Tennessee Woman Sentenced To Jail For Not Mowing Her Lawn

The trend of average U.S. citizens being incarcerated by overzealous judges and prosecutors within the police state formerly known as America continues with reckless abandon. In fact, these sorts of cases are becoming so commonplace I simply cannot keep up with all of them. The following story is a perfect followup to my piece earlier today, which shows how American public school students are being arrested or harassed by police for the most minor of infractions, such as wearing too much perfume, sharing a classmates’ chicken nuggets, throwing an eraser or chewing gum.

If you are an adult American slave, you can add not mowing your lawn to the list of prison-worthy crimes in the police state.

If you are a resident of Lenoir City, Tennessee, you might want to remember to mow your lawn — otherwise, you will be spending the night in jail.

 

Karen Holloway just spent six hours in a jail cell for failing to maintain her yard in accordance with the standards set by the city.

 

The saga began last summer, when Holloway was sent a citation for her overgrown grass and shrubbery. Holloway, who works a full-time job and has two children living at home, a husband in school, and one family vehicle, admits the yard needed some attention but that it just wasn’t feasible to do the work.

“The bushes and trees were overgrown. But that’s certainly not a criminal offense,” she says.

 

Last week, Judge Terry Vann handed down a five-day jail sentence to Holloway for refusing to comply with the city ordinances regarding yard maintenance, specifically the lack thereof. Holloway feels this was all just too much, saying, “It’s not right. Why would you put me in jail with child molesters and people who’ve done real crimes, because I haven’t maintained my yard.”

 

In addition to the severity of the sentencing, Holloway say she also feels that she was bullied during the process because she was never read her rights or told that she could have a lawyer present.

And you wonder why so many Americans feel the country is on the wrong track. As the Wall Street Journal noted yesterday:

The only time the public has felt worse was in October 2008, during the first, deep spasms of the recession. Then, 78% said the nation was on the wrong track, and only 12% felt good about the country’s direction. The last time “right direction” beat out “wrong track” was in January 2004 — and the last election cycle where that was the case was 2002.

Ya know, I don't think that we're exactly short of humans on this finite piece of rock we call home.  There's a shitload of them in third world countries, that produce even more of them at ever increasing rates.  I read some report on population, saying that the North African population is basically going to double within fifty years and they can't even keep the ones they've got, fed.  There sure would be a lot less problems, if there were a lot less humans.  Of course, Eugenics always creeps into this and the usual comment of starting depopulation with yourself, but what does that do?  It's all about Supply and Demand, that's what it comes down to.  If you're alone in the desert and there are fify thousand crates of navel oranges surrounding you, well the value of those oranges is about nil.  Flip that around and how about if there was one orange and fifty thousand humans?  I'll never forget the LA Times article (scrubbed, btw), that was documenting Pope John Paul's visit to Mexico and he basically told the poor, peasant Mexicans, the more children you have, the closer to God you'll be.  Now how stupid is that?  Or better yet, how evil is that?  Because you're telling this huge illiterate, third world, slum-dwelling, straining resources at the limit, peeps to have even more kids???

 

The Catholic authorities were pissed at my Grandmother, because she decide to stop having kids.  After sixteen of them, she was getting kind of tired.  In fact, my Mom and her, were pregnant at the same time!!!  I have an aunt, that's a few months younger than I am!  Eugenics be damned, I think it's the best of the best, that's got to breed and the lower life forms can get their pruning here and there, by Mother Nature.  I'm tired of seeing the 'starving children' commercials, because I didn't ask for that man, to stick his penis, in that woman, to bear yet another hungry mouth to add to the billions on the planet, did I?

What I don't get about Americans;

- It is always about Politics no matter where I am or what I am doing, like US Citizens are the biggest Busybodies or the Biggest Fascist, Work, School, what ever

- I have to protect your kids
- I have to watch my language
- I have to never refer to sexual behavior or nudity
- I have to follow all laws of the land, and never say anything about going against the laws
- I have to live up to Christian Values, Catholic Values
- I have to get a woman, make babies, work hard, and probably get married and remarried when I get divorced

All these fascist rules. Just because someone wants to protect their kids, make sure their kids don't get new ideas, set the example for their kids, and live up to their parents Ideals of Work, Life, & Church

Religion is the biggest tool of Social Control and yet we all forget about this.

Prime is Sovereignty of each Person. I don't answer to a Priest, a Preacher, a Parson, a Minister, a Guru, many of these are Capitalist Constructs, making money off of fear of not going to heaven.

Prime is Liberty, Freedom, Equality, and Individual Sovereignty.

My fear is that the USA is a fascist merging of the British Raj and German Nazi Model which was so effective as to give the Catholic Church a run for it's money.

Failing to make my point, maybe the USA is ripe for a Catholic Protestant war on US Soil... funded by Wall Street & London Bankers.

- Doing Prison Work for less than a $1 an hour
- Debt Slave, indentured servant in liquor store or restaurant laundry??
- Chinese or other foreigner in a Sweat Shop making textile products or something else... maybe Restaurant worker, motel maid??
- If Vietnam was started by a False Flag, then the Draftees were Slaves just like the Roman Army under Roman Fascism

Common sense solution to the abortion question:

The fetus must be removed intact.  If it can survive outside the womb it has the rights of any other human being.  If it cannot it's a parasite and you have no standing to force the woman to support it with her body.

After listening to a SA professor about land/property seizure in SA, I came away with an altered perspective on that. If someone is in need, they can just take it, the law says so. Your home, your property, doesn't matter. Agenda 21 in action. Each according to his skill, each according to his need. Hence OP's gated guarded abode. In the town of Twin Lakes WI, in the county of Kenosha, there is something called a "Weed Commission" that fined my friend because the weeds were too tall on the lakefront of an old house he inherited and didn't live in.

Property taxes on a falling down house on the lake, per year?  ~$25,000.  Yeah, he sold it. County valued at $1.2M, actual value was $380k. The sucker who bought was going to tear it down and build new. hate to think what his taxes are and what they are used to purchse.

Well, ever since I raised my black flag and let the yard grow, I've gotten warnings in the mail saying I've got two weeks to mow or they'll do it and send me the bill. So I call the number at bottom of the extortion threat and talk to a stump for an hour about what constitutes a "volunteer tree" and why leaves don't constitute acceptable "mulch". They seem to have skipped that part of the story.

Being jailed for contempt has no time limit. 

Depends on the state.  Here in Maryland it's 90 days.  Judges are bullies, if they didn't have contempt to charge you with, in their view it would be anarchy. But "civil contempt" is something the courts invented, like jail for not mowing your lawn, and it's nonsense. It too, should be outlawed.

This isn't the first time Holloway has been cited by the city. While her husband was serving in the military and deployed overseas, she was also sent a citation.  

On Tuesday, when she stood in front of the court once more, her sentence was reduced to six hours. The judge admitted Holloway is not a criminal, and that this is not a criminal case — but she was still sentenced to jail. Holloway turned herself in Tuesday evening and served her six hours.

Neither the judge nor the police chief have responded with comments.

This is not the first time someone has been sentenced to jail because of the state of his or her property. Linda Ruggles of South Carolina was unable to pay the $500 fine for the loose shingles left on her roof after repairs stalled following the 2008 recession. She spent six days in jail.

Things are never so crisply cut between black and white.

I'm as appalled by government encroachment into our lives as many ZHers; but I have a difficult time believing that tall grass - unaggravated by anything else - is a jailable offense. Should there even be a law on the books for it at all? No. Just like there shouldn't be laws on the books to save us from all the other things these moral busybodies are worried about: seat belts, second-hand smoke, speeding, child restraint harnesses, alcohol, guns, etc. If I were elected dictator, I'd repeal every one of these harassing laws. Also, or perhaps in spite of that, I have a hard time believing that this woman went to jail for nothing but tall grass.

This sounds to me like a case where the accused made such an ass out of herself in court that the judge sentenced her to jail for contempt. I doubt seriously that poor lawn care, by itself, is a jailable offense.

From reading between the lines and a cursory google search (yielding more vague articles), I suspect you're right.  My guess is that she treated the citation from the court the same way she did her lawn...  As such, the title is misleading, she didn't get jail time for failing to mow her grass...  that is impossible (and she'll likely get a hefty check from the state if it were true).  Rather, she likely got jail time for failing to recognize the court's authority.

Again folks, we have an adversarial legal system...  if you fail to assert your rights, then all sorts of inequities can result...  all she had to do was show up to court on her citation.

My best guess is that city code violations like this one are "must appear" offenses (because the court has to determine whether you actually mowed your lawn) and a warrant was issued for her arrest when she failed to appear or otherwise pay the fine (and the city code enforcement officer testified that her yard was higher than the height allowed by law).  Usually there is an initial warning period that offers a reasonable amount of time to mow the yard, after which you receive a citation...  at which point you're smack dab in the middle of the kangaroo court treadmill (the same one that handles speeding tickets).

Same thing happens to people who don't respond to the tax authorities when they get a "send us a check" letter in the mail...   assert your rights...  file a responsive pleading...  but do not pretend it will just go away if you do nothing.

At this point, her likely only defense is that she never received notice of the case against her, citation, etc.  Since it was probably hand delivered and she signed a ticket, I doubt that will go very far...  If she would have invested as much effort into mowing her lawn as she has done with creating a media blitz for herself, then the matter would have been resolved a long time ago.

You may be quite wrong about that. I had a similar, but worse in my opinion, confrontation with the code enforcement dept. of Tampa, FL a number of years ago. The mayor at that time was a totalitarian bitch of a dwarf named Sandra Freedman, who seemed to think she was queen of all the land. She decided the best way to obtain sufficient section 8 housing was to steal the needed real estate from the peasants. I received a letter from code enforcemant at that time stating that if I did not mow the lawn and trim the shrubs that the City of Tampa would confiscate my property. The property in question was not nearly as overgrown as numerous smaller properties in the area. This property was just what they wanted, 4 adjoining lots in a mixed, lower middle class neighborhood. They would have demolished the house and garage centered on the property and then built 4 duplexes to house 8 welfare families. All this info regarding their intentions came straight from the lawyer I hired, who was handling a good number of similar cases at that time. After my attorney wrote them a appropriately worded letter, the city backed off completely. They were looking for easy targets, not a property owner who would "lawyer up" as I did. This kind of attempted theft is happening all over the country now, more than ever. The government is enemy #1. Period. You have much less to fear from drug dealers and conventional thieves. At least common criminals don't have SWAT Teams to back them up.

It's said that property rights is one of the last remaining liberties people hold onto when governments slide into totalitarianism. This right is one that generally everyone can agree on - even misguided liberals. When cases like this come up, public backlash is usually very strong. That was my initial thought. The article doesn't state what she was criminally charged with. Not mowing a lawn has to be civil charges, not criminal. I am guessing she ignored notices given to her by some local agency and maybe a court order. This is a perfect case of adminstrative law being out of control. This is an excellent presentation in the Hillsdale Constitutional series about the APA being unconstitutional. Administrative law is what is being used to remove any liberty we may have left.

"One of my friends got hit by a paternity suit (actually that's not an accurate description - it's more like a Paternity Large Caliber Shot To The Head). The child wasn't his (by her admission) and, after years of court battles and three trips to jail (yes Virginia, there is a debtor's prison in America) the paternity test confirmed his denial.

All told he fought for eight long years and became a fearsome jailhouse lawyer. He beat the Machine - but at a terrible price. For years his "home" was a 6X8 closet in a Chiropractors office. He drove old jalopies that were held together with spit and baling wire because the state seized his vehicles. He drove illegally because the state suspended his license. He only worked odd jobs that paid under the counter because if he earned anything the state took it from him.

At one point after his "victory" the child, now a teen, showed up on his doorstep. She had gotten into a fight with her maternal parental unit and decided that she would go live with "Mr. Moneybags" (now living in a studio apartment). To my amazement he allowed her in. She lasted about four months. She had been taught that he was a bastard and it was her duty to fleece him of everything any anything she could get her grubbies on.

He tried to get her back into school and her head turned around but her programming was too strong. So he laid down the law and she ran away (good riddance!).

That's one of the more pleasant stories..."

Apparently, there is more to the story than the headline suggests.  According to this, she owns the property but doesn't live there; they live in an apartment. There have been numerous violations on the property going back over 10+ years.

She could have grown an English Garden in her front yard.  I've seen Bohemian types do this in upscale Urban areas, and get away with it.  Mind you, the English Garden in their front yard actually looked more interesting and attractive than the vanilla variety of their neighbors (mostly mowed & edged lawns, with a few bushes and flowers).

If you go to images.google.com and then search for "Front Yard English Garden", you'll see tons of gorgeous gardens that do not need "mowing", but do require work and TLC.  Actually, they require more work and TLC than the regular, boring lawns. 

BTW, if there is a Fire Hazard ordinance against uncut lawns that dry up and turn brown in the summer, then it is the perfect legal right of the community to have the grass cut.  If she won't do it, then have the City do it, and add it to her Tax bill.  QED.

 

* In Trial Law, if a lawyer can't win on principle, he'll seek to win on Procedure.  One of the most useful principles that can be used in daily life, and practiced as a Science and Art by the ambitious and ruthless.  Actually, it's instinctively also played by little children, but the Educational system (public, private or home-schooled) tends to "beat it out of them" for the sake of Obedience and Control.

I live in Delaware and that's a pretty apt description of our beaches. DNREC will shut down miles of "public" beaches if they find one nesting Plover. Animals have more rights than people here. I have not been down to the beaches in years ever since they make you buy a fishing license for tidal water now. Was it this bad in the former Soviet Union?

If they (the Overlords) can burden your property with a mandatory tax, then how is this different from the Middle Ages and Feudalism?  People were either Serfs, Merchants, Nobility or employed by Nobility (Sheriff, Military) -- and the Serfs had to pay taxes to the Nobility, i.e. paid rent (often via sharecropping) for the use of the Land Lord's land or house.
