"Common People Do Not Carry This Much Currency" – How Police Justify Stealing American Citizens' Money

Police confiscating Americans’ hard earned cash, as well as a wide variety of other valuables, without an arrest or conviction is a disturbing and growing practice throughput these United States. Since cops get to keep the seized funds and use the money on pretty much anything they want, the practice is becoming endemic in certain parts of the nation. The theft is often referred to simply as civil forfeiture, or civil asset forfeiture. Incredibly, under civil forfeiture laws your property is incredibly “guilty until you prove it innocent.”

The extent of the problem came to my attention last summer after reading an excellent article by Sarah Stillman in the New Yorker. The article struck such a chord with me, I penned a post highlighting it and addressing the issue, titled: Why You Should Never, Ever Drive Through Tenaha, Texas. That article ended up being one of my most popular posts of 2013.

Fast forward a year, and many mainstream publications have also jumped on the topic. Most notably, the Washington Post published an excellent article last month titled, Stop and Seize, which I strongly suggest reading if you haven’t already.

Fortunately for us all, the issue has also caught the eye of the always hilarious, John Oliver of Last Week Tonight. The following clip from his show is brilliant. Not only is it hilarious, but it will hopefully educate a wider audience about this insidious practice so that it can be stopped once and for all.

As one officer admitted in an affidavit justifying his confiscation of an innocent driver’s cash:

“Common people do not carry this much U.S. currency.”

Everyone has to make a stand to support those who have had their rights violated and their private possessions stolen.  When cops start getting photos in the mail of their kids standing at the bus stop, or pics of their wives out shopping. No threat or explanation included.

People can only live on a heightened state of awareness for so long before it starts to take its toll.

This might make the shit stop.

John Oliver is hilarious, but listening to the officers in that segment makes me sick…absolutely shows the sorry state of America…which is just the beginning… but what’s more, it shows the abysmal intellect of these “Law Enforcement Officers” representing our legal system.  Cops basically admitting to using the system without real cause to fund their personal slush funds...

Next thing you know, he'll be shocked, shocked!, to find out that cops facilitate, if not outright run, illegal drug operations in every major city, or that they have abandoned most gang controlled areas to the gangs in those same cities, but then they'll stop and harass any black man just driving down the street in the suburbs like Orange County, or that they shoot first in most situations, or that they do not hesitate to beat the shit out of anyone who questions their authority, or that they regularly make over 100k with bogus overtime, or that they retire in their early 50's with huge pensions and outrageous disability payments, or, well, you get the idea.

Officialdom knows that, as a law-abiding citizen you are basically powerless to their whims (and they richly Enjoy this privilege)

They have:

- Legal authority to inspect/confiscate/harass, etc., at will

- Armaments - usually superior to the common citizen's

- Authority under color-of-law to kill, with little reason

- Backing from the organizations they belong to and the legal system itself

- More...?

 

All of which is Excellent!! for them - while society at large bows to and/or maintains their own sense of submission to this abuse of authority, and continues to obey (play along).   Every society however - and America is no different, has a limit.   Not to say that the lives lost, maimed, broken, displaced, etc., are not exponentially higher than equal justice meeted out in return, it just is the way it is in a generally 'law-abiding' nation. Until a breaking point is reached.   The only question that now remains is, what is that breaking point and what (not when) will be the catalyst that 'liberates' the cowed.

I have traveled extensively around the world and know that what you wrote is staggeringly true - in a majority of countries, the "police" are the uniformed, legal gangsters, who will rob you with impunity while surrounded by "witnesses" who know they better not see or say anything.

In many countries the cops compete for jobs by bidding to the chief how much stolen loot they will pay up the chain of command, same as for the mafia.

I was stopped and robbed or harassed at gunpoint many times in my travels.

In Peru, I was stopped SEVEN times in one afternoon trying to get out of Lima by rogue cops & militia at roadblocks with automatic weapons before I decided I better leave the country before I ended up disappeared.

When the soviet union fell apart, travelling through the former easter european satellite countries was almost the same as travelling through ISIL territory - the police had roadblocks on the autobahns, stopped everybody, and demanded money to let you drive through - dieing america is catching up.

I went to Almaty, Kazakhstan with all the legal documents to get a visa to go to China.  I couldn't get into the Consulate without paying the policeman on the gate $50.  When I got inside the Consulate they wouldn't accept the perfectly legal paperwork I submitted, I had to pay another $50 dollars so they could provide me with their own fake invitation letter.  Then I had to pay another $50 dollars to pick up my passport and visa one week later.

It should be illegal, but when the President, his family and Government are as corrupt as hell then what do you expect.  In Kazakhstan everyone wants their 10%, that's how they can afford to buy new 4 x 4 Land Cruisers when their maximum income is between $500 - $1,000 month.

Another example how I was robbed by a cop in Maylasia, at the Kuala Lampur airport:

The rental car return was near the airport arrival ramp, the traffic cops wait at the rental car return until you pull up & they see that you are a foreigner, ie need a passport to leave the country, stop you with the false claim that you have stopped/parked in the prohibited area, demand your passport, which you can go to the police station to reclaim after weeks of strugle - if you are stupid enough to take that path - or just pay $50 USD to the uniformed gangster as an ad hoc departure fee.

I have many, many such true stories.

I learned that if you want a little extra protection when you travel around the world, you must get journalist credentials, including photo ID, which saved me from being taken hostage in a number of situations, but NOTHING wiill help you in any islamic cult worshiping country except being heavily armed and knowing how to use them.

In their 15-page presentment, the grand jury found no cause for criminal charges against the any deputies involved in the botched SWAT raid. but they had plenty to say about the investigation.

The jury called it “sloppy and hurried” and “not in accordance with best practices.” The grand jury said while they want law enforcement to pursue drug dealers “the zeal to hold them accountable must not override cautious and patient judgment.”

I'm not an anarchist.  I'm essentially a Left Libertarian or Liberaltarian - there's a big handful of us here, but I am willing to take seriously the ideas of other people here who have a different take (which is probably most who are close to minarchy - I believe the state should provide rigorous education and some safety nets as a practical matter of national interest rather than an 'ethics'.  Most here probably don't and the majority can quite intelligently and respectfully disagree.

 

Oh and there is more free speech here than just about anywhere. 

 

But what most of us, broadly libertarian-minded people have in common is not respecting the 2 party system or left/right paradigm, and seeing political issues not really as left right but as government versus constitution and/or individual freedom.

I'm thankful I'm one of those piss poor people they feel sorry for. I was driving through Kansas in the early morning hours in July--had my two daughters sleeping in the backseat. I was trying to make time to Ohio on interstate 70, about 20 miles east of of Colorado (one of two states with legalized marijuana--how convenient). I had no idea why the cop stopped me, but as soon as he saw my Thai husband I think he knew he made a mistake. Interrogated me inside his car for a few minutes, I told him I was going to my father's funeral, told him my husband was a Thai national but was a green card holder. He was looking at paperwork city and I didn't have anything for him to take. He let me go quickly. I had to ask what he'd stopped me for. "78." he said (In a 75 MPH zone). Guaranteed the cop was hoping I was some dumbass out of stater that had scored MJ from Colorado that I was planning on transporting to my home state--then he coulda taken my car, my cash, put my kids in CPS...the power they have to destroy someone's life for their own benefit is just breath taking...

So, let me get this straight....

1.) If you carry cash, they can seize it (because it's clearly criminal to carry cash)

2.) If you move money electronically, it is reported via a SAR (Suspicious Activity Report) so they can keep tabs on where your money goes (for future confiscation)

Can anyone else feel the vicegrips tightening..??  What the fuck is going wrong in this country...??  I don't even recognize this place anymore....

The point Meat Hammer is that there are plenty of people who call themselves "conservatives" and belong to the relevant political party. But in truth they are not genuine conservatives, hence the earlier comments from headhunt. They are actually lefties and statists in camouflage. In some cases they are more extreme, leaning towards fascism or Marxism etc.

[In the UK the current PM David Cameron claims to be a conservative, belongs to the Conservative Party and has all the right educational background et al. But in truth, he's really a liberal Lefty and persues more government. His Home Secretary ditto]

It's just one of the many deceptions that's endemic in politics nowadays.

These civil forfeiture laws serve the same purpose as unconstitutional road side checkpoints, this is Social Engineering, in order to create situations which place law enforcement personnel "at odds" with everyday citizens, thereby creating, separating and isolating the two groups.  If the two groups can be maintained in a state of perpetual friction, policemen eventually begin to perceive law abiding citizens as adversaries or enemies, rather than the citizens they were trained to protect. The ruling class needs to be sure that the day the masses rise up, their law enforcement minions will obey immoral and illegal orders without questioning.

Our town blocked a portion of the main thoroughfare one Friday allowing organizations to set up tables with community information, etc. They also had a fire truck and the county MRAP. I was inspecting the MRAP for weaknesses (ha, just joking NSA). I think the public is becoming more aware of the situation, but probably not fast enough.

If you're carrying a bunch of cash just make sure you've got your withdrawal slip(s) with you. Yea, the cops will hesitate if they see those. And if they still take the cash your lawyer will have a field day with them. It's a hell of a world when you have to do some planning to protect your rights but that day has come. I got stopped in Carrollton, Texas with $8,000 on me and the withdrawal slip worked like a charm. I had the cash on me for a trip.

I buy at auctions all the time and always carry several thousand dollars when I'm going to one.  I also keep the bank withdrawslips to the rolls of money with rubber bands.  Same is true of my house money / emergency / hurricane money.  Very smart.

thanks for advice.  it is a very good one.  i try to never travel by car, but i do sometimes leave my coin dealer with shiny relics.  i'm really serious - you have a great point.  i can grab a lawyer, and prove i purchased within a few hours.  legally.

I've just begun to hear these stories of cash theft. Un-fucking believable, talk about cops out of control. Once they stop you in your car, you are basically at their mercy. I got stopped years ago for a headlight out on my way home from work at 10:00PM, this was from my after school job. I tried to be polite to these cops, but they came at me right from the get go with aggressive language and manner, they simply did all they could to get me to respond to their abuse. Fucking cunts! They kept me there for half an hour with questions about everything I do or ever did. I was a 26 year old white blond haired Navy Veteran working nights to fund my technical school education. If they went after me like they did, I can't even guess what a latino or black guy would get run through.

Cops shoot, tazer and use chemical sprays to attack people and then claim self defense. It is your word against cop word. And to quote the movie "Blade Runner" When Dekard speaks to the head dective. For comparison -

Last spring we were returning to our home (a neighboring state) from Acapulco. We got snared by a pair of cops for 'not making a left hand turn from a left turn lane'. Trouble was there was a parked car I had to pass on the left.

The cop pulled up besides our car and said 'pull over'. I said - 'ok I'll pull into that gas station up ahead'. So I pulled into the station and gassed up, looked around - no cops. Got back onto the road and there - up about 100 yards - are these cops parked on the side of the road with their trunk open (hiding their tag) - telling us to pull over.

Cop said 'you didn't make a left turn'. Had a piece of cardboard listing 'fines' - 3000 pesos ($230). Give me your credentials. Once I handed him my credentials I was sunk. When it came to pay he said 'careful - there are cameras. Here, put the money in my book (which he handed my wife - and told her to put the money into the book under the dash). We were under time constraints and paid - but in the future we will try to stick by our guns. 

Mordida ! More and more it seems the Mexican and US cultures are assimilating.

We live in Mexico. Perhaps we have another 10 years left. Some people think we are crazy but we have probably enough money (pesos) here that we should be able to live on it for at least 5 years (and no debt).

I was telling someone yesterday how I try to be extremely honest with the US/IRS when it comes to all these rules/paperwork we are burdened with - but all I can do is hope I am doing everything correctly. It really shouldn't be so difficult that you have to hire a tax accountant for a retired couple to live outside the US.

You watch - I'll bet that in the not too distant future even those in the US will be required to report all of their finnancial holdings every year at tax time in an attempt to cross check what the banks/brokerages are reporting the IRS for the chance of inflicting more penalties.

I stick to the interstates.  I also avoid states like Tennessee, Arkansas, Kentucky, and anywhere else I hear these stories coming from.  Stay away from the back roads, that's where most of the Barney Fifes hang out.  You can ask to know if your're being detained, but they wouldn't know the difference.

The down and up votes here are concerning. I often read comments for direction on things where I lack knowledge. This exchange is basic common sense and a small concesus here seems to be lost.

Currently - right now in the world we live in-  the premise for confiscating cash is in fact that it could be drug money. This is documented legal fact used often in courts in building a case.

Currently - right now in the world we live in-  no one buys dope with freeze dried foods. Moonshine, laundry detergent, your sister, whatever, sure but not freeze dried foods.

In the future if authorities are comming for your food or household items then we will be in a world where ones stash of ammunition will be diminishing rapidly. No one will care what you are buying with your freeze dried foods, rather, their kid in hungry and they have a badge and lots of back up.

I fear the cops more than I fear criminals.

In this state, if a man tries to carjack (seize) my car, kidnap (arrest) me,or threaten me with deadly force, I can respond with deadly force.  UNLESS that man is wearing a badge.

In that instance, you must submit and watch them potentially take your money, your car, or your life if the officer claims he felt threatened. 

And if he does kill you, he will get paid administrative leave and the shooting will be declared justified.

And the worst part is, that most people still support the brave policemen. Only because they haven't had an interaction with one recently IMO.

You'll have my attention when it becomes commonplace for people to travel in groups of very much unremarkable vehicles, and if stopped for any reason, all exit multiple vehicles at once, commencing fire with many .30 caliber battle rifles using API rounds, instantly neutralizing the threat, then quickly exiting the area.  Kinda like Argentina, Brazil or Venezuela at various times.  Our future in a short while.  Now give us reports of that kind of response and you will see LEOs opting to leave good looking citizens the hell alone.  One may hope.
