US Request To Delay Lifting Of Deepwater Drilling Ban Denied, Judge Feldman Gives Salazar 30 Days To Comply With Lift Of Drilling Ban
Judge Feldman refuses to budge, and get this, gives Ken Salazar (aka the President) 30 days to comply with overturn of the the drilling ban. HopefullyFeldman ends up being a more firm version of Judge Rakoff, who folded like a lawn chair under Christina Romer's sturdy derriere to the administration's demands in every matter. Full filing attached.

Perhaps the president is gonna make him quit his job too?
--- you ever notice how nobody ever acted this way to Cheney...
You mean former President Cheney?
They did and were quickly silenced. In fact, they still are. It's just that the Ponzi is coming apart at the seems and leaks in the dam are appearing faster than they can be plugged.
I wish Judge Feldman good health....
...and tight fitting Kevlar.
Great,
someone finally exercising THEIR authority.......BHO just got a a Flip Off.
Just hope someone from the Chicago Thugocracy doesn't break off the flip off.
just another pimp†
United States Senator from Colorado from 2005 to 2009
In 2004, Salazar declared his candidacy for the U.S. Senate seat being vacated by retiring Republican Senator Ben Nighthorse Campbell. Salazar considers himself a moderate and has at times taken positions that are in disagreement with the base of his party — for example, he opposed gay adoption for a number of years.
how utterly stupid of a stance. shows how sick some of these focks, really are. concerned about gay adoption. holy heck batman, he is in charge of the U.S. Secretary of the Interior.
i quit.
Salazar won the senate seat by being in the right place at the right time. He wasn't a particularly good candidate (his election was almost an accident). He's not a moderate, he's leftist.
Further, he's actually not a very bright person. We're talking "IQ", or "book learning", or "adept at working a room" or "full of common sense". Listen to him talk. He's slow, and doesn't use big words, or uses them incorrectly. He doesn't sound very smart. That's because he's not: He is literally incapable of reading multiple facts and coming to an independent conclusion.
Still, his Momma is proud, so good for him.
The Salazar family goes back 500 years in this state and has big support east of the divide. He and his brother both got elected by the lefties in metro Denver, and a hispanic coalition put together by a Bishop in Pueblo who thinks he's running a modern version of the Underground Railroad.
Both are going to be out of office soon.
Ah, a fellow Coloradoan... I feel your pain.
The only thing more asinine than the Salazar appointment was Obama's hand picked replacement for that seat, Senator Bennet. He preaches sane fiscal spending, but in reality he votes totally in line to Obama's wishes. If Salazar's a pimp, Bennet is a prostitiute.
Don't quit, velobabe... the fun is just starting.
Well this will show how independent law is from a criminal network. Good luck Judge Feldman.
How long before someone "follows the money" from big oil to Marty Feldman? This is about 33 deep water wells folks... there are thousands of others in the gulf not affected by the ban.
More shamefull, bankster backed corruption... supported by the ZH community... curious indeed?
It's about setting a precedent. Win the one case involving 33 wells and the rest will follow. Lawyers need a case to cite.
Setting a precedent?
Bullshit... it's about defending big oil, and the oligarch's that profit from it (including billions in corrupt government handouts)... nothing more, nothing less!
Wake the fuck up... you have a President that stands up to these thieves, and you "drink the right wing kool aid" and defend the perpetrators of the worst ecological disaster in history!
Your president is a joke. The blue collars dont like him, and the white collars not much better. Good luck with your socialist life coming in 2011.
Both of you are acting exactly how TPTB want you to act. You stay divided and close minded and in affect keep this bullshit democracy moving. There is no left, there is no right, there is taxpayer raping and that's all. So they divide you and others and obfuscate the real issues. We stand together and change or we stay divided and let them continue to apply minimal vaseline before they bend us over...the power resides in numbers

excuse me but fascist
"you have a President that stands up to these thieves"
bwwwhahahahahahaha! +1Billion Barrels
It's about the rule of law. Plain and simple.
Arbitrary, absolute, and unlimited power should be repugnant to everyone.
Do you really believe it will only be used by "the good guys" against "the bad guys"?
Will you be just as happy about it when a Republican has that unlimited power?
"Necessity is the plea for every infringement of human freedom. It is the argument of tyrants; it is the creed of slaves." --William Pitt
RS,
+10
The real issue.
When you learn who has unlimited and absolute power you will understand you've been duped, and are supporting the wrong side.
Yeah, it's all those rich white people that are all corporatey and stuff, right?
is that you Sarah?
Is that you Janeane Garofalo?
A President that stands up to thieves? Our President is the Thief in Chief. It's about not allowing the Federales to trample our rule of law based on their ideology, whether it comes from the right or the left.
You need to do a better job of seeing the forest from the trees, my friend.
Do you fucking drive a car??
then this is about YOU TOO.
BP is not down there to ruin the fucking environment, they are down there to PUMP OIL. Every barrel going into the GOM is a barrel not going towards their bottom line.
so sad...
More shamefull, bankster backed corruption... supported by the ZH community... curious indeed?
First of all - shameful only has one L
second, what alternate reality are you from?
OK... you broke the code (we have a Wynner)... the second one's for liberal!
What do you say then about the Obama administration giving 2 billion for Brazilian deep water wells ?
Follow Glen Beck on the story...
http://www.youtube.com/watch?v=JEsQYZ6kT6A&feature=player_embedded
Not saying Beck is onto all the facts , but there is an agenda.
Follow Glenn Beck on the story... nuff said!
Why don't you guys just admit you a bunch of racist bigots, that will not calm down until you get a white leader? Palin / Beck in 2012... that should fix everything!
Is that really the extent of you debating skill?
"If you disagree with me, you are a racist and bigot."
Aim high there buddy.
"Aim high there buddy"
Your hero Beck has been getting filthy rich pandering to the racist bigots of America for two years now... I don't think he's done a show without calling your president a Nazi and worse.
Sometimes you fight fire with fire... you can't debate civil discourse with a group that doesn't know the meaning of the words.
Obviously written by someone who had never actually listened. Only been told by others what Beck says.
I don't give a shit about Glen Beck. Turn off your TV and read a book.
Don't you understand that they're all on the SAME TEAM. You remind me of the people who think professional wrestling is real.
If you can't have a rational discussion on a conceptual level without resorting to race baiting, you're really just a little pissant douche.
The adults are trying to talk here.
Maybe Segestan is disagreeing with the white half. Is he still racist? Read carefully - it's a trick question.
EP,
There is no white half. If you are not pure (white), you are black... society says so!
The trick part of the question was simply the part about the disagreement. You simply charged someone with racism for not liking the way someone is running the country. I guess by that logic, those who liked neither obama nor clinton during the primaries were both racist and sexist.
Two questions:
1. How "white" do you have to be in order to be "pure white"?
2. Does your having no clue what anyone's race is on this forum, does that change your charge of racism? Why or why not?
My pleasure,
1. That was answered in my previous comment... and that is societies answer, not mine.
2. My position is based on the organised (Beck, Hannity, Rush, The Tea Party, etc) opposition to the Obama presidency from the day of the election... they didn't even wait for the Inauguration. I have come to the conclusion that this right wing power element is purposely feeding the racial tendencies of their "base" for political gain (and IMHO that is despicable). The race of anyone commenting on this site is irrelevant.
Are LaShawn Barber and Star Parker racist for disliking obama? What about Thomas Sowell? BTW they didn't wait until the inauguration to criticize obama either.
If the race of anyone commenting on this site is irrelevant, then you should have no problem retracting the accusations of racism. I mean, really, let's just assume all comments against obama are from blacks, and then there's no need for calls of racism, fair enough?
Ok.. I gave you a chance.. Fuck You!!
that you Denninger?
Hey, what's up?
Get rid of all the "[Color]" this, and "[Color]" that.. starting with the "[Color]" caucus ,the [Color] Entertainment Channels , the [Color] national organizations, and become AMERICAN'S first and some [Color] (if you so desire to continue to label yourselves) second. A lot of us are tired of the race baiting and [Color] people bashing. You are American FIRST or you are not. This president has been nothing but "EPIC FAIL" since day 1. And just to deflate your "Booooooosh" retort, Bush was a fascist, prick and I'll never forgive him for the patriot acts (which Obama extended, mind you). So go stick your race bullshit up your ass sideways.
UGrev,
Truly noble sentiment... and I mean that.
But (yes, here it comes) why is it that the groups (Tea Party, etc) that are passionate about their objections to minority support initiative organisations are 99% white?
Could it be because the minorities are for the "Minority Support Initiative Organizations", which do everything to benefit them and continue their segregation and isolation from calling themselves Americans furthering their racism towards those of us who would rather welcome them as brothers and sisters if they would just realize that handouts are absolutely destroying them and making them dependent upon the very social class that they despise?! .. hmm.. twisted indeed..
It could... but do you really think they would be necessary if minorities were really ever "welcomed as brothers and sisters" by the majority of society... it's a "chicken or egg" thing, isn't it.
Unfortunately, there are a lot of trav7777s out there (see below).
We've been ready for quite some time. The onus, I believe is on the minorities to realize that the "elites" have dug their leech-claws into them because they made themselves a target of the welfare mentality by relying too much on the gov't to make the choices for them and force "choice" on others "or else". I just couldn't imagine the outrage the [Color] community would have if White people started matching (1:1) the organizations that existed for the [Color] community. Riots would ensue. It's your turn to step out of the box and start telling gov't "We can do it on our own, thank you".. do you really think you can't? are you that "down" on yourselves? seriously.. don't let them bull-ring you like that.
There's no reason that it can't be done.. but you have to realize that it's not going to be a fast train. It took my family 3 generations to a good grounding. time and patience, brother.. time and patience... and a whole lot of "Thick Skin". I still get the Mafia jokes because of my last name.. but I laugh with them and defuse them. I refuse to let them control me by using my own anger against me.
Very well said UG... I'm sure your (and family) experiences give you the compassion you have for other minorities. Unfortunetely, a once in a life time opportunity (a black President... something no one could of even dreamed of just a few short years ago) has been railroaded by the far right (for political gain)... by feeding on the bigotry of many of their base supporters... that's just sad.
I can't and won't deny that bigotry as you describe it doesn't exist, but it exists and persists in all parties. The conservative right has been lambasted by the progressive left just as much. It does go both ways. People like Jesse Jackson and Al Sharpton have point-manned efforts to make all white people in the tea parties out to be racists. It's just as unfair and just as sad; I'm sure you'll agree.
We need to shed ourselves of these types of people that seek to subdue us with mis-information, bigotry for their own benefit. For the record, I am a "tea party" member and a registered independent.
One thing you need to understand is that white people, more so than ever before, have been painted black. Obama's election has been rubbed in our faces even though a great many white people voted for him. This is where racism gets tired. Trust me.. if white's were as bigoted as claimed, Obama would have never made it to the ticket.
The ball is in your court now... what are you going to do with it?
Sir, do you believe for one minute that Barack Obama would have had any chance of being nominated on the Republican side... you know the answer to that! How about we email the White House to see if we can "borrow" the Rose Garden to "have a beer" together and sort these issues out... how could they possibly turn us down... lol!
If I may get back to the point at hand, it is the cynical pandering to the bigoted views of many of your fellow Tea Party members by the right wing leadership, for political gain, in spite of the irreparable damage to race relations in America, that I find most offensive... no, it is disgusting!
Thank you for your thoughts... and cheers!
As I mentioned, the pandering is done in both parties for the same purpose. I don't like it anymore than you do. Perhaps, some day, people like yourself (and myself) will outnumber "the other guys", and we can finally move into the future.
Because minority communities expunge dissenters from their ranks, considering it treasonous no matter how reasonable the idea of true freedom is. Would you like some milk with those oreos?
If you are black, tell all your friends that maybe the patriots are onto something with this small government freedom stuff, and see how many lashes your ideological masters give you.
In any case, why would anyone think that any minorities at all are in the tea party movement, since the media pick and choose their footage to purposefully bleep out any minority presence? By news report standards, there would appear to be only .01% of the movement, if that.
TOTALLY!!
Try to look at race from a genetics standpoint. Everything I've heard on the subject seems to point to the fact that there is no meaningful difference among races. It's more of a social construct than an actual thing.
fuck you and the black dildo you rode in on

Obama has "executive order" as his last resort via "national emergency," which is by no means legal either but seems to fool the pups.
He doesn't have the balls to do that.
No, but stupidity outweighs "ball" size with this President.

Though probably played. Obama wants that oil, he just does want to look like he does.
There may be reasons that are less than obvious, and not necessarily in the nation's best interest at stake:

I can't confirm, but, according to this Obama stands to make (or lose) all of his life savings based on the success of BP and Exxon.
well - while we're on the subject of the energy industry, and how they seem to get away with a lot ... try THIS everyone:
The US Supreme Court Thursday set aside part of Enron boss Jeffrey Skilling's fraud conviction, saying it was "flawed" and unconstitutional.
The Real Bush Legacy: Fascism
Judge Feldman's decision, when considered together with the Enron decision today and the Monsanto decision earlier this week, really shows just who is in charge of this country. Welcome to Corporate America.

"HopefullyFeldman ends up being a more firm version of Judge Rakoff, who folded like a lawn chair under Christina Romer's sturdy derriere to the administration's demands in every matter."
Are you quite mad? Do you know what would happen to the human food supply if by some stroke of bad luck we had another blowout only this time in the Pacific? The legal presumption that these wells are "safe" as currently configured has been irrefutably rebutted. A halt until a full design review is the only reasonable course of action. For example, a 737 fell out of the sky based on a mechanical fault what judge would just presume all the others are safe? The locate the fault and then ground all the planes with a similar fault until such fault is remedied. In this instance we know what of at least one fault. A single RAM blowout preventer has proven to be an insufficient design. We ahve to ground the fleet as it were.
"Do you know what would happen to the human food supply"
I wonder, what will happen to that food supply without cheap oil,... and LOTS of it?
+1
Are you really that conceited that you think it's acceptible, for whatever reason, to risk killing all the fish in the sea? Like I said if an airplane falls out of the sky because of an identified mechanical fault it's routine to ground the rest of the fleet with a similar fault. We have a material identified fault in our BOP design these slick. Fix it!
You need to get a grip.
The oil running into the GOM is definitely a problem, but within 2 years of the leak being stopped, you won't be able to tell it happened.
Why would you use the word conceit? Who said anything about this was acceptable?
I had nothing to do with the fact that for the last 100 years our country has built up an economy and way of life based almost completely on cheap and plentiful oil.
We've sucked out all the easy to get stuff, and we need more.
There simply is no substitute.
Your sanctimony for the fish is being typed on a keyboard made of oil.
Oil companies only need one regulation as far as I'm concerned; You break it, you bought it (including personal liability for top management - just like they do with banks in Brazil).
If it takes every penny BP has, so be it. You want the other oil companies to clean up their act? That'll do it.
Who wouldn't fold like a lawn under Christina Romer's derriere???

I say suck it Salazar! Judiciary branch, bitches!!!
this is going to turn into a standoff between the National Guard(s) of the southern states and the Coast Guard. The South will rise again!!
“Hopefully Feldman ends up being a more firm version of Judge Rakoff, who folded like a lawn chair under Christina Romer's sturdy derriere to the administration's demands in every matter. Full filing attached.”
I think this time its different, Mr.Obama and team fully expected this reaction, i.e. an appeal by the drillers and a ruling in their favor, if not anything Obama is a qualified lawyer. I suspect O and team are in bed with big oil and Co., there is no way you can make it in US politics without servicing Big oil & Co.
Now the game maybe, just my guess, kill two birds with one stone and let someone else take the blame.
Let me explain: You come out with a moratorium on deep sea drilling to calm the angered masses and with an eye on November. You project an image of strength ( I’m not in the hip pocket of Big oil & Co.) and try to somewhat salvage your populist appeal. But then you ask what about Big Oil? you don't dare inconvenience them let alone anger them, well to them I say, look I know the law, all you guys need to do is file an appeal and my drilling ban will be overturned by any judge who knows the law and does his job. So you are back in business and I get to show the people that I am tough when it comes to doing the right thing, irrespective of the size of the corporate entity I take on, and hey if I’m really lucky maybe I’ll get Cap-and trade going and that would make another of my bed-fellow in banking happy.
Maybe I’m just reading too much into this, we’ll know soon enough.
This was really great. Not enough, but someone actually did something:
