It would appear, given the equity market reactions, that investors are not expecting a dramatic impact to the gun-makers as Sturm, Ruger, Smith & Wesson, and even Cabela's are all rising ahead of the Biden-Obama Gun-Control Decree. Perhaps, this is front-running of what is likely to be record-breaking gun sales in the next 48 hours if past history is anything to go by. From the NRA's view of Obama as an "elitist hypocrite", Republican calls for his impeachment, and many US citizens against gun control (even though emotions are raw - 51% of men polled want to protect the right to own guns), it would appear that the populist might be struggling, especially as Politico notes that there are strong indications that any comprehensive legislation restricting weapons and/or ammunition won't even see a vote on the House floor.

This is long overdue. I'm ashamed to admit that America's gun legislation is far behind the rest of the developed world. It's embarrassing that we have thousands of deaths every year caused by firearms in this country, and yet right-wingers religiously support lax gun regulations. The rest of the works looks upon America's gun loving culture with horror. How many more people need to die before the right supports a ban on dangerous assault weapons?

List of the 23 Executive Orders is as follows:   

 

 

1. Issue a Presidential Memorandum to require federal agencies to make relevant data available to the federal background check system.

2. Address unnecessary legal barriers, particularly relating to the Health Insurance Portability and Accountability Act, that may prevent states from making information available to the background check system.

3. Improve incentives for states to share information with the background check system.

4. Direct the Attorney General to review categories of individuals prohibited from having a gun to make sure dangerous people are not slipping through the cracks.
5. Propose rulemaking to give law enforcement the ability to run a full background check on an individual before returning a seized gun.

6. Publish a letter from ATF to federally licensed gun dealers providing guidance on how to run background checks for private sellers.

7. Launch a national safe and responsible gun ownership campaign.

8. Review safety standards for gun locks and gun safes (Consumer Product Safety Commission).

9. Issue a Presidential Memorandum to require federal law enforcement to trace guns recovered in criminal investigations.

10. Release a DOJ report analyzing information on lost and stolen guns and make it widely available to law enforcement.

11. Nominate an ATF director.

12. Provide law enforcement, first responders, and school officials with proper training for active shooter situations.

13. Maximize enforcement efforts to prevent gun violence and prosecute gun crime.

14. Issue a Presidential Memorandum directing the Centers for Disease Control to research the causes and prevention of gun violence.

15. Direct the Attorney General to issue a report on the availability and most effective use of new gun safety technologies and challenge the private sector to develop innovative technologies.

16. Clarify that the Affordable Care Act does not prohibit doctors asking their patients about guns in their homes.

17. Release a letter to health care providers clarifying that no federal law prohibits them from reporting threats of violence to law enforcement authorities.

18. Provide incentives for schools to hire school resource officers.

19. Develop model emergency response plans for schools, houses of worship and institutions of higher education.

20. Release a letter to state health officials clarifying the scope of mental health services that Medicaid plans must cover.

21. Finalize regulations clarifying essential health benefits and parity requirements within ACA exchanges.

22. Commit to finalizing mental health parity regulations.

23. Launch a national dialogue led by Secretaries Sebelius and Duncan on mental health.

 

 

Number 1: just freed up ALL federal agencies (including the IRS) to share data for the NICS check system currently in place. 

Number 2: just trashed HIPAA's privacy guarantees for your health information when it relates to a gun. So now, any time a doctor asks "Do you have guns" or even asks family memebers ... all that information can be collated into the NICS system as well. 

Number 4: Allows the Attorney General to add entire classes of people to the no guns categories in a form 4473. If you make it to the "No Fly" list for the TSA ... kiss your ability to purchase a weapon goodbye. 

Number 5: Allows for LE officers to perform theft under color of law by requiring background checks before handing your property back to you.

We as a nation can not stop mass casualty incidents. The discussion has lost all direction, and the proposals put forth by the Biden Task Force failed to come up with meaningful legislation that would limit the damage done during the Sandy Hook incident. The first line of defense in school is the teacher/staff. Current active shooter drills focus on law enforcement for stopping the shooter and ensures that during a lockdown teachers lock the door then hide with the children. This ensures that the teachers become victims rather than giving them the means to be the first line of defense.

I would support federal legislation that would reimburse schools for the cost of handheld Stun Batons, Mace, and even taser guns for each teacher and the proper training to handle these non lethal devices. With teachers stationed near the room entrance during lockdowns the use of these non lethal devices would enable the teacher the chance to disarm the assailant and give the police and/or school resource officer the precious moments needed to respond. By making the teachers active participants during these incidents and training them during the active shooter drills we can limit the potential harm done.

Most incidents at schools are not mass casualty but angy students with a grudge. These non lethal devices in numerous capable hands can and will limit the overall potential damage done by a student with a pistol or knife.

This legislation would include funding from the federal government to reimburse schools to ensure that at least one full time Resource Officer is on hand in each school who is trained to detect and subdue imminent threats to the children and staff.

Giving teachers loaded firearms is not the answer as many teachers will not accept them. Banning Assault weapons is not the answer as only 3% of gun homicides are committed by rifles. Banning magazines is not the answer. Spending billions to turn schools into 24 hour locked down prisons is not the answer.

Enabling and ensuring that our educators and school officials, have the skills, training, and knowledge to protect themselves and those around them is the answer.

Obama and with his brilliant plan to "ban" the AR-15 (and other "assaulty" weapons), because he's a pragmatist, and really wants to do something to reduce gun violence by psychopathic killers:

 

"...of 12,664 murder victims last year, [just] 323 were killed with rifles, according to the F.B.I.’s Uniform Crime Report."

That's correct. 97.5 out of 100 homicide victims last year were killed with handguns, knives, glass bottles, hammers, baseball bats, fists, etc., and not rifles of any kind, let alone "evil, black, assault-y" semiautomatic ones.

I'm quite confident that nearly all the homicides that were perpetrated this weekend in Chicago, land of some of the most restrictive firearm ownership laws -- yet land of an abnormally high homicide rate-- were done so using "low capacity" handguns and revolvers (not to be banned, Mr. President?).

While the anti-RTKBA agenda crowd will renew their dogmatic, irrational push to try and legislate away the right to purchase magazines holding more than 10 cartridges of ammunition, they will never want an honest debate on the efficacy of such a piece of legislation.

There are fewer on the red team, but we know how to shoot, and how to be "close to the earth" a heck of a lot better, so it's sort of a tossup that depends on dedication of the players to the cause.

Our government has proved they suck at "assymetric warfare", and that's what this would be.

The fight is really city vs country.  Has been for a long time.  Most voters are in cities.  So, city folk expect us to export our food to them, want to put their polluting plants with us instead of them, and send them excess tax money for "you name it" - for example, rural VA sends excess bucks north to fix their roads among other things.  While they export laws, pollution, pipelines, fracking, costs, all to us.  We are being ripped off by the tyranny of the majority, something our government was originally designed to protect us from.

It's disgusting.  We rural folk chose what some might think is a harder, less convienient life, and we like things the way they are - and there's very little gun crime in a place where everyone has one - it's too dangerous for the perp - no 20 years of appeals if I shoot you dead on my doorstep.

And this is one of the prime things wrong with central statism.  Truly, you need different laws in different places.  I can't swing my arms in NY without breaking someone's nose.  But where I live, if I hit your nose, you're tresspassing on my land!  It's quite different, and the law should reflect it.

I get really worried when a gov official "knows what's best for me".  Which me is he talking about?  I myself have been a race driver, a musician, an inventor (where the money was), a homeless bum, and a pro stock trader.  That's leaving a few out - but it's just one "me".

What an arrogant fucktard.  All the vets I know think so too.  So do the 'necks, and yesterday a hardcore christain type came over wanting to buy a gun and get safety/use training, not because he's going to shoot anyone - but for defense against those who would.  I didn't sell him a gun (nothing he wanted was for sale by me) but I did take him out on my range and he had a lot of fun learning.

As far as I can tell (after considerable searching) that's the story for just about every gun part and piece of ammo in the entire COUNTRY.

I'm not just talking .223/5.56 or common handgun rounds - I'm talking .22 lr, AR15 components (LPKs, firing pins, bolts, BCGs, lowers, uppers, barrels, stocks, mags, EVERYTHING). I found a few odd boxes of high-end ammo, but that's about it.

I've never seen anything even close to this. Hopefully the panic will pass, but it's looking more and more like people are reading the writing on the wall and hedging accordingly.

Yup. I ordered a part for my 1911 at the beginning of December - still not available. The local Turner's has even sold out of those cheap (dollar and quality) Mossberg .22LR semi's. Nothing but a couple of bolt-action .308's and a few 12 ga. last time I looked. Ammo was limited to 2 boxes of 7mm, 2 boxes of .22LR, and assorted 12/20ga shotgun shells on the shelves - out of five aisles dedicated to ammo.

Although there is NO CONSTITUTIONAL PROVISION OR STATUTE that explicitly permits executive orders, there is a vague grant of "executive power" given in Article II, Section 1, Clause 1 of the Constitution, and furthered by the declaration "take Care that the Laws be faithfully executed" made in Article II, Section 3, Clause 5. Most executive orders use these Constitutional reasonings as the authorization allowing for their issuance to be justified as part of the President's sworn duties.

I actually agree with some of the proposed mandates, but I do not agree with the method. We have three branches of government for a reason. Checks and balances were placed into the framework of our government so that we have a deliberate and structured debate and collective agreement on our legislative process. Our country was never supposed to be mandated via executive order. If it were, it would have been placed directly into the constitution. This is a slippery slope that future presidents may use to become more dictatorial in their desires for legislation.

My favorite that you mentioned is "no one needs assault weapons."

1) who are you to decide that for me?

2) most violence / murder involving a firearm is perpetrated with a handgun not a rifle.

3 if a person is even remotely proficient with a firearm changing mags quickly is easy and performed fast enough as to make no difference whether it's a 10-20-30-saw mag et al.

4) it's a semi automatic rifle not fully auto which means it is already different than weapons fielded in war....... or as this administration is so fond of saying, "kinetic action."

5) the reason these types of weaponry are appropriate for the citizenry is as a protection against tyranny. If you believe that can't or more aptly put isn't happening in America, you're a fool. They don't achieve parity but they do give the people that want greater and greater control pause.

So, please crawl back to the rock you scurried out from under and let the adults with some semblance of common sense speak.

xtop23, I'm sure you're a paranoid extermist like the rest of the lunatics on here who are incapable of seeing past their own self-centered need to have an arsenal despite the costs to society, so I have no idea why I would waste my time responding to you or anyone on here due to your inability to think critically about the system that is best for our modern world as a whole, but I will anyway.  

1.  There's a good reason why these Sandy Hook attacks never involve missile launchers or grenades.  Because they are difficult to acquire.  WHO decided to draw the line there and why are you okay with that?  Why don't we allow everyone to have missile launchers?  The purpose of the 2nd Amendement in modern times is for self-defense and to deter crime.  Assault weapons are overkill for that purpose.  

2.  This isn't about the most violence and murder.  This is about minimizing the possibility of the mass killing of innocent people.  It's imperative that people have concealed handguns, so the one-on-one violence that occurs as a result of that is just something we have to live with.  That violence tends to be motivated by interpersonal causes.  That's not the violence we're trying to prevent. 

3.  The more someone is limited by needing to reload, the better the chance they will be stopped.  

4.  I'm not going to get into the nuances of what defines an assault weapon.  I'll let experts determine if they need to be widened to ban more ridiculously unnecessary weaponry. 

5.  You live in a fantasy land if you think there's any chance the gov't can overtake America by military force.  That kind of paranoia shouldn't determine our laws and it's a distraction from the real concerns of enslavement via currency devaluation and the other rights that are being undermined.  The paranoid need to protect ourselves from tyranny is not worth the tradeoff of allowing crazy people access to high powered weaponry.  

The modern version of the 2nd Amendment that takes into account advances in weapon technology should allow everyone access to a basic set of guns for the purpose of self-defense.  If you want a more advanced weapon like an AR-15, you should be required to take an advanced training class to prove you're ability to handle it and weed out those who can't.  

The following metaphor is how I would explain this to a rational person actually open to discussion, not the lunatics on this board who just want to justify an opinion they already had, and are only concerned with how it affects them and not society as a whole:

What if we were running a huge international corporation with A LOT of power?  We would need a CEO to make decisions that would affect A LOT of people. Would we want a mentally unstable person to be the CEO?  Of course not.  Would we want any random person to blindly be allowed that kind of power?  No.  That person would have to earn the responsibility to prove he could handle that much power. There would be limits and a system in place that would prevent someone who hasn't proven he could handle it from getting so much power. The same should apply to guns. I completely support the intention of the 2nd Amendment and the NEED for the populace to have guns for self-defense and to deter crime by making the weak on par with the more physically powerful. The problem I have with gun fanatics is they aren't seeing the nuance of the argument that no one wants to take away normal civilian guns for that purpose. We want to impose limits and restrictions to attempt to make it more difficult for mentally unstable people to get access to such high-powered weapons that belong in the military and are overkill for self-defense in society.  No matter how much we improve the mental health, detection-of-violent-people system, people will fall through the cracks.  I'd even be okay with some kind of training program that allowed you to earn the right to have an AR-15, much like a black belt in karate.  We have a violent nature to us as a species, so it's up to us to try our best to impose limits and restrictions on the technology that the founding fathers could never dreamed of coming into existence when they wrote the 2nd Amendment in the first place. To do nothing right now, or only focus on the mental health aspect is just negligent. And dangerous. There is no way to prevent these tragedies completely, but that doesn't mean we shouldn't make an effort WHILE retaining the self-defense intention of the 2nd Amendment.

  The truth is the weapon is incidental. If you repeatedly legislate symptoms and not causes you never cure the disease. It does not matter one whit that this or any other form of legislation is passed, if you don't address the causes.

  Your comment on handguns actually approaches correct. We do need more concealed carrying of handguns. Much more. People that are, adequately trained / maintain that training, would be an extremely intelligent way of addressing gun violence.

  You assume that by making "evil black rifles" illegal that mass killings will stop. That is purely assumptive on your part and quite honestly unprovable. 

  On the other hand, I can show you a multitude of examples where a populace either had their right to bear arms severely curtailed or outright removed and thousands > millions of deaths resulted.

  Sure. Reloading could possibly slow down the rate of fire from a shooter. I'll simply say that if you are competent with a weapon, swapping mags causes very little delay if any. But more importantly, limits on those same magazines affect the people that might be in a position to take the shooter out. Get it?

  The "gov't can take over America by military force" argument is debatable, but irrelevent. It is the tyranny of the individual that is in question. That should be easily understood and require no explanation.

  It should also be mentioned that you talk of currency devaluation and loss of civil liberties as things of great import that we should be focusing on.

  I don't disagree that these are very important topics. But don't you understand that history is rife with civilizations that followed the exact same path we're on?

  You don't see the possibilities of that same descent occuring here?

  Don't you think it makes sense if the intent of the 2nd Amendment was defense against tyranny to have weapons that make this more possible? 

  As far as your example of a CEO etc, I question whether or not we don't already in fact have lunatics running the asylum.  

  Whether or not our nation's political class has any interest whatsoever in yours or my safety and isn't simply exerting another level of control or merely pursuing talking points for political ends is open to debate.

  Look man, I don't mean to sit here and just go off. All I'm saying is if you outlaw a certain type of weapon people that want to commit crime will either build one, steal one, run to Mexico and snag one of Holder's, or create one.

  If they want something that is capable of high rates of fire they'll simply build it. The concepts aren't difficult and relatively easy to realize.
