Supreme Court Rules Police Can Violate The 4th Amendment (If They Are Ignorant Of The Law)

U.S. Supreme Court Rules 8-1 that Citizens Have No Protection Against Fourth Amendment Violations by Police Officers Ignorant of the Law

WASHINGTON, D.C. — In a blow to the constitutional rights of citizens, the U.S. Supreme Court ruled 8-1 in Heien v. State of North Carolina that police officers are permitted to violate American citizens’ Fourth Amendment rights if the violation results from a “reasonable” mistake about the law on the part of police. Acting contrary to the venerable principle that “ignorance of the law is no excuse,” the Court ruled that evidence obtained by police during a traffic stop that was not legally justified can be used to prosecute the person if police were reasonably mistaken that the person had violated the law. The Rutherford Institute had asked the U.S. Supreme Court to hold law enforcement officials accountable to knowing and abiding by the rule of law. Justice Sonia Sotomayor, the Court’s lone dissenter, warned that the court’s ruling “means further eroding the Fourth Amendment’s protection of civil liberties in a context where that protection has already been worn down.”

“By refusing to hold police accountable to knowing and abiding by the rule of law, the Supreme Court has given government officials a green light to routinely violate the law,” said John W. Whitehead, president of The Rutherford Institute and author of the award-winning book A Government of Wolves: The Emerging American Police State. “This case may have started out with an improper traffic stop, but where it will end—given the turbulence of our age, with its police overreach, military training drills on American soil, domestic surveillance, SWAT team raids, asset forfeiture, wrongful convictions, and corporate corruption—is not hard to predict. This ruling is what I would call a one-way, nonrefundable ticket to the police state.”

In April 2009, a Surry County (N.C.) law enforcement officer stopped a car traveling on Interstate 77, allegedly because of a brake light which at first failed to illuminate and then flickered on. The officer mistakenly believed that state law prohibited driving a car with one broken brake light. In fact, the state traffic law requires only one working brake light. Nevertheless, operating under a mistaken understanding of the law, during the course of the stop, the officer asked for permission to search the car. Nicholas Heien, the owner of the vehicle, granted his consent to a search. Upon the officer finding cocaine in the vehicle, he arrested and charged Heien with trafficking. Prior to his trial, Heien moved to suppress the evidence seized in light of the fact that the officer’s pretext for the stop was erroneous and therefore unlawful. Although the trial court denied the motion to suppress evidence, the state court of appeals determined that since the police officer had based his initial stop of the car on a mistaken understanding of the law, there was no valid reason for the stop in the first place. On appeal, the North Carolina Supreme Court ruled that even though the officer was wrong in concluding that the inoperable brake light was an offense, because the officer’s mistake was a “reasonable” one, the stop of the car did not violate the Fourth Amendment and the evidence resulting from the stop did not need to be suppressed. In weighing in on the case before the U.S. Supreme Court, Rutherford Institute attorneys warn against allowing government agents to “benefit” from their mistakes of law, deliberate or otherwise, lest it become an incentive for abuse.         

Affiliate attorney Christopher F. Moriarty assisted The Rutherford Institute in advancing the arguments in the amicus brief before the U.S. Supreme Court.

We, as a collective, are becoming sloppy, arrogant, complacent, and dangerously oblivious to what happens as a country gains momentum in the process of becoming a flat out dictatorship. Pretty soon, if not already, mass executions will be the norm. The Sanctity of Life, which, more or less, has been the default in this country over the past 200 plus years, will be totally ignored. We've never seen that in this country on a massively grand scale. But look at Russia in the early 1900's and SE Asia in the latter part of the 1900's...millions. It appears we have passed the point of no return, giving me a real bad feeling about the near future of the country.

The Supreme Court seems to now be #1 threat to Liberty.

Did these people not swear an oath to protect and defend the Constitution? Maybe the time draws near to do as the Declaration of Independence directs, that when Government becomes tyrannical, it is our right and duty to alter or abolish it and install new guards to secure our liberties. I do not see anywhere where it says to wait till the next election.

 

I wrote my congressman, John Culberson, before the last election and told him to immediately get to work on Articles of Impeachment for that jungle monkey and that I would be watching his vote closely, as I was very disappointed he voted against the Amash bill. I saw no action or recieved any response so he lost my vote and I told him so.

I want some politicians with some guts to work to remove the Prez. Disipinary action is in order, and I think our elected officials need a dose of fear. I certainly fear them, especially since the police can now say they were not in class when they gave civics courses.

 

I'm still in amazement about the Boston Marathon bombing where the police pretty much strong armed their way into private homes searching for a wounded teenager. That bastard would have been apprehended or found bled out in a day or two tops, but that slur on Liberty will become routine.

In the "court" system they have this thing called precedent. Which means that earlier court decisions are used to steer current court cases.

So, with this decision we now have the Supreme court, and I use that term with a snicker, blessing ALL stops by police whether they have probable cause to stop you or not.

The PRECEDENT set by this case now applies to ALL future court cases.

I'm a Juris Doctor.  Indio is right.  Sure, the precedent regarding the fact that a legally baseless stop can't be used as a basis to throw out subsequently obtained evidence will stand.  However, DO NOT VOLUNTEER TO CONSENT!  If he hadn't volunteered, the case might have even gone the other way.  The reason being that the court isn't going to stand in the way of cops thinking something is a crime and then asking people if they can search.  However, the court might stand in the way of cops thinking something is a crime and then forcibly searching on that (false) premise.

Somewhat OT, but connected loosely....

Just returned from holiday trip with extended in-law clan.  Really got into it last night about critical thinking, not believing everything gov't tells you, etc, and was absolutely outraged at the complacency of these people.  Two nephews are recent college graduates and they are spewing the garbage you expect from the establishment.  No critical thinking.  They were aghast at my claim that government statistics are manipulated like CPI and GDP.  Couldn't begin to wrap their heads around the possibility that the Fed is not acting in people's best interest (2% inflation is good for us??).  Had no idea about the debt problems and what's ahead.

I'm fucking fed up.  I'm doing well in this contrived economy, but I still am hoping for a reset.  Yes, it might very well be ugly, but I have come a very long way over the past 3 years and am far more ready than many, many others, including my village idiot in-laws.  I'm sick of being the nut-job.  It's incredibly petty, but I imagine a day when things have gone Mad Max and they show up at my door looking for a hand out and I get to tell them to Fuck Off!  (and while I'm at it, a special "FUCK YOU!" to a particular sister-in-law).

The Constitution states that we the people have a duty to fight against and remove anyone who goes against our Constitution. So although those particular officers might have been good guys (who knows), they are unfortunately part of a group of criminals and tyrants who are trying to slowly but surely erode the Constitution, along with judges and politicians. 

 

So according to the words in our own Constitution, the targeting is not only "fair", but absolutely mandatory.

 

And in answer to your question,  I am on the side of human freedom. I believe that *anyone* who tries to take away humans' freedom should be removed with extreme prejudice, to grow and  preserve freedom for all, for the entire planet.  For humans to accept anything less is absurd. Who ever said that one human had the right to rule over and subjugate another? None of us should be tolerating any of these infringements.

That is completely ass backwards.  Have you actually read the document?  Read this again if you have.  Based upon what you have said it appears that you fail to realize the Constitution IS what creates tyranny.  I used to believe in the Constitution and the whole Ron Paul thing but I finally realized that the constitution IS the problem because it enables them.  I have given much though to the matter over many years and I already that there one thing that they fear the most and is gun ownership.  Hands dow, they are shitless of that concept but the Constitutions does not really protect that right.  We protect our rights.  Here is why, .gov employees do not want a real fight:  They only want a paycheck and benefits and that is all.  They could give a shit less about your rights or what the law is.  Forget that bullshit.

The problem is that cops are not neccessarily bad folks but they are trying to survive on our dime and that has created an issue.  I'm the kind who think that shooting a cop is a good idea but I also do not think that I should have pay for this gang of thugs to rampant.  What about my children?  Cops children are better than mine?  And then I am supposed to pay for retirement benefits?  I have issue with that mentality and it is just plain wrong.  

What was wrong just having a Sheriiff and Deputy?  Now there are cops of one sort or another everywhere.  See something say something.  Well, I see a lot of cop cars running around for no good reason.

This phenomenon we are seeing transcends laws. Maybe you are LE and that is why you can't get past your fixation on laws? The People don't give a damn about unconstitutional laws. Watch the news,  they are ready to blow the whole thing up.  

 

So when cops are killing unarmed people like that bum in the NM desert, and that fat Garner fk,  no law is going to save the gang of killers from the people. Every person with a soul wanted to kill a cop after watching that Garner kid get choked, and then the killer cop was set to run free.

 

Personally I think that Mike Brown kid should be dug up and shot again for what he did to that shop owner.  But other true innocents have been getting killed by out of control cops and it will not be tolerated by the people. Judgement is at hand right now on the streets. I don't think it can be stopped either. 

 

That said,  those cops handing out money are making a go at improving  relations. Some are getting the message loud and clear that they need to change their respect for the Constitution, as it looks like their lives depend on it.

Never an excuse for the government because the government is tasked with enforcing

the "laws".

The government should never be allowed to practice for itself  a double standard of enforcement or abiding by those laws.

As for citizens, the maze, complexity, and even self-contradiction of some laws (e.g. IRS) should allow consideration of INTENT, and therefore degree of guilt. I would even recommend, in some cases, considering such in assessing the degree of guilt as individuals for government agents.

But to allow government, for any reason, to legally have the fruit of a poisoned tree is diabolic.

I bought a small bottle of whiskey the other day for a Xmas recipe and the clerk asked if I wanted a bag. I replied that with what police can do today I definitely want a bag.

If you are in your car then do not leave anything suspicious out where a cop can see it or you invite a search - legal or not. And if the cop finds something it's now a simple matter for then to grab their nightstick and take out your tail light!

But did the court rule that a defendant is to be held to a higher standard?  It won't be long until they are hearing the same excuse from a defendant,  sighting this precedent,  if they didn't.   

If they did make that distinction it would be obvious to include it in the article to show the total corruption of the court...which we know is true.  If they didn't...I doubt we have to wait long until they do say that we are officially held to a higher standard than the "legal system" itself.
