NJ Supreme Court Finds Source Shield Law Does Not Apply To Bloggers
In another direct stab at the last remnant of truly independent (if often times quite incompetent) media, the New Jersey Supreme Court has just found that people posting opinions online don't have the same protections for sources as mainstream journalists. According to our secret sources at the AP, (also known as Copy and Paste), "The court ruled Tuesday that New Jersey's shield law for journalists does not apply to online message boards. The case involved a New Jersey-based software company named Too Much Media. It sued a Washington state blogger for defamation and wanted her to reveal sources she cited on message board posts." It is sad that the legislative has decided to invoke a tiering in the media world, which will most certainly backfire and bring even more eyeballs to the blogosphere, where while the bulk of the information comes in the form of CTRL+V information exchange, it does serve a critical role of being a non-conflicted (corporate advertising) source of much needed information. In the meantime, ever more blogs will find it necessary to offshore their operations (Iceland and Sweden are quite friendly in that regard) in order to avoid the encroaching US police state.

I'm not a lawyer, but from what I understand of English common/equity law (which evolved into US law?), protection of property was the main point from the get-go. My own inference from experience is that the amount of realized legal protection is proportional to the amount of property one owns (or the capital which one holds under his sway).
I have never trusted the legal system, maybe because I've never had much money with which to buy my protection when playing by their rules. It seems as though the courts have always been under the sway of one form of kleptocracy or another...Santa Clara County v. Southern Pacific Railroad being the ultimate example of this allegiance.

The Judiciary likes to oppress, as it is their narcissistic way of holding sway.
I get the sense recently that the judiciary likes to promote lawsuits, as costly litigation is their bread & butter.
The best way to promote lots of lawsuits is to convince rich people and corporations (the only ones can afford the law) to use the courts to consolidate their power over others. This is not hard to do at all, all the courts need do is hand down a few landmark cases that telegraph to potential litigants that if they throw enough money at the legal system they will enjoy handsome returns.
Notice that this is a form of legalized racketeering.

Notice too that handsome returns is something people used to expect from their investments via the financial system. I think that as finances has become a game for chumps the smart money is moving into litigation. Now comes the Plaintiff and hereby prays this Court to enter an Adjudging the Defendant is Contempt of a standing Preliminary Injunction.
As grounds therefore, the Plaintiff relies on the Complaint filed with this Court on October 29, 2009. The same complaint that formed the basis of a TRO granted by Judge Lanphear on October 29, 2009 and a Preliminary Injunction issued by Magistrate Revens after taking sworn testimony on November 12, 2009. This Preliminary Injunction is still in full force and effect.
The Defendant has ordered the Transcript of the Preliminary Injunction Hearing held before Magistrate Revens. There is confusion regarding her Order and given this fact, no foreclosure should take place without the benefit of the transcript. The Defendant's view of the docket, which is clear, is myopic and self serving and in line with the Foreclosure Industries battle cry of foreclose, foreclose, foreclose, right or wrong foreclose.
This Court should send this Defendant a strong message hold it in contempt of an existing Order of this Court.
This Court should fine this Defendant an amount equal to the mortgage in question for said willful disregard of a Court Order and for its total lack of respect of the Court as a whole. This Defendant has options that cost it nothing that would not be an open insult to the Court yet it decides instead to test the mettle of the Court to stand by its own Orders and to stand by the other justices of this Superior Court.
This is a compelling case where there has been an Order entered by a Justice based upon her finding of wrongdoing in the handling of an assignment. To allow this Defendant to simply ignore her comments, ruling and Order runs against everything that the Justice System stands for.
Further, given that there has been no change in circumstances since the TRO hearing and the Preliminary Injunction Hearing, the order of the previous justices who heard this case should not be disturbed.
WHEREFORE, the Plaintiff prays this Court to find the Defendant in willful contempt of an order of this Court and that it fine this Defendant an amount equal to the outstanding amount of the mortgage which is in the area of $280,000.00.

People seem to forget that The Guardian did the dirty on him, grabbed the source from someone else, then started leaking without consent. Wikileaks was only ever publishing sources that had already been handled by the MSM, and so therefore was outside the juridiction of idiot Judges like this.*shrug* But believe the hype, or that he was operating 'outside the rules'.
