Moscow Furious After Both Belgium And France Freeze Russian State Assets

Russia has summoned the Belgian ambassador to Moscow and threatened to “respond in kind” after bailiffs instructed nearly 50 Belgian companies to disclose Russian state assets, a move which reportedly sets the stage for the seizure of Russian property in connection with the disputed $50 billion Yukos verdict. Essentially, Russia was required to submit a plan for a €1.6 billion payment pursuant to the ECHR decision by June 15, and because Moscow did not do so, Belgium will attempt to extract the payment on its own.

As a refresher, here’s what we said last year regarding the arbitration:

The Hague is not Vladimir Putin's favorite place today. Following the "war crime" comments earlier, the arbitration court's decision to rule in favor of Yukos shareholders (and thus against the allegedly "politically motivated" confiscation of the firm's assets by the Russian government) with a $50 billion settlement (half what was sought) has prompted a quick and angry response from the Russian government. Blasting the "one-sided use of evidence," and re-iterating the massive tax evasion that the leadership were involved in, Russia slams "the puzzling unprecedented amount of damages" awarded, claiming the process is "becoming increasingly politicized."

Here’s RT on Belgium’s move to freeze Russian assets:

The bailiffs were reportedly acting at the behest of the Isle of Man-based Yukos Universal Limited, a subsidiary of the Russian energy giant, dismantled in 2007. They have given the target companies a fortnight to comply..

 

Russia will appeal the court’s arrest of Russian property, Russian presidential aide Andrey Belousov said. According to the official, “the situation with the arrest of the property is politicized, [and] Moscow hopes to avoid a new escalation in relations.”

 

A letter accompanying the notice, reportedly drafted by the law firm Marc Sacré, Stefan Sacré & Piet De Smet, accused Moscow of a “systematic failure to voluntarily follow”international legal judgments.

The addressees included not just local offices of Russian companies, but international banks, a local branch of the Russian Orthodox Church, and even Eurocontrol, the European air traffic agency headquartered in Brussels. Only diplomatic assets, such as embassies, were exempt.

 

The situation was not unexpected, and Russia is considering a number of measures to deal with possible asset seizures both in Belgium and in other countries, said Andrey Belousov, an aide to Russian President Vladimir Putin.

 

Yukos Universal Limited was awarded $1.8 billion in damages by the Permanent Court of Arbitration in The Hague in July 2014, as part of a total settlement for approximately $50 billion, owed to its former shareholders and management. The court concluded that the corporation, once headed by Mikhail Khodorkovsky, who spent more than a decade in prison for embezzlement and tax evasion from 2003 to 2013, “was the object of a series of politically motivated attacks.”

 

Russia has not accepted the ruling, saying it disregards widespread tax fraud committed by Yukos, and constitutes a form of indirect retribution for Russia’s standoff with the West over Ukraine. 

And more, from Interfax (Google translated):

Russian institutions in Belgium, except for diplomatic missions, received on Wednesday by bailiffs arrest warrants in their possession of the State Property of the Russian Federation.

 

The document stated that the arrest is made on the basis of the decision of the Belgian Court of Arbitration of 18 July 2014 to the claim of "Yukos Universal Limited."

The specified amount of the claim in it - 1.6 billion euros.

 

Bailiffs indicate that the plaintiff has demanded such a measure, "because it has serious concerns about the possibility to receive the sum due, in particular, due to a systematic failure of the Russian Federation to fulfill handed down judgments against it and considering the attitude of the Russian Federation to the decision."

 

As explained by "Interfax" the representative offices of bailiffs' Marc Sacre - Stefan Sacré - Piet De Smet "listed in the organizations are obliged to declare within two weeks at their disposal cash, property of the Russian Federation and the debt to the Russian Federation.

 

The list covers almost all the major banks, registered in Belgium, and even organizations such as "Eurocontrol", which regulates air traffic over Europe. In it - all Russian representative, except for the protected diplomatic immunity until the Archbishopric of Brussels and Belgium ROC, including the representation of non-governmental organizations and the media.

But it's not just Belgium. France also froze the accounts of Russian companies on Thursday, targeting Russian firms run by a French subsidiary of the country's second largest lender, VTB. Here's RT again:

French law enforcement has frozen the accounts of Russian companies operated by the French subsidiary of VTB, Russia’s second-largest bank, CEO Andrey Kostin told RBC. Diplomatic accounts were briefly frozen as well, but have since been unlocked. “As of this morning [diplomatic accounts] were unfrozen… The sums are small, some dozens of thousands of euros, [but] Russian companies' accounts are still frozen,” the bank chief was cited as saying. “We are working on the problem with our lawyers now.”

And the response from the Kremlin:

“[Remove the violations], otherwise, the Russian side will be forced to consider taking adequate response measures against properties of the Kingdom of Belgium, including properties of the Belgian embassy in Moscow, as well as of its legal entities”

We imagine this will only serve to further inflame tensions between Russia and Europe amid escalating violence in Ukraine and an increasingly aggressive stance towards the Kremlin on the part of Washington and NATO.

Ukraine is going though a civil was, One faction is backed by NATO the other by Russia.

This was the inevitable outcome of the Yukos arbitration. Arresting assets (ie, seizing them based on the judgment of a court) is pretty straightforward. 

The Russians should have reduced their exposure to this a long time ago - but I suppose hope dies last in Russia. The hope that the venerated "Rule of Law" and common sense would somehow magically make a $50 billion judgment dissapear. The rule of law these days is now being used in "lawfare" against enemies of state and common sense is long sense gone in the west.

I think the west and Zionist led regime are going to take a big bite out of Russian ass on this one. Vladimir Putin has some incredibly stupid people working for him at times - the same jerk offs who loaded the Russian Government up on Fannie and Freddie Mae stock in 2006 being some of them. 

So now Putin can:

A. lawyer up, fight and negotiate in court and lose.

B. give that Jew Mikhail Khodorkovsky a few billion (as if a pardon and $500 million wasn't enough...but the Jewish Bankers smell blood and I think they go for the big payout)

C. Get midevil on them

Personally, I think he goes for A. Though it would be nice to see that Jewish gangster get what he deserves. Khodorkovsky never appreciated the fact that it was Putin who kept him alive.

Soon he will be in that rarefied air of ‘fuck it, what do I have to lose’ and I predict he comes out swinging and decides to just take Eastern Ukraine, close the borders to Russia, take his toys and go home…while doubling gas rates.

"Legal?"  I think you credit the West a little too much.  There is no "legal" here.  This is "if you are Russian we are stealing all your stuff, no matter who you are".  This is an open declaration of War.  This is the West losing all credibility as well.  Anyone who owes anyone anything as of 24 hrs ago can have all of their assets seized?  What sane person would keep anything in the West with this kind of "legal system" and response to a judgement?

Khodorovsky was part of a coordinated effort to steal Russian natural wealth after the collapse of the USSR.  If not everything that was done to disgorge that mafia was precisely legal, why doesn't The Hague get to Russia after getting to American and Israeli war crimes and terror all over the globe.

Basically, how you create a socio-political movement like Zionism, is that you use your culture's 'Trans-generational Anchors" (its Clerical Elite) as the Crystallizing Points for the movement.  In the case of Zionism, its elite Rabbis lead the movement (hand-in-glove) with its Secular Elite (Banksters/Rothschilds), since their inception in the 1890s.

In Saudi Arabia, the exact same thing has been happening via the Wahhabi clerical elite and the Saudi Monarchy for several decades.

The 'partners' thing is diplomacy, allowing for bridges to be built or rebuilt. It does not mean that Russia respects or kowtows to these 'partners'. Putin is an adult, so he sees no need to be childish and to totally block trade with the contemptable EU. Russia would be happy to trade with entities it holds in contempt providing they pay their bills.

Americans in particular seem to have great difficulty of the concept of diplomacy (the art of dealing with people you may despise without cutting off your own nose). I guess that comes from the 'shoot first, ask questions later' mentality.

The fact both the NATO powers AND Russia signed a treaty guaranteeing the integrity of Ukraine's borders is meaningless as far as Putin is concerned. Treaties are something others are obliged to adhere to not Russia. Maybe if Russia apologised for the deliberate slaughter of some 6-8 million Ukrainians and pay reperations for the land and property stolen there might be room to talk but Russians never apologize for their atrocities and G.H.W. Bush refused to hold them accountable for their crimes against humanity that dwarfed e end the Nazis.  Small wonder we have a revanchist tyranny in Moscow that feels entitled to bully and steal whatever they want. 

 

The flaws and failures of the west are what they are but none of them properly excuse Putin from looking in the mirror, seeing Stalin and liking the reflection.

Is it me, or does every headline seem to be brewing up for a perfect storm of war and economic collapse? We've had them before sure, but the timeframe, intensity and money involved feels like a denouement before the reveal. End of this month is going to be very interesting with Greece and its possible exit aftermath of derivatives tsunami.

You are absolutely correct.

I imagine the news pre WW2 are not unlike the news today, full of stories relating to military actions, new weapons, who has what, accusations, lies, schemers and dreamers.

We are on a path to war, I do not like it for one and many people don't, yet for some reason we have no say or ability to curb this onlsaught of evil as there is no other term that describes it so well.

Considering the shares and assets in question were cold bloodedly and deliberately stripped and plundered from the Russian people -the court ruling is both obscene and bizarre.

This is carrying the economic attack on Russia and its people way beyond the remotely acceptable line.

You plunder the natural assets of a country and its population and then you plunder its foreign assets when your thievery is stopped.

This is the level of global and crony capitalism - an abomination.

We need to return to the real thing.

And have respect for fairness and justice - not the law that makes a judgement as in this shocking case.

I agree 100% with James Jatras that Moscow is doing a PISS POOR JOB of getting their story out -- in the West.

They are SOOOOO frikkin concerned about appearing "diplomatic" and "professional", that they overlook the Truth 101 out via any and all means. 

1st rule of Public Speaking:  Know. Your. Audience.  Moscow, your 'Audience' are not just Russians -- no longer Russians -- but meat & potato 'Mericans.

To get the word out in the West, they need Fleet Street or NY PR types, not the Moscow-raised, well-educated, intellectual PR types.  IOW... they need a Donald Trump type of PR face -- who will use Truth to generate Headline-grabbing Punchlines and Headlines (aimed at the A.D.D. Western Audience).

Shit, even 10% of ZHers could come up with better lines than the crap/pap coing out of Moscow.  Putin needs to do an END-RUN around Obama, to get at the US audience.  FFS!
