Russia Slams "Puzzling And Unprecedented" $50 Billion Yukos Award, Challenges "One-Sided" Court Ruling

The Hague is not Vladimir Putin's favorite place today. Following the "war crime" comments earlier, the arbitration court's decision to rule in favor of Yukos shareholders (and thuis against the allegedly "politically motivated" confiscation of the firm's assets by the Russian government) with a $50 billion settlement (half what was sought) has prompted a quick and angry response from the Russian government. Blasting the "one-sided use of evidence," and re-iterating the massive tax evasion that the leadership were involved in, Russia slams "the puzzling unprecedented amount of damages" awarded, claiming the process is "becoming increasingly politicized."

 

As Bloomberg reports,

The Permanent Court of Arbitration in The Hague found that Russia is liable to pay just under half of the $114 billion sought, GML Ltd., the holding company for Yukos’s main owners, said today.

 

The decision showed the campaign against Yukos was “politically motivated,” GML head Tim Osborne said in London.

And Russia replies...

Today Permanent Court of Arbitration in The Hague issued a final judgment rendered in three interrelated arbitration proceedings initiated by the former majority shareholders of JSC "NK" YUKOS ". Decisions were based on the Energy Charter Treaty.

Conclusions of the Arbitration Court shall enter into a direct conflict with the findings of the two Houses of the European Court of Human Rights. The European Court of Human Rights twice concluded that JSC "NK" YUKOS "committed massive tax evasion that the leadership of" NK "YUKOS" aware of violations that additional charge of almost all taxes JSC "NK" YUKOS "was lawful and lawful that JSC "NK" YUKOS "was not subject to discrimination, and that the actions of Russian authorities were not of a political nature.

In the Russian Federation drew attention to other serious flaws in the decision of the arbitral tribunal. Among them:

- One-sided and one-sided use of research evidence;

 

- Completely unacceptable revision challenging the decisions of courts of the Russian Federation, carried out by the Arbitration Court in such a way as if the arbitral tribunal was more authority to challenge acts of the Russian courts;

 

- Speculative and not confirmed by the Court of Arbitration evidence assumptions about the reasons for the actions of state authorities of the Russian Federation, as well as the use of these assumptions, the Arbitration Court to justify its conclusions that are not supported by the facts;

 

- The denial of the validity of the Arbitration Court accrual of JSC "NK" YUKOS "income tax because the arbitral tribunal rejected the fact many acts of courts of the Russian Federation, including the decisions of the Supreme Arbitration Court, which have been handed down for many years before the emergence of the dispute;

 

- Failure of the Arbitration Court properly accommodate them recognized by the fact that several shell trading companies JSC "NK" YUKOS "used a similar scheme of tax evasion and later were reorganized several times and re-registered in places thousands of miles distant from their original location , in an attempt to avoid detection of violations and to prosecute the Russian authorities;

 

- The inability of the Arbitration Court to come to the obvious conclusion that the management of JSC "NK" YUKOS "aware of the permitted violations of tax legislation and acknowledged that used by trading companies JSC" NK "YUKOS" scheme of tax evasion, if disclosed, led to be "essential" for the financial consequences of the JSC "NK" YUKOS "; guide JSC "NK" YUKOS "also understood that performs actions on tax evasion and that his income trading companies with which taxes have not been paid will be treated as income of the JSC" NK "YUKOS";

 

- The denial of the validity of the Arbitration Court accrual of JSC "NK" YUKOS "value added tax on the basis of representations of the Arbitration Court on how to be Russian tax legislation and not on the basis of actual requirements of the tax legislation of the Russian Federation to the fact that the presence of such claims is recognized by the arbitral tribunal;

 

- Failure of the Arbitration Court to pass certain disputes to the competent bodies of the United Kingdom, Cyprus and the Russian Federation, despite the requirement in the Energy Charter Treaty, the transfer for consideration of such issue of whether the tax is an expropriation;

 

- Senseless and extremely speculative attempt to give a hypothetical valuation JSC "NK" YUKOS "after almost ten years after the alleged expropriation.

Of fundamental importance is the fact that the arbitral tribunal does not have jurisdiction to consider questions put before him. The Russian Federation has not ratified the Energy Charter Treaty. In accordance with paragraph 1 of Article 45 of the Treaty the Russian Federation has not applied any provision of the Agreement is temporarily in the extent to which the provisional application of the provisions of the Constitution, the laws and regulations of the Russian Federation.

In addition, the Russian Federation in any of its more than fifty international agreements on the protection of investments did not consent to arbitration of disputes with investors prior to the ratification of an international agreement, as it would contradict the Russian law.

Finally, the puzzling unprecedented amount of damages awarded by the arbitral award that is brought on the basis of the Russian Federation unratified international treaty and that, moreover, come into direct conflict with the earlier decisions of the European Court of Human Rights.

All these facts confirm that the arbitral tribunal was unable to come to the dispute with the prudence that is required of judges in such situations. Instead of objective, impartial consideration of the case the Arbitral Tribunal conquered their actions tactical reasons and eventually adopted politically biased decisions.

Such an approach undermines the authority of the Court of Arbitration and the Energy Charter Treaty, the mechanism for which is becoming increasingly politicized, as in this case, becomes the object of abuse by domestic investors, tax evaders.

For this reason, and also because of the presence in the arbitral award of significant flaws, the Russian Federation will challenge the arbitral award in the courts of the Netherlands and expects to achieve a fair outcome there.

In conclusion, the Russian Federation will challenge the arbitration award in the Dutch courts and expects to achieve a fair outcome there; and we suspect the Yukos shareholders should not hold their breath as last time we checked Putin is not exactly "compliant" with arbitrary western propaganda decisions.

How about an article fairly and honestly discussing how and why it was that in a country where the Jewish population is under 2%, the vast majority of the oligarchs who benefited from the Yeltsin fire sale were Jewish.

I suspect that such a network existed, was tied to Jews in the US and UK and elsewhere, and that a major part of the anti-Russian, anti-Putin propaganda from, disproportionately, Jewish neocons, pertains to Putin not merely resisting NATO expansion, but private central banking/oligarchical interests fairly described as Jewish-dominated, as a matter of fact, if not politically correct water bubbler conversation.

Given the deep ties of certain "Ukrainian" oligarchs to Israel - this may be a broader issue than it may seem at first blush, notwithstanding the predictable cries of 'antisemite/hitler/nazi' that always seek to obfuscate and distract from actual evidence of a {largely} Jewish conspiracy to gain control of banking, media, and natural resource wealth. 

I know, I know, I'm a horrible hate fulled tin foil hat wearing man, but when the same pattern is repeated in nation after nation (look at the US, Russia, Ukraine - look at South Africa where Jews are 0.07% or so of the population but represent about 25 of the richest 100)....  it begins to look like there is some phenomenon going on which, given renewed cold war tensions, and the seeming involvement of Jewish people, in disproportionate numbers, everywhere you turn...  

crying 'anti-Semite' simply doesn't dissuade an honest person for wanting to know what the fuck is going on with this excessive power by the same ethnoreligious group, many of whom are loyal to that group before their own country (come on, Richard Perle, Jeff Doldberg, Rahm emmanuel et al.) - in various countries across the globe.

While everyone says that Russia simple ‘won’t pay’, the fact of the matter is that, assuming their appeal gets denied (which I expect it to do so), then the Hague will issue a judgment against Russia and they will start seizing assets. Specifically, the challenge with this decision for Putin is they (US, UK, EU, etc.) plan on seizing and arresting assets of Roseneft and other Russian oil companies around the world if he doesn’t pay up…also, if Putin touches a hair on Exxon, BP or Shell assets in Russia….then how soon do you think it will be before the Hague denies his appeal and starts issuing judgments against Roseneft, Gazprom, etc.

 

The real threat I see is that Putin is losing on all fronts – he is losing the propaganda war, he is losing the economic war, he is now losing the legal war, he has more sanctions coming out this week (most likely will cripple VTB outside of Russia) and now Putin knows he will not get a fair shot from the US, UK, or EU.

 

Soon he will be in that rarefied air of ‘fuck it, what do I have to lose’ and I predict he comes out swinging and decides to just take Eastern Ukraine, close the borders to Russia, take his toys and go home…while doubling gas rates.

 

This is thermo-legal economical global warfare.

As you say, this is getting very serious and is clearly part of a long term plan. This is part of the US's pre-emptive strike.

The timing of this announcement after so many years of processing the case cannot be an accident.

The US is trapped in a financial hole due to their ballooning deficit. If they don't act now, and 'kill' the opposition then, the BRICS+ will be in a position to strike with a potential alternative reserve currency. That represents the start of the end for the dollar and the power of the US. Which they cannot allow to happen.

Time for the BRICS to strike back with an alternative distraction. How about the largest exercises yet seen in the seas off China?

By the way, did you notice that on the 16th July 'a source' in Moscow announced the re-opening of the Russian Intelligence gathering base in Cuba, followed by Putin the next day saying that they were not. Interesting.

As posted above. The courts rulings can and will be implemented by many countries around the world pouncing on Russian assets. With the Rothschilds apparently a major benefitiary no-one will or possibly can stand in the way. They are probably T(most powerful)PTB there is.

As their power also reaches deep into Russia, Putin has a big problem and will be watching his back a bit more closely from now on.

Occupying countries and building army is something majority wants to see (for the last 500 years of Russian history) - so just look at Putin ratings - but economically the country is dying. The most active and intelligent are increasingly choosing emigration (3 million in last 3 years), while beaurocrats are becoming a core of middle class (Russia now has more beaurocrats than Soviet Union did, which was double in size and known for its total control of the people). All the social benefits are put not even in a back seat, but somewhere in the trailer as the budget goes to building military, donating Crimea (which would otherwise, of course, fall apart) and creating all those corruption intensive and highly inflated sports event like Sochi 2014 and WC 2018 - (and also subsidizing various foreign bloggers to better brainwash Western people). Meanwhile, local media is fully in hands of the great leader and any opposition is violently repressed. Don't really see them even as big threat, they are surely powerful enough to hit some more planes, but I don't think that supposedly strong army without any kind of economy backing it is enough in XXI century to get anything more that Luhansk

wrt. Russia it appears that the parasites that have captured control over certain aspects of the West are working overtime to destroy all aspects of the world they do not control. The evidence we see is a series of loosely related attacks on all independant thought and industry. Syria, Libya, Ukraine, Iran and today Russia proper have been attacked and destroyed with varying degrees of success. The media coverage of it all being a pursuit of freedom, liberation and prosperity for the local populations is still spun but the crowd of believers is dwindling. The announced 50B fine today will not be paid but will of course lead to seizure of Russian assets abroad. I think Russia + China are presently in a race to build an alternate version of the world before the parasites feeding on the West use their extensive power to capture them as well. One concern seldom seen on zero hedge is that the Chinese and Russian leadership are potentially even more tyranical than the Rothschilds. Would a BRICS run world be a better place, a worse place or the same with the oligarchs being of Chinese, Russian and Indian extraction rather than being WASPs and Jews?

Interesting thought.  I read an article that went into a little of what Putin inherited when he first took the riegns of power.  Concerning the oligarchs, Putin told them they could keep their ill-gotten gains, but they would have to pay taxes like anyone else. 

From what I have been reading, I am beginning to think Putin is not an evil man.  He was a part of and inherited the mess that was left after Communism fell.  He was secretly brought up a christian by his mother and apparantly is pushing christianity in Russia.  Could be worse.

As far as a BRICS run world, if they go with gold backed currencies at some point they will run the world.

Although, I do agree with a lot of material ZH posts daily, however,in this case I do express my slight frustration with how this subject has been addressed on that subject matter here.

Firstly, only the russian side lawyers comments are posted irrelevant of the actual statements from the Tribunal.

Secondly, although Russia acts more rationally than the West, and in particular the US, on most of international issues from its own perspective, however, it was atrociously wrong on Yukos case and I can only applaude to the decision made by Permanent Court of Arbitration as well as really believe that no Rotschilds etc had had any role here but agree that affected parties might have been various portfolio investors and etc as a class as a whole.

Thirdly, I believe that many still do not understand that this court and the body has nothing to do with Dutch but a body of a type of World Bank or UN similiar as well as by Russia signing the agreement, ie effectively binding from the moment signed, this ratification is a total baloney gobbledygook, ie similiarly as if anybody has signed a contract and got a mortgage but when is still deciding at home whether he/she will "ratificate" it and should really start making monthly payments. Like really?

How do we reconcile this ruling with the ones from the European Court of Human Rights?  Twice they said that the head of Yukos deserved to be jailed and that his imprisonment was not politically based.

I suspect politico-economic reasons behind the current court ruling.

The quality of the panel was way way higher on that and actually qulified to assess commercial disputes whereas the European Court of Human Rights only assessed the issue based on European Human Rights convention pro-forma documents.

In addition, the amount of material was more than 10,000 pages of documents to support the commercial dispute relating to Russia signed Energy Charter Treaty relevant to investor protection rules plus 37 experts, plus witnesses, plus full disclosure of secret agreements between the syndicate of banks and Rosneft, plus... and etc etc.

The evidence provided is so self descriptive that person who negates is either a clinical imbecile, zombie, in some way related to the Russian governement side, hence not objective, or is completely unqualified to form the opinion due to the lack of basic education on that matter.

Interesting but mostly a BS story. It's not binding since when did any country pay out even a billion settlement. Why doesn't the US pay its UN bill 1.2 billion dollars. Non-issue.
