Obama Goes Full Stalin: Tells Secret Court To Ignore Law He Signed 4 Hours Earlier, Extend Illegal NSA Surveillance

Just when we thought the absurdity that marks every single day of Obama's reign could not possibly be surpassed, we learned that 4 hours (3 hours and 47 minutes to be precise) after the US president vowed to sign a new law banning bulk data collection by the NSA (named, for purely grotesque reasons, the "USA Freedom Act"), the Obama administration asked the secret Fisa surveillance court to ignore a federal court that found bulk surveillance illegal and to once again grant the National Security Agency the power to collect the phone records of millions of Americans for six months.

Or, as the Guardian's Spencer Ackerman, who spotted this glaring page out of Josef Stalin's playbook, summarized it:

According to Ackerman, this latest travesty by the administration "suggests that the administration may not necessarily comply with any potential court order demanding that the collection stop."

Or, in other words, the administration "may" give orders that openly flaunt US laws. From the Guardian:

US officials confirmed last week that they would ask the Foreign Intelligence Surveillance court – better known as the Fisa court, a panel that meets in secret as a step in the surveillance process and thus far has only ever had the government argue before it – to turn the domestic bulk collection spigot back on.

 

This is a problem because Justice Department national security chief John A Carlin cited a six-month transition period provided in the USA Freedom Act – passed by the Senate last week to ban the bulk collection – as a reason to permit an “orderly transition” of the NSA’s domestic dragnet. However, Carlin "did not address whether the transition clause of the Freedom Act still applies now that a congressional deadlock meant the program shut down on 31 May."

So after the second circuit court of appeals already ruled NSA surveillance illegal, and after Congress officially shut down NSA's bulk data collection in its current form, Obama's DOJ decided to singlehandedly order that NSA spying on Americans be extended for at least another 6 months.

Follow the details of how the US Department of "Justice" crushes every semblance thereof:

Carlin asked the Fisa court to set aside a landmark declaration by the second circuit court of appeals. Decided on 7 May, the appeals court ruled that the government had erroneously interpreted the Patriot Act’s authorization of data collection as “relevant” to an ongoing investigation to permit bulk collection.

 

Carlin, in his filing, wrote that the Patriot Act provision remained “in effect” during the transition period.

 

“This court may certainly consider ACLU v Clapper as part of its evaluation of the government’s application, but second circuit rulings do not constitute controlling precedent for this court,” Carlin wrote in the 2 June application. Instead, the government asked the court to rely on its own body of once-secret precedent stretching back to 2006, which Carlin called “the better interpretation of the statute”.

The punchline:

The second circuit court of appeals is supposed to bind only the circuit’s lower courts. But the unique nature of the Fisa court – whose rulings practically never became public before whistleblower Edward Snowden’s revelations – has left ambiguous which public court precedents it is obliged to follow.

Said otherwise, the NSA's espionage activity is above the law, any law.

Amusingly, some still harbor hope that "justice" is still a viable concept in the United States, such as the FreedomWorks conservative group, which is asking the Fisa court to essentially disband itself:

On Friday, the conservative group FreedomWorks filed a rare motion before the Fisa court, asking it to reject the government’s surveillance request as a violation of the fourth amendment’s prohibition on unreasonable searches and seizures. Fisa court judge Michael Moseman gave the justice department until this coming Friday to respond – and explicitly barred the government from arguing that FreedomWorks lacks the standing to petition the secret court.

Which, incidentally, is like asking Wall Street to police itself. A quick reminder of what happened there: after gross market manipulation was taking place for years involving trillions of interest-rate products, the person who witnessed it every single day called it, don't laugh, a "conspiracy theory."

Incidentally, "conspiracy theorists" is precisely what all those who accused the NSA of engaging in mass illegal surveillance even before the Snowden revelations, were branded as. And, we are confident, before all is said and done, the "conspiracy theorists" who dare speak the truth against the surreal Orwellian state that the US finds itself in, will be crushed by the administration, both the current and the one that will replace it, whose every day modus operandi is taken straight out of the Stalin memoirs.

I guess this is also why the gov keeps buying up America's supply of ammo, gun powder etc.  Was talking to a trap shooting buddy recently and supplies are still in chronic shortage.  The 2nd doesn't really matter when the gov keeps everything in short supply.  Where are all of the lawsuits?  Can Americans buy from foreign nations since the US has such a terrible and long term shortage?  Still no explanations and no one seems to even be asking, unbelievable.

Well, I don't often post anything very positive but I did have positive experience today.  It is actually not winter here in MN anymore so I thought I would go for a motorcycle ride and I was cruising around came up on a pretty new Corvette.  I respected my distance but of course they saw me but continued to go 45 mph for a while.  I was like WTF?  Well, we came to a T in the road and they happened to be going the same direction that I was.  There is pretty long straight away there and they opened that Vette up.  I have a Harley Sportster(actually two of them but who is counting) with the fuel injection and the Screaming Eagle package.  It is a fast bike as far as Harley's go.

I could not resist the challenge so cornered and rolled the throttle down and blasted through the gears.  They saw that I was keeping up so they laid the lead to the pedal and left me in the dust but not out of sight.  I was doing over 100 mph and they were walking away from me like I was standing still.  Holy fuck!  They had to be doing 150 mph plus.  I kept on the throttle and I saw where they turned off.  It was a very curvy road with many S curves.  The Corvette is not so good there.  I have ridden that road a few times so I know how to gain ground and I caught them.  We rode/drove back into town at reasonable speeds and when we parted ways we gave each other a thumbs up and a smile.  That is cool. 

It was a Millennial driving that Corvette.  Maybe borrowed from Dad?  We risked a lot by doing what we did.  That is not your average speeding ticket.  The copzis get a really big boner to shove up your ass if you are clocked at over 100 mph.  We didn't care.  The Corvette and the Harley rolling at well over 100 mph through the cornfield roads must have been a quite a spectacle.  I normally would not ride that hard but sometimes you have to.  I felt alive.  When you are going 100 mph on Harley chasing a new Corvette who is doing 150 mph that is complete disrespect for wathever they call law these days.

For me that harkens back to earlier times when no one gave a shit about some bullshit laws.  That shit was OK to do back in the day but now everything is some sort of felony.  Iti didn't matter at all to us today though.  I am old enough to know better but it was awesome.  I have no idea who these kids were but they seem pissed off.  I did not get to drive any of Dad's anything because he died when I was six months old.  I had to earn it and I take care of my family. 

Sometimes the wind needs to cleanse your soul.  What if I make a slight mistake at 100 mph?  I die.  I would rather die than be a slave.

Why doesn't someone put up an IMPEACH OBAMA website and take a petition.  All petitions to the white house with over 100,000 signatures they usually address.

It is a start.  I would do it but I am not an American.  It would be better if the petitioner is home grown black or native, anything but white as they will use the race card and it is not about race, it is about lying, stealing, war crimes and more.

Maybe a few clowns in congress may get the idea that there are people who are fed up and it isn't safe anymore playing the game like it is being played.

@Asf...  Thanks for the link.  I can remember the day of the big event like it was yesterday.  I've always been interested in the Kennedy thing, but I was completely unaware that Ruby had gone to Cuba and was involved with the "Fair Play for Cuba" group, which was the coverstory for the assasination.  If so, Ruby was without question, a conspirator, which was never disclosed to the public because that would have put the lie to the "lone gunman" story.  Again, thanks.

This type of collection of data is of course nothing to do with protecting against foreign/terrorist threats of any kind and all to do with protecting the Status Quo of TPTB.

 

The data will be a stock pile of potential information on people who might rise in influence and be a threat to the powers of the status quo or the Elite want to use them for their own ends. Somebody who becomes a judge, regulator, politician and so forth, there will be tons of data on all your electronic activity over many years, too easy then to put you in jail, get you sacked, or blackmail you to do as your told.

 

And of course, once you have many thousands of pieces of electronic data on somebody over years it becomes quite easy to insert Invented data into the mix, in order to deal with that person.

congress does not even try to convince the people they make and understand the laws they vote in..see ACA and most recent secret TPP..courts are given the final say, until they don't agree with .gov then they are overruled by secret courts of un named judges..republic? I think not.

once america became a super power, a republic form of government became a casualty of this new role.

(once a super power the need for security of the state leadership expands until it consumes any freedom the citizens once had) it is almost a comedy when news papers and media look past such little items as secret deals as national law, voted on by congress which never even read the law, ACA and TPP as recent examples..laughable.)

a good example of how it works is 2008, and a mega  tax payer money dump into hank paulson's hands to be used by him in any way he wished. his actions were exempt from a controlling legal authority in perpetuity. as the risk to our rule as superpower is also based on our economy-

perhaps we have given too much to be a superpower..as no Republic can fill that role and remain a republic.

In collapse gov't turn their attention to the enemy within. That enemy is democracy. I called BS then because it was clear to me the type of person he was
