"They Just Want The Money!" The IRS Can Now Seize Accounts On Suspicion Alone

The topic of civil asset forfeiture has been high on our agenda recently as federal 'agents' discover how to steal Americans' hard-earned cash with zero repurcussions , and decide unilaterally how much cash a 'common man' is allowed to carry; but as The NY Times reports, the escalation to The IRS brings a whole new world of possibilities with regard asset confiscation based on no actual crime being proved...
For almost 40 years, Carole Hinders has dished out Mexican specialties at her modest cash-only restaurant. For just as long, she deposited the earnings at a small bank branch a block away - until last year, when two tax agents knocked on her door and informed her that they had seized her checking account, almost $33,000.
The Internal Revenue Service agents did not accuse Ms. Hinders of money laundering or cheating on her taxes — in fact, she has not been charged with any crime. Instead, the money was seized solely because she had deposited less than $10,000 at a time, which they viewed as an attempt to avoid triggering a required government report.
Her money was seized under an increasingly controversial area of law known as civil asset forfeiture, which allows law enforcement agents to take property they suspect of being tied to crime even if no criminal charges are filed. Law enforcement agencies get to keep a share of whatever is forfeited.
Critics say this incentive has led to the creation of a law enforcement dragnet, with more than 100 multiagency task forces combing through bank reports, looking for bank accounts to seize.
Using a law designed to catch drug traffickers, racketeers and terrorists by tracking their cash, the government has gone after run-of-the-mill business owners and wage earners without so much as an allegation that they have committed serious crimes. The government can take the money without ever filing a criminal complaint, and the owners are left to prove they are innocent. Many give up.
“They’re going after people who are really not criminals,” said David Smith, a former federal prosecutor who is now a forfeiture expert and lawyer in Virginia. “They’re middle-class citizens who have never had any trouble with the law.”
On Thursday, in response to questions from The New York Times, the I.R.S. announced that it would curtail the practice, focusing instead on cases where the money is believed to have been acquired illegally or seizure is deemed justified by “exceptional circumstances.”

But the Institute for Justice, a Washington-based public interest law firm that is seeking to reform civil forfeiture practices, analyzed structuring data from the I.R.S., which made 639 seizures in 2012, up from 114 in 2005. Only one in five was prosecuted as a criminal structuring case.
The practice has swept up dairy farmers in Maryland, an Army sergeant in Virginia saving for his children’s college education and Ms. Hinders, 67, who has borrowed money, strained her credit cards and taken out a second mortgage to keep her restaurant going.
The $10,000 loophole line in the sand...
Under the Bank Secrecy Act, banks and other financial institutions must report cash deposits greater than $10,000. But since many criminals are aware of that requirement, banks also are supposed to report any suspicious transactions, including deposit patterns below $10,000. Last year, banks filed more than 700,000 suspicious activity reports.Owners who are caught up in structuring cases often cannot afford to fight. The median amount seized by the I.R.S. was $34,000, according to the Institute for Justice analysis, while legal costs can easily mount to $20,000 or more.
There is nothing illegal about depositing less than $10,000cash unless it is done specifically to evade the reporting requirement. But often a mere bank statement is enough for investigators to obtain a seizure warrant. In one Long Island case, the police submitted almost a year’s worth of daily deposits by a business, ranging from $5,550 to $9,910. The officer wrote in his warrant affidavit that based on his training and experience, the pattern “is consistent with structuring.” The government seized $447,000 from the business, a cash-intensive candy and cigarette distributor that has been run by one family for 27 years.
As one lawyer defending against the IRS' aggressive 'stealing' tactics concludes...
“I don’t think they’re really interested in anything,” Mr. Potashnik said of the prosecutors. “They just want the money.”

This is sadly happening Canada too. The CBSA seizes undeclared gold legal tender coins you enter Canada even if it is less than $10,000 market value.
They do however offer to return it, if you pay a 25%-80% penalty, calculated at the discretion of the border officer.

The CBSA will penalize the undeclared import of sub-999 precious metal, just as it will penalize the undeclared import of booze or tobacco.
FWIW >999 metal (a "raw material" not subject to GST) can be imported into Canada in any amount with no tax, duty etc.
Bringing Maple Leafs into Canada in any amount is not reportable ("declarable") to Canada, as MLs are of Canadian origin, and thus do not constitute an import.

Correct, the gold they seized from me was four 1oz gold buffalos, which are issued by the us mint as legal tender (0.9999 purity), and their value was below $10,000, so I wasn't required to declare them.

Oh, yes, I have the badge number, but somehow these people never give their names, even when asked, for "privacy purposes", ie they need anonymity to do the shady work they do.

I guess we can add that undeclared import of >999 precious metal (of non-Canadian origin) will be hammered by the CBSA; even if no tax is due on the PM, they will get you for the non-reporting. or maybe just for being an American.....
I am Canadian, I don't believe citizenship makes a difference.
Fortunately they did issue a "receipt of seizure", which shows what was seized, and the officer's badge number. At the moment I've sent an appeal to the "CBSA Recourse Directorate", explaining that according to the known laws, my coins Gold Buffalo coins really are legal tender, and thus are not required to be declared if valued under $10k.
The officer indicated that had I declared the gold, it would have simply been subject to 13% tax, and I'd be on my way. This is of course false in the case of >999 gold that is legal tender, on which as you pointed out also, no tax or duty is charged, as legal tender falls under the classification of "monetary instruments".
I hope this seizure was just the unfortunate outcome of un overzealous, undertrained border officer, and not the policy of the government.
My lesson is that the ignorance/undertraining of border officers is very much a risk to crossing the border with gold.

Good luck with your appeal. These days, I'd only transport PM across a national border if I had a hard-copy of the applicable regs in hand or, ideally, a letter from the Border Agency which addressed my own specific situation. Even with a letter in hand, there's no guarantee that there won't be a disagreement with the particular Border Guy on site, but at least they'd be less likley to accuse you of trying to sneak material in.
Alternatively, at least when driving across a land border, there's always the option of deep concealment, but that raises a lot of other potential issues, including criminal charges.

While I respect you and your opinion, I find that those that hold a similar view are misguided in three respects:
1) The Constitution was never formally removed as the "law of the land," and therefore is still the law of the land. They can create and shuffle around legal documents all they like, but they carry no weight until the contract between the people and states that created the US government is formally removed.
2) Fraudulent-reserve banking is nothing more than theft by fraud. The Federal Reserve, the DC US' central bank, is not provided for in the Constitution, and therefore is Unconstitutional. Therefore, the Federal Reserve is nothing more than a criminal cabal of theft Unconstitutionally put in place to plunder the American people and country.
3) America resides in us, the American people. America is what we say, and expect, it to be. We should expect America to be governed by the republic that was created by the Constitution between the states. We should not desire to, or acquiesce to, being governed by the criminal syndicate that has now taken up occupation over the American people and country.

I love driving around a beater that's been paid off for years. Guy in the office the other day told me about his buddy who just bought a new truck for nearly 50k. I remember a while back the US/IRS offered people the chance to convert their IRAs over to Roth IRAs, and there was some sort of tax incentive to do that.
Well we have various retirement accounts in the US; annuities, IRAs, SEPS, etc. I'm not unpatriotic (and my wife is extremely patriotic) but I wish the US/IRS would offer us some sort of option to just pull all of our money out - at a fair tax rate. Then I won't have to worry about/file all this paperwork and they won't have to worry if I am avoiding my taxes. Let's just agree to be friends - and at least financially - part friends.

But why when they print all the assets they want. It probably takes them a few seconds to print the assets we spent 30 years working for/saving. I'm just trying to make things easier for them and us.
To be honest - where the US is _really_ losing out is - we have our little nest-egg and we are spending it here in Mexico. Mexico very smartly gave us permanent status.
