NJ Supreme Court Finds Source Shield Law Does Not Apply To Bloggers

Tyler Durden's picture

In another direct stab at the last remnant of truly independent (if often times quite incompetent) media, the New Jersey Supreme Court has just found that people posting opinions online don't have the same protections for sources as mainstream journalists. According to our secret sources at the AP, (also known as Copy and Paste), "The court ruled Tuesday that New Jersey's shield law for journalists does not apply to online message boards. The case involved a New Jersey-based software company named Too Much Media. It sued a Washington state blogger for defamation and wanted her to reveal sources she cited on message board posts." It is sad that the legislative has decided to invoke a tiering in the media world, which will most certainly backfire and bring even more eyeballs to the blogosphere, where while the bulk of the information comes in the form of CTRL+V information exchange, it does serve a critical role of being a non-conflicted (corporate advertising) source of much needed information. In the meantime, ever more blogs will find it necessary to offshore their operations (Iceland and Sweden are quite friendly in that regard) in order to avoid the encroaching US police state.

Too true! The Powers That Be are scared shitless by the direction the internet is taking. They will react. This is just the beginning. They would like to sell the internet to corporate interests and give them the same power over it that they have over CNN/MSNBC/FOX.  They would turn the net into a rubbish dump of propaganda in 5 minutes if given the power.

Social engineering is a real growth industry..........

And I hear it sells at a "historically cheap valuation."  Any pullbacks in price would be a "buying opportunity" and any such weakness would likely be very "transitory."  "Our Channel checks indicate a strong second half"  for police state industries and social engineering firms exposed to "Global Growth."  The continued "soft reprofiling" of the US dollar represents an "economic tailwind" supporting "forward earnings projections" in this dynamic new growth play.

Justice McKinnon... was flabbergasted by Adekeye's "shocking" arrest during a judicial proceeding: "It is simply not done in a civilized jurisdiction that is bound by the rule of law."

"Almost nothing in the U.S. attorney's letter was true," Adekeye's lawyer Marilyn Sandford said Thursday.

Adekeye was suing Cisco for forcing customers to buy a maintenance contract to cover future software-bug fixes, patches and updates for its operating system and applications.

He left the U.S. in 2008 and was denied re-entry when he attempted to return to participate in the litigation.

The entire incident was a planned and deliberate act (smear campaign against Adekeye) by Cisco, which prevailed on U.S. prosecutors to "grotesquely inflate" a minor civil complaint into a criminal charge requiring 500 years imprisonment.

Sandford called the U.S. conduct Kafkaesque...

actually, it's fascist

Re Google - a company set up and seeded with CIA money - see for example this article, about Google blocking search results to 'erase' and murder dissidents from the United States ... Google is obviously not what many people think, Google Inc is just a more clever part of the US censorship apparatus:

« Google Agrees to Assist CIA, Blocking Belgian Journalism Websites to Help Murder US Dissident, non-Zionist Jew, in Brussels » by Dan Hajidah

Example of site with journalism censored - exterminated - from Google Inc search results, with Larry Page's apparent personal approval to censor, destroy and assassinate another Jew who is non-Zionist ... most of the suppressed articles are about corrupt US courts and the mass bribery of the High Court 'federal' judges of the United States:

This dissident is well-known inside Belgium and has been protected by the house of Belgian's King Albert II; the royal household here helped prevent his murder by US goons.

And Americans think there is no 'use' to constitutional monarchy ...

I mean, aside from the fact that Sergy (Mr Enlightenment himself) was born in Russia to two Russian spies who we gave asylum so they didn't get hacked to death by the KGB and the way Sergy shows his appreciation is by censoring blogs and emailers on Google, and for an especially nice touch, Sergy shifts Google's profits (and jobs) to Ireland (12.5% corporate rate) who ships Google's profits to Holland who ships Google's profits to Bermuda...and the next thing you know...Voila!  2.4% U.S. corporate taxes, mom!  And mom, guess what, I might even get a $1billion tax credit like Exxon and GE! And you know what else, mom?  I'm going to get involved in politics now and the first thing I'm going to do is lobby to take the mortgage tax deduction away from poor people.  No, mom,  you don't understand America at all.  That's not changing horses in mid-stream!  But if we're ever expect get the Oligarchy going (just like the old country, mom,) we have to keep all dumb ones off-balance.  No, mom, TV isn't enough...oops!  Sorry, mom, gotta go!  It's Zbigniew calling about the Bilderberg dinner.

Don't worry about getting junked. We Christians have been getting junked throughout time, usually when the erosion of civil liberties is under full swing by despotic governments.

The sad thing is, we had centuries of people abusing the word of Christ, and acting as oppressors in its name -- starting with Constantine -- and now many people see the Bible less as the book kept from 19th Century American slaves (lest they get any wacky ideas about being equals), and more about the book that people were asked to swear apologies on before seeing if they were heavier than a feather.

Sucks, that.

Most of the courts are rapidly becoming instruments of the Kleptoligarchy with little regard to The People whom their authority comes from.

I'm not a lawyer, but from what I understand of English common/equity law (which evolved into US law?), protection of property was the main point from the get-go.  My own inference from experience is that the amount of realized legal protection is proportional to the amount of property one owns (or the capital which one holds under his sway).

I have never trusted the legal system, maybe because I've never had much money with which to buy my protection when playing by their rules.  It seems as though the courts have always been under the sway of one form of kleptocracy or another...Santa Clara County v. Southern Pacific Railroad being the ultimate example of this allegiance.

Well, if you think that Sweden is a jurisdiction that welcomes bloggers who want to remain anonymous while speaking truth to power, then I suggest that you review the actions that Sweden has taken against Julian Assange, the founder of WikiLeaks. I think that Sweden would be one of the last countries that I would trust. Norway or Denmark? Dunno. Actually, Yemen or Pakistan might be better, because their governments are so much more hostile to the interests of the US government. But I cannot trust the governments of those countries. AFAIK, ZH servers are a bit further south, surrounded by the Alps. I may be wrong, these conversations happened a while ago, and am too lazy to check. I was referring more broadly to the decision to relocate off US shores.

Assange is/was a figurehead, and a specific, publicly known human -- as such vulnerable to the classic 'honeypot' tactic. Strange how that's coming back into vogue these days... There are some very good reasons for this policy:

I am not aware of WL's servers/data being compromised -- if indeed they are a true force for good and not just another mindgame by some PTB.

I get the sense recently that the judiciary likes to promote lawsuits, as costly litigation is their bread & butter.

The best way to promote lots of lawsuits is to convince rich people and corporations (the only ones can afford the law) to use the courts to consolidate their power over others. This is not hard to do at all, all the courts need do is hand down a few landmark cases that telegraph to potential litigants that if they throw enough money at the legal system they will enjoy handsome returns.

Notice that this is a form of legalized racketeering.

The Mafia finally won.

Notice too that handsome returns is something people used to expect from their investments via the financial system. I think that as finances has become a game for chumps the smart money is moving into litigation.  I take some small comfort knowing that rich people will eventually have nobody to harass except other rich people, though I suppose I will be too busy being poor to much enjoy the show.

At least Bill Gross is sometimes a writer of interesting commentary. You Mr. Weiner are just a total bore and a perv and i cant think of any redeeming qualities you might have except a keen eye for good looking females.

Sue me assholes.

So if the woman reported the information to a "real" journalist, he would be obliged to protect her.

Maybe someone should start the Real Internet Media Journalists on Blogs. Now they are registered as real journalist independent contractors/ stringers and are protected as such.

EDIT: this is brought to you by journalist Spanish Inquisition member RIMJoB

TRO and Preliminary Injunction Granted. Who cares? Not Harmon Law. It is there intention to defy TWO court orders and foreclose anyway - June 6, 2011

STATE OF RHODE ISLAND                                                                                                                                          SUPERIOR COURT

PROVIDENCE, SC

DEREK THERIEN                                                                                                                                                           CA NO.09-6256

                                                                                                 MOTION TO ADJUDGE IN CONTEMPT

Now comes the Plaintiff and hereby prays this Court to enter an Adjudging the Defendant is Contempt of a standing Preliminary Injunction.

As grounds therefore, the Plaintiff relies on the Complaint filed with this Court on October 29, 2009. The same complaint that formed the basis of a TRO granted by Judge Lanphear on October 29, 2009 and a Preliminary Injunction issued by Magistrate Revens after taking sworn testimony on November 12, 2009. This Preliminary Injunction is still in full force and effect.

The Defendant has ordered the Transcript of the Preliminary Injunction Hearing held before Magistrate Revens. There is confusion regarding her Order and given this fact, no foreclosure should take place without the benefit of the transcript. The Defendant's view of the docket, which is clear, is myopic and self serving and in line with the Foreclosure Industries battle cry of foreclose, foreclose, foreclose, right or wrong foreclose.

This Court should send this Defendant a strong message hold it in contempt of an existing Order of this Court.

This Court should fine this Defendant an amount equal to the mortgage in question for said willful disregard of a Court Order and for its total lack of respect of the Court as a whole. This Defendant has options that cost it nothing that would not be an open insult to the Court yet it decides instead to test the mettle of the Court to stand by its own Orders and to stand by the other justices of this Superior Court.

This is a compelling case where there has been an Order entered by a Justice based upon her finding of wrongdoing in the handling of an assignment. To allow this Defendant to simply ignore her comments, ruling and Order runs against everything that the Justice System stands for.

Further, given that there has been no change in circumstances since the TRO hearing and the Preliminary Injunction Hearing, the order of the previous justices who heard this case should not be disturbed.

WHEREFORE, the Plaintiff prays this Court to find the Defendant in willful contempt of an order of this Court and that it fine this Defendant an amount equal to the outstanding amount of the mortgage which is in the area of $280,000.00.

                                                                                                The Plaintiff,

                                                                                                By his attorney

                                                                                                George E. Babcock, Esquire

                                                                                                574 Central Avenue

                                                                                                Pawtucket, RI 02861 724-1904

     Date: June 6, 2011

I hereby certify that I mailed a true and accurate copy of the within to Shanna Boughton, Esquire, 6 Kimball Lane, Suite 200, Lynnfield, MA 01940 on June 6, 2011 and via email to Shanna Boughton on even date.

The Judiciary, regulators and politicians in the US are all bought, owned and fully paid for.

You guys are fucked. Banksters and corporate America have stolen your country right before your eyes. Your constitution is bankster toilet paper.

So, if the Constitution has been negated, do the Articles of Confederation now take precedence?

I know, I know, silly question. The Constitutional Convention was a coup d'état in the first place...

in Rome it was christens being fed to the lions,in nazi germany it was every one who wasn't a part of the"master race" (at least until they needed to look elsewhere to replenish the ranks, esp. in the waffen ss) long, sad story short there always seems to be one ethnic, political or social group or another up for cleansing or re-education of one from or another. Obama and others like minded did say they found the blogosphere "troublesome" among other things, and seeing as it appears the battle of freedom vs oppression here in the US has been most hotly contested in cyber space (at least for now) one has to consider that bloggers esp. those that do not conform to the right/left scam, recognize the real criminals sit in palaces of fiat money in Washington and wall street, may be next on the block. the question is how will the independent minded, freedom loving individuals be repressed? will it be old school, labeled as "domestic terrorists" or some such then to be rounded up gestapo style and taken to those fabled fema wouldn't be hard to do, WGA and google make it extremely easy to track and record everything one does on their computer, and your iphone, android or blackberry makes you easy to find. Or will they find some new more devious and subtle levers to bend... some kind of neo-brave new world, clockwork orange re education program that turns you back into the empty consumer you were always meant to be, without the brown shirts snatching people in the middle of the night (though i think the DHS and TSA are training us to accept exactly that sort of thing even now), inconvenient publicity of slave labor camps or need to hide gas chambers. this story is just another example of the deteriorating state of individuality and freedom that exists in this country...the question is once the PTB's  don't get the desired results from the relatively more subtle, social engineering methods of repression and control they have been employing, what more direct and violent methods will they use next...whatever they decide it won't be good for us.

@Cougar_w - your namesake michael is getting out of jail in August; dark times, hmm.

@Cdad -  ... old news. Although I find it laughable that the M.I.C. is allegedly only 2.7% of GDP - more like 5-6%.

For the record - part of the Wikileaks issue is that J. Assange is not a journalist, which is part of the legal attack. Which is precisely why the chain was supposed to go Assange -> registered media (Guardian etc) -> public. People seem to forget that The Guardian did the dirty on him, grabbed the source from someone else, then started leaking without consent. Wikileaks was only ever publishing sources that had already been handled by the MSM, and so therefore was outside the juridiction of idiot Judges like this.*shrug* But believe the hype, or that he was operating 'outside the rules'. think this is bad?
