California Mayor Forced to Hand Over Electronics and Passwords at Airport – Compares U.S. to Nazi Germany

As I was being searched at the airport, there was a Latino couple to my left, and an Asian couple to my right also being aggressively searched. I briefly had to remind myself that this was not North Korea or Nazi Germany. This is the land of the Free.

Just in case you’re still under the infantile illusion that you reside in a free country.

Stockton, California Mayor Anthony R. Silva attended a recent mayor’s conference in China, but his return trip took a bit longer than usual. At the San Francisco International Airport (SFO) this week, agents with the Department of Homeland Security detained Silva and confiscated his personal cell phone among other electronics. According to comments from the mayor, that may not even be the most alarming part.

 

“Unfortunately, they were not willing or able to produce a search warrant or any court documents suggesting they had a legal right to take my property,” Silva told SFGate. “In addition, they were persistent about requiring my passwords for all devices.”

 

The mayor’s attorney, Mark Reichel, told SFGate that Silva was not allowed to leave the airport without forfeiting his passwords. Reichel was not present for Silva’s interaction with the DHS agents, either. The mayor was told he had “no right for a lawyer to be present” and that being a US citizen did not “entitle me to rights that I probably thought,” according to the paper.

 

Evidently, Silva was well aware of the situation and only had his concerns heightened by first-hand experience. Talking to SFGate, he briefly compared the government battle on privacy to notorious dictatorships worldwide.

 

“I think the American people should be extremely concerned about their personal rights and privacy,” Silva told the paper. “As I was being searched at the airport, there was a Latino couple to my left, and an Asian couple to my right also being aggressively searched. I briefly had to remind myself that this was not North Korea or Nazi Germany. This is the land of the Free.”

This is not what freedom looks like.

ANUS, I quit flying because I withdraw my consent to infringement on the 4th amendment.  ANUS, I have not encountered an illegal immigration checkpoint in my LIFE, so I'm not going to stop driving on your say so.  ANUS, I live rural, there are no sidewalks here and in the very small towns nearby, the deputies could care less if you jaywalk.  In fact, we don't have a single traffic light in our county of 900 square miles.  

If you want to condone and support illegal search and seizure, by all means, this is a "free" country and your right, but don't give me illogic that you pulled from your ANUS.

I'm telling you, the easiest way to avoid all this is to have the electronics shipped to your destination... the key is to avoid having the following items/parties in the same area at the same time:

- you

- your electronics

- pesky border guards / TSA McAgents

remember that the stuff going on at most border entry points is basically security theater... also remember that in the vast majority of cases the laws governing mail & shipping are very different from what you encounter at a port of entry... government is a slow lumbering beast and it won't move from its spot if it's inconvenient... so, make the co-location of the above inconvenient, problem solved...

Anyone who believes in the land of the free needs to stop drinking so much. If you think about it the idea we are free  is delusional. People live in countries subject to the rules and laws in those countries and this means they are in a similar situation to slaves and prisoners at the best of times. Slaves have to live according to a set of rules, prisoners have to live according to the rules and Americans have to live according to the rules. The Land of the free is an oxymoron and should be recognised as such.

Was he under arrest?  Your point doesn't stand up.  It doesn't matter if he was under investigation.  If they thought his laptop contained illegal information,  why wasn't it searched with a warrant at his house?   It wasn't.

Hey Dumbass, does that mean that they get to take the data unobtainable by warrant and grab it because he chose to fly a plane?  THINK- They needed the passwords to obtain things unobtainable under their current warrant, if they even had one.  The data and all passwords would have been included in a warrant if they applied to said investigation...sounds like they want to railroad him and this was their chance.

I'm no fan of the TSA - but on a recent flight out of the US our boarding passes were stamped PreCheck (free without asking). That is a small step in the right direction.

Oh how times have changed.   About 20 years ago I remember flying between Hawaiian islands on Aloha Airlines.   We had a number of tickets between islands over a 3 week period.    They didn't even care if we gave them the correct ticket for the destination!!!!!  They treated all the tickets between islands as interchangeable.

This was the first time I was ever on that airline. My wife has over 2 million miles on another airline. I guess I'm used to the better level of service.

 

I didn't mention that the cabin door was already closed and the airline had no chance of making any more money on those 8 empty seats.

At the risk of belaboring the point - on the first flight of the day exit row was rather empty. When the door closed the flight attendant approached a woman in an exit row seat and invited her to sit in first class. Is theft involved in that scenario ? Is the first class seat the attendant's to give away ?

We once lived in a community in the US which has terrible water pressure. The water company came up with a solution - larger meter sizes (from 5/8" to 1"). Everyone should swap out their meters ! Then the water bills arrived, The rates for 5/8 meters were : 11.26 (water), 18.12 (wastewater). The rates for the 1" meters were as high as : 32.16 (water), 42,41 (wastewater). (per 1000 gals). Is theft involved in that scenario ?

 

Perhaps we should have asked if we could move up a row. At the same time the stewardess could have been more civil. I'll say this - that airline made no fans on that flight.

I have a flip phone.  I will throw it in the trash and not think twice about it.  It was 39 bucks with plan...4 or 5 or 6 years ago.  All data on any device is fair game to these jackboots, period.  100 miles inland from coast is a constitutional free zone by the way so you have no rights in these areas, FYI.

Keep in mind that when you get off international flights - the customs area is not considered part of the US - its considered international territory.  You do not have the same rights against search/seizure in this area as you would once you are inside the airport proper (past customs).

Even then the various federal agencies have massive power to pretty much do whatever they want, regardless of "rights." They act first then defend later.  If you persist in complaining about your rights they can threaten to "charge" you with something - drop your complaint and the charges are dropped.  There is ALWAYS something they can come up with to charge those that are difficult.

Good luck getting a job in the future if you are charged with espionage, materially assisting a terror group, transporting drugs on an international flight for distribution (oops, the dog was mistken ...), child porn (found on your phone... in their possession ... etc. Even when the bogus charges are completely dropped you now have a public arrest record ....

Actually, that's not correct. There is an exception to the fourth amendment as it relates to border searches (like SFO), and specifically as to electronic devices, which do not require probable cause/suspicion and may be conducted without a warrant.

I am not saying I enjoy the police state. I am just saying that the laws are what they are. In fact, I even wrote a tongue-in-cheek book about the police state.

i believe there is a 'reasonable suspicion' requirement. They do not have legal authority to search anyone and everyone's electronic data without some level of cause. It is bullshit nonetheless and is NOT settled law. The government cannot supercede your Constitutional rights. Fuck em.

PhilofOz, I last went to the USA from Oz in 2011. We were groped, shouted at, separated, made to get on the floor and unpack bags. Extremely unpleasant. We vowed never to return to the USA.

However, in terms of security, in 2009 when I was in the USA I had absentmindedly slipped a small multi blade foldable penknife in my bra for lack of a pocket, intending to dispose of it before boarding. It went through every security at LA and New Zealand before it fell out when I undressed for the shower on returning to Queensland. We had a good laugh! What a joke!

Good to know. If I ever travel overseas again, I will be sure to completely wipe all of my electronics before hand and start with a fresh OS install. Then whatever digital goodness I happen to acquire while overseas I will just upload to an online file sharing/hosting account (or perhaps directly into my home computer using remote access). Then before heading back home, I will wipe/reinstall again for good measure.

Hell, while I'm doing this, I may as well just buy some cheap expendable electronics before my flight that I won't mind getting confiscated...

You can also put your smart phone into the Checked Luggage, and use a basic phone while in the airport and dealing with Customs/Immigration and TSA, to send and receive calls.

If you work for a company -- even your own Single-Member LLC -- be sure to put a nice big company logo on your iPad or Laptop. The TSA won't want grief from corporate lawyers. And, as a company employee, you are obviously bound to Confidentiality Compliance, and must protect Company Property from illegal/warrant-less intrusions or confiscations.

It is perfectly legitimate and normal to hard encrypt corporate laptops, and almost foolish if you don't. I am also aware of company policy that "Password-protected and encrypted documents must not be opened under duress, unless a company lawyer is present."

It is not unusual for people to "freeze" or have transient memory lapses under duress, and to forget the password. Search the web for Stress-Induced Amnesia, if you're skeptical. Having a lawyer present helps the brain to relax and to recall things better. Of course, it is entirely possible that you may have repeated episodes of "I cannot recall", even or especially after your lawyer has arrived -- if Congressional hearings and testimonials are an indication.
