Okay, now they have gone too far. And sorry, this is absolutely BULLSHIT.

the lies, but now you people want to mess with someone who has NOTHING
to do with what you fraudsters created in the first place.

Deutsche Bank Sues Foreclosure Fraud Expert's Son With No Financial Interest In Her Case
After
she'd been sued, Szymoniak said, she began investigating the
documentation on Florida foreclosures, uncovering alarming
irregularities, including signatures that were apparently forged. If so,
those signatures allowed banks to push foreclosures through overly
quickly, charge improper fees and assert improperly inflated borrower
debts.
Shortly after appearing on "60 Minutes" Szymoniak won a
major victory in her own foreclosure case. The court found that Deutsche
Bank was unable to demonstrate ownership of her mortgage, which had
originally been issued by the defunct subprime mortgage lender Option
One, and threw the case out.
Deutsche Bank was permitted to refile
their case if they could obtain proper documentation, however. And on
Friday, May 6, Szymoniak received a notification from the bank's lawyers
that she was again being sued for foreclosure.
But Deutsche Bank
wasn't just going after her. The bank was also attempting to sue her
son, Mark Cullen, who is currently pursuing a graduate degree in poetry
at the New School in New York. Cullen hasn't lived in Szymoniak's house
for seven years and is not a party to any aspect of her mortgage -- he
has no interest in either the property or the loan, and never has had
any such interest, according to Szymoniak.
"It is just absolute
harassment," Szymoniak said. "He doesn't own anything, for god's sake!
He's getting a masters in poetry. He not only doesn't have any money,
he's never going to have any money."

stop whining, you're lucky they didn't name your poodle as a defendant. looking at akerman's web site i think you should expect motion after motion to be filed in your case. they will research every possible legal issue and probably run up a $500,000 legal bill. seems like douche bank wants to silence you or at least keep you too busy to look at the big picture issues. did they commit widespread fraud? was there compliance withthe tax rules on the cdo trusts? i have no idea but seems like hiring akerman is rather excessive - must be a reason.
Akerman has been doing DB foreclosures for a long time. Once a big company commits massive fraud it moves "test" cases to the big boys. You should see the poor schleps that have to litigate these cases for them. Thought they were going to law school to do "big deals" and this is what they are doing - foreclosure defense. The bottom of the heap for that type of law firm. They try to win some of these test cases so they can transfer all the law they won to the other crap cases. Suing someone with no involvement happens all the time. Motion to Dismiss and then it is done. The Palm Beach courts are dealing with David Stern etc. - they are over this.....After the silly press, they will move to amend their complaint and say "no harm no foul". All it takes to sue someone is paper and filing fees. Akerman has lawyers assigned to these foreclosure cases for a reason....much of which no one seems to care about in the ponzi game of the planet.
foreclosures may be the bottom of the heap for a big law firm like wakerman but i wouldn't underestimate any law firm or large bank. if i was a high profile defendant, my computer and cell phone would be equiped with government-grade encryption software.

This is a step too far. Of course this will turn out to be an innocent mistake.
I personally would have said nothing and allowed them to make absolute fools of themselves in court. Let them present all the fraudulent documentation to back up their lawsuit against the son and then exposed them for the scum they are.

As soon as I read the article I knew some twat would comment on the poetry angle. Sorry but I find that the most intelligent and articulate ZH posters seem to have had a liberal education. They understand history, literature and mathematics. I am grateful I got a good grounding in all three.

I am sure she will do this, but she can follow Federal Rule of Civil Procedure (I'm assuming she is in federal court) FRCP 12(b)(6), or file a failure to state a claim motion and he should be out real quick. (relatively speaking-since fed court is s-lo-ow-w, IMO)
I'd follow that up with an Ethics Complaint as well, but short of stealing money from the attorney trust account or murdering a client, they rarely do dick.
