Check out this letter sent from "Foreclosure Stoppage" Attorney George Babcock to opposing counsel Mark Harmon...

Dear Mr. Harmon,

Please 
be advised  that  I have been retained by Mr. Conley  regarding  the
notice of illegal foreclosure  you mailed  to him on February 4, 2011.
The chain of title to this properly and  the note is like a walk down 
the yellow  brick road.  Is Harmon  Law the Wizard of Title? You
display  extreme  indifference to the law by noticing a foreclosure  on
this property. As you know,  I take great pride in defending my
clients  against  the evil forces that guide your actions. Mr. Conley 
is a personal friend. It is my intention to be even more pugilistic in
this matter.  It is disgusting  and  I will make sure  that whoever 
violates  his property rights is knocked out of the ring. No TKO's will
be accepted. A full  fledged,  right cross to the chin of the beast.

I
look  forward to a response although  I am quite certain  you will not
engage me as is your habit. Send your minions that  I may  lay waste 
to them before me.

I hope  that this letter  is circulated  as
has been your habit in the past. I like my enemy  to know  that I am at
its doorstep.

investigated by the state attorney general's office for allegedly
unlawfully evicting residents from bank-owned properties.

officials want to determine whether Harmon Law failed to comply with a
new Massachusetts law that protects tenants living in foreclosed homes
from eviction, a spokesman for Attorney General Martha Coakley said

Plantation foreclosure company's director quits amid investigation ...

Mark
P. Harmon has resigned as a director at the Plantation foreclosure
processing company with ties to David J. Stern's law practice, as the
Massachusetts Attorney General said it is investigating whether
Harmon's firm illegally evicted tenants from repossessed homes in that
state.

Harmon's resignation, announced by DJSP Enterprises Inc.
on Monday, comes as the beleagured company said it is laying off
another 198 employees, bringing the total to 300 within the past two

well i got back from my time in the ring and it was a bloody mess.....knew i was in trouble when the judge allowed the lawyer to be 30 minutes late and then had plesantries with him for 5 minutes....it was like a tag team, as soon as i was about to take my first swing at the plaintiff lawyers, THE JUDGE blindsided me and didnt stop punching me for 30 minutes.....she accused ME of everything from fraud, to negligence, to looking for a free house, to outright being a deadbeat (short story, i am on title, only wife is on mortgage and father who is attorney closed mortgage 9 years ago, so i guess red flags)......after fighting her and i did not disrespect her position but never once backing down, i told her it was the worst fraud ever if it took me 9 years to be here today trying to get a "free house" and the mortgage was prepared by the NOW DEFUNCT mortgage company and was written just as THEY REQUESTED (not me !!...the system sure loves to blame the little schmucks not the professionals who get paid a salary!!)....so, after her granting me that it may not be fraud afterall (thanks alot your honor)....i finally was allowed to mention the broken chain of assignments and as i went to mention the deposition of the robosigner.....she cut me off, and beat me down for another 10 minutes as told me she didnt care about any of that, its meaningless and "we people" think we can go on the internet and then come into court looking for a free house........absolutely amazing , i must say i never saw it coming.....never got to really address the plaintiffs attorney as the judge did all the talking/yelling......i am proud that i never backed down from her bias spew and then out of nowhere, she ruled MOTION DENIED AGAINST PLAINTIFF (and i won the decision.....no TKO, definately no coma knockout........a split decision at best, but a victory)......i guess even with her bias against "deadbeats looking for a free house", she must still follow the rule of property law....then as i am leaving Wells Fargo attorney asks if he can discuss this and is acting like my buddy (my gut is telling me he is playing me on a game of good cop/bad cop).......i tell him get lost, i am not interested and he wants to know why i am acting like punk...... so even though i won today, it sure didnt feel so good and i have a headache that still hasnt gone away...strange day !

Does anyone worry this will result in a delay in clearing the shadow real estate inventory, introduce uncertainty into the market, and suppress prices for an even longer period of time?  Isn't there a risk that, if precedent is set in such cases, that there might be a tidal wave of strategic delinquencies, and the debts will effectively be assumed by the Government through additional bail-outs to the banks and GSEs, resulting in us all paying for other people's housing?  Further, an important technical matter: In the confusion, could Title Insurance rates rise and availability decline to the point that it hurts young people's ability to buy a home?

I guess some here believe the bankers can be hurt this way.  Given precedent over the last 3 years, I'm not so sure.  I wonder how many of those enthusiastic about this letter are that way because it will accelerate the inevitable economic collapse (happening one family at a time already), and provide some protection to a number of victims of the collapse with a roof over their heads.  In any case, I think the net result will be to shift who is a victim, not reduce the number of victims or consequences.

Yes, of course it might grind the whole market to a halt, but are we supposed to just forget about all the fraud, that is just coming to light? It seems people want to focus on the one side of this story - the people getting foreclosed on. I really can't sit here and totally blame one side when not too long ago everyone and their mother was hounded with refis, mortgage offers, loan offers. When a loan officer tells you you can afford your dream house with this product, how the f*ck is Joe Sixpack going to know better than him - a representative of a bank? Yeah buddy you were so fucking stupid for trusting a person in a position of apparent authority.

Agreed to some extent. But its not like most people are new to getting harrased by sales people.

Most people have walked into a car dealership and were pushed twords the $40k unit with creative financing. Many people participated in the tech bubble with experts, expecially those in the media saying its "a new paridgm". Didn't our trusted Dan Rather quit is desk job to star on an internet news company that failed miserably? Many many parents have been sold on the college scholarship plan where little Johnny/Stephanie was identified as a great soccor player and has earned a partial scholarship to the local 4th teir private university that covers 50% of a $30k/yr bill. Only to find out that there is a new sports superstar comming next year for Johnnys spot. Whoops, 3-4 more years at full price if you want that degree. And you need that degree because somebody else will pay the price.

I am not a fan of Real Estate agents or mortgage brokers, but we can not make two wrongs into a "right" for lawyers to tripple dip into the moral hazard. The longer we pick this scab the bigger the scar.

Yes, all of those things will occur. Lawyers will get even richer. People that were genuinely gaming the system will have another chance to min/max the system. Those that were not trying to game the system have probably moved on to more affordable housing. Local governments will have to hire more clerks and judges, at the expense of cops and infrastructure.

As stated over and over again here on ZH. This is why america is in decline. Our biggest, drama rich, and most highly compensted industries are law and shady finance. Why would anyone tell thier kids to be a doctor, sceintist or engineer?

Let's not lose sight of the very real possibilty that many of these innovative financial products include the following:

  • Mail Fraud (state and federal)
  • Wire Fraud
  • Multiple FDCPA violations
  • Multiple state debt collections
  • Unfair and deceptive acts and and practices under state law
  • Conspiracy
  • Money Laundering
  • Fraud upon the court and/or bankruptcy fraud
  • Uttering fraudulent documents
  • Fraudulent conveyence
  • Slander of title
  • Financial institution fraud
  • Securities violations
  • Identity theft

It appears that (snicker) one or more banks (the servicers and/or trustees) do not have the proper controls in place to keep them from committing one or more of the above acts. If a national bank does not have the proper controls in place it is acting against public policy and against it's charter. It is my belief that such a national bank would be operating ultra vires or without capacity. Any of these issues (violations of law or lack of internal controls) would be SOX violations.

Unfortunately, most of those are not going to be pursuable or provable by an adverse party...  the big deal thus far in these cases have been frauds upon the court...  which are more than fair game for debtors to utilize...  (even frauds upon the debtor would not necessarily be grounds sufficient to set aside a foreclosure decree, but who wants the house back?).

We have our congress, prosecutors, and regulatory agencies to thank for the lack of pursuit...  debtors are left with fewer options at their disposal for relief...

You seem to hope that grifters are going to get free houses ultimately paid for by the taxpayers.

Just remember all you losers out there trying to get a house without paying for it. There will be plenty of us vulture investors in recourse states who will buy up those debts and come after you and any cosigners personally.

Your assets, your income, tax return, inheritance, all that will be fair game in recourse states even if the house cant be repossessed in your lifetime.

You wont be able to sell a house with conflicting claims either.

The best you losers can hope for is a few years of free rent, then me and my buddies will buy up the notes for pennies on the dollar and chase you down for as much as we can get.

I will enjoy taking your tax returns, garnishing any wages, and that inheritance you were expecting from your parents. Because that is exactly what the His Majesty's creature Babcock does in his letter.  He lies.  But then creatures of the Court (His Majesty's no less) always lie, because it is what they do.

So let us examine the letter in question to detect the first lie.

First Line: Law Office of (nope not here)

Second Line: George E. Babcock, Esquire (well not here, but George THE LIAR does explain his rank in His Majesty's Court)

Third Line: A Christian Lawyer (Ding Ding Ding) !!!  The First LIE.

And we have not even gotten past his address!

Lawyers do not exist anymore, there are only Attorneys.  The verb Attorn: "returns moneys to the Crown" tells us this creature's function.

Black's Law Dictionary: "a member of the Court with dual alliance to client and Court, when these alliances come into conflict the Attorney is a creature of the Court."  (not those words exactly! :)

So one ex-US Attorney (as they gave up being US citizens when they took the rank of Esquire) writes another similar creature a letter saying:

"Let us feast on these fools who brings us tasty legal fees and we shall also return moneys to our gang's boss."

Disgusting.  Puerile.  Non-functional.  Obsolete.  Counterproductive.  Inane and Insane.

(1) Understand what the heck is going on.

(2) Determine whether or not the present services meet your requirements.

Of course, one is always free to represent himself...  but, being in the situation in the first place, the debtor might not be prone to the best decisions...

i am jumping in the ring this friday on my own against Wells Fargo foreclosure attorneys.......broken chain of assignments 3 times, back dates, post dates , forged signatures and then i catch the BIG break and googled Krystal Hall who signed for the "bank" (apparently she became an overnight sensation when she was in a deposition admitting to all her fraud and now i get to use her sworn words in court for free) ....i am not looking for a TKO , i am looking for a coma knockout.......BOOM BOOM MANCINI !.......still i am expecting to be robbed by the "judges scorecard"
