Background Check Amendment Fails To Pass Senate, Gun Control In Tatters: Obama To Make Statement

Tyler Durden's picture

Following a full court press by the Obama administration, and specifically gun tzar Joe Biden, to legislate "stronger" gun law in the last several months ever since the Sandy Hook massacre, the initiative may have just suffered a terminal defeat following a failure to even pass a bipartisan background check amendment in the democrat-controlled Senate. CBS reports that "In a major setback for gun control advocates, the Senate Wednesday voted down a key amendment to the embattled Democratic gun bill, signaling the increasingly dim prospects of any meaningful legislative action aimed at strengthening America's gun laws. The bipartisan Manchin-Toomey amendment, a background check expansion devised by Sens. Joe Manchin, D-W.Va., Pat Toomey, R-Pa., and a handful of other lawmakers, earned only 54 votes, falling six votes short of the 60-vote threshold. Vice President Joe Biden, who led the Obama administration's months-long lobbying effort on behalf of stronger gun laws, presided over the vote."

The vote effectively kills any hope for a comprehensive law, and makes a mockery of Obama's recent aggressive anti-gun initiative:

The failure of the Manchin-Toomey amendment, which was crafted over weeks of negotiation with the aim of attracting Republican support in both the Senate and, eventually, the House, could serve as the death knell for the larger piece of legislation, though it's possible Reid will bring new amendments to the floor at a later date.

In the hours before the vote, Organizing for Action, an advocacy group that works on behalf of the president's legislative agenda, urged voters to call their senators in support of expanded background checks. The Democratic National Committee (DNC) sent out similar emails, specifically targeting a group of Republican senators who had at one point appeared amenable to the Manchin-Toomey language. Meanwhile, a pro-gun group that had previously backed the ban pulled its support.

In the end, four Republicans voted in favor the Manchin-Toomey amendment, and four Democrats voted against it, excluding Senate Majority Leader Harry Reid, D-Nev., who switched his vote from yea to nay for procedural reasons.

Sen. John McCain, R-Ariz., one of those who broke with the GOP ranks, delivered a vehement defense of the bipartisan amendment in debate over the bill, and disputed the argument, touted by his fellow Republicans, that it would strip Americans of their Second Amendment rights.

"For over three decades in Congress, I have built as strong a record as anyone in this body in defending the Second Amendment. I have consistently opposed the efforts of anti-gun activists to ban guns and ammunition, staunchly defending the Constitutional rights that Arizonans hold dear," McCain said, continuing with a list citing his pro-gun credentials. But, he added, "Just as I have long defended the Second Amendment to the Constitution, I have also long believed that it is perfectly reasonable to use available tools to conduct limited background checks, as this amendment prescribes, to help ensure that felons and the mentally-ill do not obtain guns they should not possess."

"In my view, such background checks are not overly burdensome or unconstitutional," McCain said.

Obama will take the podium at 5:30 pm to speak about "commonsense measures to reduce gun violence" and justify this latest disappointment of an administration which should count its lucky stars, it has the labor force participation rate to fudge the unemployment rate with, and the Fed to ramp stocks higher, or else living in America today would be a very different thing if the full ugliness of reality was exposed for all to see.

And the fact that most of the above posters have around 2 months or less, makes me less inclined to believe anything other than the statements being pure, inflammatory, fuckwit rhetoric, coming from a paid troll.

You're not? Fiat's and your postings scream out otherwise.

Rather than speak out against an imbecile potus based on his administration's total lack of transparency, his drone program that causes monstrous collateral damage and creates more terrorists than it eliminates, his dreadful mismanagement of our economy, his unceasing war on civil liberties, his blatant subservience to banking interests and Wall Street / Corporate America, his lack of backbone ( or lack of interest ) in truly confronting our nation's problems and instead diverting attention to issues of relatively minimal depth that only serve to divide us,

.......you waste your time resorting to ( or agree with ) calling him a nigger, a fag, and a muslim.

By this alone, I would say the tag is justified, by my understanding of the term. Perhaps you think I judged you too harshly. Perhaps it is my own hypocricy, and I have similar guilt as you, in utilizing such language in describing another.

My point is this. Even if you or Fiat for that matter, are not paid trolls, your childish need to resort to such attacks when matters of infinitely more dire concern are afoot not only demeans the debate on ZeroHedge but renders your criticisms of it ridiculous.

On a side note, your Johnny kissing behind the tree comment was pure genius.

Excuse me, if I don't bother with the sarc tag.

I always imagined most ZH readers were in finance. This thread sadly disproves it; go run the numbers on "defense" stocks this year.

Again, I'll state it real clear for you: Defense Industries are businesses and they're run by smart people. They often employ government ministers when they've left office. If you want to change this, you don't look to the Senate, you look to the enormous grants from Gov and the entire ethos of America.

Cougars attack from behind and have tracked and scoped you out long before you see them. They are killing machines and if they get a hold of you you're done unless you are extremely good with a knife. Walk alone in the mountains of Cali and being of small stature is inviting attack. Travel in groups is better but they do have an affinity for children. I've had experience with them and fortunately have lived through my encounter. A gun has limited use for the average person. My friend who used to hunt them almost was killed by one and is an extremely experience hunter. He was fortunate to have a buddy with him.

.280 Rem,  Ruger M77 Mark II with a Timney adjustable trigger.  Or if you want to save the money on the trigger you can take the trigger assembly apart and take a dremel tool to the trigger sear's edge to get the burrs off.  I do not know why Ruger does not do this at the factory.  Those burrs are what lead to an inconsistent trigger pull for Rugers.(ruins your accuracy)  If you decide on a Timney, it's probably best to have a gunsmith do that because you have to modify a few things or the safety will not engage resulting in a gun that is always on fire mode with a hair trigger and you have one chance to install it correctly or will piss away the cost of a Timney trigger which you do not really want to do.  I highly recommend the Timney though.

For up close and personal, you need a shotgun with some buckshot.  The Mossberg Model 590 with pistol grips is what I have.  They don't have the smoothest actions but they go bang.  Don't get the cheapest pistols grips if you want to go that route because that's a twelve gauge you are shooting there after all and your hand is gonna know about it!  For close range defense the shotgun is the best choice.  For offense, the rifles are the best choice with a good scope.  270 Win, 257 Roberts, 243 Win, 25-06, 7MM and any 30 cal. should more than enough to dispatch a cougar.

My two cents - get yourself an 870. Low cost, reliable, you can mod the hell out of it, and swap out shells on the fly to fit your needs.

The military, the coast guard, swat teams and sheriff departments all over the country use the 870 as a service weapon.

It’s hard to beat the versatility of a 12 gauge or 20 gauge shotgun.  There is a huge variety of different ammo available from slugs to fine shot.  The only thing they're not much good for is a long distance shot, but I assume you were not trying to hunt cougars but only defend yourself from them.  It is absolutely amazing how much damage even the lightest birdshot will do at close range, and your aim is not required to be quite as precise as with other weapons such as rifles (and, even better, this birdshot is much less lethal, if not completely harmless, after 100 meters or so of distance fired; so, it's even safer than many alternatives).

I don’t know much about cougars, however.

Agree with your 4 points. IMHO, John McCain no longer fits the bill for being trusted to be aligned with 1-4. His laurels of decades in the Government are ashes, starting with his corruption with the Keating 5, his lame ass presedential campaign, and his bipartisanship on laws that he evidently never reads that have buggered America big time. If the economy was hunky dory, 1 bankster or lobbyist had made a perp walk and/or we didn't have 17 trillion in debt, he might have some comtemporary laurels to trumpet. As I see him, he is not a conservative and is a liar, thief and a closet Dimocrat. Any bill for gun background checks put forth by the current crop of 'ist Dimocrats will be a lie and have a caveat hidden in it that will incrementally make a list of all gun owners available to the jack booted thugs, as already evidenced in Califas and NY.

This is a great article showing just what a dickbag Harry Reid is.

http://reason.com/blog/2013/04/17/harry-reids-sorry-explanation-for-sudden?

Harry Reid's Sorry Excuse for Suddenly Supporting an 'Assault Weapon' Ban

Office of Harry ReidToday Senate Majority Leader Harry Reid (D-Nev.) reversed his longstanding opposition to a renewed "assault weapon" ban, explaining his new stance this way:

We must strike a better balance between the right to defend ourselves and the right of every child in America to grow up safe from gun violence.

I'll vote for the ban because maintaining the law and order is more important than satisfying conspiracy theorists who believe in black helicopters and false flags. I'll vote for the ban because saving the lives of police officers, young and old, and innocent civilians, young and old, is more important than preventing imagined tyranny.

In short, Reid will vote for an "assault weapon" ban because he has suddenly discovered, to his dismay, that the people who are against it are a bunch of crazy conspiracy theorists. He does not explain how prohibiting certain arbitrarily selected, functionally unimportant firearm features serves "the law and order" or saves people's lives, probably because there is no credible reason to think it will do either of those things. In fact, if the choice is between believing in the effectiveness of "assault weapon" bans and believing in "black helicopters and false flags," I'm not sure which is crazier.

Another sample of Reid's logic, this time explaining why he might vote against requiring interstate reciprocity for concealed-carry permits, despite having supported such legislation in the past:

I think we've all learned a lot in recent years, about first graders mowed down, people watching a movie being victims of an attack, a courthouse in Las Vegas.

I am not saying that Reid would necessarily be wrong to vote against this particular amendment, which raises serious federalism issues that need to be considered along with Second Amendment objections to overly restrictive concealed-carry policies. But since concealed-carry policies had nothing to do with the attacks he mentions, his explanation for having second thoughts makes no sense, just as it made no sense when Sen. Joe Manchin (D-W.Va.) cited the Sandy Hook massacre as a reason to expand background checks for gun buyers.

One more example, from the same New York Times story, of substituting emotion for logic in the case for stricter gun control:

Senate Democrats, trying to simply hold their ranks together behind a background check amendment written by Senators Manchin and Toomey, met for an emotional luncheon on Tuesday. Mr. Manchin gave a tearful, impassioned appeal for his measure as former Representative Gabrielle Giffords of Arizona looked on. Senator Tim Kaine, Democrat of Virginia, retold in detail the story of the professor at Virginia Tech who threw his body in front of a door to save students during the massacre there in 2007.

"It was really dramatic and convincing," said Senator Amy Klobuchar of Minnesota.

Dramatic, yes. Convincing, no. Since the Virginia Tech gunman bought his pistols from a federally licensed dealer after passing a background check, the lack of a background check requirement for private sales was irrelevant. The story of that heroic professor therefore does not strengthen the argument for Manchin's amendment one iota. The fact that people who think it does are in charge of making our laws is more than a little alarming.

Talk about a false choice to be rejected.

MJGreen| 4.17.13 @ 1:40PM |

It even goes beyond false choice. The former is a large component of the latter. It's like saying we must "strike a balance" between eating an appropriate amount of vegetables and maintaining a healthy diet. Not only are these two things not in conflict, one is dependent on the other.

There is NOTHING in the U.S. Constituion about driving being a "right", so it is not a big deal.

After  the 9/11 damage and deaths in New York City, the Saudi government offered to help with a sizable monetary gift of $10 million in disaster aid. The Mayor of New York, Rudy Giuliani , refused the help.

But now the real controllers of American foreign policy and the experts on “terrorism” (assassinations of foreign officials, torture, cyber spying, bomb making and police state concentration camps), the Israelis, are offering their help and it will be accepted of course.

Wonder if it’s too late to help with evidence gathering or planting?

Israeli police head to US to aid in Boston Marathon bombing investigation | RT (Russia Today)

April 17, 2013

The investigation into Monday’s deadly bombing at the Boston Marathon has officially gone international: law enforcement officials from Israel have been sent to the United States to assist in the probe.

Israel Police Chief Yohanan Danino says he has dispatched officials to Boston, Massachusetts, where they will meet with Federal Bureau of Investigation agents and other authorities, the Times of Israel Reports.

Citing an earlier report published by the newspaper Maariv, Times of Israel writes that Danino has dispatched police officers to participate in discussions that “will center on the Boston Marathon bombings and deepening professional cooperation between the law enforcement agencies of both countries.”…

In an address made Tuesday, Israel President Shimon Peres said that tragedies such as this week’s incident in Boston, sadly, bring people together from across the world.

“When it comes to events like this, all of us are one family. We feel a part of the people who paid such a high price. God bless them,” Peres said. “Today the real problem is terror, and terror is not an extension of policy: Their policy is terror, their policy is to threaten. Terrorists divide people, they kill innocent people.”…

New York Mayor Michael Bloomberg has also confirmed that he has dispatched law enforcement officers from the Big Apple to assist in the investigation by meeting with agents at a Boston fusion center, one of the DHS-funded data facilities that collects surveillance camera footage and other evidence in order to analyze events like Monday’s attack.

“We are certainly engaged in the information flow with the FBI through our Joint Terrorism Task Force. We have two New York City police officers, police sergeants, who are in the Boston Regional Intelligence Center,” Bloomberg said on Tuesday. “They’re up there, they’ve been up there since last evening.”

But in a study conducted last year by the Senate’s bipartisan Permanent Subcommittee on Investigations, lawmakers found that those fusion centers have been more or less unhelpful in assisting with terrorism probes.

The Department of Homeland Security’s work with state and local fusion centers, the subcommittee wrote, “has not produced useful intelligence to support federal counterterrorism efforts.” Instead, they added, so-called “intelligence” shared between facilities consisted of tidbits of shoddy quality that was often outdated and “sometimes endangering [to] citizen‘s civil liberties and Privacy Act protections.”

“More often than not,” the panel added, information collected and shared at DHS fusion centers was “unrelated to terrorism.”

You are making good points, but when the guns are gone they’ll be very little to worry about  regarding taxation or private property or QE printing. Instead, we will be completely subjugated in one of the harshest, most sophisticated police states in history.

And believe me, it is they who will decide who will eat and who will survive.

We are seeing an incredible acceleration in the takings of private property, incomes, livelihoods and other freedoms, yes. And much already has been lost.

But the end of the story has not been written; the response is just starting to kick in. And the only deterrent now between freedom and enslavement on this modern planet is Americans and their guns; again, just as in America's founding, it would be unthinkable to try to defend our liberty and private property without the use of guns.

Many of the peoples of the western world have relinquished their guns and are defenseless. Americans have not, will not and are not.

The gun laws already on the books in this country have consistently been perverted by the ATF.  Ever hear of "Ruby Ridge" or "Waco"?  Perversion of the "gun laws" is the fuse that touched both off.

Personally, I think the so-called "gun show loophole" should be looked at, but here in California that loophole doesn't exist, and if you live here you can't go to out-of-state gun shows and buy either.  So my thinking is it's not as big a "loophole" as one might think.  And the state troopers in CA are actually out confiscating guns! Think I'm crazy? Then see this: http://www.huffingtonpost.com/2013/02/19/california-gun-confiscation_n_2...

A great book on guns and the attempts by the state to control people who own them (entertaining as hell too) is "Unintended Consequences" by John Ross.  You'll find the book at your library or here's the link to the author's site:  http://john-ross.net/  Makes a great gift for the un-informed "gun haters" you may know or be related to. And if you're part of the "gun culture" it's a must-read.

however, you do not change laws due to a horrible tragedy. unfortunately shootings like that have happened before and will prob happen again sadly. criminals are always going to be criminals, and this will be whether we make laws or not, hence the word criminal, they do not follow ''laws''. all the laws would do is take guns out of normal peoples hands, law abiding citizens, so that when they are in a situation with a maniac with a gun, they are defenseless.

so i say to you hussein obama, will you shut the fuck up with your fucking gun law crap and stop using the victims of sandy hook as your propoganda machines. let them have peace, and let us fucking have peace in america and not have to here from you again on gun control,or in general.

I'm old enough to remember when Ronald Reagan and John Brady were shot by a John Hinckley, who had a history of mental illness.

So they passed the Brady Bill, focusing on the guns and essentially ignoring the mental illness aspect.

Needless to say, this legislation did not prevent Columbine, Georgia Tech, Newtown, Gaby Giffords and several other tragedies involving mentally deranged individuals with guns.

Seems we don't learn fro history. The currently proposed legislation will do nothing to prevent the same thing from happening again.

More Guns, Less Crime.

Guns don't kill people, postal workers do.

We're told that Adam Lanza slaughtered children in the Newtown school. He was on prescription drugs for his mental condition, and used his mother's guns, according to the official story.

Most gun crime happens in places with the tightest gun laws. Why? Because sadly insane people or madly badly criminal people do not abide by bureaucractic 'laws'.

Most gun owners in the USA are law abiding.

Nazis disarmed Germany shortly before slaughtering jews. So did Stalin, Mao, Pol Pot...and all the other international bank Zionist funded mass killing haters of the 20th century.

History teaches us that unarmed peoples end up in mass graves.  Disarming the people is the first step.

Here is why I think Reagan was shot. Note how Reagan was also standing up for Baker, Anderson, Crane and Dole who Poppy was also trying to stiff.

Sort of like how Lyndon off'ed Jack. LBJ got real rich of Vietnam.

I think Reagan was a poppy CIA job. Odd how after Reagan we get the same CIA connected/Mena drug connected POTUS'es. I think Reagan was the last real election we have had. He was the last non-skull & bonesman/Harvard man. Even though with the CIA pakistan visiting Indonesian - his school records are all sealed. His supposed mum was a CIA/Ford Foundation cutout.

Yeah Amerrika has presidential elections.

Obama is too arrogant a prick to make meaningful change.  Obama makes change with a hammer.  That's why his healthcare reform is a fucking disaster (and a front for union expansion).

Leglislative change isn't the problem.  Obama's shit fucking attitude toward others outside of his circle is the problem.

And when these markets tank, Obama is going to wish he didn't run for the second term.

It had no chance of passing the house so the Senate was not going to piss the electorate off. It is that simple..Both parties (yes republicans as well) want a total ban on guns...but they want to keep their jobs even more...

Socialists live through the power of the Mob. The unyielding force of the mob allows them to TAKE what cannot be earned. Discussion yields to shouting and personal destruction, as ideas lack the foundation to stand on their own merits. Obama is a leader...a leader of mobs intent on having their way.

The Mob is controlled by the demogogue and the enormous money of the party in power -In America the demogogue is simply the puppet of the elites-he who has the money and power controls the mob  - the President  (whether Republican or Democrat) is the puppet. The elites control both parties - they have a lock on it right now through their control of money  and the media. Those of us who are are informed and who do not have our heads firmly embedded up our ass -need to double or triple our numbers  -very soon - Our hope has to lie with youth  -ie -college students and young professionals -employed, unemployed or underemployed- - the average retard on the street is simply hopeless  -if we can disrupt the supply lines-so that the elites cannot adequately feed the mobs with the food, drugs and material comforts they need  -then we can recruit them to join our ranks to act as foot soldiers-mainly by promises of plunder and wealth  -theres some really good shit to steal from the Hampton's.

If that is what you think, then I suspect you might be terrified of these charts:

http://www.usgovernmentspending.com/spending_chart_1890_2012USp_13s1li01...

(And . . . by the way . . . who at least says they want to reduce spending -- if not actually do it?)

Doesn't more spending as part of the economy equal more power which equals more corruption?

I should have mentioned that these charts are all supposed to be for all the governments in the US and not just the federal portion . . . if I clicked the correct buttons.

I disagree.  (With the part about his smarts.)

I think it's rather impossible to become President of the US without being at least somewhat brilliant.  There are just way too many other people who will take your place if not.

He is just an emotional right-brainer kind of person who is fabulous at reading people's emotions, emoting with them, and telling them what they want to hear.

Think of the best salesperson ever.  What do they really know about what they're selling unless the custmomers tell them?  The salespeople aren't the engineers or inventers of this stuff, usually.

After all, emoting and selling is so much more enjoyable than actually doing hard critical thinking about cause and effect.

And, given that he is a politician, all that really matters is gaining the more power, for his politcal group and self.  The other consequences are less relevant for almost all of those folks as far, as I can tell.

Besides, he never one the Presidency of the US.  He’s jail, I thought.
