FBI Busts Mastermind Criminal For Issuing Silver Currency, Demanding Repeal Of Fed And IRS; Faces 15 Years In Prison

The FBI, which apparently has no major criminals to pursue, is now busting those who are preparing for the dollar's imminent destruction. Bernard von NotHaus, head of the National Organization for the Repeal of the Federal Reserve and Internal Revenue Code, commonly known as NORFED and also known as Liberty Services (his website can, or rather could, be seen here), which since 1998 has been issuing silver coins as a replacement for the relentlessly devaluating US currency, was convicted today by a federal jury of
making, possessing, and selling his own coins. "
Following an eight-day trial and less than two hours of deliberation,
von NotHaus, the founder and monetary architect of a currency known as
the Liberty Dollar, was found guilty by a jury in Statesville, North
Carolina, of making coins resembling and similar to United States coins;
of issuing, passing, selling, and possessing Liberty Dollar coins; of
issuing and passing Liberty Dollar coins intended for use as current
money; and of conspiracy against the United States." The devious scheme for which von NotHaus faces up to 15 years jail time: "NORFED’s purpose was to mix Liberty Dollars into
the current money of the United States. NORFED intended for the Liberty
Dollar to be used as current money in order to limit reliance on, and
to compete with, United States currency."
In other words make the US currency less credible. We are confident the Chairsatan will take this shining example of what happens to "counterfeiters" of US currency to heart, and promply proceed to release another cool trillion in green 75% cotton/25% linen products, forcing US jails to promptly fill up with millions of subversive elements who no longer wish to interact with the former reserve currency.

Defendant Convicted of Minting His Own Currency

STATESVILLE,
NC—Bernard von NotHaus, 67, was convicted today by a federal jury of
making, possessing, and selling his own coins, announced Anne M.
Tompkins, U.S. Attorney for the Western District of North Carolina.
Following an eight-day trial and less than two hours of deliberation,
von NotHaus, the founder and monetary architect of a currency known as
the Liberty Dollar, was found guilty by a jury in Statesville, North
Carolina, of making coins resembling and similar to United States coins;
of issuing, passing, selling, and possessing Liberty Dollar coins; of
issuing and passing Liberty Dollar coins intended for use as current
money; and of conspiracy against the United States. The guilty verdict
concluded an investigation which began in 2005 and involved the minting
of Liberty Dollar coins with a current value of approximately $7
million. Joining the U.S. Attorney Anne M. Tompkins in making today’s
announcement are Edward J. Montooth, Acting Special Agent in Charge of
the FBI, Charlotte Division; Russell F. Nelson, Special Agent in Charge
of the United States Secret Service, Charlotte Division; and Sheriff Van
Duncan of the Buncombe County Sheriff’s Office.

According to the
evidence introduced during the trial, von NotHaus was the founder of an
organization called the National Organization for the Repeal of the
Federal Reserve and Internal Revenue Code, commonly known as NORFED and
also known as Liberty Services.
Von NotHaus was the president of NORFED
and the executive director of Liberty Dollar Services, Inc. until on or
about September 30, 2008.

Von NotHaus designed the Liberty Dollar
currency in 1998 and the Liberty coins were marked with the dollar sign
($); the words dollar, USA, Liberty, Trust in God (instead of In God We
Trust); and other features associated with legitimate U.S. coinage.
Since 1998, NORFED has been issuing, disseminating, and placing into
circulation the Liberty Dollar in all its forms throughout the United
States and Puerto Rico. NORFED’s purpose was to mix Liberty Dollars into
the current money of the United States. NORFED intended for the Liberty
Dollar to be used as current money in order to limit reliance on, and
to compete with, United States currency.

In coordination with the
Department of Justice, on September 14, 2006, the United States Mint
issued a press release and warning to American citizens that the Liberty
Dollar was “not legal tender.” The U.S. Mint press release and public
service announcement stated that the Department of Justice had
determined that the use of Liberty Dollars as circulating money was a
federal crime.

Article I, section 8, clause 5 of the United States
Constitution delegates to Congress the power to coin money and to
regulate the value thereof. This power was delegated to Congress in
order to establish and preserve a uniform standard of value and to
insure a singular monetary system for all purchases and debts in the
United States, public and private. Along with the power to coin money,
Congress has the concurrent power to restrain the circulation of money
which is not issued under its own authority in order to protect and
preserve the constitutional currency for the benefit of all citizens of
the nation. It is a violation of federal law for individuals, such as
von NotHaus, or organizations, such as NORFED, to create private coin or
currency systems to compete with the official coinage and currency of
the United States.

Von NotHaus, who remains free on bond, faces a
sentence of up to 15 years’ imprisonment on count two of the indictment
and a fine of not more than $250,000.
Von NotHaus faces a prison
sentence of five years and fines of $250,000 on both counts one and
three. In addition, the United States is seeking the forfeiture of
approximately 16,000 pounds of Liberty Dollar coins and precious metals,
currently valued at nearly $7 million. The forfeiture trial, which
began today before United States District Court Judge Richard Voorhees,
will resume on April 4, 2011 in the federal courthouse in Statesville.
Judge Voorhees has not yet set a date for the sentencing of von NotHaus.

“Attempts
to undermine the legitimate currency of this country are simply a
unique form of domestic terrorism,” U.S. Attorney Tompkins said in
announcing the verdict. “While these forms of anti-government activities
do not involve violence, they are every bit as insidious and represent a
clear and present danger to the economic stability of this country,”
she added. “We are determined to meet these threats through
infiltration, disruption, and dismantling of organizations which seek to
challenge the legitimacy of our democratic form of government.”

The
case was investigated by the FBI, Buncombe County Sheriff’s Department,
and the U.S. Secret Service, in cooperation with and invaluable
assistance of the United States Mint. The case was prosecuted by
Assistant United States Attorneys Jill Westmoreland Rose and Craig D.
Randall, and the forfeiture trial is being prosecuted by Assistant
United States Attorneys Tom Ascik and Ben Bain Creed.

From the Coinage Act of 1792  -- I've read that this has never been repealed.

 

SEC. 19. And be it further enacted, That if any of the gold or silver coins which shall be struck or coined at the said mint shall be debased or made worse as to the proportion of fine gold or fine silver therein contained, or shall be of less weight or value than the same ought to be pursuant to the directions of this act, through the default or with the connivance of any of the officers or persons who shall be employed at the said mint, for the purpose of profit or gain, or otherwise with a fraudulent intent, and if any of the said officers or persons shall embezzle any of the metals which shall at any time be committed to their charge for the purpose of being coined, or any of the coins which shall be struck or coined at the said mint, every such officer or person who shall commit any or either of the said offences, shall be deemed guilty of felony, and shall suffer death.

It was nullified by LBJ by the Coinage Act of 1965, reversing the original 1792's stipulation that debasement of U.S. Currency was punishable by death.

According to Wikipedia's page:

The Coinage Act of 1965, Pub.L. 89-81, 79 Stat. 254, enacted July 23, 1965, eliminated silver from the circulating dimes and quarter dollars of the United States, and diminished the silver content of the half dollar from 90% to 40%. This act was in response to coin shortages caused by the rising price of silver.

In addition to the above provisions, for which it is best known, the act:

  • Allowed the Secretary of the Treasury to continue to strike 90% silver coins for up to five years, until the Secretary determined there was an adequate supply of clad coins. This authority was exercised, through 1966, though the coins were dated 1964.
  • Forbade the minting of silver dollars for five years.
  • Gave the Secretary broad discretion to enter into contracts to assure an adequate supply of clad coins, without regard to public procurement laws.
  • Established a Joint Commission to make recommendations regarding coin and currency.

Yes, this is technically still the law, as the principle Void Ab Initio states that any act or law that is passed which conflicts with the Constitution doesn't need to be repealed, but simply ignored as 'void from the beginning.'  Since the Constitution still states that nothing but Silver AND Gold coin can be legal tender in any state (& Social Security Act says DC is treated as a State for SS), the only legitimate later Coinage Acts were those that changed the gold/silver ratio, not any acts that moved the US to monometallism or nonmetallism as it were.  There is no legal basis for an Executive Order to override the Constitution for generations.  In fact, since the President's primary Oath is to uphold the Constitution, if he tries to subvert it with an Executive Order, it is Congress' responsibility to impeach him and restore the Constitution.  This is my legal proof for the fact that the USA is a an unconstitutional dictatorship.  If anyone has the time and guts to sue their State for 'gross dereliction of duty' for accepting FeRNs as legal tender, go for it.

Unfortunately, the Constitution states that no STATE shall make anything but gold and silver legal tender. It does not expressly forbid the Federal Gov't from making something other than gold and silver legal tender.

You're also overlooking the fact that the constitutional federal government was declared bankrupt in 1920 thereabouts and taken into receivership by the Fed acting in proxy for international bankers, meaning the Constitution you refer to and rely upon is null and void, it no longer applies, all 50 states are viewed the same way as the District of Columbia which Congress has always had full legislative authority over with no constitutional constraints. 

It's why FRNs are legal tender in all 50 states, not just in DC.  It's why the FBI has jurisdiction in all 50 states, not just in DC.  It's why unconstitutional federal laws, which were always valid in DC, are now valid in all 50 states.  It's why federal income tax is collected in all 50 states, not just in DC.  It's why all this federal stuff applies in all 50 states, not just in DC.  It's why original state constitutions are null and void, all 50 states are now federal territories just like DC, no difference.  It's why every state name has been replaced by a two-letter federal territory code.  It's why your residence has a 9 digit federal residence ID number just like you have a 9 digit federal citizen ID number. The list goes on.

It's why "illegal aliens" who haven't become federal citizens yet and don't have a 9 digit federal citizen ID number are given more respect and treated better.  It's a sales pitch to sucker them into becoming federal citizens.  Once they elect to become federal citizens and get their 9 digit federal citizen ID number, they're just as fucked as we are.

I find it difficult to follow all the laws that the federal reserve have gotten passed for THEIR benefit.  BUT i did find a book from the 1930's that had an appendix with some of the Federal Reserve Act and there was a part that said that the Federal Reserve could charge interest on currency in circulation that is not backed by gold and silver-- so it was self interest fulfilled for this privately held corportation to push for a currency not backed in gold and silver.

It is known that all "profits" get returned to treasury from the private federal reserve corp, but 6% on 1% of all excess reserves is a price kept as their expense for operation--isn't that funny, since our 2008 crisis expecially, their balance sheet has blown up several times, so you know what happened to their government sanctioned "expenses".

The coinage act of 1792 also states that persons may bring gold and silver bullion, to be coined free of expense. If this condition is not met by the treasury then I doubt there are constitutional grounds for the charges.

I thought there was just a story about the guy in Las Vegas who handed out $300m to his family in gold.. the IRS wanted its piece but the JUdge said no go becuase Gold and Silver are not money.. so whether or not the Gentleman has fashioned Gold or Silver into the shape or with markings likely recognized as money.. the Fact that Gold and / or Silver Can Not be Money per the U.S. Law / Tax Code should weigh heavily.

 

The Department of Justice (what a fucking joke that term is as a description) will more than likely want to say this Gentleman was trying to replace the dollar / money.. I dont know of anyone.. un-educated, ignorant and / or stupid who are un-aware of the fact that precious metals are worth more than paper / linen.

 

So proving that a group of people were stupid enough or maybe more easily wanted to partake in the plan?? maybe an issue.. how many people.. Gold or Silver bug or not.. would not rather have precious metals money.. so the easy sale arguement will come up.. which opens a whole new conversation inside the Courtroom.. Look for this to be a media blacked out case.. maybe not right at the start and maybe not even for a long time.. but I would assume some portion of the testimony will be not made available in real time.

 

I could try this case (I am not ans esquire) and win easily. I stayed at a hoiday inn express last nite.

NC, UT, VA to name 3 states that I know of that have pending laws concerning legality of bullion as money in their states

 

I'll tell you what we need to do...I think it is NDakota that has a STATE BANK? The whole state PROSPERS because all interest paid to it remains in the state and supports the GENERAL FUND, if I recall correctly.

The government is taking this seriously enough to make a big splash with it. I would guess this shows that they are getting a bit worried. I wonder if it meant to be a warning to Utah and other states thinking of going with the P.M.'s as legal tender.

 I believe certain Islam nations are starting to consider a gold dinar as well.

 I also believe that the U.S. will at some point want to link the $ to the P.M.'s again, but they will do it when they are good and ready and will not allow a major power/currency to front run them. I expect this to happen at much higher gold prices and much higher interest rates.

Brings up some thoughts in my mind regarding  ampedstatus.com

Orginally, I thought ampedstatus was gpoing to be a good experiement in cat hearding and collaboration against the top 1/10 of 1% eleites and teh keltacracy lead by corporate global banking and financial firms.

After reading alot of the posts on ampedstatus and looking at some of the groups formed - I am not so certain.   

Being a libertarian at heart or at least and anarco-capitalist I think people should be allowed to find their own way forward without central planning -- having said that individuals that seek to forge legal and monetary weapons to combat the machine need to find common ground to  coordinate resources and efforts.  Is ampedstatus a social networking tool to enable this, or will it be another failed fringe forum?

Anarco-capitalist?  You may want to learn the correct spelling, and then spend some time studying living conditions in Somalia.

From what I understand, survival-of-the-fittest, anarcho-capitalism creates a really chaotic, merciless, hell-like environment that might well qualify as the single WORST social structure on earth.

Funny thing about the currency laws of the U.S., they were originally intended to prevent others from debasing or destabilizing the U.S. currency, through counterfeit or reduction of metal content.  Now they are being used to prevent others from preventing the debasement.

This is such a sham case.  Recall how long the Treasury tried to get the public to accept the Susan B. Anthony coin, but the public wasn't fooled.  Nobody who has seen a Liberty Dollar coin confuses it with the counterfeit money issued by the Treasury or Federal Reserve Corporation.

There is also another flaw (possbily) in the stautes . No currency is explicitly banned. The statute only affirms what the will recongize as legal tender it's not a prohibition.

legal tender means legal offer and there are a multude of "legal offers".

Honest money should not be denominated in dishonest, fictional terms like "dollar", "peso", "yen" or anything else.

Honest money is grams of gold, or grams of silver.

So let's see.

You can play all sorts of online games which have their own internal digital money used to buy things within the game. That money can be bought using FRN or it can be earned in-game (meaning the game developer is creating it out of thin air). Therefore, the digital alternative currency is directly competing against FRN to buy in-game goods and services (to the extent that the developers create the currency in-game and allow it to be "earned").

So my question to the FBI is simple. Regarding liberty dollars, HOW THE HELL IS THIS ANY DIFFERENT?

Nothaus should have never put a dollar denomination on his ingots.   He was getting some free publicity a few years back on another popular website and despite my warnings about this issue my content got scrubbed.  Apparently it was too important to push the guys wares then it was to give him some grassroots common sense.  If you have subordinates listen to them once in awhile.  You might save some money and a great big hassle.
