Deutsche Bank Sues Foreclosure Fraud Expert's Son With No Financial Interest In Her Case
After
she'd been sued, Szymoniak said, she began investigating the
documentation on Florida foreclosures, uncovering alarming
irregularities, including signatures that were apparently forged. If so,
those signatures allowed banks to push foreclosures through overly
quickly, charge improper fees and assert improperly inflated borrower
debts.
Shortly after appearing on "60 Minutes" Szymoniak won a
major victory in her own foreclosure case. The court found that Deutsche
Bank was unable to demonstrate ownership of her mortgage, which had
originally been issued by the defunct subprime mortgage lender Option
One, and threw the case out.
Deutsche Bank was permitted to refile
their case if they could obtain proper documentation, however. And on
Friday, May 6, Szymoniak received a notification from the bank's lawyers
that she was again being sued for foreclosure.
But Deutsche Bank
wasn't just going after her. The bank was also attempting to sue her
son, Mark Cullen, who is currently pursuing a graduate degree in poetry
at the New School in New York. Cullen hasn't lived in Szymoniak's house
for seven years and is not a party to any aspect of her mortgage -- he
has no interest in either the property or the loan, and never has had
any such interest, according to Szymoniak.
"It is just absolute
harassment," Szymoniak said. "He doesn't own anything, for god's sake!
He's getting a masters in poetry. He not only doesn't have any money,
he's never going to have any money."

INDIANAPOLIS | Overturning a common law dating back to the English Magna Carta of 1215, the Indiana Supreme Court ruled Thursday that Hoosiers have no right to resist unlawful police entry into their homes.
In a 3-2 decision, Justice Steven David writing for the court said if a police officer wants to enter a home for any reason or no reason at all, a homeowner cannot do anything to block the officer's entry.
"We believe ... a right to resist an unlawful police entry into a home is against public policy and is incompatible with modern Fourth Amendment jurisprudence," David said. "We also find that allowing resistance unnecessarily escalates the level of violence and therefore the risk of injuries to all parties involved without preventing the arrest."
David said a person arrested following an unlawful entry by police still can be released on bail and has plenty of opportunities to protest the illegal entry through the court system.
The court's decision stems from a Vanderburgh County case in which police were called to investigate a husband and wife arguing outside their apartment.
When the couple went back inside their apartment, the husband told police they were not needed and blocked the doorway so they could not enter. When an officer entered anyway, the husband shoved the officer against a wall. A second officer then used a stun gun on the husband and arrested him.
Professor Ivan Bodensteiner, of Valparaiso University School of Law, said the court's decision is consistent with the idea of preventing violence.
"It's not surprising that they would say there's no right to beat the hell out of the officer," Bodensteiner said. "(The court is saying) we would rather opt on the side of saying if the police act wrongfully in entering your house your remedy is under law, to bring a civil action against the officer."
Justice Robert Rucker, a Gary native, and Justice Brent Dickson, a Hobart native, dissented from the ruling, saying the court's decision runs afoul of the Fourth Amendment of the U.S. Constitution.
"In my view the majority sweeps with far too broad a brush by essentially telling Indiana citizens that government agents may now enter their homes illegally -- that is, without the necessity of a warrant, consent or exigent circumstances," Rucker said. "I disagree."
Rucker and Dickson suggested if the court had limited its permission for police entry to domestic violence situations they would have supported the ruling.
But Dickson said, "The wholesale abrogation of the historic right of a person to reasonably resist unlawful police entry into his dwelling is unwarranted and unnecessarily broad."
This is the second major Indiana Supreme Court ruling this week involving police entry into a home.
On Tuesday, the court said police serving a warrant may enter a home without knocking if officers decide circumstances justify it. Prior to that ruling, police serving a warrant would have to obtain a judge's permission to enter without knocking.

It is a clear and concise (and full of lies - the first paragraph contains a half-dozen) plan to change state laws to benefit the big Banks at the expense of property rights using the Uniform Law Commission and the American Law Institute, both, "whose mission is to clarify and update state laws".
This kind of stuff isn't supposed to happen here. Unless we stand up to this our future is bleak. This document needs to be spread far and wide. The Founding Fathers warned us this day would come.
Everyone that bought a house who is no longer in that house having lost it (or given it back) in foreclosure has a nightmare story to tell about a bank (s). There are no organs of government that are looking out for us either individually or collectively no matter what you might think or how the shitheads in DC like to crow about consumer financial protection.
In my case I needed to move and could not sell after my house dropped in value to about half the mortgage principal balance. So I packed and moved, cleaned it like it was a rental, and mailed the keys back to the bank. That was May of 2010 and as of now it is still in my name, in Oregon I am legally responsible for the property till it is sold. The bank will never sell that house, at least not until the price they can get will exceed all past due payments, all fees and dues, as well as the principal, there is no law forcing them to sell it at auction on the courthouse steps, I can't compel sale. This means they have bought an insurance policy on the house for more than 300% what I paid for a homeowner policy, probably from a related company, and I can't get around that by buying insurance on a house I do not reside in.
I was notified months ago of a auction sale to be held but every month they cancel it, last month of the 140 foreclosures to be sold on the steps of the courthouse all but one was postponed and that one was at a reserve price nobody was interested in. In fact aside from me there was only one other person that bothered to show up.
I had read the advice on all the blogs, examined the laws and studied news stories about strategic default before deciding to leave, in all of it the bottom line was that if you do it you can clean up your credit within three years. But that three years starts once all is said and done and the house has been disposed of. I consulted an attorney and was told that my best option at this point would be to move back in and live there free till I am evicted, and carry my own insurance of course.
What this will do is have the effect of forcing me into bankruptcy to rid myself of the debts related to the mistake of buying that house. Once I file chapter 7 I can include any debts related to the house and bank even if they have not yet accrued, in other words the bank would no longer be able to stick me with all future costs associated with that address. At that point they will sell since from a legal point of view they will be responsible for the house and the costs. The larger problem for me and the wider economy is that if forced to go to bankruptcy court to extract myself from the games Chase likes to play I will also be forced by economic reality to dump all other debts at the same time. Three credit cards with about 5,000 balance between them, the car loan (and with it the car). From that point I can live quite comfortably on a smaller scale.
Do I feel bad for the bank, no, they were the ones that intentionally created this mess, it was they that started it by listing foreclosures so far below market price no one else in any neighborhood could afford to sell. In my neighborhood houses that had sold for over 200k in 2007 were selling for 129k in 2008 and banks were listing foreclosures in 2009 for half of that though they refused to sell them. No appraiser will bring in an appraisal for 130k or more when there are similar (or identical) units in the area for half that, they would lose their license, ditto RE agents. It is as if the banks got pissed about having a few foreclosures and so decided to get back at us by making sure nobody could sell but all would be taken in foreclosure.
And the really stinky part of it from you the taxpayers point of view? You put up the money for the mortgage in the first place, Chase did not put a dime of their own money into the deal, the original funding was Ginny Mae, but you did bailout Chase to the tune of tens of billions anyway, and my mortgage is guaranteed by USDA Rural Development so even if Chase did have some skin in the game the government will eventually make them whole. You put up the money, you bailed them out, and you will buy the house from them when all is said and done and they have racked up more in fraudulent fees for lawyers, court costs, insurance ans such than the house is worth. Do not blame me because I did not set the system up the way it is. It is my credit that is wrecked and I do not feel sorry for the banks or the taxpayers, when you have to move you have to move. Until they simply wipe the slate and force the banks to use proper accounting methods we will be in this mess, move over Japan because we are following right exactly in the footsteps of Tokyo and their 20 year depression.

I'm no lawyer, but if mom used a lot of money from the house equity to pay for the undergraduate and graduate degrees, then I could be convinced that there was reason to pursue the son for recapture.
I'm not saying that the law allows such tactics, but what is the difference if your parents borrowed against their home, and gave their kids the money, and then the parents went bankrupt? A bankruptcy court, i would think, would allow the recapture of the money, even if the kids spent it.
Maybe this is what's going on here.

Also, I do not generally agree with '4closure'. Most banks relied on electronic records of mortgages (just as the DTC does for securities) and now after the fact some municipalities are second guessing the process.
I understand the chain of title, and filings, but some of this is nonsense. It should be clear, if you are not paying your mortgage you lose the house. The banks have no problem sorting out who has rights to the mortgage.
I have a mortgage that I pay. It disgusts me that others are trying to keep a house that they are not paying for, and blaming everyone else. That is stealing.

Are you aware that the spate of quick foreclosures were mostly by the banks that no longer hold the original notes? Few have fought as hard as this person against foreclosure and you should be thanking her because she and others have exposed that many banks didn't hold the notes and were/are using fraudulent documents and what better way to launder it then to foreclose quickly to hide that evidence.

Take a look at it and then ask your mortgage holder to see a copy of the original note. If they don't match or the title transfers have not been made, you own the property. They play dumb throughout the process, even if they still actually hold the original note.
