2016 Presidential Hopeful, Texas Governor Rick Perry Indicted For Abuse Of Power

Tyler Durden's picture

Texas Governor, and 2016 Presidential hopeful, Rick Perry has been indicted by a grand jury. Rather ironically, as AP reports, Perry carried out a threat to veto funding for state prosecutors investigating public corruption, promising publicly to nix $7.5 million over two years for the public integrity unit unless District Attorney Rosemary Lehmberg (who pled guilty to drunk driving) resigned. He was indicted by an Austin grand jury on felony counts of abuse of official capacity (maximum punishment 5-99 years in prison) and coercion of a public servant (2-10 years in prison). Perry is the first Texas governor indicted since 1917. We have one word... oops!

As AP reports,

A grand jury indicted Texas Gov. Rick Perry on Friday for allegedly abusing the powers of his office by carrying out a threat to veto funding for state prosecutors investigating public corruption — making the possible 2016 presidential hopeful his state's first indicted governor in nearly a century.

A special prosecutor spent months calling witnesses and presenting evidence that Perry broke the law when he promised publicly to nix $7.5 million over two years for the public integrity unit run by the office of Travis County Democratic District Attorney Rosemary Lehmberg. Lehmberg was convicted of drunken driving, but refused Perry's calls to resign.

...

Perry was indicted on charges of abuse of official capacity, a first-degree felony with potential punishments of five to 99 years in prison, and coercion of a public servant, a third-degree felony that carries a punishment of two to 10 years.

No one disputes that Perry is allowed to veto measures approved by the Legislature, including part or all of the state budget. But the left-leaning Texans for Public Justice government watchdog group filed an ethics complaint accusing the governor of coercion because he threatened to use his veto before actually doing so in an attempt to pressure Lehmberg to quit.

"We're pleased that the grand jury determined that the governor's bullying crossed the line into illegal behavior," said Craig McDonald, executive director of Texans for Public Justice. "The complaint had merit, serious laws were potentially broken."

...

Perry said Lehmberg, who is based in Austin, should resign after she was arrested and pleaded guilty to drunken driving in April 2013. A video recording made at the jail showed Lehmberg shouting at staffers to call the sheriff, kicking the door of her cell and sticking her tongue out.

Lehmberg faced pressure from other high-profile Republicans in addition to Perry to give up her post. Her blood-alcohol level was nearly three times the legal limit for driving.

Lehmberg served about half of her 45-day jail sentence but stayed in office, despite Perry's assertions that her behavior was inappropriate.

...

The indictment is the first of its kind since 1917, when James "Pa" Ferguson was indicted on charges stemming from his veto of state funding to the University of Texas in an effort to unseat faculty and staff members he objected to. Ferguson was eventually impeached, then resigned before being convicted, allowing his wife, Miriam "Ma" Ferguson, to take over the governorship.

That'll teach you not to smile when President Obama visits.

Breaking News out of Finland. Now we see how Europe reacts to being sanctioned themselves. Finland can not afford to lose it's largest trade market. Tens of thousands of Finns stand to be unemployed in return for obeying Obama.

"Finland will impose no additional sanctions on Russia in response to Moscow’s ban of food imports from some EU countries, said Finnish Prime Minister before the presidents of the two countries are set to meet on Friday in the Black Sea resort of Sochi."

This is where I remember coming across it.

And thus our State which is also yours will be a reality, and not a dream only, and will be administered in a spirit unlike that of other States, in which men fight with one another about shadows only and are distracted in the struggle for power, which in their eyes is a great good. Whereas the truth is that the State in which the rulers are most reluctant to govern is always the best and most quietly governed, and the State in which they are most eager, the worst.

Whether he's guilty of these charges or not, I have no sympathy for Perry.

A few years back, a lot of prisoners in the Texas Department of Corrections were dying due to heat stroke.

Temperatures indoors were routinely reaching 140+.

Let's just throw every 'criminal' we can in oven-prison, or maybe just genocide 'em like we did the natives?  No skin off your back, eh?  Let the lazy fuckers all just die in their *free lunch* 140F prisons!  We can just assume that ALL of them are either 100% bad or 100% good, and since we're talking about 'them' vs. 'us', we'll just go with the 'all bad' option for 'them'.  BRILLIANT!

Agreed. The number of people on here holding up rick perry as some scion of freedom is appalling. This indictment does seem to be bullshit. As you stated above, many of these people are in there for non violent bullshit charged, and many of them were put there by this thundercunt who does the exact same thing. These people are thrown in a cage for bullshit, and perry lets them die in prison of heat stroke. Want to save the taxpayer money, stop locking them up for non violent, victimless crimes. These same people like to talk about how Perry's Texas is some last bastion of freedom in the US. What a crook of shit. Land of the free, my ass.

I hear it's much worse than that...Word is Perry likes to dress up like Yosemite Sam and hunt the prisoners with his six shooters while screaming "die you varmit" and twirling his mustache.

I'm with you guys on people not being locked up for stupid shit, but being acquainted with a CO who works in CA, it seems as though most the guys are in there for hard core shit, not smoking dope and shop lifting. Apparently there is simply not enough room for anybody but the real assholes. Now Texas may be a different matter (although I doubt it), but I'm not about to shed a tear over some rapist or child molester who died of heat stoke, sorry.

Nope. Lehmberg, worthy or not, was elected by the voters of Travis county. Please show me in the Texas constituion or state law where it is the governor's "job" to depose elected officials.

The threat of veto wasn't tied to any reason other than deposing an elected official.  If he wants to veto a bill on its merits, fine. That's not what he did.  He didn't organize a recall, the normal route to remove officals for poor performance.

Imagine if a democrat governor deposed an elected republican county DA. Would you defend that governor?

Fri, 08/15/2014 - 20:58 | 5100603 Bazza McKenzie

So the story appears to be that a governor vetoed the spending of some taxpayers' money, under powers he has in his position, and this was done publicly.

But some lawyer on the public teat, aligned with the group who wanted to get their hands on that chunk of taxpayers' money arranged to get Perry indicted for feloniously NOT spending taxpayers' money.

And this was done through some kangaroo court where the accused is not allowed to mount a defence.

And none of this is political -- because everyone, especially lawyers, has a right to the taxpayers' money.

This banal indictment by the same Austin DA as in the Tom DeLay case, is the same trick (sue someone and they will not get votes) that they used on Tom. After 8 years Tom finally got the case thrown out by a higher court - instructing that the Austin DA was close to losing his law license for "shopping 11 or 12 grand juries. I guess they feel that since they were able to ruin DeLay's political career, why not go for something bigger.

Kinda like that time a few years back when republicans had the White House, congress, and the senate? Remember all that great stuff they did for America? All the freedoms we got, all the wars we didn't fight, all the bullshit laws that were repealed, all the welfare entitlements those "small government conservatives" did away with, and how fiscal sanity finally reigned?
Me neither....cuz it didn't happen. why people still think if they can just get republicans in charge again, anything will change is hilarious. I think the GOP doesn't want to win a majority. They can't handle the responsibility. They would rather be the loyal opposition that simply screams about the horrors of the left while doing nothing to stop it yet enjoying the spoils of power and privilege. We conservatives have little choice but to vote for the lesser of evils as what little resistance they offer at least keeps hope alive. At least I think this has been their formula thus far but I think its over. Conservatives are not going to continue to watch this slide to the left. If we cannot get our principles represented by those who lay claim to them, then we will have no representation at all. Fuckem. Let the left own it all. Give them no cover of "obstructionist" republicans. Obama has used the republicans as a foil in every event. He is even trying to pin this latest immigration fiasco on the right and they are scurrying about to pass some type of amnesty for fear they will fail to get the Hispanic vote (like they have a chance in hell of winning over the FSA). It is simply embarrassing to admit voting for a republican now. People supporting a false profit look far weaker than those who support the devil. This is the contest.

i wouldn't be surprised if ted cruz is behind this op.

Perry and most of the entrenched state legislature needs to be replaced. Too entrenched.

I guess Perry can't just cut the budget of the Tejas Judicial Branch, huh?

This is all part of the attack on Texas being orchestrated by the Usurper, who is attacking the Texas border with illegal aliens, and since Perry didn't like it (he wants to send the National Guard) they are attacking him. This is how "Community Organizers" and their fellow travelers roll. All political theater designed to obscure what is happening at the border.

Obama, the domestic enemy Usurper, and his minions and puppeteers are a disease inflicted on America.

Let me get this straight...

It's ok and legal if I punch you in the face but if I tell you I'm going to punch you in the face first , then it is coercion?

Well ain't that the doggonest thing?

So typical of those who seek to rule us...they see themselves as superior and their "cause" as giving them exemption from rules of decency. Booze usually provides a pretty good window on the soul and hers is dark indeed. You can only imagine the abuse and fear she has imparted to those around her, especially those on the ladder beneath her.

Sounds to me like the DA should resign.  And it sounds like Rick Perry committed an indictable offense, overstepping the limits of the Governor's authority.  The voters are the ones who make these decisions.

Watch the politicians, and pay no attention that someone is alienating your rights.  Enjoy the show.

Obama and Holder next.  All has to do with blocking illegals from entering the country.

To summarize the defenses of Perry:

1) Obama! Perry shouldn't be charged because Obama has done worse!

2) DA Lehmberg is a drunk! Perry can break the law to get rid of a county DA.

3) Payback for Perry sending National Guard to the border. That makes Perry innocent.

4) Travis county is full of democrats. That makes Perry innocent.

None of these are legal defenses.

Texas you have got a real problem down there and Perry is the least of them. I can smell the fucking rot in Austin north of the Red River. And when it gets mixed in with stench coming out of OKC, well, I prefer napalm.

The indicting prosecutor group are the same Austin based Leftwing assholes who indicted Tom Delay for the same purpose:  neutralizing a political enemy.  Although found guilty at trial by a group of these same Leftwing assholes, on appeal the indictment was dismissed for not even stating a cause of action.  Result:  Win for the assholes.  Delay is out of the picture, although innocent.   Why not run this same shit again?

No matter how much you may dislike Perry or disagree with his politics, you should not condone this abuse of power.  It could be turned on you next.  As long as it works, why not expand its application?

To you.

What was the abuse of power again because he cut the budget of the district attorney who spend time in jail for drunk driving and doesn't want to resign?  WTF, this is nothing but bullshit lawsuit and bullshit grand jury.  This should be thrown out of the court because the governor has the power to cut expenses in the State budget wherever he wants.
