Obama Prepares Executive Order For Indefinite Detention

First president Obama becomes Bush in all but name with respect to his predecessor's economic policies, and now he follows by espousing Bush's interpretation of "civil rights" as well. According to Pro Publica, the White House is preparing an Executive Order for indefinite detention. And while the premise behind a comparable draft has been circulating around for 18 months, the uptake was seen as problematic. The "humanitarian" premise behind the order is that it will "provide for the periodic reviews of evidence against dozens of prisoners held at Guantanamo Bay... and allow for the possibility that detainees from countries like Yemen might be released if circumstances change." That's the theory. The "practice" is that the Order will, as the name implies, afford the administration the option of "indefinite detention as a long-term Obama administration policy and
makes clear that the White House alone will manage a review process for
those it chooses to hold without charge or trial." In other words all those, and we assume that the Order is not merely targeting those involved in September 11, and is wider in its scope, who are perceived by the administration as "high value detainees" will be denied due process, and will be held in captivity essentially indefinitely with no legal recourse, for as long as the "review process" so deems fit. As for the "theory" aspect, Politico summarizes just how much of a bold lie Obama's promise two years ago to close Guantanamo has become: "Nearly two years after Obama's pledge to close the prison at Guantanamo,
more inmates there are formally facing the prospect of lifelong
detention and fewer are facing charges than the day Obama was elected." In other words, Obama has one upped Dubya not only when it comes to Republican economic policy, but has in fact surpassed his abrogation of basic human rights. And seeing how in the aftermath of the Assange arrest (speaking of which, Julian better run following this announcement), it is only a matter of time before that whole 'Internet free speech' premise is perceived to be a form of treason, by the likes of Biden, Palin and Lieberman, potentially punishable if not by death, then certainly indefinite, lifelong detention.

After taking office, the Obama administration reviewed the detainee population at Guantanamo Bay and chose 48 prisoners for indefinite detention. Officials, who spoke on the condition of anonymity, said that number will likely increase in coming months as some detainees are moved from a transfer category to a continued detention category.

If signed by President Obama, the new order will provide added review for detainees designated for long-term detention. The order, which is being drafted jointly by White House staff in the National Security council and the White House counsel, will offer detainees in this category a minimal review every six months and then a more lengthy annual review. Detainees will have access to an attorney, to some evidence against them and the ability to challenge their continued detention.

Prisoners who have been deemed "high-value detainees," including the alleged conspirators of the 2001 attacks, have been designated for prosecution in civilian or military courts.

In 2008, Guantanamo detainees won the right to challenge the lawfulness of their detention in court. The executive order aims to create an executive branch review which would occur separately from the court review and would weigh the necessity of the detention, rather than its lawfulness, officials said.

"Perhaps the dangerousness of the detainee's country of origin could change, or the group that the detainee is affiliated with could cease to exist," one official explained.

Sorry to interject, but the humor factor of the possibility that someone would be released from Guantanamo after the CIA lowers the threat level of i.e., Yemen from burgndy to mauve, is just as powerful as that of someone stating that Bernanke will ever stop printing monetary ones and zeroes.

At the end of the day, this is merely another example of what happens when Congress refuses to play ball:

Weeks later, administration officials said the White House had decided to work with Congress on indefinite detention, rather than through Executive Order. But by the end of 2009, the White House had said it would not support legislation.

Then, in 2010, a government task force on Guantanamo completed a year-long review that placed 48 detainees in long-term detention. In its report, task force members said those detainees would be "subject to periodic Executive Branch review."

..

Jameel Jaffer, a national security lawyer at the American Civil Liberties Association, agreed that "more review is better." But he said that an executive order would only "normalize and institutionalize indefinite detention and other policies," that were set in place by the Bush administration.

While we hope we are wrong, we have this very nagging feeling that the timing and sudden reappearance of this order on the docket is in advance of one or more charges of espionage about to be lobbed at Wikileaks... And to think, all Julian Assange threatened to do was to take down Bank of America, something that should have happened over two years ago if that whole 'free market', risk/return thing was even remotely close to what it is taught to be at various ivy draped business schools.

VI, loss was all around in those days.
Here in India, during the british brokered "partition" of India, many millions of lives were lost.
All to "maraudng" bands of "vigilante" hindus or muslims, depending on which side of the story you wanted believe.

Millions died, far more than even the biggest hollow-cost claims.

My family is exactly half from the now Pakistan side and half from "original" India.

And my mother, father, uncles, aunts, all saw it first hand, live, border crossings, lynchings et. al.

And yet no two can corroborate a story, yet they can perfectly corroborate their hatred for "muslims".

I hope that tells you something. Family histories are just as given to distortion as national ones.

At various times, I've seen you accuse many of hate for pointing out what are really "hate facts."  Those being facts that run against what is politically correct to say, which expose said as a lie or a sham.

I think we figured out you were a jew quite awhile ago...no revelation here.  However, you seem to be quick on the draw with the racist tag when people simply state facts.  It's always as if there must be some agenda lurking.

As you know from your clan-history, the tribe has been run out of every country they've ever been in.  When the entire world dislikes you, is it really everybody else?  I mean, I am highly disagreeable at times and I have never once characterized dislike of me as others' problems.  It's not the rest of the world, it's me.  Sure, perhaps I am misunderstood and not malicious, but seriously...

I've had this discussion with other jews and been told that white people just have an anti-semitic "kink" in them.  This level of self-deception is mindblowing.

I don't really have time to address this fetish with "hate" and I put that in quotes because nobody can really define it.  It's whatever you say it is.  "those who hate," is a kind of a STRAWMAN.  It is really rather clever in its lack of intellectual rigor.  Especially because it cannot be disproven.

Am I a hater?  You can say I am...how can I demonstrate that I'm not?  I cannot anymore than I can prove I am not a racist.  Recognizing this, I just laugh at people who toss these nebulous terms about.  They are intended as nothing more than cloture tactics in the face of hate facts.

Thank you for giving me your time, trav.  And, I defer to your intelligence.  In a war of words, there is no doubt you are the stronger avatar.

Also, you are right about my continual jump in to the "Jewish" fray around here.  I've overplayed the message.  It's going to be lights out for the VI regarding this topic. 

I am a person, who, for whatever reason, has always looked for injustice/unfairness.  I have always stood next to anyone who was on the wrong side of an attack when they didn't deserve it.  Call it what you will, but that's me.  It's the reason I enjoy ZH.  The reason why I have made it all too obvious that I am Jewish.  I'm looking for the people in this world who perpetuate unreasonable injustice, unfairness, et al.  Drawn to them.  Hope to embarrass them - have done worse.  It's the reason I get people to clarify their position whenever the "J" rhetoric starts around here.  Everyone who listens to me knows this.  It's my game.  So, on we go.

The klan were haters.  The modern day version white supremest groups are the same.  The list is endless, really.  Race, religioun, sexual orientation, culture, et al, have all suffered at the hands of "hate." You really don't need a definition for hate, trav, you know what it is.  It's not some meaningless word.

I'm proud of my people, trav. And we don't need to debate what the definition of "people" are in the Jewish context.  You and everyone else who have read my posts on the subject know where I stand. 

Are there Jews who are an insult to the people who call themselves Jews?  Yes, without a doubt.  You name a religion, culture, race who can't say the same.  I'm just a person who loves my Jewish heritage, trav.  And probably not the best example, btw, as i do consider myself a religious atheist.  That being said, most Jews, whatever level of faith/tradition, feel a kinship towards each other.  And we don't have a lock on kinship, btw.  Another obvious example would be Italians - the list is endless.

I have always been drawn to some of what you say, trav.  Partly because what you have to say makes sense, but also because some of your statements appear to have a distinct undertone.  I use the following as an example (with my reply) below.  Not the best example, but those, like me, who see you as having your own agenda, buried within an opinion, will recognize "it" too:

I missed the number of junks when I moved my post over, btw.  To be fair, there was one.  Anyway, trav, who are you, really? I sort of envision you as a person who has somewhat of a "supremacist" lean.  IMO, you mix common sense with something else.

My mother’s grandparents their child and a brother of my great grandfather made it out of Poland.  No more.  My immediate family lived in Warsaw.  I don't know which camps they were interned to. I'd rather not volunteer my age, but I think you get the picture.

I would like to go into this with village idiot , if would indulge me some about it.  What exactly does it mean when someone says they are a jew?  I am a questioner. I ask questions. I am also a Christian and believe me, there are many questions I have about all of that subject as well.  To me, every subject is open to discussion due to the fact that our history as we have been taught it, is full of lies and deceit. Ever since I woke up the fires inside of my mind have burned brightly, never to be extinguised again by nonsense. If only every American was like this. For me, the path is clear. I will continue searching for real truth, in all of my ways. My family has pretty well rejected me and cast me out, my friends laugh at me and say that I am crazy but these actions happen to those who dare to ask the questions and discuss the issues that need to be discussed, the issues that make ears itch and people feel unconfortable and insecure. I have heard men talk who are in their 60's and 70's about truth, having known it since they were young. Can you imagine it? Being rediculed and scorned your whole life, trying to tell people what is really going on and now you are in your later years of life and still going strong. God what men these are. I salute them.

So I should not be upset because why?  This order would give force of law to the willful abrogation of another's God given rights.  Sorry, I do not care who it applies to, or who is enforcing it.  All I care about is that we can now sleep warm in our beds knowing that some others might be whisked away to God knows where, never to be seen again.

3 - The reason why Soviet Red Army invaded Afghanistan at the end of  1970s can be shown that it was not for the purpose to capture the territory for any gain other than to create artificial legend for the upcoming "democratic" Russia that Russian "former" communists have nothing to do with Islamic terrorism and that these are fully "independent" operations of the Muslim terrorist groups and states, including Iraq, Iran, Syria etc. Russian and Chinese involvement must remain hidden, for if it was revealed and recognized, communists would lose their much needed element of surprise [as for example the old Chinese military strategy Sun Tzu directs.]

4 - It is clear that just based on the deceptive background of these various strategic operations, including the major Soviet - Russian communist deception and long-term fraud called Perestroika, Russian "former" communists cannot be possibly seen behind anything that harms America, including the 9/11 attack.

5 - The organization of the entire "Islamic" terrorist network, including all terrorist groups of the KGB founded PLO [Hamas etc. - Yaser Arafat was a KGB long term agent, another such comparable Moscow asset is Libya's Muamar Qadaffi], is too perfect and too well organized which doesn't suggest that some "horseback riders" of Al Qaeda are capable of keeping themselves organized, supplied with weapons, intelligence, logistical support and a good level military training. The state sponsorship behind such groups is visible - but which state is behind it [Russia, China etc.] escapes most western analysts.

6 - The western [flawed] thinking, not accustomed to communist evil practices, disables beforehand any recognition of any long-term communist planning and operational strategy. [Russian, Chinese etc.] Communist "word of honor" is accepted, also based on the materialist western doctrine that as long as these "no longer communist" countries can produce cheap products for the West, they have no other intentions other than to be economically competitive with the West. This totally naive assumption does not take into account the criminal nature of these communist regimes, their strategic planning and their full long-term commitment to implement communism around the World.

7- It is clear that the Soviet-Russian communist long-term strategy is working. Without recognizing that America and the West were fooled by these communist criminals, there will be no recognition of such strategy and of any background of the upcoming "Islamic terrorist" attack on America.

8 - Various state sponsors of terrorism are available to the Russian communists so they can skillfully "present" these states to the World as the "true culprits behind terrorism" using Russian moles within the U.S. and other western intelligence, law enforcement, government and media entities. To deny that such people exist is to deny the goals of communism also - and that is precisely what has happened, and what will be the stumbling rock of the West when the hour of truth approaches.

Not only is Obama backed by all of the above, George "Goldfinger" Soros, owns the entire democratic party. None of the progressives want to admit their party has sold out to the uber-capitalists.

They look the other way when you tell them $2 billion from US taxpayers went to Soros for offshore Brazil drilling, but applaud bans on us offshore drilling and jobs. And Bamm got more $$ from BP than anyone -- and BP got their enviro short cuts.

We're captives and economic serfs. If government now controls 50% of the economy and the financial industry now controls 30% that is only 20% for the rest of us. And the point has been made that the financial industry pulls the levers of government, so they really control 80%.  We're back to the Money Trust Monopoly days where it all started at the turn of the century.

yep, declare war vs. nation state.  That proved to be a loser v. U.S.A., so the experiments started: korea, lebanon '58, veetnam, fricken lebanon again, granada, etc. all kinds of testing, 'till the current mess.

any way to declare war on "the base"?

Hague and Geneva and predecessors and sucessors were put into place when it was important that "we'll not hurt you and you won't hurt us" in defenseless (hors de combat) situations obtained.

So, Hg, riddle me this: how do we do such basic treaties when the other side will strap on C4 or any plastique and walk into a Train Station or a ... ?

Isn't ISRAEL considered a policy state, too ?   & why are there so many jewish people working in our Federal Government ?    If I didn't know any better, I'd swear we were being infiltrated from within to try to make our country a police state just like in Israel !!    Is this all in my 'conspiracy theory' imagination or is it real ?
