Darrell Issa Fuming Upon Learning Lois Lerner's Hard Drive Was Destroyed

Following Darrell Issa's subpoena of Lois Lerner's hard drive, the rather stunning (and ripped from the pages of a badly written inside-Washington TV mini-series) news is that the IRS reports that the hard drive in question has been destroyed (just as we hinted last night). "We've been informed that the hard drive has been thrown away," Sen. Orrin Hatch of Utah, the top Republican on the Finance Committee, said in a brief hallway interview and as Politico reports, Ex-IRS official Lois Lerner’s crashed hard drive has been recycled, making it likely the lost emails of the lightening rod in the tea party targeting controversy will never be found, according to multiple sources. Issa is pissed... blasting in a statement that the 'lost emails' meme was "just one more attempted deception... e-mails of a prominent official, don’t just disappear without a trace unless that was the intention." His response... requesting the White House attorney's testimony on Lerner's emails.

As Politico reports,

Ex-IRS official Lois Lerner’s crashed hard drive has been recycled, making it likely the lost emails of the lightening rod in the tea party targeting controversy will never be found, according to multiple sources.

 

“We’ve been informed that the hard drive has been thrown away,” Sen. Orrin Hatch of Utah, the top Republican on the Finance Committee, said in a brief hallway interview.

“IT experts have weighed in and said yes — we can get those” emails, said Rep. Charles Boustany (R-La.) earlier Wednesday.

 

The latest news suggests such professionals may never get the chance to try again — and the IRS has even said its criminal investigators who specialize in rebuilding hard drives to recover hidden information from criminals were unable to restore the data back in 2011.

 

“We believe the standard IRS protocol was followed in 2011 for disposing of the broken hard drive. A bad hard drive, like other broken Information Technology equipment, is sent to a recycler as part of our regular process,” an IRS spokesman said in response to a query from POLITICO.

So the standard IRS protocol is to wipe away all the evidence? Can US taxpayers then use the same protocol to "wipe away" their W2s?

As for this latest fiasco, who could have possibly seen that coming?  Well, everyone.

As for the hard disk, we have a suspicion it will not only have passed through a massive magnetic field first, but ultimately Issa will receive something that looks like this:

 

 

At that point it will be up to America's army of White Hat hackers to attempt salvaging whatever data is on it. Because only in the US government - the same government that demands businesses retain electronic data for years at at ime - is there no requirement to back up one's communications and files.

Upon learning about the latest lie from the IRS he issued this statement.

“If the IRS truly got rid of evidence in a way that violated the Federal Records Act and ensured the FBI never got a crack at recovering files from an official claiming a Fifth amendment protection against self-incrimination , this is proof their whole line about ‘losing’ e-mails in the targeting scandal was just one more attempted deception. Old and useless binders of information are still stored and maintained on federal agency shelves; official records, like the e-mails of a prominent official, don’t just disappear without a trace unless that was the intention.”

And finally his latest request:

Committee seeks answers from current White House attorney who supervised IRS’s response to congressional inquiry

 

House Oversight and Government Reform Committee Chairman Darrell Issa, R-Calif., today requested that Ms. Jennifer O’Connor of the White House Counsel’s office testify on Tuesday, following Internal Revenue Service (IRS) Commissioner John Koskinen’s testimony on Monday.

 

“From May 2013 until November 2013, you served in a career position at the IRS as the Counselor to the Commissioner, with the primary task of ‘navigat[ing] the scandal over [the IRS’s] reviews of conservative organizations,’” said Issa in the letter. “In this position, you had a direct and substantial role in the IRS’s response to congressional requests for documents, including documents sent or received by Ms. Lerner.  In fact, IRS Chief Counsel William Wilkins, when asked who was supervising the collection of, ‘documents relating to the committee’s requests for material,’ responded ‘Tom Kane and Jennifer [O’Connor] are the two I would identify as the key supervisors.’ Given your prominent role in supervising the IRS’s document review and production processes, you likely knew or should have known that the IRS was missing a portion of e-mails sent or received by Ms. Lerner responsive to the Committee’s subpoena.”

 

Ms. O’Connor earned a promotion to the White House earlier this year. The Oversight Committee had previously subpoenaed Koskinen for testimony which comes as a result of the agency’s recent statement that the IRS lost an unknown number of emails pertaining to the activities of former IRS official Lois Lerner from January 2009 to April 2011. It also comes on the heels of the IRS’s repeated empty promises of compliance with oversight.

One wonders how long before her hard drive fails? and also how long until Americans finally realize they too have had enough, and proceed to inform the IRS they have systematically "lost" all tax forms documenting income sent to them in the last several years as well?

It's already been mentioned, but this story is so laughable on so many levels.  I am the Exchange admin for my organization and no matter what email solution they were using, for disaster purposes there would be database copies; probably numerous copies - local backups and offsite tape backups.

No one in the media should be buying this horseshit story.  At the very least there would be disaster backups of the mail system.  In the case of Exchange, you would have backups of the databases and possibly even mailbox/brick level backups for granular email restore.

In short, this story is shit.  Local hard drives have nothing to do with email!

People got apeshit about their emails. I was an Exchange Admin for a while and got burnt out on it. People save fucking everything and use email basically as a file server rather than just communication. Plus, people are always in CYA mode. Keep everything...forever. I personally don't work that way. If you gotta CYA that much, might want to do some soul searching or get in another line of work.

I'd bet my right nut that Lois has a copy of her local .pst archive file on a USB drive for "insurance" purposes. Probably in a safe deposit box.

You don't fuck with email servers.

I do VMWare now as a contractor for another gov contractor. Shit runs tight.
You can't just go around willy nilly deleting and whipping data. There are audit/access and logging trails. Plus, if she was using commercial email for her hi-jinx, that's another major policy violation and probably broke many laws in itself. That also would be easy to subpoena and expose.

Bingo! I too, work extensively with Exchange. It is highly likely, that this IS has some type of email archiving application in place that stores emails for 7 years at least.

The Republicans have an Impeachment level offence if they can find ONE email that clearly shows the Administration orchestrated IRS abuses for Political gain.

There can only be one reason that it isn't being pursued with a vengeance: the Republicans are fully implicated and CAN'T go after Obama without blowing Themselves up.

-It's the only answer that actually makes sense politically.

IF the Republicans are shown to be employing the IRS in concert with the Democrats to destroy political movements; then the Country will know BOTH Parties are hopelessly corrupted and hopelessly inter-dependent.

The can be no Democracy if BOTH Parties are in effect ONE Corrupt Cabal of Power Monopolists.

In every company I know, the company email server is redundantly backed up and archived on a regular basis. They do not depend on emails to be kept on the user's hard drive. That would be idiocy.

Dear Senator or congressman whomever:

The recent events regarding the alleged IRS targeting of conservative political groups has prompted me to write you this letter. 

The use of public resources to stymie the political opposition is clearly inappropriate and will not be tolerated.  But what is particularly disconcerting is that congress is completely unable to find out, definitively, what had happened.  

The inability of our federal government to effectively investigate the IRS represents a clear breakdown in the government?s system of checks and balances.   To even allow the IRS to destroy evidence during an investigation is, in and of itself, criminal.  

You should know this, but so as to not take any chances I will remind you: Our government is charged with the task of, above all else, protecting the freedom and rights of its citizens.  It is not to be complacent while one of its many bureaucracies victimizes and intimidates its citizenry while aiding in ?what I can only describe as ? a type of election fraud.

SENATOR OR CONGRESSMAN, I ask this from you: become passionate about (1.) getting to the bottom of the IRS allegations (no political party can argue that it is unimportant) (2.) punishing those that tampered with evidence during an investigation (both sides of the aisle should agree it is important and that it actually occurred) and (3.) preventing departments and bureaucracies from deviating from their originally intended purposes in the future (bipartisan-approved goals all around).

Seeing as how there should be no political opposition to such indisputably positive objectives, your new passion should see abrupt results.  Now I know you are already brimming with ideas of how you can complete these objectives, but I would like to make some suggestions myself.

- Use a carrot.  Provide a large monetary reward to whomever comes forward with Learner?s missing emails.  This may sound like a radical idea, but please read on.  The reward doesn?t have to be publicly funded.  Within days I could have a crowd-sourced prize large enough to make anyone turn on their morally-vacant ideology.  Just let me know.

- Create a department charged with two objectives:  

1. To record any and all transactions, communications, and dealings of the federal government.  If the NSA can do this for an entire country, it is not fantasy to imagine a government that actually knows what it is doing some of the time.  

2. To monitor the bureaucracies and assure the United States that they are only pursuing objectives in line with their originally intended purposes.  

I sincerely thank you for your new enthusiasm and passion in this matter.

Only a brain-stem or liberal, but I repeat myself, would believe this story for a second. Email is the one electronic form of document that cannot be lost. Every person it was ever sent to, and all system backups of the sender and receivers would have to have been destroyed for an email to disappear. Plus, someone likely printed it and/or copied it, which is also stored on disk.

It's fucking impossible there is no trace of these emails unless there has been a concerted effort to make it disappear.....from everywhere.....

Just call the fucking NSA - if no one else has a copy, they do.

Here’s the political calculus:

 

Before this revelation, Dumbassrats were daring the Repugs to throw a woman (Lois Lerner) in jail.

 

Then this bullshit story hit.  Nobody believes it, and it even seems like some part of the vox populi ignoranti is starting to see thru this galactic corruption of the Obungle Court.  Now all bets are off.

 

Here are the key words in Issa’s letter:

 

“…you likely knew or should have known…”

 

Them’s fightin’ words, the law- talkin’ kind.

 

Ms. O’Connor is about to be subpoenaed, likely charged, and likely imprisoned. 

 

Ms Lerner is also about to be imprisoned.  Both by the House Sergeant at Arms.

 

Next, they should threaten some of the low-level IRS IT shlubs, and one of them will spill the beans.

 

The emails at minimum contain direct evidence of White House involvement in the illegal IRS actions.

As a former Microsoft and Cisco systems engineer, I can attest that in any corporate environment all emails accounts are client server based. So multiple hard drives across multiple arrays and 500 back ups must have all gone amiss!  250 days of daily backups  / annum x 2 years so that for every email to have gone missing is absolutely bollocks! That means they are lying!. Why don't they just fry the b*tioch and be done with it!

So they are going to sit there and say that the RAID array on the email server somehow managed to suffer an impossible failure, the tape backups were all lost, and sadly the only thing left was a personal hard drive which also magically died and was recycled all at the same exact time to ensure that the questionable timeframe of emails were all lost.  And they expect anyone to buy that story?

 

Well, looks like I'll be filing my taxes this year, what the hell, whip out the old excel chart and crunch the numbers to ensure I get free money despite having paid them nothing in over a decade.  No prepayments, nadda, zip, zero, zilch.  If they audit it, well... that hard drive was lost, sorry, money please.

Some have trouble accepting that these unfortunate and regrettable deletions of evidence do happen. I remember poor Rose Mary Woods who worked for the nice  Mr Nixon being pilloried just because she "accidentally pressed the erase button on the tape recorder while reaching for the phone, and then forwarded the tape by keeping her foot on a pedal." and in doing so sadly deleted what might have been damning evidence against her boss. A completely understandable error, just like Ms Lerner's. People must stop being so cynical.

Will government policy be now to keep all communications on multiple drives updated every hour.

Emails always have a trail, I am sure some competent IT person could trace back on other Hard drives her emails.

To say we are awash in scandals is an understatement. It is fortunate that the American people have the attention span of a gnat, this will help them through these troubled times. It is almost guaranteed that  all the scandals and all the revelations that emerge from the nations capital  will come to naught. A polarized America has become unable to react  with any real outrage. 

It appears that in its current form our Government has simply become to big to obtain the degree of over-site necessary to keep its agencies in line. These scandals are becoming to many to count, but to small to have much meaning to many people. Even when the law is broken the Presidents supporters often try to argue it away as political nitpicking. More on this subject in the article below.

Today I went back to the data law course I took as a Manager of Data Base Administration in 2002. I used the summary sheets of the various federal data laws to estimate probable jail time in the Lois Lerner case. I came up with 4 to 7 people responsible for data law violations. The jail terms I estimated would range from 3 to 5 years for 4 people (technicians) and with 3 people (managers) serving from 20 to 50 years hard time. These estimates do not include the terms added for laws violated if the data was altered in any way.

 I spent years listening to auditors who screamed the government was cracking down on data mishandling. Now our own government pisses in our faces and flaunts these “strict” laws. There are thousands of people in our federal jails for “white collar” crimes that involved these data laws. I now believe these people can make a great case for sentence reductions or parole.

The Obama administration is making a mockery of our constitution and our legal system. This too will come back to haunt them…

The only mistake here is by the Adminstration.  By "losing" the emails it exposes the Fed Gov as fallible.  I think they will "find" them, declare victory and say "let's move on" to more important things like bombing Iraq.
