Supreme Court Rules Police May Search A Home Without Obtaining A Warrant

If the most disturbing, if underreported, news from yesterday, was Obama's "modification" of NSA capabilities, which contrary to his earlier promises, was just granted even greater powers as phone recording will now be stored for even longer than previously, then this latest development from the Supreme Court - one which some could argue just voided the Fourth amendment - is even more shocking. RT reports that the US Supreme Court has ruled that police may search a home without obtaining a warrant despite the objection of one occupant if that occupant has been removed from the premises. With its 6 to 3 decision in Fernandez v. California on Tuesday, the Court sided with law enforcement’s ability to conduct warrantless searches after restricting police powers with its 2006 decision on a similar case.

In 2009, the Los Angeles Police Department sought suspect Walter Fernandez, believed to have stabbed someone in a violent gang robbery. When police first arrived at the suspect’s home, they heard yelling and screaming before Fernandez’s live-in girlfriend Roxanne Rojas answered the door, appearing “freshly bruised and bloody,” and with an infant in hand, according to argument recap by SCOTUSblog.

 

Fernandez was spotted by police, and said, “Get out. I know my rights. You can’t come in.” Yet police arrested him on charges of domestic violence. Later, once Fernandez was out of the home, police asked Rojas for permission to conduct a search, which yielded evidence implicating Fernandez in the robbery.

Probable cause or probable loss of all civil rights?

The Court’s decision justified the police actions, with Justice Samuel Alito writing the majority’s position.

 

“A warrantless consent search is reasonable and thus consistent with the Fourth Amendment irrespective of the availability of a warrant,” Alito wrote. He added that “denying someone in Rojas’ position the right to allow the police to enter her home would also show disrespect for her independence.”

 

Alito was joined in the majority by Justices Breyer, Kennedy, Roberts, Scalia, and Thomas.

 

Justice Ruth Bader Ginsburg – joined in the minority by Justices Kagan and Sotomayor, marking a gender divide among the Justices in the case – wrote the dissenting opinion, calling the decision a blow to the Fourth Amendment, which prohibits “unreasonable searches and seizures.”

 

“Instead of adhering to the warrant requirement,” Ginsburg wrote, “today’s decision tells the police they may dodge it, nevermind ample time to secure the approval of a neutral magistrate.” Tuesday’s ruling, she added, “shrinks to petite size our holding in Georgia v. Randolph.”

 

Georgia v. Randolph was a similar case the Supreme Court addressed in 2006, in which a domestic violence suspect would not allow police to enter his home, though his wife did offer police consent. The police ultimately entered the home. The Court ruled in the case that the man’s refusal while being present in the home should have kept authorizes from entering.

 

A physically present inhabitant’s express refusal of consent to a police search [of his home] is dispositive as to him, regardless of the consent of a fellow occupant,” the majority ruled in that case.

 

In addressing Randolph in the majority opinion, Alito wrote that the difference between that case and Fernandez was the physical presence of the suspect.

 

“Our opinion in Randolph took great pains to emphasize that its holding was limited to situations in which the objecting occupant is physically present,” he wrote.

 

“We therefore refuse to extend Randolph to the very different situation in this case, where consent was provided by an abused woman well after her male partner had been removed from the apartment they shared.”

 

Prior to Randolph and Fernandez, the Court ruled in the 1974 case United States v. Matlock that any one of the co-tenants in a home can consent to a police search of the premises.

Well there goes the fourth amen... oh look, over there: it's another all time high in the S&P 500. On paper, those who hold stocks have never been richer. Everyone else, barricade your doors, and the police come knocking, don't even bother answering - they will come in anyway. And also prepare your guns for return to the government: that particular "constitutional" amendment is the next to go.

It is sad to see that a day is approaching when the same price will have to be paid again. Many lives will be destroyed or impacted so that there may be hope that some will see freedom, however fleeting, again.

It's funny to sit at stop lights and see guys staring at me with their jaws dropped. I think they can't believe I'm driving the car. I will admit cops walk up to me cautiously when I get pulled over which happens quite often.

Our locals here are decent enough. Non-union, with hiring policies that give preference to candidates with more education, and better mental test scores. No SWAT team at all. Last time I saw an ad for a new position within the department, there was still no preference given for prior military experience. The PD in the adjoining town (about 4X our population) just got an MRAP.

Yes, many local departments are decent, but the moment something goes down, the Feds will likely attempt to federalize all LE, then bring in a goon squad.  At that point everyone will have a decision to make, obey the goon squad, or something else.

There are some cops that are good. I have met a few in my time.

 

The most dangerous element about being a cop is when they are working Criminal Enforcement...(NOTE THE TERM...IT IS NOT BY ACCIDENT.) They become Criminals and ENFORCE Criminal Law. Criminal Law is not about justice but is about how a Crime Syndicate runs its affairs. The Enforcers do Criminal acts against the opposition.

 

This terminology is NOT ACCIDENTAL. It means exactly what it says.

 

Good Cops, those who are not corruptable, are moved into places as Administration, Traffic, or Courtroom duty. They do not advance and are drummed out of the Force.

 

In San Diego County most Sheriff Department Deputies begin thier career in the County Jail System. It is here that they are introduced to the Criminals and the Criminal Justice Syaytem. (NOTE THE TERMINOLOGY.) By the time that they advance out of that environment they are the first responders to Crime.

 

Thus they perceive that EVERYBODY is a Criminal because that is all that they see. They do not see people behaving well. (There is no need for that. Nobody calls the Cops to report a benevolent and loving action.)

 

So what they get is a biased and skewed view of the population. The problem is that it is distorted intentionally so that when the time comes then they will fire upon decent law abiding citizens.

 

There are some that escape this indoctrination. But they are as common as those who see the Red Team/Blue Team False Paradigm. But there are some...some. They, like us, are not an Urban Legend. We exist. They exist. They are on the same team. There may even be some here on this Forum. They are worthy of due respect.

 

No. I am not one of them. I am not a cop. But I would not be surprised if some frequent here.

Apart from extreme red tape to get a gun license, then more to purchase a weapon (all up can take 6 months or more) we have ammo registration in NSW and open search warrants in Sth Australia:

This unimpressive document – recently described by one of our clients as “some [expletive] bus ticket that I could have typed up on the computer myself” – allows a police officer, at any time of the day or night, to “enter into, break open and search any house, building, premises or place”

oh and in QUeensland we now have anti-association laws aimed at "bikies" but it doesn't specify "bikies" so 3 or more "bikies" in a public place is a ticket to jail even if they're related - lawyers are scared to call "bikie" witnesses in case they have 3 or more at a court house at any one time and get a free trip to jail.

We just complain for a moment then....... well then nothing

I'm in NSW (Sydney).

Same crappy laws here.

To have any firearm you must have approval from the police, you must register the firearm and you must agree that the police can inspect the firearm and your gun safe (compulsory) at your home at any time, no warrant necessary.

Our cops now have the power to demand ID, to demand you move on (no right of protest) and to conduct strip searches in public.

Saw 3 bikies stopped and questioned by cops last week at my local shops. They must stop, they must answer questions and they must accompany the police when ordered. No probable cause or need for arrest required.

the strategy seems to be - let each state introduce new draconian legislation that if introduced nationally would cause an uproar.... then call on the states to introduce uniformity in their random laws and it becomes national by default and without an up roar.

bikies are not my cup of tea (they've caused havoc in towns I've lived) but jesus arresting brother-in-laws with a passing by bikie delivering a pizza for unlawful association, sticking them in jail over Xmas without knowledge of a release date.......wow!

Of side interest, I was informed to not have any pro-gun type  of bumber sticker on my car if I should legally purchase an authorised weapon and need to put it into a discrete hidden locked box in my (lift back) car to transport it to my property.... I could be arrested for advertising I had a gun in the car...... WTF?

You're right, it's happened before.  Though the tinder wasn't stacked high enough at the time.  Now we're in a situation just like pre-forest fire, or pre-avalanche where we all know it's only a matter of a trigger event.  The conditions are all set for a massive disaster of epic proportions.  It's very sad, but it's not for lack of warning.

I've posted before but I can't help it.  7 seconds.  Man whittling on a stick walking in downtown Seattle.  An office gets out of his car, and 7 seconds later, the man is dead laying on the sidewalk.  Listen closely and you can hear a woman yelling at the police officer telling him that the man wasn't doing anything.  Consequence?  The officer resigned, but did so on the same day that he learned that he would not be prosecuted.  Birk had testified that he feared for his life...  Please...

I have several friends who saw multiple combat tours.

They have shared many stories about tactics in battle.

You just outlined how to disrupt action within a group, hit one and the others come to aid.

Pelvic girdle is another quick acquisition target zone, never have to worry about body armour.

Hit center mass which knocks target off balance, then a couple to pelvic girdle. Quite painful and lots of larger vessels.

Anyone who thinks body armour gives one invincibility has never done much research, only rifle plates offer effective insulation.

Soft armour may save your life but will leave you dazed and confused until help arrives and gets you to serious medical attention.

Just some thoughts shared by those who had first hand experience.

To every action is an equal and opposite reaction - i.e. the same energy at your shoulder, slightly less will be on the receiving end, but really fast in a projectile form. 

At 10 feet, buckshot stays pretty tight.  It stays pretty tight until it loses energy, or hits a wall, then it turns into a mess.  That's why it's so dangerous inside buildings.

The State is announcing its intent to go to the extreme.  So now, everyone has a decision to make as to whether or not they will be willing to do so, also. 

Those who waver or vacillate at decision-time will become the first victims, wondering from the inside of their taxpayer-provided cage, "how did this ever happen to me?"

Zero-sum game.  Make your decisions, now, and plan accordingly.

Fernandez was spotted by police, and said, “Get out. I know my rights. You can’t come in.” Yet police arrested him on charges of domestic violence. Later, once Fernandez was out of the home, police asked Rojas for permission to conduct a search, which yielded evidence implicating Fernandez in the robbery.

Prior to Randolph and Fernandez, the Court ruled in the 1974 case United States v. Matlock that any one of the co-tenants in a home can consent to a police search of the premises.

I wouldn't get all freaked out about this.  This appears to be a clarification of "probable cause", which clearly the police knew Fernandez was a suspect and apparantly expands the time-frame to "sometime later" to exercise a "probable cause" search.  Evidently Rosas was a co-tenant, and thereby authorized to give permission to search (probably because she doesn't like being beat up and was weighing her options); and certainly was within her right to decline the policmen's request.  And look on the bright side, one less dirtbag on the street. 

Now IF (BIG, BIG "IF"), the cops came back and searched the house with no permission from co-tenents and no search warrant, all evidence would have still been thrown out of court.

Sure hope they have the funds to increase the size of the State(s) police department's to make this a reality?

Or maybe the States will simply rip up the 10th completely and willingly step aside on this now that the Supreme Court has spoken and let the FBI, DIA and DHS do all the work for them?!!! They trade in the state seal they wear on their unifrom and become Federal law enforcement without quitting?! May sell my soul in the process but at least I'll still have a paycheck!!!

Can't have everyone in your Country pay enough taxes to support Federal, State and Local police and at the same time help Secretary of State Kerry find enough loose change in the back of every American couch to build more military bases, ships and overthrow governments and start moar wars -that's a given.

If I say the guys in D.C. are insane it goes without saying -but so are we to have allowed it to fester this god damn long!

I told you. They all know that there is no US Constitution and no law other than what they say the law is. The "United States" was Usurped by the installation of British born subject Hussein Obama(born of a British subject father), who is not a natural born Citizen (born in the US of 2 US Citizen parents-- See Minor v. Happersett, 88 US 162, 167 (1874)). If the executor of the laws is not a legal entity then there is no "law".

The only way back is to first Yank that Domestic enemy sitting in the White House out, and give all of Congress the appropriate penalty for allowing him there

Much ado about nothing.  Probable Cause is as old as the hills, so to speak.

With Cause, they can come/break in.  W/o Probable Cause, they still need a Warrant.

E.g. It worked for Jesse Pinkman and Walter White, when a DEA Agent (Walt's brother-in-law) tried to break into Jesse's RV.

MORAL: Don't give them Probable Cause!

p.s. I actually know of a guy who has a sign on his front door that says:  "We do NOT answer the door to Law Enforcement Agencies (LEAs), unless they have a valid Search Warrant.  Have a nice day."

They also have a No Trespassing sign, and a No Soliciting sign.  Clearly these people are  libertarians with SERIOUS privacy tastes.
