Guest Post: Is The NDAA Lawsuit Headed To The Supreme Court?

Tyler Durden's picture

Via Michael Krieger of Liberty Blitzkrieg blog,

The NDAA lawsuit is one of the key topics we have written about over the past year or so.  For those of you that aren’t up to speed, one of the most popular posts we ever wrote was NDAA: The Most Important Lawsuit in American History that No One is Talking About.  Basically, Section 1021 of the NDAA allows for the indefinite detention of American citizens without charges or a trial.  Journalist Chris Hedges and several others sued Obama on the grounds of it being unconstitutional.  Judge Katherine Forrest agreed and issued an injunction on it.  This was immediately appealed by the Obama Administration to a higher court, which promptly issued a temporary stay on the injunction.

Yesterday, oral arguments began in front of this aforementioned higher court; the 2nd Circuit.  As Chris Hedges states in the interview below, if they win the case then it will likely be brought in front of the Supreme Court within weeks.  On the other hand, if the Obama Administration wins and the Supreme Court refuses to hear the appeal, Hedges states: “at that point we’ve just become a military dictatorship.”

To get a full update on the progress of the NDAA lawsuit make sure to watch this video.

this case is a moot point. if the supremes say it is constitutional then .gov can do it in the open. if the court says it isn't constitutional do you really think that will stop .gov.

on the bright side, the hunt for the cop killer in california exposes the behavior of the police when their own skin is at risk. a few more copycats and they will have to supply diapers as standard issue. the police can't take the heat when it is aimed at them.

Speaking on that Ca killer, concerning to J6P should be that  they shot up 2 blue trucks in the early hours. I KNOW/HOPE that's not their training, that's manpower (officer) intellect abort. Somebody calls in that they saw this Christopher dude in a silver midsize foreign car and half of Californians will be in the fuckin' hospital, w/ gunshot wounds, at this rate.(on the bright side, LAPD evidently couldn't kill two ladies delivering newspapers with 50 rounds, so that's indicative of their success rate?)

Jim in MN's picture

Good "excuse" to implant tracking chips in their mercenaries though, just in case, eh?

Winston of Oceania's picture

Don't forget the NYC cops who shot seven or nine people trying to kill a guy who never even got off a shot. I bet they were shitting themselves the whole time!

The meanest person in the welfare office is the supervisor whose family is a multigenerational recipient. Odd that a black president is wagonmaster on the last roundup. What horrible advise, and from whom, as he is duped into riding the last, best hope, destroying 800 years of human progress.

The politicians who voted for this and Obama are guilty of treason and should be tried as such.

The Nobel Peace Prize should be stripped from Obama as he is the only Nobel Peace Prize winner I heard of who has a license to murder.

I am not racist, nor follow any political party.  I am a human who finds these aberrations of the Constituion and morality not only unnacptable but demand that these people who work for us are held to account, all actions by the CIA nd other covert intelligennce agencies made public and Eric Holder brought to trial for Fast and Furious.

Guys like Chris Hedges are getting older (57) and have been around and seen a lot of things. How is he now in the media & political spotlight all of a sudden after all the years he spent in war zones and the media? His "passion" never changed, yet he's switched to fighting court battles that cost (waste) millions that will accomplish NOTHING except get him media attention, and I'm sure he's not fronting the money to pay the lawyers himself. Watch for him to declare he's running for office somewhere... soon. He's setting up his political gravy train for his old age. He couldn't give a shit about global fucking warming or anything other than making sure he's comfy-cozy in his twilight years at taxpayers expense.

Ron Paul spent over 30 years in politics yet did virtually NOTHING outside of Texas until he became an old man cult figure in his 70's with little chance of winning a Presidential election due to his age. His fanatic supporters quickly vanished into thin air after his second attempt, and his son Rand is looking more like the devil every day. If the TPTB wanted to throw a wrench into any organized rebellion, they couldn't have planned it better. Ron Paul was a false old geezer hope, and he shattered the hopes of many.

I'm sick and tired of these old fuckers coming out of their shells in the last years of their lives and stirring up shit that they can't and won't back up with the vigor of their own youth they had decades ago.

Don't forget how there are really brilliant accomplished people (in real science, business etc) that even to this day believe status quo is moral and "normal" state of affairs. We've all went through public schools (even private school that has to go over the curriculum stamped by "civil servants" is not much different). Also, this water is boiling very slowly. 20 years ago it was hot enough to complain, but it did not seem to be dangerous. Now it's scalding so now people that got out for a second to feel the difference are screaming. If they screamed than, they would look like idiots. Why are you screaming - I actually like to sit in a little hot water like that! This is not an easy trap to get away from.

Also while I have no tolerance for lefty dogma and their crooked logic - I can't attack Hedges integrity. He seems to be honest man that also leans a lot to the left. For a person like this courts will be natural way to go and after all it is not pointless it can slow down the process. It does not go for the fundamentals, but seriously - how is it pointless? He declares his own contept for NDAA, should he stop on this?

Angus McHugepenis's picture

Watch for Chris Hedges to SOON enter politics and try to get elected for some type of position. If he does, all his past credibility goes down the toilet.

And why can nobody answer where he is getting all the money to pursue these court cases?

What the law might disallow, the administration will do nevertheless by having subcontractors do it for them.

Hedges states: “at that point we’ve just become a military dictatorship.”

And at this point, the whole lot of Humanity is lost, as we Americans stand as the last hope for Mankind.

Signed: an American.

Monedas's picture

Chris Hedges .... a zero in my book .... however, his fear of government and a military take over .... are hopeful signs of intelligent life !  He has to be .... has to be .... an ardent supporter, then, of the 2nd Amendment .... and must understand .... that it's intent was to allow the citizenry .... to retain sufficient military capability .... to have a fighting chance .... of creating mischief .... for a rogue government                    and has nothing at all to do with hunting, target shooting and home defense .... rights so basic to Americans .... that it wasn't deemed necessary to enumerate them .... by the Founding Fathers !      Soooo, Chris, baby .... you must be a charter member of the NRA ?           I'm Monedas .... don't fuck with me .... liberal half wits !

Not to worry. I have a cave in Afghan you can hide out in for a while. Plenty of ammo and beer, but no food. And watch where you walk if you have to take a piss during the night. It's 8,000 feet down.

I do not subscribe to the anti-Zionist position .... that the world is ruled by three Jewish banker kings .... Larry, Moe and Curly .... or by those other stooges .... Manny, Moe and Jack !

Is it true .... as I have heard .... that the Saudi royal family .... is descended from Jewish patriarchs ?

Do we have a Supreme Court? I think NDAA will be just fine.

Cloud9.5's picture

It is immoral to obey an immoral law.   The NDAA breaches the social contract.  We are in a state of nature.  Govern yourselves accordingly.

dcb's picture

good post, thank you rfor keeping me updated on this impt topic that is being ignored by conventional media

Monedas's picture

It's funny .... people like OWS .... who threaten civil disobedience .... don't take umbrage .... in the 2nd Amendment's .... acknowlegement of their right .... to resort to arms .... when a government goes rogue .... is it because .... they are government hole lickers .... whose real aim .... is to impose a draconian regime .... that will abolish all rights ?

The simple, amoeba-like reflex to grab on to power 'just because' while expecting someone else to put the appropriate limits in place (who else?  Their moms?) is simply revolting.  This is the overriding psychopathic impulse we see in maxi-state fascists and global elite kleptocrats alike.

To say that the institutional incentives are simply aligned to favor unrestrained aggregation of power at the risk of destroying society is tantamount to admitting that these institutions need to be forcibly torn apart and rendered powerless.

And yet we sit.

It was New England "Progressives" like Chris Hedges .... that fanned the flames .... of the Civil War .... resulting in 500K dead Americans .... and a federal government out of control .... which they now publicly complain of .... but, which they secretly .... want to replace with a "Tyrannisaurus Rex" socialist tyranny !  Liberals are liars !  North Korean Communists are refreshingly candid .... about their intentions !

Does anyone think the bastards running (or not) North Korea don't know what will happen to them if they shot a nuke our way?

EDITORIAL: Rambo Supports Assault Weapon Ban

“I know people get (upset) and go, `They’re going to take away the assault weapon.’ Who … needs an assault weapon? Like really, unless you’re carrying out an assault. … You can’t hunt with it. … Who’s going to attack your house, a (expletive) army?” –  “the ludicrous hypocrisy” of Sylvester Stallone

Monedas's picture

I want a remake of the movie "Twins" .... casting Stallone and Gov. Christie .... as the twins ?

mendolover's picture

Everybody bitching about Chris Hedges.  Who's the bigger problem, Hedges or assholes like Stallone and Jim Carey.  Thanks for the support Bruce Willis!

TheGardener's picture

Thanks we can lay those movie characters to rest and their
anti-gun propaganda roles in hollywood promotions of SENSELESS violence.
