Obama To Overrule Supreme Court? President Considers "Mitigating" Obamacare Ruling

Tyler Durden's picture

Having had his omnipotence chipped away at last week, President Obama has - seemingly - been pushed too far by the Supreme Court's decision on contraception and Obamacare this morning: The White House stated...

  • SUPREME COURT DECISION ON CONTRACEPTION COVERAGE JEOPARDIZES HEALTH OF WOMEN EMPLOYED BY THESE COMPANIES
  • WILL WORK WITH CONGRESS TO MAKE SURE WOMEN AFFECTED BY RULING WILL HAVE SAME ACCESS TO CONTRACEPTION
  • WILL CONSIDER WHETHER PRESIDENT CAN ACT ON HIS OWN TO MITIGATE EFFECT OF SUPREME COURT RULING

Totalitarian? You decide... One wonders if the phrase "do you know who I am?" was uttered this morning?

As The Hill adds,

White House press secretary Josh Earnest said women should be able to "make personal health decisions for themselves,” and called contraception "vital" to the health and well-being of women.

...

"We will, of course, respect the Supreme Court ruling,” he added.

...

Republicans cheered the ruling as a victory for religious freedom.

The decision affirms that Americans, contrary to what the Obama administration attempted to impose, have a right to live and work in accordance to their conscience and can’t be forced to surrender their religious freedom once they open a business,” Sen. Ted Cruz (R-Texas) said in a statement.

It is not "totalitarian" for the executive and legistaltive branch to propose new laws to address new problems (or mistakes that the SCOTUS made).  For example, Citizens United could be neutralized easily by congress and executive order, assuming the political will is there.  Which is assuming a lot.

That fact that Viagra is covered by insurance but not contraceptives for women, is total bullshit.

I don't think viagra should be covered by insurance any more than rograine or hair dye should be covered by insurance.

edit: wait, so Obama wants women to have contraceptives covered so they won't have babies, and viagra is covered so women WILL have babies.  Oh I see, they cancel each other out, got it.

Proposing new laws??

Who the hell is proposing new laws?  This is pure executive action, out of thin air, with no legal authority behind it.

IM GOING TO SAY THIS TO YOU IN HOPES YOU CAN UNDERSTAND WHY THE OUTRAGE OVER EXCECUTIVE ORDERS MATTERS:  Even if you are a big supporter of Obama you should still be terrified of the way he's acting.  He won't be president forever.  What if Jake And The Fat Man (Chris Christie and co.) win the Presidency in 2016 and start running shit by executive order, casting aside laws and things that YOU care about?  You know the Fat Man ain't shy about hammering his rivals and groups that aren't in favor with him.  Would you want him to have this same level of power but working AGAINST your personal desires?  You would be on the other side of this issue so fast it wouldn't even be funny.

Couldn't have said it better myself. If I were American, I'd be shitting my pants now - or I'd be very, very mad.

Either way, this president with his contempt for trivialities such as the Constitution or the Supreme Court should be impeached. I'm really starting to think the USA is facing one of its moments of truth, just like it did in 1776, 1860 or 1941.

I'll give you a hint of where the danger lurks: Ermächtigungsgesetz, look it up to see what I mean.

Touché. Your info is not exactly supporting my point of view, but it matters a great deal in discussions like these. Only question that remains is: is this merely a matter of numbers or should we also be talking about the content and nature of these different presidential executive orders?  I suppose not all executive orders are equally important, right?

"Citizens United could be neutralized easily by congress and executive order,"

I don't think you understand how Constitutional review works.

The SC indicated that the 1st amendment doesn't allow the government to fine or jail people for engaging in political speech, even if the person works for an incorporated entity, and even if the goal of the underlying law is to regulate campaign finance.

How in the fuck, do you think, that by "executive order" - the 1st amendment would allow the government to fine or jail documentary film makers again?

Do you have any idea, at all, about how the federal government is set up?

And the government isn't going around mandating insurers provide "free" Viagra, shithead.

No one is telling Sandra Fluke she can't have birth control. They're telling her that she has no right to demand a private, Catholic institution provide it, and no right to demand it be provided "for free" on the backs of other insureds.

Exactly right.  Roberts was flipped; either he had skeletons in his closet, or they had something he was willing to sell out the Constitution to get. Maybe both: carrot and stick.

But there is no doubt, is there? Roberts was turned. There is no other credible explanation. He backstabbed the people and the Constitution. May he rot in the 9th Circle.

Unfortunately the assholes have been given too much power. Now it is time for the majority to say to alito and scalia STFU

If you want to drive a car or own a home, you are forced to buy insurance. No one ever expressed outrage at the notion before Obamacare came along.

I have NEVER heard any organized opposition to compulsory auto or home insurance. Complaints, yes, everyone complains about it. But no one seriously suggests that people should have the right to opt out because you don't HAVE to own a home or drive a car, or that they have a good driving record, so shouldn't have to pay insurance premiums that cover damages for others.

They make these arguments about health insurance (Obamacare, to be specific). And those who say they shouldn't be forced to pay into a pool that covers other people's accidents and damages when it comes to healthcare would be to embarrassed to suggest they be allowed to drive without insurance, or decline homeowner's coverage while the mortgage company still has a financial interest in the home. It is understood that some things you do carry significant risks to others, those others are within their rights to ask for some kind of insurance from you.

And while you CAN choose not to drive or own a home and avoid the mandate, you CAN'T choose not to need medical care for the time you are alive. In life, EVERYBODY is a licensed driver, and EVERYBODY takes their car on the road every time they get out of bed in the morning.

"If you want to drive a car or own a home, you are forced to buy insurance. No one ever expressed outrage at the notion before Obamacare came along."

Let's set aside the fact that the federal government does not require anyone to buy home or auto insurance.

The reason you never heard most people complain about home and auto insurance is because most people understand that with car and home owner's insurance you are insuring risks to OTHER people and/or their property.

You can blame tort law for that, which makes us liable for harm we cause to others.

See how that works?

Maybe you guys don't consider having to pick up the tab for some uninsured person's medical care a "damage", but a lot of people would disagree.

If you want to chance it, fine. But if you DO get sick, you know damned well you will be able to access care...at someone ELSE'S expense. You know damned well that society will not just let you die.

If THAT isn't freeloading, I don't know what would be.

Are you genuinely this stupid? You have to have car insurance to protect other drives from the very high possibility you will damage their car, not your own; as for a mortgage lender demanding you have insurance, that's to protect them in the case you default on the loan if your house burns down or gets sucked into a tornado.

But when you get ill, there are virtually no such negative externalities. Who suffers if you get ill and you don't have sickcare insurance? You and your loved ones do... and your creditors, if you have any. All people whose association with you is voluntary.

To me the argument is why Hobby Lobby has any right to control how their employees use their compensation from their work. Providing access to health care services is part of their pay, their compensation. They are free to use it, or not. Or to only use parts of it as needed. Hobby Lobby wasn't being asked to provide the actual birth control, they were being asked to provide OBGYN services that MAY have included birth control for some patients.

Those employees can still use part of their money wages to purchase the same thing. Or not. Hobby Lobby doesn't get approval-rights to their employees spending decisions. Again, it is THEIR compensation, THEY should decide how it is spent or used. Or not.

Should an employee have the right to withhold wages they suspect may be being used to buy illegal drugs? If an employer is anti-gun, can they insist that their employees not purchase weapons or ammo with their paycheck? Would they have a right to take punitive action against them if they do?

The religious excuse is bogus, this was about making a statement on birth control, not employers religious rights. The larger issue of how much control an employer HAS over his employees is more important to me. Can an employer exercise veto-power over how his employees spend their compensation, this ruling appears to open the door to saying yes, they do. And where does THAT end? The employer/employee relationship is being disrupted in so many ways these days, and the employee is getting the short end of the stick.

Insurance- To pay for unexpectd or unavoidable situations..

Paying for birth control should not even be covered by insurance.

Using insurance to subsidize ones prescription merely spreads the cost to those who do no use/need it.

Another kicker.. My wife a pharmacists, just filled a prescription for ADHD drugs for a 3 year old child. The doctor shoudl be barred and the mother wacked across the ass with a skinny stick a dozen times..

Uhmarikahns are fucked in the head, thinking pills are the answer.. Amazing how these disfucntions are so prevelant in the USA as compared to the rest of the world...

Your wife is a pharmacist, not a doctor. She has NO WAY of knowing why a particular drug is being prescribed to a particular patient. Hormonal agents, like most birth control medicine is, are prescribed for a variety of reasons having nothing to DO with contraception.

As for the 'ADD' drugs for a three-year old? Well, if it is being given for the wrong reasons, of course that would be wrong. But again, as a PHARMACIST, it isn't your wife's job to make that determination. What she CAN and should do is question whether this is the BEST drug for that patient, and to alert the doctor that there may be contraindications for such a young patient, see if something less potent can be substituted.

But if the drug hasn't been prescribed for typical ADD, but for some other reason entirely, it may BE the appropriate drug in that case. Then your wife's job is to FILL it.

As a nurse, I can tell you that the drugs used for ADD are often prescribed for other conditions like narcolepsy and other sleep disturbances. Birth control medicines are often given for endometriosis and other 'female' disorders, as well as for menopausal women having problems with the symptoms. In fact, ALL drugs have uses for things they were not specifically designed for...

Viagra began as a cardiac drug, a vaso-dilator that somebody discovered gave guys a woody. Do you really want to be explaining why your doctor ordered it to your pharmacist?

NOT one doctor on Earth can justify ADD drugs to a 3 year old. NOT ONE. They have NO beneficial effect for a 3  year old child no matter what the imagined off-label use. None.

"WILL CONSIDER WHETHER PRESIDENT CAN ACT ON HIS OWN TO MITIGATE EFFECT OF SUPREME COURT RULING"

You ask if that is totalitarian. Well, if we were talking about Stalin, do you really think he'd be considering ways to mitigate the effects? A totalitarian President would nullify the ruling, not look for ways to deal with it.

And what IS the effect of this ruling? Women who work for Hobby Lobby are going to have a harder time obtaining birth control on their insurance plan than other women who don't work there. So, since HL's 'rights' were upheld, why would they or anyone else care if those women found a go-around? Would it be better to vow to fight the ruling to the death?

How is this totalitarian? Please explain how something like this leads to the gulag...

Thanx for the good advice. When the TEA Party finally takes over, they can increase the size of the SCOTUS to 24, appoint 12 new constitutionalists, and change the appellate districts.

I think the Ninth Circuit should have its jurisdiction changed to just Johnston Atoll, for starters.

What, are we back to nine justices again? Derp. My bad.

I think the number has been changed by congress a couple times now. It was originally 12 before congress changed it to nine to avoid having the first President Johnson appoint three replacements after the civil war.

Still works out. Once the four retards retire, the number can be reset again.

The whole Jefferson vs. the courts thing was seriously amusing. Every time a Federalist judge tried to punish Burr for shooting their tin god Hamilton, that judge's district suddenly vanished. The SCOTUS upheld all of it, saying "he could do that to us as well".
