Background Check Amendment Fails To Pass Senate, Gun Control In Tatters: Obama To Make Statement

Following a full court press by the Obama administration, and specifically gun tzar Joe Biden, to legislate "stronger" gun law in the last several months ever since the Sandy Hook massacre, the initiative may have just suffered a terminal defeat following a failure to even pass a bipartisan background check amendment in the democrat-controlled Senate. CBS reports that "In a major setback for gun control advocates, the Senate Wednesday voted down a key amendment to the embattled Democratic gun bill, signaling the increasingly dim prospects of any meaningful legislative action aimed at strengthening America's gun laws. The bipartisan Manchin-Toomey amendment, a background check expansion devised by Sens. Joe Manchin, D-W.Va., Pat Toomey, R-Pa., and a handful of other lawmakers, earned only 54 votes, falling six votes short of the 60-vote threshold. Vice President Joe Biden, who led the Obama administration's months-long lobbying effort on behalf of stronger gun laws, presided over the vote."

The vote effectively kills any hope for a comprehensive law, and makes a mockery of Obama's recent aggressive anti-gun initiative:

The failure of the Manchin-Toomey amendment, which was crafted over weeks of negotiation with the aim of attracting Republican support in both the Senate and, eventually, the House, could serve as the death knell for the larger piece of legislation, though it's possible Reid will bring new amendments to the floor at a later date.

 

In the hours before the vote, Organizing for Action, an advocacy group that works on behalf of the president's legislative agenda, urged voters to call their senators in support of expanded background checks. The Democratic National Committee (DNC) sent out similar emails, specifically targeting a group of Republican senators who had at one point appeared amenable to the Manchin-Toomey language. Meanwhile, a pro-gun group that had previously backed the ban pulled its support.

 

In the end, four Republicans voted in favor the Manchin-Toomey amendment, and four Democrats voted against it, excluding Senate Majority Leader Harry Reid, D-Nev., who switched his vote from yea to nay for procedural reasons.

 

Sen. John McCain, R-Ariz., one of those who broke with the GOP ranks, delivered a vehement defense of the bipartisan amendment in debate over the bill, and disputed the argument, touted by his fellow Republicans, that it would strip Americans of their Second Amendment rights.

 

"For over three decades in Congress, I have built as strong a record as anyone in this body in defending the Second Amendment. I have consistently opposed the efforts of anti-gun activists to ban guns and ammunition, staunchly defending the Constitutional rights that Arizonans hold dear," McCain said, continuing with a list citing his pro-gun credentials. But, he added, "Just as I have long defended the Second Amendment to the Constitution, I have also long believed that it is perfectly reasonable to use available tools to conduct limited background checks, as this amendment prescribes, to help ensure that felons and the mentally-ill do not obtain guns they should not possess."

 

"In my view, such background checks are not overly burdensome or unconstitutional," McCain said.

Obama will take the podium at 5:30 pm to speak about "commonsense measures to reduce gun violence" and justify this latest disappointment of an administration which should count its lucky stars, it has the labor force participation rate to fudge the unemployment rate with, and the Fed to ramp stocks higher, or else living in America today would be a very different thing if the full ugliness of reality was exposed for all to see.

PS -- I certainly don't intend to be disparaging to any salespeople by the above comments.  They serve a very important and very challenging purpose in our society which I suspect is beneficial to everyone.

I also don't think I could do it because of the pressure of not making enough sales.

Toomey is a real POS.  I warned conservatives that he was as bad as Specter.  Santorum was 10X better than Toomey.  The state of PA should primary Toomey and run Lou Barletta.  I think Lou would beat that creep Toomey.

Did Obama happen to mention that it was a thorough bi-partisan defeat for this legislation?

I kept hearing him mention something about Congress doing what the American People want.  I kept listening to hear if he was announcing the repeal of Obamacare.  Maybe that will be in the full release of the text.

Let's hear Biteme tell us a few more times that this bill was only the start of the gun grabbing.  It really will help insure passage.

Finally, I hope that this vote will finally sink the Senate career of the odious McCain.  The bastard should have been recalled long ago by the people of Arizona.

Looking forward to mid summer, the ammunition and firearm manufacturs should have the shelves restocked again and I can BTFD. It would be interesting to see the sales figures. If this cycle runs a few more times the growth of common peoples stock of arms will hook on a chart proud enough to match another QE round. Bang!

I have a number of shotguns but no rifles or handguns.  I was going to stock up on ammo anyway, just to have something to trade if things went south.  It is darned amazing that 22LR is in such short supply.  It was only about $0.05 a round a few months ago and is now about $0.40.  And all of that has occured without any real problems, just rumors of potential problems.  that would have been the trade to have been in, not silver or gold.

I enjoy trap shooting, go to about once per month, I estimate the price of a box of cheap ammo has risen about 30 - 40% over the last year from about $5 to close to $6.75 now. .22 LR (my favorite round for woods plinking and sharing the enjoyment of shooting with newbies and anti gun folks) shelf has been real lean at my local Fleet Farm last few months and the price has risen big time too. June of 2011 I picked up a case of 7.62X39 at  21 cents per round. Same round at case price is going at about 40 cents per round now (close to double the price in less than two years). Wish I could have bought more back then, as you say would have been good to trade in Augustus.

I do object to the tactic of opposing the closure vote.  If the Repubs had a hair on their collective asses they would have allowed the vote and forced the so-called "Conservative Democrats" to vote againts their constituencies.   As it is, they can claim it failed on a procedural vote, which it did.  Sackless fucks.

So I get an email from the fucking RINO in Illinois, Mark Kirk claiming 40% of all gun sales occur without a background check. I've heard that number bandied about a lot, but how realistic is it?

There have been nearly 71 MILLION documented background checks done for firearms purchases since Obameo took office, so does it sound reasonable to anyone that there have acurally been 118+ MILLION purchases? I'm not an expert on other states, but in Illinois you cannot buy or sell privately to anyone without a FOID card, which means even for private sales a background check has been done at some point, since one is required to get the FOID in the first place. Even at gun shows.

Where the eff are they getting that 40% figure?

Bill did pass with a majority but because it basically takes 60 votes now in the Senate to pass through any legislation due to a few Senate procedural rules (that have nothing to due with the Constitution and aren't found in any part of it) it didn't go anywhere.  Most of those procedural rules too were only really either invented or passed in the past 40-50 years.  Constitution specifically calls out what Congressional powers the Senate is supposed to have and the types and number of votes required for special types of bills.  Otherwise it was supposed to be a simple majority just as in the House.

It is ironic too that you hear people here keep ranting mindlessly about the Constitution too and the original 2nd amendment when the Founding Fathers (especially Madison) were terrified of the common masses/mob mentality and created the Senate with almost all of the important powers in Congress, 6 year terms, and no direct elections for Senators.
