Writing's On The Wall: Texas Pulls $1 Billion In Gold From NY Fed, Makes It "Non-Confiscatable"

The lack of faith in central bank trustworthiness is spreading. First Germany, then Holland, and Austria, and now - as we noted was possible previously - Texas has enacted a Bill to repatriate $1 billion of gold from The NY Fed's vaults to a newly established state gold bullion depository..."People have this image of Texas as big and powerful … so for a lot of people, this is exactly where they would want to go with their gold," and the Bill includes a section to prevent forced seizure from the Federal Government.

From 2011:

"The University of Texas Investment Management Co., the second-largest U.S. academic endowment, took delivery of almost $1 billion in gold bullion and is storing the bars in a New York vault, according to the fund’s board."

 

The decision to turn the fund’s investment into gold bars was influenced by Kyle Bass, a Dallas hedge fund manager and member of the endowment’s board, Zimmerman said at its annual meeting on April 14. Bass made $500 million on the U.S. subprime-mortgage collapse.

 

“Central banks are printing more money than they ever have, so what’s the value of money in terms of purchases of goods and services,” Bass said yesterday in a telephone interview. “I look at gold as just another currency that they can’t print any more of.”

And now, after we noted the possibility previously, as The Epoch Times reports, Texas Governor Greg Abbott signed a bill into law on Friday, June 12, that will allow Texas to build a gold and silver bullion depository. In addition, Texas will repatriate $1 billion worth of bullion from the Federal Reserve in New York to the new facility once completed.

On the surface the bill looks rather innocent, but its implications are far reaching. HB 483, “relating to the establishment and administration of a state bullion depository” to store gold and silver coins, was introduced by state Rep. Giovanni Capriglione.

 

Capriglione told the Star-Telegram:

 

“We are not talking Fort Knox. But when I first announced this, I got so many emails and phone calls from people literally all over the world who said they want to store their gold … in a Texas depository. People have this image of Texas as big and powerful … so for a lot of people, this is exactly where they would want to go with their gold.”

 

But isn’t New York, where most of the world’s gold is stored, also big and powerful? Why does the state of Texas want to go through the trouble of building its own storage facility?

There are precisely two important reasons. One involves distrust in the current storage system. The second threatens the paper money system as a whole.

“In a lot of cases with gold you may not have clear title to the metal. You may have a counterparty relationship that makes you a creditor. If the counterparty has a problem unrelated to gold, they can default and then you become an unsecured creditor in bankruptcy,” said Keith Weiner, president of the Gold Standard Institute.

 

This means you get whatever is left after liquidation, often just a fraction of the initial value of your holdings.

 

“This exact scenario happened with futures broker MF Global. I knew people who had warehouse receipts to gold bars with a specific serial number. But that gold had an encumbered title and they became unsecured creditors in bankruptcy,” said Weiner.

 

In Texas, two big public pension funds from the University of Texas (UoT) and the Teacher Retirement System (TRS) own gold worth more than $1 billion.

 

Being uncomfortable with holding purely financial gold in the form of futures and Exchange-traded Funds, University of Texas actually took delivery of the gold bars in 2011 and warehoused it with HSBC Bank in New York.

 

At the time pension fund board member and hedge fund manager Kyle Bass explained: “As a fiduciary, which I am in that position to the extent you own gold and you are going for a long time, and it’s not a trade. … We looked at the COMEX at the time and they had about $80 billion of open interest between futures and futures options. And in the warehouse they had $2.7 billion of deliverables. We are going to own it a long time. You are on the board, you are a fiduciary, so that’s an easy one, you go get it.”

 

Bass is implying that there is much more financial gold out there than physical, and that it is prudent to actually hold the physical.

 

Taking the gold to Texas would then also solve the counterparty risk. “In this case it’s going to be a depository, the gold is going to be there, they are not going to be able to lend it out and it won’t serve as collateral for other transactions of the bank.” said Victor Sperandeo of trading firm EAM Partners. “Because if the bank closes, you are screwed.”

 

“I think that somebody was looking at that, we better have this under our complete control,” said constitutional lawyer and gold expert Edwin Vieira, of the Texas bill. “They don’t want to have the gold in some bank somewhere and in two to five years it turns out not to be there.”

So far most of the attention has focused on the part of the depository and the big institutions. However, the bill also includes a provision to prevent seizure, which is important for private parties who want to avoid another 1933 style confiscation of their bullion by Federal authorities.

Section A2116.023 of the bill states: “A purported confiscation, requisition, seizure, or other attempt to control the ownership … is void ab initio and of no force or effect.” Effectively, the state of Texas will protect any gold stored in the depository from the federal government.

 

And free from the threat of confiscation, private citizens can use gold and silver as money, completely bypassing the paper money system.

 

“People can legally do that with gold contracts. The difficulty is the implementation. Now Texas has set up a mechanism with the depository. We have accounts in that institution and can easily transfer back and forth certain amounts. So we can run our money system a gold or silver basis if we were so inclined,” said Vieira.

 

This would not be possible if the gold is stored in a bank because of the risks of bank holidays and bankruptcies. It would also not be possible if the federal government could confiscate gold.

 

According to Vieira, this anti-seizure provision rests on Article 1, section 10 of the Constitution of the United States, which obliges the States to not make anything tender in payment of debts apart from gold and silver coin. 

 

If someone from the Department of Justice comes along you are going to see legal and political fireworks. The state is going to say ‘we need to have a mechanism to make gold and silver money. This is pursuant to the constitutional provision we have. You can’t touch this. Our state power on the constitutional level is more powerful than any statute you may pass,'” said Vieira.

 

Because one of the litigant parties is a state, the case would go directly to the Supreme Court.

 

“We are talking about something completely new in terms of the legal playing field. This is no longer a fringe concept,” he adds, but cautions about a possible fight with the federal government: “We will have to see how committed the governor and the attorney general are.”

 

Official Statement from Governor Abbott:

Governor Greg Abbott today signed House Bill 483 (Capriglione, R-Southlake; Kolkhorst, R-Brenham) to establish a state gold bullion depository administered by the Office of the Comptroller. The law will repatriate $1 billion of gold bullion from the Federal Reserve in New York to Texas. The bullion depository will serve as the custodian, guardian and administrator of bullion that may be transferred to or otherwise acquired by the State of Texas. Governor Abbott issued the following statement:

 

“Today I signed HB 483 to provide a secure facility for the State of Texas, state agencies and Texas citizens to store gold bullion and other precious metals. With the passage of this bill, the Texas Bullion Depository will become the first state-level facility of its kind in the nation, increasing the security and stability of our gold reserves and keeping taxpayer funds from leaving Texas to pay for fees to store gold in facilities outside our state."

Is this the first step down a road to secession? Notably, they'll need that gold to establish their own country once they win the potentially imminent war with the US military which starts on Monday (Jade Helm).

This implicit subordination of The Fed's gold sends a more ominous signal of rising fears of confiscation and leaves us wondering just how long before every state (and or country) decides to follow Texas' lead?

In a deflationary collapse, the U.S. government would go bankrupt as it could no longer service the existing outstanding debt.  I doubt that they would voluntarily choose this route.  Inflating the debt away is more likely.

Not how established nations die.  Call it hyperinflation in an instant if you will as a satisfactory analogy.  If it is palpable, it will be short lived.  Not some long, drawn out process like a 3rd world country or country in post-war shambles.  Between now and then, deflation is the name of the game.  Desperate governments are going to hunt $.  And when pensions really start to roll over they are going to rob everyone blind.  $ will go underground.  It will increase in value as long as it has confidence behind it (which will strengthen during the period where government is hunting it down). 

Then, as Frank Zappa said, they will pull down the curtains and show you the brick wall behind the stage.  It is at that point you can render your cash available to warm your house via fireplace (if you have any left).

PM's?  Great insurance.  Maybe worth something some day.  Maybe worth your life if they work to get you out of hot water.  But, go all in on them?  Hell no.

Not a great outcome.  But better than where we are heading with Wall St and DC at the helm.  One can only dream of seeing the public trial for treason of most of DC, Wall St., etc. - and subsequent executions, clawbacks, family banishment, shame, etc.  How best to quell the bloodlust that they (the traitors) have been stewing?  The irony of it all.

There was a guy supposed to be an intel analyst who said the Southern Border is going to be a source of conflict or terrorism. His guess was that this was what Jade Helm was all about. That maybe there was intel that is predicting a big problem pouring in from Mexico.

Makes as much sense as anything else, except I keep hearing that it is special forces exercise when covering such a large area would seem to need more conventional forces.

Sure would like our Military to seize the bankers though and then ban lobbying, gift giving and campaign contributions. Oh and break up TBTF Banks. Not sure what they could do to the Politicians. I guess declare a coup and marital law.

My only exposure to Texans was forty years ago at our County Fair here in South Central Wisconsin.  They are a boastful, cocky, tougher-n-shit bunch who don't back down.  At least they were 40 years ago.  The rodeo guys were, anyway.  Don't know how things stand today.

It was an August Saturday night at the Sauk County Fair.  The livestock auction was during the day, the entertainment in the grandstand arena had been a traveling rodeo show from Texas, and now the local farm boys and visiting cowboys were swaggering and drinking in the beer tent on a hot summer night.

The trouble started when the local Volunteer Fire Department's brat stand had a huge grease fire and burned up. The intoxicated Texans thought this was hilarious, and gave the frantic (and equally intoxicated) firemen a lot of unsolicited advice on how to deal with the conflagration.

Then the Texans began insulting the local beer and brats, and admiring the local women.

The ensuing brawl was a wonder to behold.  Those Texans were TOUGH (they rode crazed bulls for a living).  The farm boys were STRONG (they threw hay bales and feed bags around for a living).  Honestly - they were hitting each other with picnic tables.  The "security officers" patrolling the fair grounds ran for cover, as did everyone else not directly involved in the melee.

When it was over a few participants went to the Dr.'s trailer who was on site because of the rodeo; some needed stitches or whatever.  No one got arrested.   No one went to jail.  No one got sued.  No one got shot.  It was a hot time in the old town that night!

Now you hear that Israel may have supported Saudi Strikes in Yemen and that Saudi oil pumping is destroying the wealth of Anglo Oil Biz.

Seems plausible that the old Guard Anglo Rulers are losing to the Neocons. In which case it is possible that Saudi Arabia would work on a nefarious plan to consolidate more power for the neocons at the cost of US Individual Rights.

Can't argue with the logic, with 80B in open interest and only 2.7 actual, one can easily see why a fiduciary responsible person entrusted to care for a public Texas employee's pension would be concerned.  The costs to construct and maintain an official depository may be significant, but completely justifiable.  I certainly think they'll build it to hold more than 20T au, don't forget the ag and other "precious metals".

I suspect ghosts of the Hunt's royal spanking by the US Congress and their suspension of basic commodities rules continue to haunt the minds of Texans.  They have a way of "remembering".

What a huge part of this entails is that Texas will no longer have to pay them lib-uh-rul, gun-grabbin', mouth-breathers in Manhattan a bunch of money to store the (assumed allocated) gold bars which is rightfully that of the Lone Star State. Although I want to give them yankees the benefit of the doubt, yet I strongly encourage Texas to give each and every bar the x-ray treatment as the TSA does to We the Sheeple before getting on a flight, especially because of the threat given to Texas by the DHS, yet it has a very open border today. Besides, tungsten doesn't spend quite as well, and we deal with an Uncle Sam who deserved to have his Fed Res credit cards yanked away long, long, LONG ago!

I throughly enjoy skeet shooting with my real Uncle in southeastern Texas, not having to heed Uncles Asshole in Maryland or New York State who thinks they know so much more than We The People regarding our own protection. Furthermore, what guarantee do these States, including the People's Republic of California grant that I would receive prompt and fair protection from some scumbag wanting to rob me? They and the cops seem to have the guns anyhow in those areas, and that's why I'm so pleased Illinois is trying their best to force Chicagoland out of their stupor, not that TPTB aren't trying to secure their status-quo, mind you!

Tyler, I'm pleased you brought up the possibility of secession. Although I personally doubt Texas is considering this, there have been pockets of thought regarding such. Former Governor Perry even made mention of it early in Obama's tenure, although I somewhat doubt his sincerity, it was nevertheless refreshing to sense backlash, therefore to those who believe that Texas cannot again function as their own independent entity, you don't understand the Texan mentality, spare the rich history she enjoys.

Since I live just minutes from Texas, I am quite willing to declare that I would gladly defend her if she again waves the middle finger of enlightenment at the District of Criminals. Moving there is really no issue at all and would likely take less than a few days! You see, Texas is one of the few States capable of functioning as a separate nation, besides, I want badly to see the State DPS officers finally act more like the Rangers do instead of the nonsense many motorists experience on parts of I-10 and I-20. Getting the Feds out of Texas policing, particularly ridding any elements for unconstitutional civil asset forfeiture would be among the finest things to happen!

Finally, there's the lib-uh-rul holdouts, the islands therein. Houston has a few welfare recipients wanting "reparations" and Austin has their own vibe which lawmakers deal with annually. Both can be easier tolerated once the District of Criminals is out of the mix. Heaven can return to Earth, and Texas already has an Earth in it. I've been there. The smarter Californians are leaving their state in droves to conduct their businesses where it's nowhere near as regulated or expensive. Either way, they'll be speaking at least some Spanish, but much more on their own terms.

I just read something about Otto Von Bismark saying that long before the US Civil war the European Bankers wanted to divide up the USA to prevent our power from getting too great. They wanted to sell arms to both sides like the Civil War and cause tremendous debt on both sides. But they preferred to break up the USA into smaller countries and foment war continually.

Kind of an Ugly idea. Don't know if Bismark actually said that. But the Civil war and many of our wars show the ugly hand of Europeans.

A sovereign or non-sovereign can use anyone's currency they choose. Or better yet, let freedom reign, and allow the People to make the choices of whatever currency, money they choose to contract in.

Really, at the end of the road, the Market will decide which currency... Consider Zimbabwe. They use u.s currency. Argentinians use the u.s dollar under cover even though the government has harsh laws making it illegal. Most nations are multii-currency. The u.s is but does not advertise it. This way if a currency fails one can jump to another more stable currency.

What is the point of Texas seceding if not to go into a new currency other than the dollar. As you say they still might use dollars for trade with the USA.

But if the Debt, poor stewardship of the USD, and Exponential Budget Spending of the Federal Government is the main problems... surely Texas would demand a new currency or to use someone else's currency to mitigate risk brought on by the USG.

Franklin,  who with Hamilton, invented the United States, realized early on that a paper currency was essential. However, he made qualifications. (1) something of value had to support the system, ie, currency could not be introduced into the system that did not create equal "standard" (gold/silver) value, be it a house, a farm improvement, a dock,  road, bridge, etc. or anything else that is required for the food,  clothing and health of the People (the source of new value creation). (2) That each $Dollar printed must come into the economy only from the government-any interest collected above cost of financial system operations must come back to the people (a Credit System, not a debt system).

Franklin  believed that human labor was most stable of any asset and viewed a  house, a farm improvement, a dock, road, bridge, etc. or anything  else that is required for the food, clothing and health of the People to  back paper currency as certainly as gold/silver.

The only Founder  quoted was Jefferson. Jefferson was idiot concerning economics and  didn't and wouldn't sign the Constitution. Both would do well to study  the Russian and Chinese (BRICS) system and learn how to run a  Constitutional system by using gold/silver and value backed lending to back their new international currency.

OT  This news would be of interest to gun owners.  News the last few years would have people thinking gun sales are going through the roof, yet Colt has just filed for Chapter 11 bankruptcy and apparently .gov has not been ordering too many M4 and M16's.

Maybe there is a back door peace initiative going on and weapons will be relegated to humanity's past :)

Hmmm. well if Kyle Bass decided to take $1b in delivery from the CRimex  and then store it at the NY  FED he is either an idiot , or  more likely  CIA. As soon as that gold was sent from Comex to the NY Fed , it would have been immediately  been leased back to the COMEX  for a piece of paper . So in summary what Bass did was steal $1b from the Texas  retirement fund and turn it over to the FED  all the while increasing the supply of paper gold…. nice move to keep the piece capped. Now Texas is gonna get it back in a new storage facility  that they are yet to build……. yeah right.
