Judge Halts Bloomberg's Sugar Drink Ban, Calls It Illegal, Arbitrary And Capricious

Just hitting the tape ahead of tomorrow's scheduled hit of Bloomberg's ban on "large sugary drinks":

  • Judge invalidates New York City's ban on large sugary drinks; ban had been scheduled to take effect tomorrow.
  • Judge says sugar drink limit "illegal"
  • Judge finds ban to be arbitrary and capricious.

Has the time come to ban independently thinking judicial authorities who don't agree with multi-term Spanish-speaking authoritarians?

From the WSJ:

A state judge on Monday stopped Mayor Michael Bloomberg's administration from banning New York City restaurants and other venues from selling large sugary drinks, a major defeat for the mayor who has made public a health initiatives a cornerstone of his tenure at city Hall.

 

The city is "enjoined and permanently restrained from implementing or enforcing the new regulations," New York Supreme Court Judge Milton Tingling decided Monday.

 

The regulations are "fraught with arbitrary and capricious consequences," the judge wrote. "The simple reading of the rule leads to the earlier acknowledged uneven enforcement even within a particular city block, much less the city as a whole….the loopholes in this rule effectively defeat the state purpose of the rule."

We pray Judge Tingling didn't miss a comma or two in his New York State bar exam or else Holder will have a drone on permament patrol above his home.

I am sure that the personal dieting of the judge has noting to do with it decision and only with the letter and the intent of the Law, whatever they may be, based on the diet independent interpretation.

It seems like the sugar morphed in fatty cells, rules over the freedom, for more sugar yet to be transfered in to fat. Sounds like self fulfilling fattiness.

The courts allowed the government to ban hemp, the single best source of protein and oil for animal nutrition, however, high fructose subtances, which are literally as bad as alcohol from a metabolic point of view, should be allowed? ... Not sure if I should feel all warm and fuzzy for freedom right now...one dictator (a judge) allows us a freedom another dictator (Bloomtard) wants to take away.  So now I can still drink a 44-oz Mountain Dew...

but still be declared an enemy combatant and either detained without charges indefinetly during the "conflict" or outright turned into human hamburger by a Reaper-launched hellfire if I set foot outside the U.S.  Or have DHS kick down my door and fill me full of 40-cal JHPs when I leap up from bed and grab my soon-to-be illegal 14-round clip pistol to defend against an unknown home invasion.  Or be crushed by a DHS MRAP when it drives over my vehicle when I can't get out of its way as they speed a SWAT unit to take out someone else.  Or have the three-letter intel agencies monitor my electronic communication and send a team of FBI investigators to question and detain me for aiding and abbetting an enemy by my non-mainstream critiques of the homeland and the emperor. 

But at least I can slurp a 44-oz drink!
