The Shocking Reason Putin Isn't Worried About The $50 Billion Yukos Ruling

Having $50 billion of assets under potential seizure is enough to make anyone whince. However, despite a quickly worded statement on the Yukos award, Vladimir Putin seems less than anxious to find a resolution. We think we know why, and it's very concerning.

As The FT reports confirming our earlier comments:

The award is a landmark not just for its size – 20 times the previous record for an arbitration ruling. The tribunal also found definitively that Russia’s pursuit of Yukos and its independently-minded main shareholder, Mikhail Khodorkovsky, a decade ago was politically motivated.

Though Russia cannot appeal against the award, Moscow said it would pursue all legal avenues for trying to get it “set aside”.

 

Even if the ruling stands, shareholders face a tortuous battle trying to enforce it. If Moscow refuses to pay, they must pursue Russian sovereign commercial assets in the 150 countries that are party to the so-called 1958 New York Convention on enforcing arbitration awards.

But perhaps this explains why Putin is not coming out swinging, as The FT concludes,

One person close to Mr Putin said the Yukos ruling was insignificant in light of the bigger geopolitical stand-off over Ukraine.

 

“There is a war coming in Europe,” he said. “Do you really think this matters?”

Indeed winter is coming, and the wall is ill defended. A force none of us has seen in our lifetimes is about to descend on us all. Global war this time around will kill billions. You have to ask, "Who is driving this war and what do they seek to gain?" That question probably belongs inside the beltway in Washington DC, because of all the forces in the world, the DC crowd seems most intent on a global conflict with Russia and CHina. Washington is inhabited by groups of million and billionaires who have bought the entire congress and president. Using this power since 9/11 they have gone from war to war non-stop. I do not equate Washington DC to America anylonger, because they do not represent us, or act in our interests. Only a fool would believe they do. Banks, Israeli, Corporate profits and stock markets are all they care about, somehow they believe war will make Israel a super power, make banks all powerful economic rulers and fuck knows where they see us ordinary people. One hint though, notice the vast police and spy state they have set up, that should tell us all a thing or two about their plans for us.

Spot on again Jack. The DC crowd don't seem to realise that unlike their previous opponents Russians can shoot back properly and, even without nuclear, could hit the US mainland hard for the first time in history. Is there is no-one in Government that remembers that fights between near equals are messy and last years. Think Korea or Iran/Iraq. Quick strikes only work against incapable foes.

A hanger on an airbase in Arizona flying drones is just not a war fighting option. DC politicians spend money as instructed, they probably have little understanding of the vulnerability of their aircraft to Russian AA missiles and their carrier task forces to their ASMs. The Navy may even have forgotton to mention that they have no idea where many of Russia's subs are, they are too quiet. Then there is the army, well basically there isn't one in Western Europe, disbanded as part of the 'peace dividend' and there is no way the US Army with heavt weapons would get across the Atlantic.

That of course ignores any secret Russia/China defence agreement. The US couldn't take on both at the same time and hope to win so of course strategically they would join up. Only idiots pick a fight they can't win.

We just have to hope that European politicians would stop the idiots. It is their countries that the fighting would take place in, not Russia or the US. It is probable that the Russians would be at the old Warsaw Pact countries' western borders in days. They know the way pretty well from the old days. I am sure that after today every Rothschild property will have its own incoming cruise missile.

Europe has everything to lose. We really don't have a dog in this fight. The US needs to sort it.

The idea that Russia will stop selling gas to Europe is rather odd, considering that Russia's chief foe is right now demanding that Europe stop buying gas from Russia. Neither Europeans nor Russians will stop their business. The US is making noise because it doesn't have a horse in the race economically. No one will listen. They'll cut off gas only in the event of war, during which all trade would be halted anyway, obviously.

  • The last Russia Early Warning satellite went dead just 3 days ago
  • Putin and his associates are thieves and there is no honer between thieves. Putin can be overthrown at any moment. Most if not all his associates could be bought out at any time. He has never develop his own security apparatus. The question is by whom.

The NSA didn't need to spy on the arbitrators (not that they wouldn't or didn't), particularly after Russia appointed an American arbitrator. There are a lot false paradigms and dichotomies that bias the outside observer. I think the Russian spokesman has it right. The West and the International Bankers have tried everything they can, including war and now law suits, to victimize their most important enemy – Vladimir Putin. And he doesn’t look fazed because he stands with a superpower behind him. And the action that’s taking place is within his zone of influence.

The fact that the Yukos ruling can’t be appealed is good reason why Putin shouldn’t pay it. If your adversary is the judge, then it’s a kangaroo court.

More and more it looks like they are attacking the Principle of Independent Sovern Nations around the world – with Arbitrators and Judges joining in the scam – the PPT and the counterpart in Europe, allows corporations to be exempt from local law and if rules, regulations or laws are enacted  locally then they can sue for opportunity cost.

Elliot, Yukos and other emerging icebergs are just the beginning – by this time 20 years from now there will be no local rule for environment, labor, courts and many other systems will be null void and of no force or effect

If Putin losses and USA controls the border of Ukraine, Russia will be gone. Then there is one world government sooner or later

I sense that there's more to this than meets the eye. 

The ongoing reputation-trashing ("International Pariah") aside, it probably sets the stage for next series of boycott and sanction moves -- in an attempt to weaken Russia and scare others from supporting them or their financial initiatives (de-Dollarization).

The mere fact of going on the offense and labeling them with whatever name, seeks to re-affirm US's role as The World's Authority/Police.  Clever use of the Jedi Mind Trick, if others fall for it.

It's not a ruling. It wasn't a court. There were no judges.

The Foreign Ministry or Prosecutor General's office fucked up right off the bat buy naming a representative of a strategic adversary as an arbitrator, that's bush league stupidity.

Russia can walk away from the Washington Convention any time it chooses (which it hasn't even ratified)... and the follow-on events to that withdrawal would have serious ramifications for the future practice of the international law, particularly since expropriation can be deemed an act of war.

The other challenge in enforcing the award is that Russia is both a net exporter and net recipient of FDI - so exactly which court is someone going to march into and find 50 billion of Russian assets to seize, where their is no significant cost to the host country of enforcing the award (even absent a visit from the Russian Navy or Air Force)?

If they try enforce it London - BP could lose all its assets in Russia (much more than 50 billion), and that's before they go to work on the bankers in London...

If they try enforce it the Hague - Shell is in the same boat as BP.

If they try and enforce it in Germany - how many German industrial investments would be subject to expropriation (never mind not being able to power or light the factories in the motherland)?

If they try and enforce it in an even more corrupt country hosting a Russian State-owned pipeline, there is a good chance the will lose, and in fact have actual Courts (which might have to consider national interest) find the arbitral award invalid.

This is a quagmire with no good or easy extraction options (except perhaps the liquidation of the officers and shareholders of the claimants). No one wants a war (except perhaps the neoimperialists) so it will be interesting to see where they compromise their corrupted ethics and laws to avoid one, if they do so.

Ceteris paribus, this would be correct because the BRICSs would need to issue and export an gazillion CNY,RUB,BRL,INR,ZAR to actually displace the dominant 80% market share that USD has.

But nothing is ever equal, and if either the ongoing trade war or a hot war leads to a collapse and write down of USD debt pyramid, the BRICS have to do far less printing to produce and export the required float to achieve their goal.
