Is Obama Lying About Big Brother?

As of this moment, Obama is making the case that the US government is not eavesdropping on phone calls. Specifically, he said "nobody is listening to your phone calls - they are just looking at phone numbers and duration of calls" and concluded that the NSA was only engaged in "modest encroachments." It was unclear if that clarification was meant to put to rest fears that Big Brother has made personal privacy a thing of the past. He further went on to add that the telephone surveillance program is fully vetted by Congress and supervised by the Federal Intelligence Surveillance Court (FISA). In other words: Obama is making the case that the NSA's Big Brother supervision is perfectly legal and not only that, there are checks and balances and neither the telephonic snooping nor the internet supervision is anything to be concerned about.  There is one problem: Obama is lying.

Back in April 2009, three months into the Obama regime, none other than the NSA admitted it has overstepped its legal boundaries. As the NYT reported: "The National Security Agency intercepted private e-mail messages and phone calls of Americans in recent months on a scale that went beyond the broad legal limits established by Congress last year, government officials said in recent interviews. "

NYT goes on:

Several intelligence officials, as well as lawyers briefed about the matter, said the N.S.A. had been engaged in “overcollection” of domestic communications of Americans. They described the practice as significant and systemic, although one official said it was believed to have been unintentional.

 

The Justice Department, in response to inquiries from The New York Times, acknowledged Wednesday night that there had been problems with the N.S.A. surveillance operation, but said they had been resolved.

 

As part of a periodic review of the agency’s activities, the department “detected issues that raised concerns,” it said. Justice Department officials then “took comprehensive steps to correct the situation and bring the program into compliance” with the law and court orders, the statement said. It added that Attorney General Eric H. Holder Jr. went to the national security court to seek a renewal of the surveillance program only after new safeguards were put in place.

The same Eric Holder who is currently being investigated for perjury before congress. As for "compliance" 4 years later it seems nothing has changed.

As for Obama's clear conscience:

The legal and operational problems surrounding the N.S.A.’s surveillance activities have come under scrutiny from the Obama administration, Congressional intelligence committees and a secret national security court, said the intelligence officials, who spoke only on the condition of anonymity because N.S.A. activities are classified. Classified government briefings have been held in recent weeks in response to a brewing controversy that some officials worry could damage the credibility of legitimate intelligence-gathering efforts.

Well thank god the most transparent administration held classified briefings to discuss the biggest government espionage program ever conceived. One may have gotten ideas otherwise...

Finally, on Obama's pinky swear that it is only foreigners' emails and iMessages that are being intercepted, turns out he is lying here too:

In recent weeks, the eavesdropping agency notified members of the Congressional intelligence committees that it had encountered operational and legal problems in complying with the new wiretapping law, Congressional officials said.

 

Officials would not discuss details of the overcollection problem because it involves classified intelligence-gathering techniques. But the issue appears focused in part on technical problems in the N.S.A.’s ability at times to distinguish between communications inside the United States and those overseas as it uses its access to American telecommunications companies’ fiber-optic lines and its own spy satellites to intercept millions of calls and e-mail messages.

And so on.

In short: what difference does it make - it is only the stripping of the most fundamental privacy rights of US citizens! And how else can you build a totalitarian government if you don't give up some freedoms - good heavens, one can't ask the poor president to provide 100% security without experiencing some "inconvenience" and handing over a little privacy. Or a lot.

In the end, let's not forget what really matters: the NSA spying program is from the government, and it is here to help you.

That is a purely symbolic gesture. The suit will be tossed out since it is more than likely that the companies were granted immunity from law suits and prosecution in exchange for their cooperation with the government spying program against US Citizens.

I believe this would serve as a perfect example of what Mussolini described as Fascism. The merger of state and corporate power.

If you still think america is a free country, then you simply have not been paying attention. That myth has been long shattered.

If it gains widespread visibility it causes quite a predicament, and would be hard to toss.  Then you end up with a few options that don't look too great.

Settle - admission of guilt.

Go to trial - we see how deep the rabbit hole goes

then

Innocent - admission that your rights under the constitution are not longer in effect, despite clear evidence of a violation of those rights.

or

Guilty - bye bye.

So why not help to make more people aware and make sure it gets the attention it deserves rather than just writing it off straight away and continuing to piss and moan on ZH without actually doing a damn thing?

If it hinges on the seizure aspect, they can always claim to have volunteered the data, as I recall Facebook claiming it did once upon a time.

The nigger issue is of course that the court/"justice" system in which the suit was filed is just another branch of the same government, one in which there is no possibility of controlling the executive branch, even in the highly unlikely event that the judicial branch had any desire to do so... Don't antagonize your boss.

It's a possibility, but it's hard to see how it would hinge on seizure.  If Verizon have nothing in their terms and conditions about sharing data with the NSA, named specifically or not, they find themselves in a very precarious position.  T&Cs would have to be very detailed in exactly which information is shared.

This is not exactly like the Facebook case as this data is carried entirely on their own private communication networks rather than a public and open network like the web.  It's also dynamic data, rather than static data, so has to be intercepted in realtime.  In short, there has to be greater effort to share.  Verizon might very well want to side with the case for the prosecution in order to exonerate themselves, saving their reputation and claiming pressure from authorities, although that might also open up a can of worms for them if any 'incentives' come to light.

What is most interesting about this action however, is that it is not being pursued by some Joe Public type with a grotty little blog and an armchair understanding of legal proceedings. This chap is a former US Justice Dept prosecutor.  His legal costs are going to be small if he represents himself, and even if not he'll have the appropriate and sympathetic contacts within the profession.  This will hopefully save him from the usual bully boy tactics of attempting to make it too expensive to persue, and help to strengthen his resolve.

Read it again, because details matter. No companies have been named as defendents. The suit is against government officials.

Of course, their first trick will be to try to get the suit thrown out for "national security" reasons, which trumps all laws, all judges, and the constitution itself.

A number of things: sending a report to a handful of senators is not fully vetted by congress. And not that it would matter. It's still a violation of the constitution. Dianne Feinstein be damned.

They have tested the spin and seems to be falling on: this is approved, this nothing new, the "benefits" outweigh the costs (which we don't know because it's all classified), and don't worry because this specific incident only referred to "harmless" metadata.

It's not approved. There is an ammendment against it. Your secret court is nothing but a rubber stamp. Feinstein and Saxby are not "Congress". It's so much data that you can't possibly be tracking or thwarting anyone in real time; this can only be used as a database to intimidate people. No one believes you when you says you're not recording messages and phone calls (and microphones and skype or FaceTime calls). And the metadata is EXTREMELY dangerous. It's like having someone's digital DNA and planting it on a crime scene. OR making a connection to terrorism and throwing down the gauntlet of the entire unaccountable justice dept, us military, intelligence agencies, and banking regulation has to bear. And not with any hard evidence. Just suspicion.

But thank god, He weighed it. He found a balance. He doesnt bother telling us what that is/was. But He decided. We've been saved. And if not for that snake in the grass "leak", we never would have known!

At this point, if you're a liberal and you don't feel betrayed, you're not a liberal. You just a regime cheerleader. This was everything classical liberalism stood against: autocratic government. Shame. But embrace your inner libertarian. After all, they're from the same classical liberal tradition.

You have everything you need: the abuse of power, instructing people to lie to congress, and public desire to punish those that don't cover up your abuses.

And if the republican party was even the least bit savvy as the minority party right, they'd bring the charges up in the House. Force an investigation and put the executive on trial. That alone sends the message that they cannot do as they damn well please. And it destroys his legacy. It gets it on record.

But no. It's because the power hungry slobs in the republican party LOVE the imperial presidency. They want to preserve it to get their man in there.

Yeah, that's exactly what a huge and growing segment of the population has been saying since even before you took office, Mr. President.  You are either grossly incompetent or a malicious charlatan, in either case you're not fit to lead.

Also, just because the Constitution doesn't specifically forbid you from doing something doesn't mean the people consent to your right to do it (ie record everything we do, but don't touch it unless we need to look it back up later!)

Matt Damon grew up living next door to Howard Zinn. I would venture to guess that has been a greater influence on his view of the world than any candidate he may have endorsed.

Many people that once supported Obama has come out swinging against him in the past few years. Most notably, Cornell West and John Cusack. I suspect there are many more.

If you want to view somebody solely under the narrow scope of a politician they may have once voted for, that would be your right...and a mistake.

Chief Justice Robert's was so shaken up he couldn't even administer Obama's swearing in oath properly and had to repeat it later in private, I always wondered about that. For sure, you can offshore hosting your websites (eg ZH) and even keep a mirror in another offshore location. And you can offshore to an SSL secure e-mail service (eg I do) etc etc. But you cannot offshore your access to the Internet. Therein lies the weak link. The information they can harvest about your Internet activities is quite substantial. Using a TOR browser can provide a lot of privacy when accessing websites, but there's no guarantee that your TOR Exit Node is not being run by the NSA or CIA. Using someone else's Internet access is pretty good for personal privacy (eg Internet cafe, Wi-Fi hotspots or just looking for any unsecure Wi-Fi LAN etc).

I was reading the comments on some of the MSM sites and 90% of them were of the "if your not a terrorist you've nothing to worry about" variety. it was unbelievable how quickly main stream America went from "this is just tinfoil hat conspiracy nut bullshit" to complete apathy on the confirmation that nothing you say, type, view or visit is private.

it took less than 24hrs for the sheeple to accept that big brother is not just watching you, but is violating every bit of space both digital and actual that was once considered sacred and private.

funny how the population here in the land of the free accepts being lied to, robbed, spied on, violated, beaten, criminalized, marginalized, murdered and enslaved while the Turks go nuts and hit the streets en mass over a park. 

and the sheeple have the blind, willful, myopic ignorance to call them uncivilized savages while they continue to take every dehumanizing serf training violation this ultra corrupt, psychopathic, control freak death worshiping "government" serves up without so much as blinking.

I've said it before and I'll say it again. "Obama is a carefully crafted plant by the corporate elite and the military industrial complex". The man IS a "Black Bush", in fact he is worse than the "White Bush".

If you want to blow your mind, ask yourself how many times you've heard the words "Calls may be recorded for quality assurance purposes..." when speaking to a Corporation or Government department, and for how long this has been going on. (5 years? 10 years?).

The recordings are used by algos to pattern match your personality to the correct script / voice actor which you'll respond to the most positively, and used to mine when / where homo sapiens exhibit stress / emotional involvement during conflicts. e.g. Your gas bill is wrong; the algo will be tracking your anger levels and attempting to diffuse them through later tweaks to the scripts. If it hasn't already happened, you can probably automate this at some point; think of Disney cartoons with actor's voice overs. Only need to record the lines once, then...

Obama is slick because he has algos run on his responses (to focus groups) to see which plays best. In fact, all major companies PR departments do this, or outsource it to "Reputation Management" companies. Obama is nothing more than a cypher here; they used to get old school actors to do it (hey Ronnie) they now train them specifically. (Or did you miss the part where Bush Junior went from eloquent northern accent to good old Texas homeboy fuddled speech? Interesting.)

This is also why Fox News anchors and the like are so often "much more intelligent in real life". If you need links to any of this, please do your own search; the real deal is algos are used to mine your voice data for emotional and cognitive clues (part of "we can see your ideas being typed"). It's not exactly new. (But, of course, the organic version is just a science fiction tall tale... Unless you've empirical proof otherwise, of course.)

As I recall, post 9-11, as the Patriot Act was being debated, restrictions were put in place to make the PA acceptable for passage in Congress. The general provision was targeted survailance of individuals with a history of behavior that justified more intense survailance, after a FISA court hearing.

At the time, criticism against the PA was government over reaches when given greater power. The Progressives/Dems/Socialists/Leftists crowed it was appaling to give such powers to the Bush Administration.

Who knows how much more thos powers would have been expanded under Bush, at this point, what difference does it make?

What we do know and what does matter is Obama and the same ilk that squealed like pigs about government abuse of the PA during the PA's initial formulation are lo and behold those who have taken the PA to that abusive level secretly without any of the debate that occured when the PA was originally enacted.

Yet, even with this enhanced survailance where we all give up a number of Constitutional Rights without any due process, did it do anything to stop the Fort Hood terrorist attack, the Diaper Bomber, the Boston Bombings? How come the Russians warning about Tarsarnev wasn't picked-up as a result of PRISM survailance? The Boston Bombers were identified by the guy who had both of his legs blown off and the kid was found by a home owner having a smoke, not by anyting BPD, HMS,ATF,FBI,NSA or CIA did.

Evidently, the illegal collection of metadata is totally inept or the powers that be don't give a crap about us little people being the victims of attact, apparently they care about something else and what ever it is, it is illegal and an assault on our Bill of Rights.

The breadth of actions undermining the Rights of Americans in this Administration and the illegal activities with no accountability is unparalleled. Most of the media & Congress has been complicit.

Harry Reid is reported to have said this Administration's enhancements of PRISM have prevented a -- massive -- number of attacks. How would he know & not the rest of Congress?

I have to confess, I'm and ex AF linguist.  We received the majority of our tasking from the NSA.  This was from 1998 to 2004.  For the duration of when I was enlisted adherence to USSID 18 (forbids reporting the content of a US Persons' communication) was EXTREMELY strict.  Basically if we discovered two foreigners talking to each other, we were cherry.  If we found one was a US citizen and the other was not, we would report/analyze/transcribe the foreign person and redact any reporting on the US person.  The transcript would look something like this:

S1://Blah blah blah

//USSID 18//

S1:// Oh? well blah blah bah.

Couldn't report them, couldn't even technically turn them into the FBI.  Even if we did our intercept wouldn't be admissible in court.  This was even after the changes to FISA.  If we found to US citizens talking and no one else we were to continue searching elsewhere IMMEDIATELY.

The Utah and PRISM programs are interesting in the sense that, by design, they absolutely MUST violate USSID 18.  First off if they have a physical tap on a network switch the rate of data transfer is so vast that it all must be recorded.  That's not really in question here on ZH (regarding Utah of course).  In order to make any of that data useful it would have to be analyzed.  As mentioned a sizable portion of those communications are very difficult to determine origin, so what can they do?  Do they just disregard all data that is difficult or impossible to trace?  Of course not, they then have to analyze the content of the transmission in order to determine it's intelligence value.  So you're now "reading" all sorts of data traffic by US citizens.  Up to this point this isn't much different with how we used to conduct business under USSID 18 previously.  Herein lies the big difference I'm betting:  If we intercepted a solely US citizens communication inadvertantly we would have to immediately flag all recorded material and completely purge it.   I can't imagine these systems do that automatically.  So they probably maintain even information deemed as "useless" you know... just in case. 

So to recap we have a system that deliberately intercepts US communications by design.  After it intercepts said communications it then analyzes the information and cross checks it against other known sources.  What remains to be (blatantly) proven, is if the data at the moment of "no intelligence value" is deleted and permanently purged.  If it's not?  It violates USSID 18.  Were I to intentionally violate USSID 18 during my AF career I wouldn't be here right now, I'd be in a federal prison.

 Obama was born in Kenya.  He is in the White House because he had help.  He is a traitor as well as those that have unlawfully put him into this position of powerThis is Treason.  Some of the recently "retired" generals should be brought back in to lead the country along with corresponding troops of Marines, Navy Seals and loyal military.  The perpetrators would then be rounded up and arrested; this includes NSA, CIA and members of any other government agency involved in the plot.  Those proven guilty in a court of law would then be executed; the lawful punishment for their treason. They will know the game is over; there is no place to hide, not even in the underground bases.

 We should then go to work on the financial sector; ...wash rinse repeat.

 We have precedent in place for returning the financial system to the Treasury.  We can continue by reinstating Glass Stegal and other laws that were removed against the best interests of the American citizens.  There is no FED; repeat: "...there is no FED".  

 There is however a faction, a moral majority in the government and among the population ready to make this scenario a reality.  People  will need to be prepared for when the music stops for the $US or they will be subject to depending on handouts from corpgov as this is part of their plan for taking total control.  It will end very badly for them, be prepared.

Even if "terrorism" in it's truest sense were a threat, would it be worth changing the Constitution and giving up freedoms guaranteed there? I think not, and don't recall any debate or the option to vote on it. This intrusive data-gathering is for control, not to flush out bad guys.  The bad guys are on the payroll of the government!  That's who is stiring the pot in Syria; it's the same Al Quieda bunch the gov is suppossedly spying on us to flush out. Proof on this just emerged in the Sarasota case of the Saudi's who flew the coop 2 weeks before 911.  Proven by a FOIA lawsuit, now the gov doesn't want to provide details for, you guessed it, "national security" reasons.  This couple was no doubt running a center for the hijackers who were also mostly Saudi.

In truth, the U.S. government is the world's biggest terrorist and this entire charade needs to stop.  A cabal performed a coup in 2000 that's still in progress.  It's pervasive in our government and the contractors they serve.  $3 Trillion is still missing and unaccounted for.  Not only that, hundreds of thousands of Americans have been swindled out of their net worth.  There have been no indictments.

ZH is a great place to find truth, but I think we really need to get down to the nitty gritty and develop a way to end all this crap.  I'm sick of it, sick of the Fed, and done with all the patriot act bs.  We need to purge it all!

Here is the thing. The people they are looking for are obviously not the pissant so-called terrorists that the FBI and CIA operate but instead any and all people with money and power that may present opposition to their regime. So this is not an attack so much on the peasants as it is the upper and corporate class that potentially represent a threat or competition to the MIC.

With continued attacks against any and all powerful opponents the greater the rise of the peasants with such opponents (those that stand behind the Constitution and with Freedom). So this is the beginning of a dramatic escalation toward an end that will rapidly unfold. Either Obama and Holder must be impeached or those that oppose and the peasants must be conquered by force, terrorism (false flags) and blackmail.

Of course the Government will collect all your emails, bank transactions, phone conversations, Internet traffic etc, it is in its nature once it has the technology. You have nothing to worry about as long as you continue to do as you are told, lot of fuss over nothing.
