Obama Is Considering Gun Control Through Executive Order

After yesterday's not one, not two, but three campus shootings, which come a week after the latest mass killing at Umpqua Community College left 10 people dead, it was only a matter of time before the administration would pick up where it left off shortly after the Sandy Hook shooting of December 2012.

The time has arrived, and according to The Hill after Obama's failed efforts to implement any form of gun control in early 2013 fizzled, the lame duck president is preparing to do what he has been threatening to do for a long time, by issuing a new executive action on gun control.

"Obama is wading back into the divisive issue of gun control as he travels to Roseburg, Ore., Friday to meet privately with survivors and families of victims of the mass shooting at Umpqua Community College."

While not a full ban on gun sales (yet) Obama is considering extending background check requirements to more dealers, according to The Washington Post. A White House official confirmed the plan is under consideration.

As we have noted previously, this proposal is among a number of executive actions that Obama considered after the 2012 shooting at an elementary school in Newtown, Conn. Back then the idea was abandoned, partly due to objections from the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).

Still, unwilling to ride off into the sunset without imposing at least one executive order on gun control, the White House is giving the plan a second look.

At a press conference last week, a frustrated Obama said he had asked his advisers "to scrub what kinds of authorities do we have to enforce the laws that we have in place more effectively to keep guns out of the hands of criminals."

The details:

Under the plan, dealers who sell guns above a certain amount would have to perform background checks and obtain a license from the ATF.

 

Many of those dealers are exempt from the requirements now under a federal law that states people who make "occasional sales" as a hobby do not have to obtain a license or perform background checks, The Post notes.

 

The rule change would effectively help to close what critics call a loophole that allows people to purchase firearms online and at gun shows without going through a background check.

 

The president’s legal staff is weighing just how far he could tighten the standard without the regulation being overturned in court.

Like on previous occasions, such an executive order is certain to set off a firestorm in Washington, with a debate raging in Congress whether gun control is needed to stem the tide of mass shootings.

Obama's proposal is sure to also launch a firestorm on the presidential campaign trail, where Hillary Clinton, the front-runner for the Democratic presidential nomination, has seized on the Oregon shooting to put forward a number of gun control proposals, including an executive action on background checks that is similar to what Obama is now considering.

The Democratic Party's focus on guns has drawn fierce criticism from Republican White House hopefuls, who largely say mental health, and not gun control, is the correct policy response. They say Democrats are using the shootings to roll back Second Amendment rights.

Meanwhile, just like in 2012, the threat of more gun control is having just the opposite effect of what the president intends, and as we reported earlier this week, gun sales are soaring in the aftermath of the most recent cluster of shootings. In fact, "gun sales this year could surpass the record set in 2013, when gun purchases surged after the December 2012 Sandy Hook murders."

In the first nine months of this year, 15.6m of the background checks needed to purchase guns from federally licensed sellers have been processed, compared with the 15.5m applications in the same period in 2013, according to the National Instant Criminal Background Check System.

Why the surge? Simple: "Once the public hears the president on the news say we need more gun controls, it tends to drive sales,” said Mr Hyatt, who owns one of the largest gun retailers in the US. "People think, if I don’t get a gun now, it might be difficult to get one in the future. The store is crowded."

Because if you want something to be truly broken, just invite the government to "fix" it. Which is not to say that everyone is a loser - two clear winners from Obama's repeated attempts to enforce gun control are shown in the chart below.

Ah yes, the American culture changed... not to mention, people are on drugs... legal ones... which turns them into psychos. I call bullshit.  Show me WHERE you can buy a gun online and have it sent directly to you.  Even C&R (Curio and Relic) purchases require a license.  You can certainly buy a gun online, but it has to be sent directly to an FFL who will then do a standard background check before signing over the firearm to you.  This sounds like a typical Libtard "gun myth" to me .... I've never heard of any situation that allows this.

If you're a licensed dealer, you have a FFL, and you have to do background checks. So what's happening here is the usual sneakly language trick.

Someone who makes occasional sales as a hobby, doesn't have a license, and doesn't have to do background checks. You know who that is? It's not a dealer. It's anyone making a private sale. So they're trying to redefine any private sale as a dealer sale by E.O. and then using that to require background checks (which in turn, of course, is registration even though it's against the law to retain the records, you know someone, be it NSA, ATF, FBI or whoever, isn't complying with that.)

As far as the online stuff, yeah, it's BS. The only thing you can order online and have shipped to you is pre-1898 guns, as far as I'm aware of.

So this is scare-mongering as usual, and twisting language as usual, to get around those pesky laws.

I didnt even think about that. So you, by executive order, make anyone who ever sells a firearm a "dealer". So if I have a gun I want to sell to a relative or friend(or some dude on craigslist) you now have to get Uncle scam involved. But that brings up a question, if anyone who sells a gun is now a "dealer" does that mean we can now order them online and get them sent to ourselves like an actual FFL can do? Hows that gonna work?

 

People who do what you describe are few and far between, at least that i have seen. I couldn't find a single one at the last gun show I went to. Because Im with you on the whole registration thing. There is NO FUCKING WAY those are actually deleted like they are supposed to.

 

We are supposed to believe that a government that is so insanely paranoid that it spends billions on servers to steal and retain our fuckin text messages doesn't retain records of who bought guns? no way. Every gun bought through a dealer in the last, say 20 years, is cataloged in a govt computer somewhere. bet on it.

How many gun shows are there every weekend and how many of those guns displayed at gun shows are even sold?

And of those, easily > 90% are dealers, not private sales.

In my area virtually all private sales are either friend-to-friend, or (largely) stolen guns via craigslist/backpage. Pawn shops are FFLs and run the serials of every gun that comes in.

"SO while literally anyone can technically buy any gun they want online, even felons" is technically a true statement, they have to send the gun to an FFL who then performs a background check, so its pretty much irrelevent. If passing a law making it illegal to do something thats already illegal makes them feel good and shuts obama up for a while, then knock yourselves out.

And I'm sure they've gotten a response that basically says there are too many uncontrollable variables to be able to craft a scenario with a high enough probability of success.

So they go back to the think tanks and tell them to keep guessing until they come up with the right answer.

That theory might work except for the fact that there has been a chronic govenment induced shortage of ammunition for years.  I could see them starting something that makes people run through their consumables though. 

Ammo is expensive and people have to wait and nobody has done a damn thing about it.  Who is taking all of the ammo.... organizations like the Post Office.  Not only that but people are complaining of defective ammo causing barrel damage etc. 

They still have have all of the bullets they need to kill innocent people though so it's okay.

I hate to tell you this, but at least down south, it is NOTHING to have 3-4-5-6 thousand rounds of ammo in a stash ...ready to go, and I certainly haven't seen any difficulty getting ammo, although at a higher price, except for the elusive brick of 22LR.

It's just that everything the government is doing these is so screwed up that even these seemingly crazy scenarios at least give me pause to think...you know, I wonder if...

Probably too late to comment but but how much of that did you own previously (rhetorical question)?  It hasn't just been 22LR, 556 rounds, 9mm, occasionally 30-06, powder and primers for those that shoot skeet have been in chronic shortage for years as well.

There were a couple of years you had to damn near suck somebodies dick to get skeet supplies, it is a little better now.  You are only allowed so much and have to wait forever.

Seems to me that  the gun control debate boils down to three options:

1) Fully outlaw guns entirely so nobody can possess them.

2) Partially outlaw guns so only certain people can possess them,  and only in approved areas.

3) Fully legalize guns for all people in all areas, aka the old west.

 

The first option obviously doesn't work, as borne out by our not too distant past.

The second option currently isn't working either, as shown by the crazy ass pharmashooticals going off in gun free zones, or the felony convict that scored his piece to blow away his ex wife from Slick Eddie down on the corner, or the other countless examples.

That leaves the third option, and as Sir Arthur Conan Doyle wrote, "When you have eliminated the impossible, whatever remains, however improbable, must be the truth."  (Or in this case, the answer)

If option 3 is taken as self evident, then maybe we can turn our attention to ways we can mitigate the risks of full legality, ie. thru tech, education, whatever.  Wouldn't be perfect, but it'd be better than the shitty compromise we have now, that combines the worst elements of options 1 and 2.

What murders in Sandy Hook??  There is absolutely no evidence whatsoever that ANYONE was shot, let alone killed, during the "Sandy Hook" incident.  In fact, one of the kids that was supposedly murdered at Sandy Hook, little "Noah Posner", ended up supposedly being murdered AGAIN (exact same kid, only a different name) - this time in Pakistan where a bunch of Christians were supposedly killed by Muslims.  Even if one were to dispute all of this, the fact that the Sandy Hook school had been closed since 2008 due to environmental contamination (asbestos and mold) should give people a clue that the whole thing was a hoax.  Before anyone flames me on this at least do your own research . . . it should only take a second to do an internet search and see incontrovertible evidence that the whole thing was a set-up.

So I felt some research was needed and came across this from 2011.

There were over 600,000 hunters this season in the state of Wisconsin alone. Allow me to restate that number. Over the last several months, Wisconsin's hunters became the Eighth Largest Army in the World. More men under arms than in Iran . More than in France and Germany combined. These men deployed to the woods of a single American state to hunt with firearms, and no one was killed.

That number pales in comparison to the 750,000 who hunted the woods of Pennsylvania and Michigan 's 700,000 hunters, all of whom have now returned home. Toss in a quarter million hunters in West Virginia and it literally establishes the fact that the hunters of those four states alone would comprise the largest army in the world.

Standard Disclaimer: Given Obama is possibly the greatest gun salesman over the last seven years, one can only imagine how large that army is now.

Can any of you see what the broader picture is? The LAW (GCA of 1968 and amendments) is in fact an (UNCONSTITUTIONAL) extension of the (taxing) power to tax and thus regulate the movement (commerce) and possesion of an object subject to a privilege excise tax. Does no one understand how government operates under the constitution????

 

Manufactureres and dealers are ingaged in an activity that would be classified by the courts as a taxable (FFL) business/occupational privilege affecting the health saftey and second amendment rights NOT possessed by the licensee. The feds have the ENUMERATED POWER to TAX (excise) the firearm. But how is this to be accomplished? What would be NECESSARY and PROPER the achieve this end? The PROPERTY must be identified and tracked as it moves in COMMERCE to insure the EXCISE is collected at every step of the way. the BATF is an ADMINISTRATIVE agency originally under the DEPT of TREASURY. For fuck sake. SUMMARY ADMINISTRATIVE CONTROL OF THE TAXABLE PROPERTY MOVING IN COMMERCE INVOLVING A FEDERAL EXCISE AND STATE POLICE POWER REGULATION OF THE BUSINESS.  The federal taxing power is an exclusive function of the LEGISLATIVE BRANCH which means HANDS OFF to the judiciary under separation of powers. Also the taxation and summary control over the property moving in commerce PRE EMTS State police powers.

 

So ask yourself. WHY does the federal government continue the power to regulate the PROPERTY under its COMMERCE POWERS once the CITIZEN takes possession???? GO back to the federal gun control acts requirements and look at the BATF form you must fill out. TRANSFER of a firearm. WOW!!!! The term TRANSFER legally involves a taxable PRIVILEGE. Movement of a taxable item between Manufacturerer and Dealer. An ACTIVITY that falls outside the protections of the second amendment. NOW the LAW as written requires the PROPERTY to be RE TRANSFERED between DEALER and YOU under these exact same summary administrative powers that are NOT qualified by the second amendment thereby EXTENDING the FEDERAL JURISDICTION to YOU when you take MERE POSSESSION. DO YOU THINK THE COURTS OF LAW AND EQUITY GIVE TWO FUCKING SHITS WHO IS SUBJECT TO THESE SUMMARY ADMINISTRATIVE POWERS ALONG THE CHAIN OF TRANSFER??????

 

Which brings me to the Executive branch and our beloved dictator in chief. LOOK at the LAW (federal ACT) and then understand that the LAW invoves a PLENARY LEGISLATIVE POWER that the courts cannot and will not interfere with EVER!!!! A power that is NOT qualified by the second amendment. Obama looks at the language of the statute and then determines what the law allows him to do (administrative discretion) and then does it through SUMMARY EXECUTIVE ORDER. And WHAT is the function of the courts??? They look at the LAW and determine IF the executive action is within the discretion granted by the legislative ACT. Limitations of the second amendment are BYPASSED and are irrelevent.

 

YOU do not own your firearms as property is defined, understood, and protected by the courts under the protections of the second amendment period. You merely possess them and they are subject to SUMMARY SIEZURE AND FORFITURE LAWS OUTSIDE OF SUBSTANTIAL JUDICIAL REVIEW.

Yes you are close. Another unconstitutional clusterfuck created by brilliant government lawyers. The courts recognized long ago that business/occupational USE of the publics right of ways could be PROHIBITED altogether or allowed as a PRIVILEGE. The public itself, however, had an anaienable PROPERTY RIGHT in common use. For those that actually have a lawful relationship to an actual  privilege (as set forth by the courts) those that access that privilege must turn themselves and their property over to what ever regulations are set forth by the legislature as a condition precedent of that EXTRA ORDINARY USE. The power to regulate is founded on the power to prohibit therefore those regs pose a POLITICAL QUESTION UPON THE COURTS. Regulation consists of an admixture of taxing and police powers. The PROPERTY being used or employed on the publics way must be statuatorily CLASSIFIED and identified for purposes of TAXATION and SUMMARY ADMINISTRATIVE CONTROL.

So what the fuck does this have to do with the RIGHT of the PUBLIC to COMMON USE and the RIGHT to maintain absolute ownership and control over their automobiles?? Nothing, yet everything. And this is how the SCAM works. Look to your State statutes. The TITLE requirements stand separate from the licensing requirements. Under the GUISE of the police powers to reduce fraud and theft, the State requires all vehicles to be titled. The vehicle then becomes a MOTOR VEHICLE. A MOTOR VEHICLE as a matter of Law and FACT designates PROPERTY being employed or used as a TAXABLE PRIVILEGE on the publics ways. NEXT go to the States licensing Statute. YOU must have a LICENCE in order to OPERATE a MOTOR VEHICLE. Hence the STATE PREEMPTS THE RIGHT OF COMMON USE BY RECLASSIFYING YOUR PERSONAL PROPERTY THEREBY ASSUMMING EXTRAORDINARY AND SUMMARY ADMINISTRATIVE CONTROL OVER THE PROPERTY (WAIVER) AND THEN USES THAT EXTRAORDINARY CONTROL TO DECLARE YOU SHALL NOT USE IT UNLESS YOU ARE LICENSED.

 

And now the Public has NO property in the common use of its property. HOW DOES IT FEEL TO BE CLASSIFIED AND REGULATED AS A MERE TRESPASSER ON YOU OWN PROPERTY??? This IS TREASON and a BREACH OF THE PUBLIC TRUST INVOLVING CONVERSION OF PRIVATE PROPERTY BEFORE THE ACTUAL RELATIONSHIP TO A BONAFIDE PRIVILEGE IS ESTABLISHED.

 

The registration you mention is an operation of the States taxing powers that proves the tax has been paid on the motor vehicle
