Cliven Bundy Responds To Racism Accusations

In response to the verbal attacks pitched at him over thelast few days, Cliven Bundy has held a brief press conference to explain his perspective on 'slavery' and allegations of racism. Much as the world seems 'happy' to live a life of debt serfdom, Bundy notably remarked that he wonders if any of us are better off now "as slaves to charity and government subsided homes."

I don't believe Cliven Bundy is racist; I know what he means to say. But even if he was racist, I really don't give a shit. So what if he is?! On the issue of his rights being trampled on by our overbearing government, his racist sentiments would not make him wrong and the government right.

I can't really understand the audio on this clip.

I do know that his original comment about "the Negro" was meant to be sympathetic, and if you deconstruct it and reword it it comes to just about that and nothing more.  Except these days if you even say "the Negro" nobody listens to a word that follows.

Heck, you're not supposed to say "the" anything, too categorical, too judgemental.  So the real sin he committed was using the word, "the".

I read the full text of comments he made, the ones that led to him being accused as a racist, bigot, right wing terrorist.

as always is the case the MSM, the SPLC and senator Reid cherry picked a few lines and presented them to a very gullible and short sighted American public.

Bundy actually made the case, in his own way, that the black community went from one form of slavery to another, from private slave owners to now being owned by the government.he questioned not whether they were better of as slaves, but are they really any better of now. he also pointed out that the criminal justice system in the US was in itself racist. he went on and praised the Mexican population for it's work ethic and family values, he was actually defending them, not attacking them.

Bundy is an old timer so his use of terms like negro and colored people shouldn't come as a surprise to anybody, most people who choose to exercise a little common sense and critical thinking can clearly see the man did not use those terms in a racist or hateful context. it's just that he comes from a time before political correctness took away a large part of our freedom of speech and verbal expression. he comes from a time most of us here don't remember.

he points out the danger that we all face, have faced for decades now, that the US federal government seeks not to enhance or protect civil liberties and freedoms but instead it strives to destroy cultures. it seeks to eliminate the individual and create one timid, mindless collective where color, or culture or religion or independent thought or action no longer exist. it seeks to wipe out the very idea of morals or values or racial and cultural identity and replace them with a state worship and dependency culture devoid of anything that makes us different, makes us real human beings. that we all will not always get along, that some of us may dislike each other based on issues of culture or religion or moral point of view is only natural, it is a part of the human condition.

in any case regardless of Mr. Bundy's personal views, which clearly are not worthy of a hate crime, his or anybody's personal point of view on another race, color or culture are his and his alone and should never be the subject of government debate or accusation as it has no legal bearing on the issue at hand nor is it any of their business unless he commits a crime motivated by such views which he clearly has not done.

it is Reid and his ilk in DC that need to be put on trail here and be exposed and punished for the criminals they are, not an 80 year old rancher from Nevada.

There has been this debate since I was a child and I am sure well before my birth. The argument that Black America has made little of their freedom since the Civil War. The fact is, the freedom was a relative word, as in the south, a new form of control over blacks was quickly put into place. And since a black no longer had value as a slave holders property, it became a no cost solution to kill those who acted up or spoke up. We are all familiar with the Southern social system that rose up after slavery. You gotta admit, it must have been tense for southern whites to see, in some areas a majority black race, the slave class unleashed upon a south used to seeing these folks as property.

My great Grandfather was a union soldier as a 15 year old from New York, and grew up to become an officer during the war years. He served as an occupation cavalry officer at war's end. Family tradition recalls his experience of seeing the black slaves wandering the roads of the south, no idea where to go or what they could or couldn't do. I think Union forces acted on local pressure to keep a tight reign on these former slaves, until they settled back down as low wage farm workers and a tiny minority used their social skill to begin small businesses to serve the blacks.

In fact, if this small business class and growing professional class of blacks had been allowed to prosper and grow, to influence the local black community, to become police, doctors, lawyers, business men, employers, preachers and influential successful independent farmers, we could have seen that influence act to bring the slaves into some form of independent peoples, looking to themselves and to their black leaders as enforcers of a social order and a system to rewards for acting as workers and owners. We all know that this happened only to a small degree and only in self segregated black comminites.

But this was not the case. And we see what many American innre cities have become. No go zones.

The guy is just not well spoken.  I understood him to be trying to make the point of what had the government done for Black people (literally destroyed their nuclear family and crushed out almost all independance and drive in return for the "privledge" of a public serfdom voting block) and who's next in line amongst demographic subgroups for the same treatment?

He could have jacked one out of the park if he'd have wrapped up by contextualizing that as a call to every American to figure out how we can free our melanin enhanced brothers from the clutches of politicians and the state.

Sad part is that a my Black friends kind of sympathized with Bundy. Let's not forget,  they have also been dispossessed by the gov't (Black Wall Street). But then he turns around tells them they were better of as slaves. Now he's indefensible.

As someone who has read transcripts narrated by former slaves after their emancipation, I can't blame Black folk for finding him repulsive. 

Had he argued that Blacks were better off under segregation, as opposed to under chattel slavery, he might have an argument. But now, not even close.

Also: what have "the Negroes" got to do with his original cause?  Have they taken his welfare cattle? his land? Does he even know any Black people? How many Black people does he even see on a given day?

Actually, this is about what happens when a territory becomes a state.
The Pollard decision expressed a statement of constitutional law in dictum making it very clear that the Feds have no claim over the lands in Nevada. The Supreme Court states: "The United States never held any municipal sovereignty, jurisdiction, or right of soil in and to the territory of which Alabama, or any of the new States, were formed, except for temporary purposes, and to execute the trusts created by the acts of the Virginia and Georgia legislatures, and the deeds of cession executed by them to the United States, and the trust created by the treaty of the 30th April, 1803, with the French Republic ceding Louisiana." I agree that this is an important issue. But I strongly agree with your legal analysis for the following two reasons:

Firstly, All political power is inherent in the people. Government is instituted for the protection, security and benefit of the people; and they have the right to alter or reform the same whenever the public good may require it. But the Paramount Allegiance of every citizen is due to the Federal Government in the exercise of all its Constitutional powers as the same have been or may be defined by the Supreme Court of the United States; and no power exists in the people of this or any other State of the Federal Union to dissolve their connection therewith or perform any act tending to impair, subvert, or resist the Supreme Authority of the government of the United States. The Constitution of the United States confers full power on the Federal Government to maintain and Perpetuate its existence, and whensoever any portion of the States, or people thereof attempt to secede from the Federal Union, or forcibly resist the Execution of its laws, the Federal Government may, by warrant of the Constitution, employ armed force in compelling obedience to its Authority.

- Article 1, Section 2 of Nevada Const.

Secondly, There is practically no basis for the Equal Footing Doctrine to which you refer. Bundy used this claim repeatedly, saying he will pay the grazing fees to the state/county, but not the United States.  The Equal Footing Doctrine should be dubious to originalists. It is absent in the Constitution and during the Constitutional Convention, the Committee of Detail purposefully removed such proposed language  from the Constitution.

As most ZeroHedgers are likely originalists, realize the Equal Footing Doctrine which you now espouse was created by “judicial activism” (Lessee of Pollard v. Hagan(1845).  If you are using the Equal Footing Doctrine, you must recognize the authority of judicial review, because it isn’t in the Constitution. The irony of that of course is that you’d have to reject all the subsequent decisions made by the Court to continue arguing the Equal Footing Doctrine prohibits Congress from keeping land for the United States as a condition for statehood. Along with other previous cases, in Light v. United State (1911) the Court ruled that federal land in California was indeed owned by the United States much like an individual who owns a farm, and that they have the same rights to retain or sell the land as they please.

Indeed, embodied in the congressional act that admitted Nevada into the Union, and the Nevada Constitution itself is the proviso that Nevada makes no claims to the federal lands within its borders.

In June 2005, the Supreme Court decided an important case involving the meaning of "public use" in the Fifth Amendment. In Kelo v City of New London, the Court, voting 5 to 4, upheld a city plan to condemn homes in a 90-acre blue-collar residential neighborhood. New London plans to give the land to a developer for $1, with a 99-year lease, to build a waterfront hotel, office space, and higher-end housing. Justice Stevens, writing for the Court, found this donation of property to a developer to be a "public use." Stevens said that the Court's jurisprudence gave government "broad latitude" to determine what uses might be "public." In a concurring opinion, Justice Kennedy indicated that the Court still stood willing to review on constitutional grounds takings that are arguably simply the city favoring one private owner over another, rather than takings based on a good faith analysis of the public interest. Angry property rights advocates reacted to the decision by suggesting that local governments consider condemning the homes of justices in the majority and turning them over to private developers for construction of B & Bs.
Shame on Nevada for capitulating the stewardship of its own lands to the Federal government. They may have reaped those fees compared to the black hole of federal fiscal mismanagement. Thank you for reaffirming my choice to sway away from the law, yet I'm still fascinated by it.

I must stress that I agree with the principle that, ceteris paribus, less is more when it comes to gov't. I also agree that a lot of the social welfare programs have damaged entire communities - including portions of the White community (which accounts for 69% of welfare recepients in America). 

However, as this case unfolds, I am increasingly convinced that it might be a poor test case for the small-gov't camp.

As for Bundy hmself, even if he did not utter those words out of malice, he is more of a liability than a hero/messenger -- especially in this age of soundbites and PR.

There are millions of acres of land with nothing but shrubs and trees.  It is not unusual to see cattle and sheep grazing on the land in california because allowing them to graze is easier than trying to mow the fields down to prevent fires.  Cattle and sheep are transported to these fields and allowed to graze for free for that very reason.  You only need to drive to the coast from the central valley in California to see this.  It is not big deal.  Not worth dividing a fucking nation over that is certain.  The politicians who are multimillionaires because of back room deals should disturb you but evidently YOU ARE OKAY WITH POLITICIANS WHO STEAL.

Smart thing to do is raise money and pay what govt says Bundy owes. Then govt has no more reason to go after him. They walk away or reveal the true reason they want that land.

Meanwhile Bundy can sue BLM for cattle loss and property destruction.

Then everyone can take this fight where it should be, Washington DC, where the laws affecting this situation originate from and the orders originate from.

Bunkerville isn't the place for this fight. It really needs to be in DC.

Guys like Cliven Bundy are all we have.  We'll just have to make do.

 

We could substitute Cliven Bundy with Sheriff Mack instead.  He's the guy who said, "women and children should get shot first".

Unfortunately our Nation has degraded so far, that we cannot field anyone better than these two.

hey meathead, this isn't just about paying taxes. the question is, 'at what point do your taxes become so oppressive to your business that you say "no"?'

many don't know the BLM wanted him to pay grazing fees AND reduce his herd AND limit his grazing periods to an ass backwards seasonal schedule that would starve his heard to death AND basically put him out of business. like paying your broker to churn your account until the balance is zero.

now we have the propagana machine saying he is a racist for basically asking 'what's the difference' between slavery and being a food stamp receipient...which is actually quite an existential question. it reminds me of that line from Jack Nicholson in "The Departed" "When I was growing up, they would say you could become cops or criminals. I guess, the best way to show Bundy the difference is to sell him and his family into slavery. He already knows one side - getting a free ride at someone else's expense - now, perhaps, it would be great if he sees the other.

 

The only unfortunate thing about the situation is that it is taking part now, and not 40 years ago. Should the stand-off happen back then with Bundy getting shot at the end, he wouldn't have the chance to pass on his genes. Now, the in-bred single IQ lineage continued and multiplied and we have what, 14 little imbecils with guns running around. A sad day for the country.

What he does is no different than illegal mininig or illegal water diversion - use of common natural resources for personal gain without contributing back to the community. On top of dismissing the basic principal of the American society (property rights), Bundy is also an evident Paula Dean-styled KKK remnant. Anyone who equates social support to actual slavery is either a moron who doesn't understand either (most ZH readers), or, which is likely the case with Bundy, a former slaver whose assessors benefitted from the free labour of others. Hence his casual references to the benefits of slavery. Hence his motto “if it good for me, doesn’t matter where it comes from and how”.
