Guest Post: Is The NDAA Lawsuit Headed To The Supreme Court?

Tyler Durden's picture

Via Michael Krieger of Liberty Blitzkrieg blog,

The NDAA lawsuit is one of the key topics we have written about over the past year or so.  For those of you that aren’t up to speed, one of the most popular posts we ever wrote was NDAA: The Most Important Lawsuit in American History that No One is Talking About.  Basically, Section 1021 of the NDAA allows for the indefinite detention of American citizens without charges or a trial.  Journalist Chris Hedges and several others sued Obama on the grounds of it being unconstitutional.  Judge Katherine Forrest agreed and issued an injunction on it.  This was immediately appealed by the Obama Administration to a higher court, which promptly issued a temporary stay on the injunction.

Yesterday, oral arguments began in front of this aforementioned higher court; the 2nd Circuit.  As Chris Hedges states in the interview below, if they win the case then it will likely be brought in front of the Supreme Court within weeks.  On the other hand, if the Obama Administration wins and the Supreme Court refuses to hear the appeal, Hedges states: “at that point we’ve just become a military dictatorship.”

To get a full update on the progress of the NDAA lawsuit make sure to watch this video.

Thankfully Washington saw fit to allow these "unwashed masses" to choose their representatives via republican government.

Peyton Randolph was the first president of the United States (there were fourteen before Washington), but he as most others from our early period were chosen from extreme minorities. The vote on the Constitution came from between 3% and 13% 0f the population. Washington was never elected by nor were representatives elected by the "unwashed masses".

While these standards were relaxed over the following two and one half centuries, we still find ways to exclude groups, add people that don't exist and erase whole areas from the results.

Washington was estimated to be the richest man in America when he became president (land sales). There wasn't much money in being the king.

He was President of the Continental Congress. Rich or not, George Washington knew what was to be right for the newly independent of America. If he was just some lazy rich dude, why did he lead an Army to victory over the World's most formidable power?

Actually, he was president and performed the diplomatic duties of an executive. A role that expanded for the entire time we were ruled under the articles of confederation. Wikipedia is not always the best source for information- unless you think the CIA is going to give it to you straight...

I never said he was a lazy, rich dude, nor did I imply it. George Washington was a hard working land speculator. As for leading the army to victory, PLEASE read history. Most of the revolution was fought between tories and rebels. Washington spent most of his time keeping the British penned in Philadelphia, New York and Boston. When attacked in Charleston- we surrendered. If the British hadn't been so lazy, they would have won handily. American officers had huge inferiority complexes and wanted nothing more than to be recognized as equals, which the British never did.

The British had more important things on their minds and actually felt we would eventually see the light. Unfortunately, we"outlasted" them and they needed to pay attention to Europe. So, they just took us over through central banking. We have been bailing them out financially and militarily ever since.

Try reading, "Tories" by Thomas Allen.

Wrong. There were actually great, noble men once, who toiled most of their lives to carve out a free nation. Read a bit about John Adams to temper your cynicism.

Instead of reading the propaganda, look at the actual results. The "Founding Fathers" were angry at taxation, market restrictions and restrictions on land development. Look into the use of national banks to fleece the country and inflation of currency. The War of 1812? To STEAL canada- we started it.

Read about the tories and the real war of the revolution- Americans fighting Americans, to protect positions of power and influence.

Lincoln the tyrant, the Supreme Court as a tool of tyranny, militarism, imperialism and now, our crowning glory: the worst terrorist country on earth.

a Canadian friend once loaned me a very value-able book, documenting numerous incursions by amrka into Canada for the purpose of expanding territory. . .wish I could remember its title, but yes, folks would do themselves a huge favour by reading outside the guide-lines.

Glad to see Hedges doing this, he has evolved to realize his far left sympathies were badly misplaced. He's deeply comitted to this and I applaud him. Common ground for everybody on this. But methinks he is still not yet ready to shout out 'Molon Labe'.

He sort of lost me when he plugged 'global warming' and Stiglitz. Global warming fraud is a major ideological conduit for global fascism, and Stiglitz (now an IMF'er and admitted socialist) wrote a paper fretting how the big banks can collect from indebted sovereigns. Answer to both is make countries and people lose their sovereignty to an unelected supranational entity like the UN.

Some countries are already using their military to round up homeschooled children, under UN orders, so they can be indoctrinated. US is the center of gravity for believers in individual and sovereign rights -- 2 million homeschoolers, 100 million (and counting) gun owners. If the US goes, we all go.

Go Chris! Go! Where do we donate?

Stiglitz:

One of many such papers, this from 2002. It's what he does, why he's at IMF: http://academiccommons.columbia.edu/catalog/ac%3A126652

Excerpts Wiki:

"He also chairs ... the Socialist International Commission on Global Financial Issues and is a member of the Pontifical Academy of Social Sciences.... ] In 2009 the President of the United Nations General Assembly Miguel d'Escoto Brockmann, appointed Stiglitz as the Chairman of the U.N. Commission on Reforms of the International Monetary and Financial System, where he oversaw suggested proposals, and Commissioned a report on reforming the international monetary and financial system."

"The effect of Stiglitz's influence is to make economics even more presumptively interventionist than Samuelson preferred. Samuelson treated market failure as the exception to the general rule of efficient markets. But the Greenwald-Stiglitz theorem posits market failure as the norm, establishing "that government could potentially almost always improve upon the market's resource allocation." And the Sappington-Stiglitz theorem "establishes that an ideal government could do better running an enterprise itself than it could through privatization"[37] (Stiglitz 1994, 179).[36]

Chris Hedges, 2008,  "Why I am a Socialist":

Perhaps Chris forgot 'NAZI' was the National Socialist Workers Party. More former useful tools like him need to wake the fuck up.

I don't agree with Hedges on many other things, but he is a complicated and interesting individual. He's kinda like actor Christopher Walken, you can't look away because you never know what they'll do next.

Hedges seems to be a genuine Utopian who actually believes that neo-socialism was never about power and Goldman Sachs, et.al. It's like he just found out there is no Santa Claus. Go Chris! Go!

If you read his stuff, yes he does believe we are moving into a era of less resources. And yes global warming is part of that.

He believes it the way I do that shit is disappearing and from my observation it is true. No idea if it is global wariming but it it is global change. But it is happening kids.

You're little late to the party, "Global Warming" changed it's name because there was no warming.

Hedges also wrote 'American Fascist,' an ambarrassing 200 page anti-Christian rant. Shocked he is just now finding out who the actual fascists really are. And it's all his former friends who are OK with NDAA because they think it is only meant for the 53% who will be hard to improve through re-education.

Medieval Warming Period (400 years long) and Little Ice Age (250 years long) were other natural climate changes examples, but were airbrushed and disappeared by the IPCC because they were pre-industrial age. Also, Carboniferous Period was 425 million years ago, and atm. was CO2 1500% higher than today, -- mmm, guess how it got it's name?

"Climate Change" is only a manmade problem if the UN IPCC has a scapegoat to tax.

Climate change -I know living in the North I have seen changes over the course of my lifetime. Big changes. Changes that cant be explained out side of science.

Religion - the anti-christian thing, no problems with that as well. But beiing a non-believier guess I'm doomed.

Changes does not mean we are causing it. It changed from what it was, into the way you found it when you were born.

It will be still changing long after we are all dust...its what nature does, its not static, never has been.

NO.

It is a split court with Justice Roberts, supposedly, the swing (conservative) vote. But as was seen with his last min change in the ObamaCare vote, Roberts switched sides. His vote was already cast and the majority opinion written. THEN he changed his vote.

Roberts will likely vote the way Team Obama wants him to vote.

You may be asking; "How do you know this?"

Ya see, Roberts has two children adopted from abroad, and various aspects of that adoption are said to have been carried out in a less than legal manner.

The best online summary I can find is here:

http://www.libertycaucus.net/forum/index.php?topic=113.msg755

If true, Roberts' vote is in the bag.

Your rights will soon be nothing more than old ink on even older parchment.

i read a comment recently about a discussion only available in audio with a historian who studied the Johnson administration for years.   he noted that Chief Justice Earl Warren refused twice to chair the commission that "investigated" the JFK hit until LBJ called him on the phone and told him that "it would be a shame if the unfortunate incident in Mexico ever came out into the public".   supposedly Warren broke down in tears, relented and thus we all know that investigation as the "Warren Commission".

all anecdotal of course, but makes perfect sense.

also choose to believe that John-Boy has more skeletons in the closet than just the adoption thing.
