's merger talks, according to one expert.

Sen. John Kerry, now reportedly under consideration for one of two top jobs in President Obama's cabinet, has spent 28 years on Capitol Hill and run for the highest office in land, during the course of which, he has left a considerable money trail...

...Kerry's seemingly contentious relationship with the military industrial complex has not prevented him from being its beneficiary occasionally. During the course of his career, the defense industry has given $671,000 to Kerry via individuals and PACs, according to Center for Responsive Politics. (This pales in comparison to the $28 million he has gotten from lawyers and lobbyists or the $20 million for the Finance, Insurance & Real Estate industry.)

The three most generous military contractors to Kerry’s various campaigns, according to Influence Explorer:

Raytheon: It's political action committee and employees raised $93,000 for Kerry;
Boeing: $58,000;
Northrop Grumman: $35,000,

In addition, among the 17 lobbying and law firms that have contributed over a million dollars to Kerry’s campaign (see chart below) are a number that represent defense contractors. For example,Sullivan and Cromwell represent General Electric, which among its other endeavors, manufactures engines and computer systems for the military.

Some lobbyists and lobbying firms on Kerry's contributor list also represent the defense industry. For example, Raytheon hires lobbyists from:

DLA Piper, which has contributed $38,000 to Kerry's campaign via a PAC and individual contributions;
Patton Boggs, $116,000, and
Holland and Knight $144,000

The reward of being first carries with it the risk of being wrong. The "Blue Stream" project, the first of ten announced Caspian pipelines, will start importing Russian gas to Turkey under the Black Sea starting in November 2000. Sixteen billion M3 volumes of natural gas will transit 1,236 km of pipeline for a period of 25 years under Turkish Law 4357 signed in April. Financing has been guaranteed by BOTAS and the Russian Federation.

"Blue Stream" is an offshore alternative pipeline to bypass five littorial states, "Emrah Eigelen of OHS toldWorld Cogeneration. Eigelen was interviewed the week of November 9 in the capital city of Ankara during a trade mission arranged by Washington- based Patton Boggs, who represents the Republic of Turkey in the United States.

The OHS Consortium, a joint venture between Turkish companies Oztas and Hazeridaroglu and Russia's Straytionsgaz, will construct the $370 million on-shore pipeline and Saipem will construct the $1.5 billion Black Sea Segment. When constructed, it will be the deepest underwater pipeline in the world at 2.1 km. OHS will also construct the metering and compressor stations.

Four of the five BOO projects signed the week of October 9 are gas-fired combined-cycle plants adding 4,400 MWs. Turkey needs an additional 40,000 MWs by 2010 of installed capacity.

Firm supply can not be guaranteed by BOTAS. Ibrahim Pektas, a board member of Diler Holdings, told World-Generation that a cogen plant was on the drawing boards for their steel and vessel divisions and that they were awaiting world from BOTAS on guarantees.

Additional pipelines are needed to come on-line. Trans-Caspian and Baku-Cayhan are two U.S. backed pipelines understudy. Enron's feasibility study for TDA on the Trans-Caspian is due November 16 for the thirty to sixty-day review. Baku Cayhan is decidedly too expensive and has found resistance industry-wide.

The Blue Stream project appears to be well ahead and will be rewarded for its risk.
