Congress Proposes Law Banning Body Armor In The Land Of The Free

By the late 1920s, Joseph Stalin became the unchallenged leader of the Soviet Union after having eliminated his opposition.

He topped it off in 1929 by serving a decisive blow to anyone that would dare to oppose him by outlawing private gun ownership in the country.

From that year on until 1953 when Stalin died, it’s estimated that more than 20 million Soviet citizens that were seen as a threat to the country’s leadership.

People were rounded up and either murdered outright, or sent to infamous gulag labor camps.

Stalin is an extreme case. But history is ripe with examples of governments which disarm their citizens, only to engage in serious oppression afterwards.

Communist China. Nazi Germany. Cambodia. Guatemala. Uganda. The list goes on and on. Pacification of the citizens is almost always a prerequisite to totalitarianism.

There have been a lot of attempts to disarm, or at least partially disarm, people in the US throughout history as well.

Each time there’s a major shooting somewhere, the chant to ban firearms grows louder.

But the latest proposal is especially telling.

H.R. 5344 is a bill currently going through Congress that would ban the purchase of body armor.

Violation would carry CRIMINAL penalties, including up to ten years in prison.

Many bullet-resistant items on the market now, such as bulletproof backpacks for school children, would be banned by this legislation.

This is incredible given that the legislation is all about banning something that is purely defensive.

Whatever your stance on firearms, I hope we can agree that it’s pretty damn difficult to hurt another human being with body armor.

People buy body armor for protection. That’s the point. Duh.

So why in the world would they want to ban it?

The government claims that “criminals and rampaging madmen” can “wreak havoc” while wearing body armor, and it’s important to shield police from these nefarious individuals.

Uh, wait a sec– you mean the same police that go around terrorizing ordinary citizens who aren’t breaking any laws whatsoever?

The same police who beat homeless people to death?

The same police who shoot and kill innocent animals in broad daylight in the middle of the street?

The same police who scream “I will f***ing kill you!” with their weapons trained on crowds of protestors exercising their constitutional rights?

Right. Those guys.

This is such a disgusting, yet unfortunately predictable, turn of events in the Land of the Free.

It’s enraging. It’s infuriating. And it’s so obvious: the country has become a giant police state. And the trend is not getting any better.

It’s time to set aside emotion. It’s time to set aside a lifetime of propaganda and programming telling you that you live in a free country.

It’s time to look at the objective evidence all around you.

They spy. They steal. They wage illegal wars. They authorize military detention of civilians. They assassinate citizens.

They intimidate. They terrorize. They torture. They suspend due process when it suits. They destroy anyone who challenges them.

And now they want to take away a non-violent means of protecting yourself.

This is our reality. And at a minimum, it’s time for rational, thinking people to come up with a Plan B. What’s yours?

They could present it as a budget cut! No body armor = fewer bullets to murder citizens = less law enforcement spending! Win win, if you work for the government. But of course, the money saved would go straight to hundreds of bureaucrats freshly hired to oversee the implementation of this new law, leaving the taxpayer exactly where he is currently - posing in front of a gun.

As of 2013 - 14.6 million licensed hunters in the United States.  My guess is many have scoped rifles and lots of them are .308 aka 30-06.  Licensed hunter means they are licensed to hunt and kill animals often at a long distance.

The "first amoung equals" rides around in a 10 tonne seriously modified Cadilac called "The Beast".  Will he be the first amoung equals to shed his armor?  This method of disarming your enemy and then killing him is the same used on Sadam and is rather obvious. 

Why not ban seat belts, steal toed work boots, safety glasses, gloves, soap, condoms, safeties on guns, hard hats, locks, fences, stop signs, rail way crossing signals, disinfection, more than 2 people talking together,

Secondly, I think they have every right to intervene in protests which include rioters.  The point is simple, if you are going to march, don't riot.  If you can't control your rioters, don't blame the police when they do it for you.

Seems that most people shoot 556 or less.  Guess than means we would be protected from most assailants, anecdotally speaking.  That seems reasonable compared to no protection.

AR500 is knife resistant but in reality, it is on the wearer to be aware of their surroundings and not let the assailant get that close to begin with.

What do you want, a steel suit that can stop 20mm?  Reasonable sounds better to me.

Armor is an odds game. For the highest percentage of small arms out there, properly maintained and fitted Level III armor is going to significantly mitigate the fatality of a gunshot that hits it. Yes, there are small arms that can and will kill in spite of armor. And even if the gunshot is not fatal, you may well wish it was given it's your body soaking up a significant amount of energy - physics is a bitch.

Anyone considering armor plates needs to seriously educate themselves on the subject and understand all the compromises involved (weight, mobility, heat, weaknesses, etc) and understand the variety of risk environments they are likely to find themselves in.

Fear sells and this is certainly a classic case of it. That does not mean that a good set of coated AR500 steel plates and a proper carrier isn't a prudent investment, but it most certainly needs to be a considered investment.

But that's precisely the problem, people don't consider much less research or learn, so they fear when they shouldn't, and they don't fear when they should.

The same 150g black tip bullet from the 7.62mm M61 cartridge that the advertisers suspiciously avoid testing against the AR500 plates like the plague (because they would penetrate), and thus specifically exclude from the YouBoob repository of "knowledge" (as well as NIJ standard) can be used in a 300RUM case which adds perhaps 600 ft/sec and 1400 ft/lbs at the muzzle would most probably propel the bullet through 1 inch armor plate, which even a roided Nazi bodybuilder isn't going to walk around in.

Alternatively, a 458 winmag might not penetrate certain armor, but since there is a 500gr bullet impacting the armor at close to 2000 ft/sec with over 4000ft/lbs of energy, the armor will simply crush the ribcage like a twig.

At the other end of the spectrum is the idiot who opted for suicide by cop the other day. No one who has went through any basic infantry course is going to try and stab a cop with a knife through his body armor, and there is no shortage of Americans of who served in the military, even in Ferguson.

In the US both sides (citizen and state) are inherently capable of destroying each other, and that isn't likely to change. Tactics will evolve as a matter of necessity and despite the Congress critters most evil efforts, and when West Point, Monrovia arrives as West Point on the Mississippi, it is going to be ugly if the State continues on its current path. The brainless zombies often die anyway, but the innocent and the thinking won't be spared from the carnage if any of the major shit storms make landfall.

If someone doesn't already own guns and body armor, they can't necessarily be expected to know everything, but they certainly shouldn't be having a Pavlovian reaction to this administration's rendition of GWB and every American's patriotic duty to shop.

Civilized exploration of the complexity (with a dose of psychotic ranting) can more productive than the Fight Club version. Cheers- (I really need to get out of Europe and back to the USSA)

I've seen a 460 Hornady penetrate a steel plate that a 357 mag, 45 and 50 cal handguns, nor a shotgun slug penetrated.  But the 460 Horny went clean through.

  • 6:00 : 300 win mag (180gr SP) : Penetrates (AR-500 spalling through the target's guts .... bad)
  • 7:30 : 338 RUM   250gr brass solid (failed) / 225gr TTSX (penetration)
  • 9:30 : 30-06 M2 AP : Penetration like a hot knife through butter

Every 5.56 round tested against it failed including SS190 (penetrators) pills from a 5.7 that were reloaded into 223 and shot at 3400 fps against it.   Now class, what are most agents of the state armed with?   M4 carbines, shotuns and subguns.  

The other weird one that never gets tested .... 22-250 .... or ss109 penetrators in a .30 cal sabot (4500 fps) .... Speed kills.

For OCONUS military and para-military settings, Level IV plates capable of stopping AP rounds might be critical. For the typical LE officer within CONUS, it is highly unusual to be confronted by opponents using AP ammo; it is much more likely to be hit with FMJ and hunting rounds from rifles in calibers from .223 to .30-06, as well as 12 ga. Shotguns. Thus, multi-hit capable Level III plates are a good choice. Currently there are four main options:

Single Ceramic Ballistic Plate Level IV protects against grenade shrapnel and armor piercing rifle such ass .30 caliber AP. Able to protect against multiple hits.

Infantry rifleman are not issued high powered rifles.

But I'll indulge... M2 (.30 caliber AP) isn't even the current standard issue to US armed forces (M61 in 7.62)...

Sticking to the calibers of high powered rifle that are issued to other members of the infantry (and avoiding the huge range of superior hunting rounds) - your Level IV ceramic ballistic plate - isn't going to do shit against a 300WSM or 338 rifle (both of which are used by hunters for larger game at longer distances)

Do have any idea how many hunters hump 300/338 rifles through miles of back country every day?

Or how many infantrymen carried the same every day in Iraq and Afghanistan? Those rifles weigh a hell of lot less than all the armor and other crap they carry.

The guys issued Barrets in 50BMG also carry their own, and that's a gun that weighs 30 lbs unloaded.

The VAST majority lugged around M4s.  The VAST majority of hunters use 06 or less. 

How many people do you really think can handle larger calibers?  How many can afford them?  How many are actually capable of taking advantage of the longer ranges provided?

I wouldn't be able to shoot more than 50 yards in any direction from my house.  For my (very common) situation, a high volume of accurate fire would be more important than a low volume of highly accurate and damaging rounds.  When the enemy starts in so close time is against you.

Edit:  The assumption is that the attacking enemy would be other Americans.  Americans tend to shoot better than others (more accurate rifles and range/hunting time).  If you aren't shooting they are closing or air is coming after you.  Tick tock.

As to who might own those guns-
1) People in bear country
2) Distance shooters
3) Collectors
4) Tinfoil hatters

Each of those groups is significantly larger than 30,000

I left off big game hunters (although there are a fair number of them. However, I have only fired the .458 in my collection exactly once on a hunt... at least I only put about $2500 into the gun and have less than 50 rounds for it.)

The guy dropped 10k on a Barrett (for snob appeal, or compensation/size factor, or something... I really don't know, but he and his less queer trendy brethren certainly don't fall into 1-5 above).

In my little gulch in the Old Dominion and the nearest city of perhaps 80k: between Dicks, a few WalleyWorlds, and a dozen gun and pawn shops, there are (were) probably 300-400 such rifles in inventory on any given day, not counting the thousands already in the community.

Fortunately, the fascist enemies aren't often very wise or considered in their adaptation. If it comes to war, I don't think it is going to be won or lost through a series of small reenactments of the last stand at the Alamo, but rather asymmetric confrontation and evasion. Responsible Body Armor Possession Act Keeps Military Armor out of the Wrong Hands Congressman Honda’s act bans the sale and possession of new enhanced body armor Jul 31, 2014 Press Release

Washington, DC – Congressman Mike Honda (D-CA17) today introduced the Responsible Body Armor Possession Act of 2014, which allows law enforcement to respond to active shooters more effectively. It accomplishes this by prohibiting the sale, purchase, use, or possession of enhanced military-grade body armor by anyone who is not a member of law enforcement, active duty military, or other authorized users.

“There is no reason this type of armor, which is designed for warfare, should be available in our communities except for those who need it, like law enforcement,” Congressman Honda said. “There’s nothing more dangerous than what a well-armored, unstoppable active shooter can do. This bill is common-sense and long overdue.”

The Responsible Body Armor Possession Act has the support of Santa Clara County District Attorney Jeff Rosen, Alameda County District Attorney Nancy O’Malley, Alameda County Sheriff Gregory Ahern, Santa Clara County Sheriff Laurie Smith, Santa Clara Chief of Police Mike Sellers, and Milpitas Chief of Police Steve Pangelinan; along with the Fraternal Order of Police, the Violence Policy Center, the Coalition for Peace Action, and Stop Handgun Violence.

Santa Clara County District Attorney Jeff Rosen said, “There is an ongoing arms race between violent criminals and police officers. Let's make sure that the men and women who stand bravely between us and the gunfire win that high-stakes race. Let's make sure criminals and gang-bangers never walk our streets shielded with military-grade body armor and the arrogance of someone who cannot be stopped.”

 Alameda County District Attorney Nancy O’Malley said, “I commend Congressman Honda on this important piece of legislation, and thank him for his long-standing leadership in keeping our communities safe and strong.  This law will serve to combat our nation’s epidemic of gun violence and protect communities and law enforcement from mass shootings.”

“By limiting civilian access to body armor that is designed to protect against ‘law enforcement ammunitions’ and weapons that are ‘generally only used in tactical situations,’ the legislation would be an important step forward in reducing the availability of military-style gear that enables shooters to attack innocent civilians and confront law enforcement responders with a level of firepower that has no place on America’s streets,” said Kristen Rand of the Violence Policy Center.

        (a) The militia of the United States consists of all able-bodied males at least 17 years of age and, except as provided in section 313 of title 32, under 45 years of age who are, or who have made a declaration of intention to become, citizens of the United States and of female
        citizens of the United States who are members of the National Guard.
        (b) The classes of the militia are–

        (1) the organized militia, which consists of the National Guard and the Naval Militia;

        and

        (2) the unorganized militia, which consists of the members of the militia who are not members of the National Guard or the Naval Militia.

All Citizens including Civilians are the Armed Forces under the category of unorganized militias. Not the Police Departments though one can say individuals who are the Armed Forces can also serve in the Police Departments at the same time.

That is why these bills and gun ban bills like the Safe Act are illegal, unlawful and Unconstitutional.

and as a reminder from the Second Amendment

A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.

These 2 reasons are also reason enough why the militarization of the PDs is also illegal and those weapons should have never gone to them in the first place but to the militias and if we follow the chain of command then the organized militias first then unorganized. Nowhere is the PDs mentioned here.

If you see what is going on here you'll understand what the Federales did is created a full time decentralized on the surface domestic standing army that has the veneer of a local police force for each node in the system.

They control the whole thing through the fusions centers, it is only a matter of time until the local PD's can't sneeze except as dictated by the DHS through the fusion centers. It looks decentralized and independent on the surface like the MSM but in reality a central source plays them all like Mariachi puppets.

So if laws deprive the Armed Forces of uniforme weaponry and armorment it is illegal and also flies in the face of the second form direct democracy which is the voluntary joining of the unorganized militia because you can choose not to by not choosing to personally house arms and armorment that meets Armed Forces standards to be periodically inspected by a Commisioner of Arms like a formal organized branch aka the National Guard, Army etc. Not only that the current law probably violates anti-discrimination laws since it excludes transgenders and women.

They don't want you know this stuff since it is perfectly legal and well within in your rights regardless of gun laws like the Safe Act in NY.

Not only that the military could easily issue the weapons and bypass Congress and the States all at the same time.....

You know to deal with real threats like ISIS coming to get you.....

You are your own fastest response team to a direct threat against you.

Ok so it "sounds" like this will not effect the stuff I own, basic level IIIa with extra plate carrier, but the "high-end" armor like dragonskin? Which is so crazy expensive no one without tons of dough could afford anyway?

So is this a make work bill so it seems like they are doing something about crime? 

EDIT: Ok actually just read the full bill, anything III and above is considered "Enhanced" and therefore will be banned.

first of all, the ZH summary is completely misleading in stressing purchase and leaving out the military-grade. It's plain lie to say as said here that a child's backpack is military-grade body armor.

secondly, it isn't even before Congress, it's before the Judiciary Committee (of which Honda is a member) ever since July 31, so it's no longer even news.

thirdly, even if it's paased into law as-is, some executive agency (???) would have to go through a rulemaking process, involving public comment, to specify exactly what is meant by "military-grade" body armor. 

who regulates body armor anyway?  ATF has no jurisdiction.  would it be HOMELAND INSECURITY????

That's why I practice head shots at the range. At 10yds I can dot the eyes. You have to train this way so when its on, that your target. Body armor restricts my movement, must move are your dead. Well if you get in a shootout your probably dead anyway. We live, we die. Such is life.

And don't we all need a set when caps start popping a mile away and we have to shelter in place?

My solution is to require all households to own multiple RPGs, when those are common body armor doesn't help, problem solved!

Go ahead and ban it. What a sick joke. Body armor plays a very minor role at best in close quarters combat.

 

Snipers certainly don't depend on body armor to get the job done, and snipers will always be the foundation of any successful insurgency, abroad or here at home.

Homemade body armor can be made with steel belted tires. Cut the tires into small shingles or plates, attach each plate to overlap the most inner plate, layer the overall armored suit with Kevlar. To make it more comfortable you can use the upper-body and arm protection from ice hockey goalie equipment as an overall padded inner suit. Depending on the types of steel belted tires and the number of layers of Kevlar, it can be made to stop 'most' rounds. High powered assault rifles with flint or specially tipped bullets will cut through nearly all body armor like butter.  Good luck in the revolution, I will be cheering for you. :)

Police prefer tire spikes or spike strips because it is proven to work. Shooting tires from a moving vehicle is unreliable, dangerous and is not realistic, it is more T.V. sensationalism then reality.  From my understanding a knife thrust is more powerful then a bullet, again depending on the knife, I understand from those in the police business, a knife can penetrate a bullet proof vest. I don't want anybody to get hurt and my suggestion is only to prevent injury. I also hope that people will be smart enough to test things out before applying it to actual use. I am trying to be reasonable, if you build a boat or a homemade plane, you test it in such a way as not to hurt yourself or anyone else. I hope that meets the standard of a reasonable man.

It really doesn't matter. When the bullets start flying, they don't want you to have the upper hand on protection. This reminds me of a movie called, The Purge.

Stepping back, I hope you folks are aware that these actions, whether it be to ban abortion or to liberalize abortion or to restrict guns or to raise taxes or eliminate loopholes are ALL part of the SHAKEDOWN SYSTEM of Political lobbying, right?!

This entire political system really is that broken.  Nothing is what it seems.  People who say they are considering banning something are really just asking for political contributions in a quid pro quo fashion.

 

Washington does nothing unless there is money to be had in doing it or not doing it.  Pay to Play. 

So don't waste efforts on just this one issue.  Of course we should be able to buy body armor!   If you want this shit to stop then fight for campaign finance reform... or move to a real democracy.

News flash:  This has not been "the land of the free" for many, many years.  The government wants to ban body armor out of fear that we will wake up some fine day and realise we are all slaves or the state and have been for a very long time.
