Exactly 220 years to the date after the Bill of Rights was ratified, the US Senate today voted 86 to 13 in favor of the National Defense Authorization Act for Fiscal Year 2012, allowing the indefinite detention and torture of Americans.

As RT reported earlier, one provision in NDAA FY2012 will allow for the reinstatement of “enhanced interrogation techniques,” essentially making waterboarding and forms of psychological torture a very possible reality for anyone America deems to be a threat, including its own citizens who, prior to the ruling, had the US Constitution on their side.

Among the corporations which have lobbied in support of NDAA FY2012 are several military contractors, including Honeywell and Bluewater Defense, who together have received millions of dollars in Pentagon guarantees this year alone.

“How long can you hold them? As long as it takes to make us safe,” said Graham.

In his closing marks, Graham ironically recited that in respect to “civil liberties and the American way of life,” US citizens must fight. “If we don’t fight for it, we’re going to lose it.”

Unfit for Office

Any Senator voting on a bill that would allow US citizens to be arrested, detained indefinitely, even sent to Cuba without being formally charged with any crime is no friend or supporter to the US constitution.

Note the absurd irony in Graham's statements. The fight for freedom can never be won by trashing freedoms or the Bill of Rights.

Senator Graham and Senator McCain are both huge hypocrites and cowards. 

Indeed, all 86 Senators who voted for that bill are cowards, a hypocrites, and no friend to the United States or the US Constitution.

Even more disgusting, Senator Mark Udall introduced an amendment intended to forbid the indefinite detention of U.S. citizens and even that amendment was rejected by a vote of 38–60.

I do not have a roll call on that, but there are 60 extreme cowards who wrap themselves in a flag while pissing on the Constitution.

There you have it. Anyone not on that list voted to trash the constitution. I am particularly pleased by the votes of Senators Jim DeMint, Thomas Coburn, Rand Paul, Mike Lee, Michael Crapo, and James Risch.

Those are the only six Republicans willing to stand behind the Constitution.

Justice Scalia said the very core of liberty, secured by our anglo-saxon system of separated powers has been freedom from indefinite imprisonment at the will of the executive. Wikepedia has the Benjamin Franklin quote as follows "They who can give up essential liberty to obtain a little temporary safety, deserve neither liberty nor safety."

Benjamin Franklin is correct and Senator Rand Paul was a hero for fighting this bill. Sadly, Rand Paul failed to a collective group of cowards who do not know what the Constitution is about or why we need it.

A.S. makes the point that the Soviet Secret Police and the Gulag System they operated were both obsessed with the legality of what they were doing, especially as the MORALITY of what they were doing became utterly indefensible.

Laws in a just society exist to back moral concepts with the force of the State, so that society may function and justice may prevail. When eternal moral concepts back the law, the law is supreme, and no man is above the law. By contrast, laws in a tyranny serve to enslave the people for the enrichment of the elite. In a tyranny, the moral supremacy in inverted- man is supreme, against his fellow men, and all the evils that the moral foundation opposes, the tyrant manifests.

If the tyranny begins with an ideological premise, the loss of morality is excused as neccessary to bring about the neeeded "change". If the tyranny begins with a security crisis, the loss of morality is excused as neccessary to meet the crisis.  In either case, the excuse for scrapping the moral foundation of the law is that the "end justifies the means". But once the moral basis of the law is scrapped, all that is left are the sociopaths who use the moral vacuum to enslave the people.

God help us, and vote for Ron Paul!

Here is how tyrany in America started, quoting from the United States Constitution:

"Congress shall have power to ... lay and collect taxes".

Sorry, no person or group of people, no matter how many, no matter what ritual they choose to call it, such as voting, or putting their ideas on fancy paper, (Constitution), and getting lots of people to agree, gives anyone the right to steal, and therefor never can any person or group ever have the "power" to  "lay and collect taxes". Consenting to pay for a service that is offered is OK, then you have a fee for something of value you consent to, or if you don't want what they offer, you choose not to pay. Violate this principle and you sow misery,conflict, suffering, and even death. 

 

Our declaration at the center of our victorious revolution stated that government obtains its just power from the consent of the governed. But taking someone's justly obtained property without permission is  theft! Claiming to be able to give a body power to empower such a theft is to give licence for extortion and murder! Such an evil seed wil attract those who wish to use that power to prey upon others, as was the case in America as soon at the first president took office.  If it wan't one group of criminals that sought to take us over it would have been another. And what was their ultimate "prize" they sought? The power to lay, and collect "taxes". 

People, plant an evil seed, reap and evil harvest, as we are experiencing now. So why should Americans be so surprised when their, (and other), "governments", kill and harm millions of people all over this world? 

So instead, deny anyone any special power to impose their will upon another who has harmed no one. Then we will transform our planet from systems based on violence to systems based on voluntary exchange; seek for genuine and lasting equality under universally recognized law that in turn makes civilization possible among those who desire peace. Please think about it.

I agree with you. But...

I don't understand how we can have individuals exercise monopoly rights over natural resources (ie, land ownership) without some overarching coercive force to grant, regulate, and ensure those rights. If this force is not a monopoly, I don't see how even genuine disagreements over ownership can be sorted out without civil war breaking out. So it seems to me you have to have a government of some kind, and it has to be paid for. How can this be done without some form of taxation?

From what I've seen, this is an area that is not thought about by a lot of anarchists or even libertarians, and is one I think needs more exploring. If any ZHers have looked into this I'd be interested to hear their thoughts and recommendations for further reading.

Hi BigJim:

Being able to productively use a particular piece of land is not "monopoly rights" over natural resources. Rights to obtain resources at a particular place and time, is hardly a "monopoly" unless you have the only source in the entire system at that one location.  Please study how much cooperation existed in pre-state California during the gold-rush for some examples of how voluntary exchange can work relating to what you are maybe thinking about here. Most miners were armed, and also defense services were available for hire, and it was hardly the "wild west" that hollywood loves to portray. The natural state of most adults is cooperation and peaceful resolution of conflicts, it is the very few who, absent some prior justification, attempt to initiate force agains others. When every one has strict equality of rights, then everyone is truly equal under the law. You can hire people if you think you need protection.  Likewise you can seek peaceful resolution of disputes. 

Here is a way you can have conflict: when people cannot eventually agree on what "just" possession of property is.  In such a situation, conflict could be in the nature of things, no matter who thinks they have a "lawful" monopoly of force. In practice, a culture has well defined rules as to what "just" possession is, it is usually a matter of the determination of the actual facts of a situation that dictates what civilized people will come to decide is a "just" resolution to a particular dispute and often it is monopoly law that is the major hindrance to such justice.  This is why free market arbitration, or free market adjudication is so superior to monopoly justice. Remember that those who have such a monopoly will insist that you be forced to pay for their "service" whether they are even able to be "just" or are in fact a criminal gang. The minute you give some entity a monopoly of "law" and/or a monopoly of "defense"/"enforcement", you give those of evil intent a fat prize to posses to your detriment.

Guys everyone needs to realize this NDAA is just a piece of the puzzle.  The Patriot act, creation of DHS and TSA, the controversial but not yet law SOPA bill, all of this is no accident.  It's part of a Coup 'de tat that began with the theft of the 2000 election and subsequent theft of the 2004 election.  Obama was a "brand" enough of us bought into to ensure his election.  And as we've seen the neo-cons didn't miss a beat.  Question is, what do we do from here?

I weep for my country and all of those who died for the very rights that are being stripped from us each day.  The inflection point is growing close where there is no way to right this listing ship.  All hands to the lifeboats. No real reaction from any of the media. While Nero fiddled, we have the Kardashians.....

I will say it again "The most successful military attack in all of history was done by the 911 hijackers on less than 500k. All of the real damage was done by ourselves to ourselves as we willingly gave up the very freedoms we hold so dear and spent money creating greater and greater debts that will enslave our children.

I want Ron Paul to win but also realize that Liberty and Freedom will be blamed, not the past decades of short sighted choices if anything happens on his watch.

Our country has become nothing but a empty shell. Zero hedge is but an island in an ocean of lies.

Rollo Tamasi,  One of the best posts in a long while and spot on.  Three of my family gave their lives in defending our country.  All who served and died would be sick with grief if they witnessed what our leaders have done to our country.  Everyone should have a lifeboat plan in place if they can afford one.  Sad times for a once great country........

Placing an embargo around Iran and goading them into action is the same tactic used on Japan and we all know how Japan reacted. Dec 7, 1941.  As we become more sophisticated with our communcation and weapons and response times the cycle of history repeating itself speeds up.  Just like a terd going down the toilet hole.

ZH is walking on the higher plain and looking into what is happening.  Can it be stopped? I doubt it because it is taking generations to perpetuate.  The only common denominator is the required inbreeding of the puppet masters.

There was this kid's show in the 70s called HR Puff n Stuff.  A kid gets on a boat that looks great and then the boat turns evil after he is out at sea.  That is what this change in our country reminds me of.  What looked great has changed, and there is no getting off.
