Guest Post: Is The NDAA Lawsuit Headed To The Supreme Court?

Tyler Durden's picture

Via Michael Krieger of Liberty Blitzkrieg blog,

The NDAA lawsuit is one of the key topics we have written about over the past year or so.  For those of you that aren’t up to speed, one of the most popular posts we ever wrote was NDAA: The Most Important Lawsuit in American History that No One is Talking About.  Basically, Section 1021 of the NDAA allows for the indefinite detention of American citizens without charges or a trial.  Journalist Chris Hedges and several others sued Obama on the grounds of it being unconstitutional.  Judge Katherine Forrest agreed and issued an injunction on it.  This was immediately appealed by the Obama Administration to a higher court, which promptly issued a temporary stay on the injunction.

Yesterday, oral arguments began in front of this aforementioned higher court; the 2nd Circuit.  As Chris Hedges states in the interview below, if they win the case then it will likely be brought in front of the Supreme Court within weeks.  On the other hand, if the Obama Administration wins and the Supreme Court refuses to hear the appeal, Hedges states: “at that point we’ve just become a military dictatorship.”

To get a full update on the progress of the NDAA lawsuit make sure to watch this video.

“at that point we’ve just become a military dictatorship.”

And just when being a fascist corporatocracy has gotten us so far.  What must happen for us to be a Constitutional Republic again?

If anyone enters your home illegally, you have the right (and the duty) to empty your magazine, reload, rinse and repeat.  They will get the point eventually when they run out of people who decide to "do what they are told".

The NDAA is so grotesquely unconstitutional that ANY court should vote it down. If the Supremes get to it, the vote should be 9-0 against it. But that won't happen, and the sheeple will continue to graze.  It's sad. Very sad.

Ruger mini-14, AR-15, AK-47 - nothin'!

All sold out!  Retail stores, online, everywhere.

The dumbshits in the MSM say it's because people are buying them "in fear of an assault weapon ban".  No you dumbfucks, it's called "in fear of our own government!".

And, that is what a semi-automatic handgun and rifle are for, putting down tyrannical governments!  That is what the Second Amendment is all about!  You know, it comes right after the First Amendment!  Not a coincidence!

It's not about hunting animals, it's about hunting crooked, corrupt, treasonous, Constitution burning tyrants!

News story from a couple years back: Sudanese Muslims were running around, burning down the villages of Sudanese Christians. One village had their huts burnt down more than once and all their possessions stolen. Suddenly they rose up, went to one of the offending Muslim villages and burned it to the ground.

The local news media said "Hey! You're supposed to be Christians, you hypocrites. What about that Turning the Other Cheek stuff?"

The leader from the Christian village said "We turned one cheek. Then we turned the other. Then we ran out of cheeks."

Moral: Don't lean too heavily on the expectation that Christians will all be docile Obama-Obeyers. Some of them will turn the two upper cheeks, and then invite TPTB to kiss the two lower cheeks.

Apparently the LAPD  not only shot the wrong truck and wounded the 2 newspaper delivery women they believed to be Dorner, they shot up the whole neighborhood.

"Goo said he could hear the bullets hitting the door, and he feared the gunmen were coming through the house. He called 911 and was told that police were already there. " (LOL)

"After the incident, police ordered residents to stay indoors, but from his window Goo could see dozens of yellow markers on the ground used to mark the stray bullets. While out surveying the damage, he counted five bullets in his entryway, a bullet hole in his garage door, two bullets hits his silver Lexus and another bullet grazed the hood of his Oldsmobile."

It's called de-evolution.  Natural Selection hasn't acted on our species for a very long time. low IQ, socio-economically challenged individuals breed faster than productive individuals.  The state manufactures more people who will vote for a larger state apparatus, ie free shit.  Democracy has an arc and is doomed always toward socialism or worse.  it's a nice idea, and the one that most aligns with the interests of productive individuals, but parasites will take down any beast, no matter how glorious, once they reach a great enough number.  What we need in order to get back to the beginning of the arc is a grand reset.

Another point - They are laying off police (and firemen and so on) as the cities implode economically. - but they want people to defend themselves with scissors.

Since nobody brought up the obvious.

Dormer is the setup to finally allow the final removal of local law enforcement and the replacement with military police actions in US cities.  It is also the end of the FBI by proxy by finally removing their greatest advocates of law enforcement on the ground.

Betrayed is another word because everyone did exactly what they were supposed to do which is cause a complete mess, to allow the switch over to military police enforcement because of the 'lack of order'.  In turn the lack of direction of law enforcement will roll back into some congressional chamber where red hot political pokers are getting fired up to jam into the Executives in the FBI.

There willl be some prefunctory tap dancing by the congressional members, but they'll pass resolutions to the effect that the FBI is fired from defending the legal practices of the USA.  This creates a schism in the other Alphabet soup agencies which break into no less than 47 groups that get busy backstabbing each other in their own offices.  The worst to feel the backstabing without merit is the NSA, without the FBI there to hold the line, the executives in that branch are put under heel, paycuts are handed out and everyone is told to shut up and like it while they watch the remainer of their careers and projects demolished.

But that's just a guess because it could never obviously happen that way could it?  LOL!

There is no argument, just a thought of how the pieces on the chess board move around and where the pawns in this game end up.

Not like you or I, or even alphabet soup agencies, can do anything about it at this point.  The situation is what it is.  Complete organisational mess, no internal political will to do even the rudimentary daily stuff and to top it off nobody knows what the budgets look like any more.  The consolidation will be done no matter what anybody thinks or says now.  Argentina's move to devalue has all sorts of unintended consequences, like moving up time tables on austerity measures.

I am thinking out loud attempting to figure out the next steps from the ideas you guys present.  I've been trying to figure out how the agencies are going to get the organisational axe, again something that no one is going to change regardless of 'clout' or manpower, this is all about math now.  Something all the agencies have been desperately trying to avoid tackling.

So now, the real powers that be like all that money their agencies have squirrelled away.  The trick is to smear the shit out of them and break them while looting them blind.  Think of it like austerity measures but you destroy the credibility of anyone working for any of the agencies while pissing off anyone already retired.

It's a dark place to be.

Thanks for replying CPL, whenever I get deeply involved

offering insider content ,analysis, psychological traps to avoid and other useful commentary.Kind of conclusive mumblings, smartly worded in a state of higher sobriety . Your convoluted thinking and writing still gives it away, and I`m not trying to mock you as I rarely post sober myself.

May we all have a discussion about our dual addiction,

The mind is like a net and catches the good with the bad.  So whether straight edge, sober, crazy, drunk or stoned.

If an idea takes a shape sometimes it's best to let the mind follow the threads and allow it to make the associations it needs to.   ZH has all the flavours for the minnestrone mental soup of the human race...yes, it's a shit load of fun, puzzles always are.

It is however too early in the day for me to be drinking anything but coffee.  So we'll go with loopy as my current mental state.

With ZH I'm afraid I am addicted like crack as well.  Lots of smart ideas and people floating around here.

After ten hours I would be into the sipping whiskey as well.  Not like you could throw more punishment at your body that the cold didn't hit you with.  Easy to hide a scent in the snow, but sound carries.  Could hear a rabbit fart over the shush of skirtering snow.  Keep the toes crispy brother and have a couple for me, almost 4:20 I'll be honouring traditions soon myself.

So is that the instruction set for the two ladies they shot up? File a claim? Who goes to jail? Who even gets put on administrative leave until they find out who needs to lose their job over this? The answer? No one until they catch Dorner. He's got them scared shitless. The Rule of Law can wait until they even the score with him.

Because that is what 'americans' have been doing since 1776, July,4th, right?

Hellfires are laser or radar guided. It's possible to coat a target with a material that scatters or significantly changes the frequency of a laser or radar reflection, while another target is painted.

When he opens his mouth, populist-socialistic platitudes come out. He is the one who opened his mouth and removed all doubt as to his political allegiance. Seriously, if you are too stupid to notice it, you have no place insulting others for their superior perception. While his command of the language is merely average, his rhetorical skills are, it seems, quite honed.

And really, look at the idiocy of his mindset. He's going to sue the very much non-independent judicial wing of the very government he's accusing of being a bought-and-paid-for totalitarian military dictatorship? It is pure fucking Kabuki theater. Like the Democratic Socialists (which Mr. Hedges, in fact, is) who think they can ally with the Communists, they go on believing it right to the very moment of their execution.

The lesson dupes like him never learn: the state serves its own interests, everything else be damned. You cannot petition a totalitarian military dictatorship from within it's own courts. To do so defies credibility.

PS: His crusade against pornography is no accident, far from it. Communist regimes, with which he is clearly enamored in some aspects - as are all socialists to varying degrees, are notoriously puritanical, they put Protestants to shame. For Christians, it steals energy and love from God, obviously a sin; for Communists, it steals time and energy from the Party, obviously a capitol offense. Their persecution of homosexuals is legendary. But we don't speak ill of communists in polite company, do we?
