Caught On Tape: What Happens When You Try To Exercise Your Constitutional Rights In Illinois

What follows is the most powerful recorded police checkpoint scene I have witnessed since posting: Extremely Powerful Video – Happy 4th of July from a Police State Checkpoint, last summer.
While the former incident happened in Tennessee, the following occurred in Illinois. The American pleb who was accosted by Illinois State Police was DeKalb resident Ryan Scott.
While it starts off slow, make sure you watch it all the way to the end.
While one of the the police officers is reasonable, the other one can’t stop yelling and seems to derive a particular pleasure from repeatedly informing the citizen he supposed to “protect and serve” that “driving is not a right, it’s a privilege.”

What’s also interesting, is you have to wonder if the second officer would have acted even more aggressively if Ryan hadn’t informed him he was being recorded at the end of the conversation.
He seems to have backed down slightly upon understanding the repercussions of the recording. It just goes to show the importance of filming police encounters.

They cannot outlaw dash cams for a couple reasons;
1) What would be their legal basis? It is already established that one has no expectation to privacy in a public place. Being recorded in a public area is ok.
2) How would someone justify it?

If it is an inclusion to the Patriot Act, all dashcams will be outlawed.
There's already a law against distracted driving in most states where one is not allowed to use a cell phone behind the wheel. Sometimes it includes interaction with devices such as the GPS. Often the law lists prohibited items simply as "electronic devices". To ban dash cams all they have to do is include them in the category and I bet they already can. The device is being "operated" while behind the wheel.
Then again, police can just shoot you in the face and come up with excuses later.

They will outlaw Dashcams under the same laws they are writing to outlaw you Operating "An Electronic Device or Cell Phone" To prevent you from driving distracted to protect the public. Slightly OT, but just barely....here in FEMA Region 5 Indianapolis, IN, I recently heard our local Police spokespukes on the radio lamenting the improved encryption of iOS 8 and locking police out of the devices on the "for the children" argument.

Try taking your cell phone camera into a Public Place like a Federal Courthouse!
I've taken a iPhone to a Federal Courthouse. FPS didn't say anything about it and I didn't record anything. Audio would have been easy to do surreptitiously from the shirt pocket, video would have been difficult. They did object to my handcuff key though.
Now a Social Security office is a whole 'nother matter. There it depends on the guard's whim as to what's prohibited.
Agreed. Just like carrying a camera on the street. You are legally allowed to film the police doing their job in public. I think that dash cam saved his ass. He probably would have been arrested or roughed up if they didn't know they were being filmed.

I'm surprised the "Powers that Be" haven't realised this yet - and made fitting at least a "necessary" requirement to obtain vehicle insurance.

Not only should everyone have a dash-cam, they should have TWO: One out in the open (which may get whacked by the Cops, or they will point at and order you to turn it off -- which you do), and a second on that's professionally installed and practically invisible, and which keeps recording (after the cheap/dummy on the dash has been neutralized). If it were me, I'd have it upload to my online email or ftp account, in case they want to take the entire unit and its SD card.
BTW, EVERYONE on ZH really MUST go to YT, search for "never talk to the police" and watch several top picks. Then practice some drills, so you can remain calm and effective in a real situation, cause Cops are trained to throw you off your game by making you scared or angry. Regular practice (mental drill while driving) will help you keep calm and on top.

How To Call The Police When You're Old... And Don't Move Fast Anymore
George Phillips, an elderly man from Walled Lake, Michigan, was going up to bed, when his wife told him that he'd left the light on in the garden shed, which she could see from the bedroom window. George opened the back door to go turn off the light, but saw that there were people in the shed stealing things.
He phoned the police, who asked: "Is someone in your house?" He said: "No, but some people are breaking into my garden shed and stealing from me". Then the police Dispatcher said: "All patrols are busy. You should lock your doors and an officer will be along when one is available."
George said, "Okay." He hung up the phone and counted to 30. Then he phoned the police again.
"Hello... I just called you a few seconds ago because there were people stealing things from my shed. Well, you don't have to worry about them now because I just shot and killed them both; the dogs are eating them right now," and he hung up.
Within five minutes, six Police Cars, a SWAT Team, a Helicopter, two Fire Trucks, a Paramedic and an Ambulance showed up at the Phillips' residence, and caught the burglars red-handed. One of the Policemen said to George, "I thought you said that you'd shot them!"
George said, "I thought you said there was nobody available!" Don't mess with old people!
MORAL: If The System (private or public) no longer works for you and is actually doing you a huge disservice or injustice, “Raise the bar, raise the Game”. Use your Brains+Guile, because that combo usually beats The System. Some old people know this. Successful crooks know this, and TPTB know this. You forget where he later gets charged for false reports to law enfocement, loses at trial, and is sentenced to 6 months in jail or more, and ordered to pay resitutuion for the ambulance and firetruck etc to come to the house for no reason. Costing him $1,000's!

I have faithfully recorded EVERY police interaction I have had (there are plenty of them from speeding tickets, to loud noise violations, to speeding, etc.). I never tell them I am recording, but the police, in general, get really pissed off when us plebes ask them questions of any sort. I have been able to baffle cops many times and they leave angry and confused and I have received my fair share of tickets.
Here is my line of questioning I generally follow -
What is the nature and cause of the your stop, officer?
Is that a criminal or civil matter?
Who is the injured party in this complaint?
Am I being detained?
Am I free to go?
I will assert my right to remain silent right now.
I need to put the videos up on YouTube again.
Good job.
I have stopped handing the officers my drivers license, when I am just travelling.
I verbaly identify myself by my first name only.
When they ask me when I was born, I tell them that I don't remember.

This coupled with "yes" or "no" answers really throws them off.
Doc, do you (or anyone else here) know if you get pulled over for what you're sure was a traffic violation (slight speeding at Warp 1), and the Cop asks you for you papers -- without telling you WHY he's pulled you over?
Do you have the Right to have him give you the reason, or should you cave to his belligerent threats (to take you in), if you do not provide him with the papers? Does this vary from State to State? I ask, because I had such an incidence in WA a few years back, and I was too much in a hurry to waste my time with the hothead.
I am not sure about the arbitrary edicts of government fools, but I will generally hold my papers in my hand (showing my intention to give them at some point) and keep firing off questions.

Also, consider posting a small sign at your home's entrance stating no entry without written consent of the homeowner, with the citation for your state's appropriate trespassing statute. Police are trained to get verbal consent for entry (or say they did) from anybody, the maid, your kid, and you. A sign may make the police think twice, and can give your lawyer something to work with, since the Fourth Amendment is long dead.
This guy has a few videos out there and while I appreciate and understand the "awareness campaign" he is on, just wait until he "baits" the wrong idiot. If it's a martyr he wants to be, he may yet get his wish...
That's the only good thing about america, if you work hard enough and have some smarts, you can usually get what you want. So that's good I guess.

LoP, that's why I prefer to take the shrewd but layered approach to dealing with cops:
1. First line of defense is always to keep a Calm, Pleasant demeanor -- no matter what! Don't make him "barking mad". You gain NOTHING, but may lose a lot. If you gotta be on the Offense, then resort to Reagan-style Irish "Charm Offensive". If you just gotta.
2. Play along if he's doing his job, and comply to the letter. Offer no additional info or comments, and do NOT attempt clever remarks, since you do not know his mood or sense of humor.
3. If you're certain he's fishing for more info, if he's Pretexting (lawful lying and deception, to which he's allowed but you are not), or if he's Out Of Bounds and his demands are unlawful, then you may want to turn "Legalese" on the guy. While doing your utmost to remain calm and pleasant. I figure if I give him an easy Out at the emotional level, and bar the door shut with a few FAQs and with legal Rights retorts, that eventually he'll do The Right Thing. Or odds are that he will.
p.s. This kind of police aggression is far more common in the US than in any Western country I know of. In large part it's baked into the US culture, I'm afraid, where cops are quick and eager to draw their guns, tazers, etc. -- either by 'training' (bad training) or temperament (poor recruiting).

In regard to speeding, which I seldom do and only when necessary, I do adhere to the Hunter S Thompson method.
When you realize you are in a speed trap, don't mash the brake. Accelerate slightly and wave. Mashing the brake arrouses contempt in the cop heart. Waving says, yes, I realize I am speeding and I know you are there. I am comfortable with this speed. Have a good day. I've had troopers wave back.

Yes, by and large our local police departments offer very lucrative pensions. Also, their unions force arbitration for any "personel actions" such as when they deny citizens their rights - or shoot someone in the back. They are, in fact, a protected class. But its more than that. They are authorized to use violence to enforce the law. That authority is emphasized by training, esprit de corps, and the personal predilictions of those who wish to be LEOs (they routinely beat their wives you know). In short, civil security in the U.S. is enforced by a gang of thugs with badges. Cops on the other hand have 2 to 4 times (20-40% depending on which studies you are looking at) the amount of DV as the average population (which is 10%). Before the age of DVRs I have had to pass numerous roadside traffic checks in CA. In all cases being courteous and shutting up and only answering their questions and responding with DL and registration has gotten me through vwey quickly. I never realized how many immigrants drive without insurance or docs.
you make an excellent sheeple. this might be a stretch but there are certain unalienable rights that formed the basis of a piece of paper called the constitution. the constitution outlined the practical application of those unalienable rights where it applies to .gov's relationship to the citizen. one of the rights, among many, is the implied right(formed by legal precedence) of privacy from .gov intrusion. one of the legal ways law enforcement has found works effectively in making people voluntarily give up their rights is to simply ask or intimidate with authority or both. the key here is you consent voluntarily to give up your rights so the cop can do what he wants. some people are really opposed to this "voluntary" deception. that is a correctly held sentiment.

Why don't you reread the constitution. I am sure (as I read it last week) there is nothing about driving in there. HOWEVER, there is something about states making there own laws AS LONG AS they do not infringe on the rights given by the constitution. Watch a few of these and you'll know why the driver acted as he did. Good to exercise your rights before they take another slice of your freedoms. Yes, he was not perfect. I'd rather have more of these guys to curtail the encroachment of the police society.

I don't see where this driver did anything wrong. Care to enlighten us as to why you say, "Yes, he was not perfect." How could he have been any calmer, more cooperative (yes, should have locked his doors). Not arguing, just asking.

Based on a CCW where the guy had his gun out in public and a citizen called the cops and this guy would not even give his name to the police I asked my loccal police if I had to give my name. There were four cops standing around watching stuff, and of course one of them immediately says, "Why wouldn't you give us your name?".
I got stopped yesterday for driving agressively. (I was) The MC cop was professional friendly and did not even ask to see my "papers." He pretty much told me to take it down a notch and let me go. You really can't stereotype. BTW I took it down 2 notches.

I can no longer watch these Police State Thugs in action, it angers me too much and ruins my day. But I'll take it that this was bad.
