If you look at Obamacare from a historical perspective, the Dems weaseled the thing by doing the following:
The law had no specific provisions about birth control so when the Repubs were arguing against it the Dems could say that the law didn't force providing birth control and they were telling the truth because it wasn't in the law.
After the law passed, HHS was able to then include the birth control provision and Dems could and can say they didn't vote for it because it wasn't in the law.
The ACA shouldn't be allowed to pass because they aren't really laws, they are laws that allow government agencies create laws which I am pretty sure is unconstitutional.
