Caught On Tape: What Happens When You Try To Exercise Your Constitutional Rights In Illinois

What follows is the most powerful recorded police checkpoint scene I have witnessed since posting: Extremely Powerful Video – Happy 4th of July from a Police State Checkpoint, last summer.
While the former incident happened in Tennessee, the following occurred in Illinois. The American pleb who was accosted by Illinois State Police was DeKalb resident Ryan Scott.
While it starts off slow, make sure you watch it all the way to the end.
While one of the the police officers is reasonable, the other one can’t stop yelling and seems to derive a particular pleasure from repeatedly informing the citizen he supposed to “protect and serve” that “driving is not a right, it’s a privilege.”

What’s also interesting, is you have to wonder if the second officer would have acted even more aggressively if Ryan hadn’t informed him he was being recorded at the end of the conversation.
He seems to have backed down slightly upon understanding the repercussions of the recording. It just goes to show the importance of filming police encounters.

I need a lawyer because some other lawyer was able to naile me for not dunning an employee far past the allowable limit. I was supposed to go way past the allowed limit to pay off some shitbags that bought the debt for under 20cents on the dollar. I could not do that under the law so they put his debt upon me. They get 24% compound interest for as long as I do not pay the debt of another that I had absolutely nothing to do with. The best part of their scam is that they will not provide proof of indebtedness.

Those flyers were created by an attorney and are proven to work, however they are STATE SPECIFIC.
Looks like there are ones for Florida, New York, California, New Jersey, Ohio, Arkansas, Illinios, Utah and Texas. ** Georgia and South Carolina maybe a few others, you have to look.
One could easy use the template and look up their specific state laws.
If other states are anything like what I've come to understand regarding the position at New York law, then annoying the hell out of a cop to frustrate them enough so that they won't want to write you a ticket essentially is why these work, if they do work, because at least in New York's case the legal reasoning is not particularly sound. Furthermore, the Supreme Court has upheld the constitutionality of brief stops for the purpose of sobriety checkpoints, in those states choosing to employ them (New York is one of those states). It should be noted that DRUG checkpoints are not legal, under a Supreme Court ruling (see Edmond (2000) ).
If you have deep pockets and want to try litigating the issue of whether you need to physically provide an officer with your documentation at either a regular traffic stop or a sobriety checkpoint, because you want to argue that showing them through your vehicle window is sufficient, by all means do so. I would prefer if we all had more rights, but I am pessimistic as to whether you would succeed, and might be a lot of money out of pocket.
Finally, if these were written by an attorney, they have made fundamental errors on their analysis of New York law that even a law student should catch, seeking to apply civil statutes and civil cases to criminal situations. That is inexcusably sloppy work and I would even say negligent, not to mention that I disagree with their analysis of New York law independently of their bad citations.

I find that using sugar instead of spice works best with these over zealous cops. I don't mean bend over and grab your ankles to get a first hand look at the long arm of the law...but what i do is comply with their requests then simply ask them how they feel about what they are doing and how it violates the very things they are meant to protect. Most of these guys have families and live in "our" communities. Most look at it as "jus' doin' their job" and don't get the big picture, after all, they decided to be cops...dealing with human scum for 30k a year...how smart can they really be?
Let me also add that most of these guys actually believe they are protectors and "heroes", keepin you safe. They really buy into the post 9/11 love a cop/firaman, first responder propaganda. Like I said, shitty job, no money, but they do it to "help" people.

My whole point was that if you push these guys they will snap and you could end up on the wrong side of a beat down, without any recourse. I also think their is a big difference between city / state cops and local county police.

But would you care to bet how much of their promised pension they will actually receive? Not 100% I would bet. It is one of the reasons I left Chicago. It is one thing to argue that Homeland Security cannot stop you, it is entirely something else when a local or state official does it. These stops by local cops have been ruled constituional for years.

It makes people upset when you assert that you know more about their job than they do, and that they are being unreasonable. There was no reason for him to ask "Am I being detained?" The officer told him he is not free to go. Asking again and again just shows he is being needlessly confrontational.
Here's how it should have gone. "You're being recorded." "OK. License and registration please... Thank you, have a nice evening" Finis. We already established the police: 1) have a right to conduct safety checkpoints 2) ask for you driving papers. They needed to yell at him, because he kept trying to talk over them.
Your understanding of the law is abysmal and you should learn something before you comment. "Am I being detained" has a specific triggering effect on your rights and the actions the police are allowed to take. There are apparently many things of which you are unaware. Where did we establish the police having a RIGHT to stop us whereever and whenever they like to check safety, are they not allowed to issue me a fixit ticket if my tailight is broken anymore they they need the RIGHT to set up a checkpoint. Listen to yourself and reflect on that.

All police checkpoints are unconstitutional. So is the random checking of license plates looking for violations as an excuse to pull you over. It's no different than "papers please" in the old Soviet Union.
You need a warrant to stop people unless you see them committing a criminal act or suspect them of such. You cannot just check or stop people randomly, period.
the issue here is entrapment and to get around this the check points are often avoidable.
see one up in the distance, there is usually a way to turn around and avoid the whole thing.

The officer is wrong, driving is not a privilege. The license gives one the right to drive. Getting the license is a privilege granted by the state, like getting a business license or a license to practice medicine. Once granted the state does not have the right to interrupt my business or stop me in the middle of surgery without just cause.

I agree, but you're forgetting about police unions. In real-world practice, it is their absolute right to be and stay employed as long as they want. A million bucks in lawyers might give you a slim chance to convince a jury that the prick in the video has no god-given right to his job.
