Uncle CyberSam Prepares To Defend Your Internet For You
There was a time when the NSA would not know the content of this sentence minutes (or depending on the speed of typing, hours) ahead of our general readership. Those days are now gone, primarily thanks to the Patriot Act, which however merely accelerated the inevitable Orwellian destination to which American society was otherwise headed and which made constant "supervision" and "vigilance" of every US citizen a necessity (for some eyewatering details read “We Are This Far From A Turnkey Totalitarian State" - Big Brother Goes Live September 2013). There was, however, one aspect of society over which the US government did not have Chinese-type "firewall" supreme authority: the Internet. Now, as a result of an Executive Order being quietly drafted, the president of this once great country, together with the Department of Homeland Security formed in response to the events of September 11, is about to grasp supreme control over this last bastion of New Normal expression and content dissemination, naturally under the guise of protecting the people. Because as Bloomberg reports, President Obama’s administration is drafting an executive order that would create a program protecting vital computer networks from cyber attacks.
The premise: the US government needs to defend the feeble and defenseless private sector from all enemies, foreign and domestic, because, it would appear, the private sector is incapable of defending itself. And Uncle Sam is more than happy to supervise and take charge of said "defense." “An executive order is one of a number of measures we’re considering as we look to implement the president’s direction to do absolutely everything we can to better protect our nation against today’s cyberthreats,” White House spokeswoman Caitlin Hayden said in an e-mailed statement today. “We are not going to comment on ongoing internal deliberations.” Also, did we mention that the US president's decision for the greater private good would be unilaterally imposed, without the benefit of a democratic vote: after all executive orders, of the type Obama has issued 134 so far, do just that: circumvent the popular vote. We did? Good.

The draft, which remains under review and could change, seeks to implement a key provision in a cybersecurity bill that failed to advance in the Senate last month, the officials said. The administration is contemplating using an executive order because it isn’t clear Congress would pass a cybersecurity bill.
The draft calls for the Department of Homeland Security to create a council that would work with the National Institute of Standards and Technology to establish the cybersecurity standards, the officials said.
While the program contemplated in the draft order would be voluntary, the Homeland Security Department would require companies participating in it to submit reports describing how they are protecting their networks, the official said.
The lack of incentives and the requirement for reports could undermine the willingness of companies to participate in the program, the official added.
John Brennan, Obama’s counterterrorism adviser, said on Aug. 8 the administration would consider taking executive action to protect computer networks.
“If the Congress is not going to act on something like this, then the president wants to make sure that we’re doing everything possible,” Brennan said.
The pretext: Weapons of Mass Cyberdestruction. And only Obama, in conjunction with the US government, but absent a democratic vote, can prevent an all out onslaught:
Senate Republicans and business groups including the U.S. Chamber of Commerce blocked the cybersecurity bill. They said the voluntary standards would be a back door to government regulation of companies. The bill was sponsored by Senators Joe Lieberman, a Connecticut independent, and Susan Collins, a Maine Republican.
Brennan said opponents misrepresented the bill, which he said called for minimum performance standards.
“Believe me, the critical infrastructure of this country is under threat,” Brennan said, adding that foreign states and hackers “are developing advanced technologies, and we have to improve our defenses on this issue.”
Obama could accomplish many objectives of the Lieberman- Collins bill with an executive order or other directive, Stewart Baker, a former assistant secretary for policy at the Department of Homeland Security, said in an interview last month.
The real purpose:
Matthew Eggers, senior director of national security at the Chamber of Commerce, has said an executive order would be counterproductive and would show the administration wants to regulate cybersecurity.
The Obama administration is already circulating a draft presidential directive dealing with a related issue: collecting and disseminating information about cybersecurity threats. That reflects “early” discussions about how to update a 2003 directive for protecting the most critical U.S. assets and “is not close to being done,” Hayden said on Aug. 29.
In other words, it will be up to the government to intermediate in isolating and determining threats: for example... anyone with a computer and an Internet connection. And it will be up to the government to deal with said threat cleanly, quietly and efficiently.
Sadly George Orwell is long dead. But if he wasn't, we have some ideas what the sequel to 1984 would be titled.
In the meantime, we, together with various government bureaucrats, are already wondering what the first false cyberflag attack on US soil will be.

I think it is a mistake to think in terms of Democrats and Republicans anymore. While both main parties would like to call themselves the party of Jefferson in that they took their names from his party, the truth is both parties are the left and right wings of the Federalist Party. Both clamor for government control and both have grown the size of government under their tenure. The Republicans have grown the government waving the flag of security and the Democrats have grown the government waving the flag of social justice. The bottom line is that now, the Government of the United States is the biggest and most powerful going concern in the U.S. and possibly the entire world. Nothing can compete with it.
The Federalist Party was a party of plutocrats. When they drew up the Constitution, they were confident that their wealth and power would enable them and their class to control the new government. That is why they saw no need for a bill of rights. Their class did not need these protections because their class controlled the government. It was the other less well franchised that feared the growth of the federal government and the centralization of power in the hands of the plutocrats. They were the ones that clamored for a check on the reach and power of this new government.
After the Constitutional Convention, the Constitution was published in its entirety in the nation’s newspapers. It was cussed and discussed in the boardrooms and bedrooms, tea houses and pubs of the nation. Two sides formed up. Those that favored the new system and those that were against it. Letters to the editors of those papers have been collected up and are called the Federalist and Antifederalist Papers. They are worth a read to get to the original thoughts of the founders.
The Federalists came to realize that they were never going to get the requisite nine states to ratify the Constitution unless they could gain the support of some of the Antifederalists. To do that, they reached a gentlemen’s agreement that if the Constitution was ratified, one of the first orders of the new congress would be to draft a bill of rights and amend the Constitution.
The Bill of Rights was the consideration given by the Federalists to the Antifederalists to get them to agree to our current government. Everyone who voted for NDAA violated his or her oath to protect the Constitution. The Constitution that was agreed upon that established this current government no longer exists.
The Federalists in their incessant efforts to increase their power created a myth early on that the Constitution was a living document that could be folded, spindled, wrapped and mutilated to support their ongoing agenda of centralized control. With the NDAA, the Federalists in both parties have successfully written the Bill of Rights out of the Constitution.
Consider this: When you have Alex Jones and the ACLU saying the same thing, it is probably true.
The nullification of the NDAA by eleven counties is very similar to Virginia and Kentucky Resolutions that were sponsored by Jefferson and Madison. Many would argue that these resolutions were the first steps toward civil war.
The irony of all of this is that if there is ever going to be a civil war in this country it will not be over food or taxes or gasoline. People riot over food, taxes and gasoline. They wage wars over freedom. Ninety nine point nine percent of this country believes what they were taught in school. They believe they are protected under the Bill of Rights. We know that they are living under and illusion. When that illusion is shattered, there will be hell to pay. Obama signed into law a bill that gives some guy he does not know, some guy that he has never met, some guy who has not even been elected yet, the legal authority to disappear him and his family. nice post, but yr history on the drafting of the Bill of Rights is not correct. it was drafted by the New York ratification delegation. by the time the NY delegation sat down to meet, the Constitution had already been "legally" ratified by 9 out of the 13 states. however, since NwYrk was at that time the seat of the US Capital, it held a psychological trump card and used it wisely.
can't remember if the Bill of Rights was attached as a conditional clause or not (and too lazy to look it up this morning) to the NwYrk ratification, but i do remember that there is a little known clause that allows NwYrk to "legally" secede from the Union (1 of 3 states that had that clause written into their ratification).
and yes, to allude to your explanation, Article V was deliberately vague in its verbiage (thanks to AHamilton and his Boys), so that it would favor a top-down oligarchical interpretation approach vs. open, transparent rewrites/revisions from the bottom-up.
As early as April 28, 1788, Federalists like George Washington were finding it necessary to make assurances that Federalists would have no objection to a bill of rights if the Constitution was ratified.

This letter to Lafayette is a clear example of the leading Federalist giving assurances to the doubters, i.e. the Antifederalist that there would be no objection to a bill of rights on the part of the Federalists. It must be assumed that a letter like this from George Washington went a long way in calming the opposition. This letter proves that assurances were being given by the Federalists to the Antifederalists to secure their support of the Constitution. Included in those assurances was a promise not to object to a bill of rights. On its face, I would consider this a gentlemen’s agreement between the parties.

Read it several times and do not see the conclusion or implication reached by Tyler. "Aimed at minimum standards" regarding a level of cybersecurity sounds far more like regulation than spying or controlling. It is more akin to emissions standards on cars than it is Hoover-esque.
Whether private business wants more regulation is a legitimate issue, and for the government---which gets hacked plenty itself---to dictate requirements seems odd, but private companies do get hacked regularly, though now it is geared more toward theft and assessing vulnerabilities than bringing down any particular system or grid.
Is the private sector capable of policing itself? China and Russia hope they think they are already doing all that needs to be done. What about municipalities that are responsible for utilities? And what about immunizing as much as possible against EMPs and solar flares, since concern is for the infrastructure?
If the US has Stuxnet and Flame, and Iran got code from China to take control of the drone earlier this year, it is rather clear that anybody's system is vulnerable. Most Americans are all for blanket cyber-protection, so long as it is done by US companies - or in Canada, Canadian companies - not companies like AmDocs, which is a de facto branch of the Israeli government.
