Supreme Court Rules Police May Search A Home Without Obtaining A Warrant

If the most disturbing, if underreported, news from yesterday, was Obama's "modification" of NSA capabilities, which contrary to his earlier promises, was just granted even greater powers as phone recording will now be stored for even longer than previously, then this latest development from the Supreme Court - one which some could argue just voided the Fourth amendment - is even more shocking. RT reports that the US Supreme Court has ruled that police may search a home without obtaining a warrant despite the objection of one occupant if that occupant has been removed from the premises. With its 6 to 3 decision in Fernandez v. California on Tuesday, the Court sided with law enforcement’s ability to conduct warrantless searches after restricting police powers with its 2006 decision on a similar case.

In 2009, the Los Angeles Police Department sought suspect Walter Fernandez, believed to have stabbed someone in a violent gang robbery. When police first arrived at the suspect’s home, they heard yelling and screaming before Fernandez’s live-in girlfriend Roxanne Rojas answered the door, appearing “freshly bruised and bloody,” and with an infant in hand, according to argument recap by SCOTUSblog.

 

Fernandez was spotted by police, and said, “Get out. I know my rights. You can’t come in.” Yet police arrested him on charges of domestic violence. Later, once Fernandez was out of the home, police asked Rojas for permission to conduct a search, which yielded evidence implicating Fernandez in the robbery.

Probable cause or probable loss of all civil rights?

The Court’s decision justified the police actions, with Justice Samuel Alito writing the majority’s position.

 

“A warrantless consent search is reasonable and thus consistent with the Fourth Amendment irrespective of the availability of a warrant,” Alito wrote. He added that “denying someone in Rojas’ position the right to allow the police to enter her home would also show disrespect for her independence.”

 

Alito was joined in the majority by Justices Breyer, Kennedy, Roberts, Scalia, and Thomas.

 

Justice Ruth Bader Ginsburg – joined in the minority by Justices Kagan and Sotomayor, marking a gender divide among the Justices in the case – wrote the dissenting opinion, calling the decision a blow to the Fourth Amendment, which prohibits “unreasonable searches and seizures.”

 

“Instead of adhering to the warrant requirement,” Ginsburg wrote, “today’s decision tells the police they may dodge it, nevermind ample time to secure the approval of a neutral magistrate.” Tuesday’s ruling, she added, “shrinks to petite size our holding in Georgia v. Randolph.”

 

Georgia v. Randolph was a similar case the Supreme Court addressed in 2006, in which a domestic violence suspect would not allow police to enter his home, though his wife did offer police consent. The police ultimately entered the home. The Court ruled in the case that the man’s refusal while being present in the home should have kept authorizes from entering.

 

A physically present inhabitant’s express refusal of consent to a police search [of his home] is dispositive as to him, regardless of the consent of a fellow occupant,” the majority ruled in that case.

 

In addressing Randolph in the majority opinion, Alito wrote that the difference between that case and Fernandez was the physical presence of the suspect.

 

“Our opinion in Randolph took great pains to emphasize that its holding was limited to situations in which the objecting occupant is physically present,” he wrote.

 

“We therefore refuse to extend Randolph to the very different situation in this case, where consent was provided by an abused woman well after her male partner had been removed from the apartment they shared.”

 

Prior to Randolph and Fernandez, the Court ruled in the 1974 case United States v. Matlock that any one of the co-tenants in a home can consent to a police search of the premises.

Well there goes the fourth amen... oh look, over there: it's another all time high in the S&P 500. On paper, those who hold stocks have never been richer. Everyone else, barricade your doors, and the police come knocking, don't even bother answering - they will come in anyway. And also prepare your guns for return to the government: that particular "constitutional" amendment is the next to go.

Well, I've weighed the possibility of a "honey trap" and I try to keep my comments to double entendre's...I do like to feed the paranoia of "the lurkers" who never comment while sending their minions here...lol...I get some sort of sick joy from that, I can't explain it, its just my personality.

But I'd say (my opinion only) 95% are the real deal, from all backgrounds and nationalities...which brings us perspective. I don't think we ever want to get to the point where we're shouting down all but that 5%.

You have to remember the history of ZH, "Tyler" was called a ferner at one point, to denigrate him in the eyes of the American public. True. But what did he bring to the table of truth? If he made a profit off of it, I say, good man and thanks.

This case never should have been accepted. Ginsberg, Kagan etal. get to look like "protectors of liberty & rights" if for only a day. A couple years ago the same people ruled it was perfectly acceptable to force everyone to buy a product or service from a corporation.

Dude, I recall standing on 7th Avenue in NYC at the Garden before a number of concerts in the late 70's (age revealed..). The NYPD would always have the Calvary out...the horses...lined up, just in case shit went catty-whompus one way or the other, or maybe it was just a good excuse to exercise the ponies.  People would be standing around, smoking hemp, doing whatever, shouting "Fuck you, pig." to the cops, giving them the finger, all sorts of other shit.  Nothing ever happened.

We used to do the same thing around the neighborhood when they drove by.

You guys do understand that someone still has to let them in right? What is says is that one occupant of a house can not block access if another accepts entry, if they person denying access is not actually on premises.

It is a slightly dumb decision, but if they have probable cause to arrest you away from the house, they probably have cause to search it anyway.

The circumstances in this case were abhorrent. I will agree.

 

But there is now Precedent Law.

 

If you are NOT GUILTY of any crime, then by a False Arrest it follows that the authorities can remove you from the premises, through the FALSE ARREST, and conduct a Warrantless Search Fishing Expedition.

 

That will be a VALID DEFENSE in any following Civil Litigation for the VIOLATION OF YOUR CONSTITUTIONAL RIGHTS. You might be able to sue for False Arrest. But any claim against the LEA for the Search will be thrown out.

 

Of course that is okay...UNLESS IT HAPPENS TO YOU, right?

I've said it before and I'll say it again and again and again, the massacre of the Branch Davidians was an in your face wake up call and glimpse into the future of life in (north) america.  Some argue it started with the ATF embarrassment at Ruby Ridge - another nazi state operation - but either way the premise for the raid was total BS, for fucks sake they shot Koresh's kid in the front yard like a dog as well as other kids in the house, as they were flying over  firing down from helicopters - not to mention a couple of ex-bodyguards of Willie Cunton but the point being the constitution was fully fucked off on that day and all the days that followed - notice how far the press was held back from the scene of the crime. Who spoke up at that time, who even realized the true implications of those days, FBI thermal imagery clearly shows automatic weapons fire directed into the doorway where as it turns out most of the bodies were found as the davidians tried to escape the blaze - state murder on tape but who said anything - what came of the congressional hearings.  

Anyway the shit show started a long time before George W Bullshit and this other Oreo fuckwit that lives in public housing now - nothing these assholes do now should be surprising.

Kudos to you and the best of luck, don't know where you live or what your community is like but observing the lessons of Mike Ruppert, Sibel Edmonds and countless other actual patriotic Americans developing and educating the people closest to you is the key also the lessons of history should be well studied when dealing with fascist/communist or NWO regimes - expect no quarter from these jackbooted psychopaths.  I truly believe the vast majority of ex military personnel - the ones who actually took thier oath to uphold and defend the constitution against all enemies seriously would be an asset.  It's not impossible but in reality you are looking to break the MIC/Bankster Cabals grip on the seats of power and I think starting locally is your best chance to do that.  In reality it all began small, family community, state, country...... just my $0.02.

The Coast Guard can board any US flagged vessel anywhere, anytime, for no particular reason.  On one big private power boat I worked on, the Coastie gang leader admitted he 'just wanted to see the inside'.  No warrant, no probable cause..."Captain, stop the boat, please, so we can board".

If you have delivery crew helping to move the boat a long distance, and a Coastie finds a bit of weed in said crew member's stuff, they confiscate the boat.  Only way the owner can get it back is to prove that the crew was sufficiently told 'no drugs on board' prior to the crew boarding.

If the boat is your domicile, tough luck.  Doesn't matter.

Former Coastie here. In boot camp one of my Company Commanders (I had three in my company) encouraged giving someone a hard time in the event that we were being disrespected during a boarding. Fuck me.

My latest critical thought:

Governments don't kill people, people kill people. Each and every on of us is 100% responsible for our own actions.

Trust in authority, which is really just 1 or a small group of people at any given time is just another form of brainwashing. When you trust someone based on the position they claim you are taking a chance that any one of the following may be true:

1. They could be in disguise.
2. They could be on a power trip.
3. They could be programmed.
4. They could be so stupid that no amount of reason will ever make sense to them.
5. They could be on drugs.

And last but certainly not least, they could be severely intimidated by the mere thought of confrontation and even more likely to overreact to the slightest perceived threat with deadly force.

I'm sure there are more. My point is that the, "He's just doing his job." excuse's days are numbered.

Even the ptb realize this and are robotizing weaponry as fast as they can in an effort to stay ahead of the trend.

Most make the same mistake in logic when thinking about their desire for not needing a warrant. First, always keep in mind that any and all actions by any and all government functionaries, pols and crats is always about "money and power." That just prevents confusion in the first place. It’s ALWAYS about money and power.

Next, the reason they don't want a warrant is so they don't have to list what they are supposedly looking for. This helps them have free reign to get you on whatever they find and/or can plant. Used to be, long ago they would have needed to list what crime(s) you were suspected of and what they were looking for. They were then limited to that scope. Now they can just come in and tear things apart until they find something, anything, they can use against you, or just say fuck it, and plant shit.

Often that is why there is a discrepancy in the amount of a drug found in a treasonous take down of someone. The gun and badge thugs will take part of the evidence and divide it up to be used for "drops" later. In that way they can boost their career "jacket" and the department can get more grants and things. Like a tank.

That is why they don't want to be bothered with warrants.

a warrantless search allows for incriminating evidence of ANY possible kind to be found... I posted earlier about South Australia's open warrents - they were used on an active political dissenter, his house was searched computers/mobile phones etc all taken including the neighbours mobile because he filmed it.

No cause for the search was given but once the computers and other files are checked the information can be shared with anyone including the tax man etc..... What's almost as bad as losing the presumption of innocence in our legal systems (Aust is way ahead), is that police no longer need to investigate and do police work... they can just retrospectively piece together "evidence" of crimes we did not even know we were committing.

The piece meal approach picks off the 'fringe', invites people to think 'where there is smoke there must be fire' and scares your associates into worrying they are next.... its impossible to fight back when you can't access your computer, can't tell your lawyer your 'crime' and suddenly your local community and police are eyeing you suspciously.

Its psychological death by a thousand cuts and fractures the family as different members start getting nervous and anxious about what's next. I am guessing that is the point, its mass intimidation one by one. Meanwhile our friends/family/neighbours in the police force are been psychologically manipulated inch by inch into fear based policing as each and everyone of us is being slowly criminalised from every angle.

But as people tell me "if you have nothing to hide...." only thing is I have nothing to hide, I obey every insane "law" to the best of my ability but I also actively speak out - that is now making me a dissadent who is apparently by consensus propoganda not fact anti-environment, anti-terrorism protections, anti-money laundering protections, anti-government.... in effect anti-community and therefore likely to be deemed in the future anti-social.

How the hell did I get from caring about the world other peoples kids (I have none) are inheriting to being on a bunch of anti-social watchlists?

How do we get people to see that compassion and justice is not a fashion designer item like hem lines? I had the propaganda feed removed from our home in 2007. I thought that I was highly immune to its "charms" before I did so. However, a few months later, when visiting my fathers home where the propaganda box blares nearly 24/7, I realized how much more of their shit I was noticing than before--I hadn't been as immune as I thought.

Moral of the story: If you value your personal freedom and ability to think, and love your family, you will turn off the propaganda box--its poison.

For motivation, count the number of "Government Good" shows with law and order, legal, medical, etc. angles. Shows like Law and Order, CSI, etc. Not even reruns, but current shows. And then there are "reality" shows...

Part of the enjoyment of doing so is that when you call to do it, the surly propaganda supply company will be the nicest they have ever been to you as they try to get you to "reconsider."

My kids are trained NOT to call 911 or the police.

Often the police arrive BEFORE any ambulance and then enter without permission, warrant or anything else. Gives them free reign to beat you, shoot your dog, steal your stuff, plant "evidence" from their treasonous "war on drugs" (actually a civil war against Americans), and then seize your house.

Then they tell the frightened one left how much trouble the one removed will be in and if they let them search things will be fine, as the cops do not have to tell the truth.

Pick off the strong one then bully the weak one for consent.

Not sure why this was a case anyways, as there was probable cause for a search anyways as the guy clearly beat his girlfriend, if the report is correct.

As for evidence being admissible in another case, well that is for lawyers, but I can certainly see how this will set a precedent and get mangled into my scenario above.

In the KJ Bible, this is stated. It's an intentional mistranslation from the 1600's when King Henry wanted an excuse for divorce, so he got one with a corrupt translation.

The correct translation is illegal marriage, not valid in the first place, marriage to your own mother for example is not recognized by the Lord and you may divorce/annul it. Adultery does not matter

Marriage is permanent if it is valid. Yes, you are still married to the first wife. No matter how many times she strays, there is no way out. That's why the Apostles were so unhappy in the Bible after Jesus told them this. 

 

There is no need to "remarry", as GOD knows you are still married. Simply forgive her and allow her back in. The Bible story of Hosea may interest you here.

I have lost track of her and it is a little too late. (Perhaps I should have just paddled her butt. Things may have turned out different...She may have been willing to submit. I do not know. I will not ever know here on Earth.)

 

Yes the KJV is poorly translated in parts but it is clearly translated in the Levitical Law.

 

If I were to go into the whole subject of Marriage and Divorce, what constitutes Marriage, and the whole then I would be opening a can of worms that I do not want to do here. Personally I like to read it in Greek.

 

I have forgiven her. I do still love her. It was MY UNFAITHFULLNESS. I may have not commited Sexual Adultery but I lacked Faith that she would change.

 

But she has disappeared. But what is past can no longer be. I am nearing the end of my stay on this planet. I thank God for Grace because under the Law I am condemned. Through Grace I am saved. That is my hope.

 

I will read about Hosea....again.

Yup, it is set up that way. "Call us, we'll 'help'." Then they start looking for excuses to steal shit, "seizure," extract wealth via arrests and fines, planting evidence, and failing that, just plain beating the shit out of you and yours. Happens so much, that when I went to find a particular case where the gun and badge thugs arrested and brutalized the (white) woman caller, I found too many results to wade through.

Violence against ANYONE is inexcusable. If a man is struck by a woman he has complete rights to defend himself. I have never been struck by a man. Let's just say it would never happen twice if i lived. However, I would never provoke a stallion. I once came home to my husband beating a metal garbage can to bits over a horrible day at work. I was amazed my seemingly quiet and reserved husband could do such damage and had new respect for the physical strength and focus of an angry man. Woman don't understand the power of testosterone unleashed.

I should have prefaced that better. I have been a violent person. I was jumped by my husband, smashed against a wall after a particularly bad outburst. Many of these, believe it or not, I don't remember. I thank god he did what he did or innocent people would have been hurt. I was beaten unconscious by my parents numerous times. I'm am mostly deaf in my right ear because of these beatings. I got help and am no longer like this. What I did was wrong and there is no excuse, only beg for forgiveness. Yes, violence is necessary at times. But unprovoked violence which I did was absolutely wrong. Violence against evil is justified.

What would you have done? I did not punch her back while driving at 65 m.p.h., nor, would I. I do not think that punching a woman is correct nor do I believe that slapping her face is appropriate. Her bottom is fair game.

 

You had children, right? Did you spank their butts when they acted out in self destruction?

 

I did not directly have children but I am an Uncle. If the kiddos acted out then they got their rumps popped. I spanked one Nephew ONCE. My niece was more stubborn and she got it three times. (In all of those many years that was all that was needed.)

 

He has been in College since he was Sixteen (Now Eighteen), extremely respectful and responsible, and is working on his Pilot's License.

She is in Honors Classes and finishing her Junior Year. (Now she wants to be a Marine Biologist. Damn. I miss her when she was still a baby.)

 

I love both of them and I think that I have done a fine job.

 

As I told them that if they want their butts popped then they only have to do something that scares the hell out of me. Having them harmed is frightening. 

 

Now they are Atypical Teens as I only expected excellence from them. And I got what I expected.

Yes Tom, I did read it and yes it brought up some horrible reminders of my personal past. Please realize I do not judge you. I cannot. For to do so would be to judge myself. Someone told me they hoped God was just. I disagreed. For if God were just, where would we all be? I am praying for mercy.

I cannot fault your actions when dealing with a violent spouse. I was such a spouse. My husband never hit me back even though it would have been justified. He just stopped me. Luckily, I did not do violent to him in a dangerous situation as was done to you. My outbursts were predictable and were only provoked when I was reminded of a horrible event of my past. My husband got to a point where he could see what was going to happen before I did. When my rationality returned, he would describe what happened and what I did. To this day, I can only remember snippets. So if you were to have beaten me for what I had done,it wouldn't have worked in my case. I was going mad and Drs wanted to prescribe meds. I was fortunate to have met a wonderful cognitive psychologist who helped me solve my problems. Between her patient work and my loving husband, they saved me.

I did spank my children on the butt many times. Mostly my eldest. She was extremely defiant and strong willed so a spank on the butt and a cool off time in her room was very common. My youngest was very passive aggressive and spanking doesn't work in that case. Both are well adjusted and at 21 and 24 are doing very well considering what a horrible mother they had during much of their lives.

I am terribly sorry you had your wife betray the most sacred of trusts. I am so thankful this didn't happen in our marriage. My husband was an integral part of my healing, I am eternally thankful and could never betray him.

Please know I intuitively feel and empathize with you. Everyday I fight grief and guilt. It is as if your skin is roughened with sand paper and the sadness of others heightens your own sensations. I know how hard it is to forgive yourself though others may have forgiven you. Do not judge yourself my friend. Work on forgiving yourself for doing what you did. At the time, there were few options and you did your best. I harbor no ill will towards you. I know in your heart you are a very kind and loving man that is carrying a heavy burden. Let it go and feel the love you deserve. And I hope there is someone in your life now that can help you heal.

Fuck that.  Never hit a woman yet in my life.  Don't plan to either but I have had this conversation with many women.  Most agreed, if a woman wants to hit someone, then they deserve to get hit back.  It is a 2 way street, mutual respect and all that.  If the woman brings the violence then she gets to sleep in the bed she made.

These days the man can get hauled through the wringer, the woman almost never. Even if she kills the man she can claim "Battered Wives Syndrome", the dead guy can't testify that she is lying and Prosecutors are usually statists under the thumb of ""womyns" lobby groups so they are reluctant to prosecute. Women even claim PMT as a defence and walk free.

If the police in this case pressured the woman to consent to the search then the evidence should be tossed out as it was obtained under duress.

I don't know how it is in America but in Scotland an ex-army friend of mine heard his downstairs neighbor beating his wife again so he went downstairs and knocked his teeth out with a golf club. It went to court but charges against him (my friend) were dropped. The wife beater saw jail time.

Time for a Waco refresh.

Koresh, despite being a whack job, and maybe some other things, is a personal hero of mine. He stood his ground, "right and duty," and took some of the federal gun and badge thugs with him. Awesome! Just Awesome!

Now for those not in the know: The Davidians were a group of people residing on a farm outside Waco, Texas in 1993. The criminals of the DC US ATF found out about them and decided to use them for a PR and propaganda stunt for their upcoming budgetary hearings--that is why there were so many reporters and cameras during the initial assault on the Davidians.

Koresh got wind of what was developing and called the local gun and badge thugs to try to arrange a sit down meeting. The Feds would have nothing of it, as they needed their “film-at-eleven” war. The Davidians resisted the treasonous assault on their home later that day. They lost 6 while taking out 4 of the aggressors.

For 51days the Feds, ATF and FBI, along with posse comitatus violating military hacks, continued to lay siege to the Davidian compound--"Treason against the United States, shall consist only in levying War against them..."

On the 51th. day the Feds assaulted the compound again, lit it on fire, used two snipers in the rear to prevent escape from the inferno and blew up the so-called "block house" building.

The Feds killed 76 men, women and children. Most of the women and children were killed not by the Feds' deliberately set fire but by the Feds' bomb on the "block house" roof.

Note: I don't know or care about David Koresh's issues, beliefs or of his followers. I only care that they were treasonously aggressed against by agents of the DC US and state of Texas.

No, guilliotines won't roll, nobody will be "held accountable", and there certainly won't be any return to the constitution.

Ameicans just don't have the guts.  Lots of of guns but no guts.

America will be the first communist nation where the people have 400 million guns.  A first in human history.

And "will be" is debabtable.   I think we're already there, the legal framework is already in place. 

People just don't recognize it yet.

One example is the increasing number of "reasons" to strip away your right to own guns.  And many more will be added under Zerocare (the biggest leap into communism in Ameirca's history).

That's why Zerocare is defended so strongly by Dems.  It's their big push into full-fledged communism.  Masquerading as a "healthcare plan".

Respectfully disagree.  See DaddyO's post above.  I was in Philly when they burned 60 homes to the ground, killing 5 kids and 6 adults(MOVE).  They repeated it at WACO only bigger.  Did you see what happened in Boston?  They not only do get away with it, they get worse every time and the majority of this country is brainwashed and remains so.  I only have to talk to certain neighbors and friends to remain certain that the bright, glowy screens in their homes and hands do the work quite well for the establishment.

That's the funny thing about complex systems.  They can go from stable to critical in a microsecond.  It applies to an avalanche, a forest fire, hyperinflation or a Ukranian revolution.  Though the result may vary greatly based on where you live. 

Once the preconditions are set, it's just a matter of time and a question of severity. 

There are lots of people who know what is going on now.  Strangers I meet suprise me with how informed they are.  It's growing exponentially.  The fact that the Tea Party, was co-opted, Occupy was co-opted and sabotaged, the Ron Paul presidential campaign was sabotaged, and throw on top the NSA revelations...  They've bought time at a precious cost.  Things are getting pretty hairy. 

It's just like the M1-M3 money supply.  Eventually that will come loose, then look out!  It's also likely that one (printed money) will trigger the other. 

If this was snow pack on a mountain, I wouldn't get anywhere near it.  They can try to de-fuse it (highly unlikely), or it will eventually be triggered.  God help us all.

Keeping us "Afraid" is their best weapon, if folks really understood how much POWER we the people have IF we choose to use it this would be over quickly.  But not without a lot of blood and suffering in the interum though, and that is what most people fear, getting their hands dirty.  Sooner or later we are going to have to make a Stand, I am not saying I am encouraging this, but you gain NOTHING without a Struggle.
