Assange To Be Indicted Under US Espionage Act

Here it comes, via ABC News:

Wikileaks founder Julian Assange, the man behind the publication of more than a 250,000 classified U.S. diplomatic cables, could soon be facing spying charges in the U.S. related to the Espionage Act, Assange's lawyer said today.

"Our position of course is that we don't believe it applies to Mr. Assange and that in any event he's entitled to First Amendment protection as publisher of Wikileaks and any prosecution under the Espionage Act would in my view be unconstitutional and puts at risk all media organizations in the U.S.," Assange's attorney Jennifer Robinson told ABC News.

Robinson said a U.S. indictment of Assange was imminent.

Justice Department officials declined to comment on the possible coming charges, but earlier this week, U.S. Attorney General Eric Holder said the release of the documents had put the United States at risk and said he authorized a criminal investigation into Assange.

"The lives of people who work for the American people has been put at risk; the American people themselves have been put at risk by these actions that are, I believe, arrogant, misguided and ultimately not helpful in any way. We are doing everything that we can," Holder said Tuesday. "We have a very serious, active, ongoing investigation that is criminal in nature. I authorized just last week a number of things to be done so that we can hopefully get to the bottom of this and hold people accountable, as they -- as they should be."

Very soon, we expect that every jouranlism degree will come with a free indictment of treason and a sentence of public stoning.

Let me explain clearly why activating -- rather than abolishing -- the Espionage Act is an act of profound aggression against the American people. We are all Julian Assange. Serious reporters discuss classified information every day -- go to any Washington or New York dinner party where real journalists are present, and you will hear discussion of leaked or classified information. That is journalists' job in a free society. The White House, too, is continually classifying and declassifying information.

As I noted in The End of America, if you prosecute journalists -- and Assange, let us remember, is the New York Times in the parallel case of the Pentagon Papers, not Daniel Ellsberg; he is the publisher, not the one who revealed the classified information -- then any outlet, any citizen, who discusses or addresses 'classified' information can be arrested on 'national security' grounds. If Assange can be prosecuted under the Espionage Act, then so can the New York Times; and the producers of Parker Spitzer, who discussed the WikiLeaks material two nights ago; and the people who posted a mirror WikiLeaks site on my Facebook 'fan' page; and Fox News producers, who addressed the leak and summarized the content of the classified information; and every one of you who may have downloaded information about it; and so on. That is why prosecution via the Espionage Act is so dangerous -- not for Assange alone, but for every one of us, regardless of our political views.

(2) Neither the New York Times, the Guardian or the other newspapers apparently in possession of these materials have published them either.

Worse, these 623 ‘leaks’ were apparently cleared by the State Department itself. According to noted American civil rights attorney Michael Ratner, “In the recent disclosure, Wikileaks has only posted cables that were reviewed by the news organisations and in some cases redacted. The news organisations showed them to the Pentagon and agreed to some of the government’s suggested redactions.”

Interesting.  I checked out 2 documents on one of the mirror sites, and both had critical names of people blacked out.  I thought, gee what's the big deal, these documents talk about something everybody knows is going on but doesn't give out any names....so, so what.....how is this a threat to anyone?  Now if what you are saying is true, then these documents have been redacted by the state dept. and that actually makes the experience make sense to me.

So you're shocked by what Assange's attorney stated on Judge Napolitano's Freedom Watch last week? He said that Wikileaks asked the State Dept to review the cables before release but they declined. Yes, names have been redacted by Wikileaks, sometimes at the suggestion of print journalists working with Wikileaks. This was also clearly stated on Freedom Watch last week by the parties involved.

It's not as if this was some big secret which Wikileaks has tried to hide.

There is no bottom to the hole of distrust.  Especially when guilt by association is a determinative rule.  While "Six Degrees of Separation" does not strictly hold up to rigorous statistical analysis, the concept nontheless captures something real. 

There is no one you can absolutely trust but yourself.

Of course, if you're real honest, you can think of plenty of times when you shouldna trusted that fool, either.

What it shows Bob is the polarization of individuals into the duopoly of left and right. To Fox, Soros is mocked by Beck as Dracula himself when Soros is the only individual media owner of scale that came right out and said TBTF banks should be broken up.

This reminds me of the criticism of Warren Buffett. Buffetr calls out the gross imbalance in the tax structure favoring the rich, highlighting class warfare in no uncertain terms most publically but is villified still by a portion of the population. To me it makes perfect sense to continue investing into the stupidity of governments as Soros and Buffett do. And Soros is funding mechanisms for stable monetary system research to the tune of $100M. I have talked to many investors, the guy is the only one with true balls of his stature and putting his money where his mouth is.

Y'know guys, it's gonna be pretty lonely being the one dissenting voice on here, but I'm of the opinion that we (The United States) live in a pretty bad neighborhood (the world at large) with neighbors (not literally, but you get the point) who mean us harm - and pure transparency for transparency's sake is potentially very dangerous.  I, for one, don't really relish the idea of waking up to a mushroom cloud.  Personally, I think having a functional security apparatus, is a pretty good idea.  I do not think the wanton display of state secrets is the right way to do things.  Are there some bad actors and abuse?  Sure.  But I'll take that over a suitcase nuke in my back yard any day.  Just one man's opinion.  I invite comment (and/or junking if it is so desired)...

In this instance, I would recommend reading a little more about the rest of the world. 

Most people I have met on my travels didn't try to kill me first thing, you know.

Perhaps you've already done so, but Howard Zinn had a good view on 'Security'.  His take on American History - and indeed her 'Enemies' is worth a look.  I have no axe to grind against americans either, just mad fucks whose juice is POWER.  The UK has its own dark history too, and the Chagos Islands were the first thing I read about on my search into the unknown.  Then I read about how we like to ship things like electric shock belts to other countries as a valuable export, and the rabbit hole continues from there...

It's us (COLLECTIVE PRIVILEDGED WHITEY) that fucked up the planet, no one else bro.

Yet, there is hope: Fear of the unknown is the primary controller of man.  Trust me though, Fear ain't shit if you look it in the eye, day by day...

Try the library and see how far the rabbit hole goes...

Clayton, you sound like a reasonable guy but the cables are a smoke screen... there was very little blow-back on this story until Assange announced he had dirt on TBTF Banks. Since then, he's been hunted down like a dog... first the questionable "sex crimes" smear, now espionage?

Wikileaks did not publish the cables, they released them to other news organisations who reviewed and published as they saw fit (reportedly some cleared with government agencies first).

None of the information "leaked" was anything that our perceived enemies did not already know.  Hell, most Americans who are paying attention could deduce it.  Personally, I think it is healthy to have investigative journalists put their neck on the line to expose the truth to the public at large.  The government is violating Assange's Constitutional Right to free speech.  They are only doing this because they lost control of delivering "content" through their authorized thought cleansing media outlets.

I did junk you, because if you are willing to give up your freedoms (e.g. 1rst amendment) for safety, then you deserve neither, and will end up with neither. 

I also recommend you travel.  I have been around the world, I lived overseas quite a while, and nowhere did I find people who woke up in the morning wondering how to harm the US.  In fact I found quite the opposite...the overwhelming majority of this world is hospitable, and just trying to get on with their own individual problems in life.  They would prefer the US just to leave them alone and in peace. 

Are there bad guys "out there?"  You bet there are and you can also bet that the US has had and continues to have its share of bad guys and gals too.  That will always be the case and such is the history of the world.  Deal with the individuals, leave the rest of us with what freedoms we have left and most importantly, leave us the fuck alone.

And for my closing punch let me turn a typical saying from your line of thinking back on yourself and that is...are you ready....it is:

"what are you afraid of, if you have nothing to hide?  If the US hasn't done anything wrong, then what's the problem with Wikileaks?  Is there something you should confess?"

Appreciate the thoughtful comments of those who chose that avenue.  I don't think the world is chock full of people out there to do us harm.  It's really the bad state actors and extremists (religious, and otherwise) that concern me.  I have traveled and totally agree with the sentiment that many, if not most, cultures and peoples are warm and welcoming.  I hope the same when they come here.  I do, however, believe it is necessary that some things remain secret.  This site brings a lot of what seem to me to be anarchocapitalists out of the woodworks, and I get that.  I think we all share a common mistrust of power - I certainly feel that way.  I'd rather we live in a world where we could all just (from a nation-state perspective) get along, but, in the words of Ice T (and in an effort to keep it light), "shit ain't like that"...  Anyhoo, again, just one man's humble opinion - Happy trading and philosophizin, party peoples...

What is the jurisdiction of the US to try a non-citizen that did something in a foriegn country?  This is really reaching, and if the US pushes forward, they make a great case for any country to put war crimes and crimes against humanity charges against Bush, Cheney, Rummy, Gonzo, Muskey, Obama, Biden, Pelosi, Reid, et. Al.  Does the US really want to go there?  Or look like complete hypocrites when they say that this is different and no other countries have no right to try US citizens, but the US has a right to try any citizen of any country?

A few months later, the UK asked the US to transfer suspects the other way, the US told the UK to go f... themselves.
