Guest Post: This Is What It Means To Be Free In America

I really hate to be negative... but this is positively revolting. Disgusting. Indescribably offensive.

In the Land of the Free recently, a California couple had their child kidnapped by the state. At gunpoint.

It all started in mid-April when Anna and Alex Nikolayev took their 5-month old son Sammy to the hospital in Sacramento to be treated for flu symptoms.

The parents didn’t particularly care for the treatment that their son was receiving. Doctors were pumping him full of antibiotics and soon began talking about performing surgery.

Anna and Alex argued with the doctors and said that they were going to get a second opinion; they took the baby and went to another hospital where another physician deemed it perfectly safe for the child to return home with his parents without the need for surgery.

The next day, with the family resting comfortably at home, the police showed up with Child Protective Services.

Alex, the father, went outside to talk to them where he was thrown to the ground by police. Officers then relieved him of his house keys and proceeded to let themselves into the house with hands on their pistols.

Then, still with their hands on their pistols, they told the mother “I’m going to grab your baby, and don’t resist and don’t fight me…”

The child was then ripped from his mother’s arms and placed into state custody, where he remained for a week.

Yesterday, a Sacramento County judge ordered that Sammy be transferred to a hospital in Palo Alto (120 miles away), and that his parents finally be given unfettered access to their son... under the condition that the State of California’s Child Protective Services continue to monitor the ‘situation’.

Guns. Cops. Government bureaucrats. Courts. Kidnapping. A dysfunctional medical care system.

This is what it means to be in the Land of the Free... where collecting rainwater, consuming raw milk, or seeking a second opinion on your child’s medical care is now criminalized.

When you don’t even have the basic right to make decisions about your own child... and when your own child can be forced from you at gunpoint in your own home that was entered illegally... you know that freedom has officially hit the waste bin of history.

Perhaps the greatest irony is that the parents are originally from Russia... but they had to come to the United States to find the Soviet Union.

In my experience w/ a lot of LE, they fall into two brackets.

One, the ones who actually have the calling, and the second for the POWER trip.Sad that 85% get shit talk because of the 15% of dikheds.

Marcia Clark got just as many juror choices as the defense yet couldn't find a single person who thought the LAPD would never set someone up. Cases like this come back to bite them years later and they wonder why.

Either you live in a microscopic town or you got your ratio reversed?  I am guessing "good" cops make up 15% of the force in big cities.  They have been deliberately marginalized for decades.  Their only purpose at this point is to make the system look slightly less rotten.  If they were truly good cops, they would have quit so as to keep what is left of their souls. 

City cops these days are selected for obedience without question, not giving a shit about the people, small penis syndrome, gangsterism, sociopathy, and even low IQs.  A borderline retard can figure out that the worst crimminals are the ones who buy the laws, but it takes a special kind of narcissicistic sociopath to ignore this fact, commit enough crimes in a week to earn himself a life in prison if he had done them without a badge, and then congratulate himself for nobly enforcing the law of the rich against the poor.

Cops ALWAYS support the system, no matter how despotic.  They are on the wrong side of history EVERY.  FUCKING.  TIME.  And they never learn.  It's always "If we had just cracked a few more hippie skulls, framed a few more minorities, there would be Law and Order"...

How many cops were worried about shooting innocent people while Dorner was loose? They burned a house down around him.

How many cops were worried about civil rights while looking for Tsarnaev brothers? They shot into a boat for 1/2 hour without any return fire (he was unarmed).

Jose Guereña was shot by a Pima County (Tucson) SWAT team and they watched him bleed out for 1/2 hour and die.

The police are not your friend. None of them. They wouldn't be part of a corrupt system if they had any honor.

It's like that dude from the Korean war documentary said. The life expectancy of a machine gunner is about 5 minutes. We outnumber them well over 100 to 1. Yep. We have a ton of hunters in PA. When I moved out here, my one friend said "Welcome to the Sniper State". 

A lot of these hunters hunt for the purpose of putting food on the table. DotGov starts screwing with their right to feed their families, and S will HTF quick.

Also have a healthy amount of ex-military personnel around here, not to mention farmers, and survivalist types.

Vato, you nailed it. I often look at the relatively civilized state of prewar Germany. These were very smart, civilized intelligent people as a nation. Yet, with little bloodshed you could mobilize the whole country to essentially oppress itself. On one extreme you had the "believers" in the National Socialist party. On the other hand you had vastly more. These are the sheep. I bet if you asked about rounding up Jews and other malcontents and sending them to death you would get a response along the lines of "I was just doing my job. What could I do?".  Most your fellow citizens and especially the government workes will sell you out in a heartbeat to preserve themselves. They don't have to have guns to their head. Someone just tells them it is their duty and to get the next paycheck they need to go find you.

It really bugs me at my core to know that it is so easy to do this. If you read the comments on Yahoo or a dozen other places you realize there is a ready made government educated low IQ (who think they are high IQ) populace primed for this. They are the ones who think seat belt and big gulp laws are good for society and freedom is kind of dangerous.

It would really be a crying shame if someone were to see a cop beating his child. After all, the guy is under so much stress. And cops have a high suicide rate. And they have guns in the home. Someone should really call CPS and get the children away from such a dangerous and unstable person. The caller probably shouldn't give their name, being a neighbor and all, the cop might retaliate. The point is that this is happening too often, all over the country. In Boston they declared de facto martial law using the excuse of one 20 yr old loose. (How many dangerous felons are loose in a city the size of Boston, every day ?)  There are cameras at intersections all over the country. The cops are being federalized/militarized everywhere - in a small town where some of my family lives there was celebration over the fact that the town PD got a humvee and other equipment from the Feds recently. What the hell for ?  Theyve got two or three cops and one isnt even full time.

They didn't get an official 'release' from the hospital.

When my father was dying from a failing heart, he wanted to go home and die in his bed. I told the doc I was taking him, but the doc told me no. He said he wouldn't sign the release, and if I took him anyway he would have me arrested. He said if my dad died after I took him out (well, yes, he was DYING!), I could be arrested for depraved indifference.

Four and a half months later, he died in the hospital.

What about a second opinion?  What about hiring a lawyer for an hour to "fire a shot across the bow" of that quack?  What about hospice?  And that's just off the top of my head.  If you wanted him out--and he was stablized--you could have gotten him out.  I hope your kids do better by you.

My mom was intimidated by the doctor, and caved. I argued with her, the doctor, the hospital admin. Then I went to a lawyer who said I had no standing, only my mother did. Believe me, I've never felt so enraged and helpless. By the end, my mom was deeply regretful. She told me that she felt she couldn't just let him go, that she wanted more time, that she was afraid of the Dr. And, at last, she honored the living will to disconnect him.

The bastard doc stood by my dad's bed and repeatedly said "Richard, do you understand your family wants to allow you to die? Do you understand you will die?" My mom started crying and said maybe we shouldn't do it. I brought a piece of paper and pen to him and he scrawled "I want to go home to my Lord." And it was finally over.

you, your mother, and your father all did the best you could do under a system that expects uniformity, one size/solution fits all.

in the end you learn a valuable lesson about this medical system, and pass that on to others, both within your family, and here.

that's the best we can offer, exposing the systems, thinking outside of old ways of being taught how to act, and that's a form of cultural evolution, one person at a time.

@20834A...As a libertarian one of the fundamental assertions is, "You own yourself." Many other ideas flow from there. I work in the medical field and your story is revealing. It actually does prove that we do NOT own ourselves in our free country. There was a time that your dad could go home and die with dignity, in a place he loved with people he loved. While sad, it would have been a great send off. I hope I can go like that one day, actually.

In America, is there any doubt by anyone outside the leftist Kool Aid drinkers, that the government does own us. We are free to do what they tell us to do and run around in the little backyard of choices they give us, but crawl over the fence and you will be punished.

I was avoiding being served for one of those speed camera tickets for almost a year. The guy would come ring the doorbell, every day at first, then down to once a month at the end. We have one of those security doors, so every once in a while I would answer and tell him to get lost. I had my wife & kids watch so they would know how to handle him, don't answer, if you do, never say your name, or admit to or agree to anything. Just shut the door, etc.

So, I'm not home, the wife answers the door and takes the paperwork.

"What was I supposed to do?"

Check your own state laws . . . . that said, the best action is to respond to the notice. Not ignore it.   There is a box to check on many of them where you can indicate if you were not the driver at the time of the ticketing. These tickets often arrive weeks after the incident and who knows if your wife, son, daughter, friend, or whomever was driving your vehicle. You are not obligated to indicate who was driving, that's their burden to prove. In our state it against the law to have face recognition type cameras anyway. Since they cannot prove that you were driving at the time, if you sign that you werent, its likely the case will be thrown out. In many places you never hear from them because they know they will lose. They count on the ignorance of the citizenry and that they will just send in the payment, which is admitting that they did the infraction. In some areas, if they don't hit the 'revenue' (robbery) levels they want, they reduce the timing for the yellow light until enough people are ticketed by the camera. A private company comes into these cities and offers to set things up for them for a cut of the 'revenue' (robbery). Often, they will say that the infraction is treated like a parking ticket and won't imipact your insurance rates. Its not about 'safety', its about getting your money.

If you, I'd do some research. See how this might apply to your situation.

I did the research on how the locals handled these camera tickets. They were all about the money. They couldn't take you to court because you were never 'served' by the camera. EVERYONE found out about this and NOBODY checked the 'yes, it was me' box and mailed in the $330.

Suddenly, process serving was a booming business. Once they successfully served the wife it turned into an extortion racket. Pay the ticket, plus a $40 service fee, or go court and pay $1k court fee, and the $500 warrent fee, and risk being arrested between the time the warrent is issued and the court date.

The good news is that the camera system lost money because large numbers of people successfully evaded being served. The bad news is I was caught and paid.

It was more of a crusade here in AZ. Everyone was refusing to pay in an effort to break the system. It was one of the few times I've seen a grassroots action work. They wouldn't admit it. They said it 'wasn't cost effective'. Either way, the cameras are gone .

In my country, to my great surprise people actually got off their backsides and did something about those "cash cameras".

The cameras cost 40,000 quid each, but the the surplus motorcycle tyres and quart of petrol (gasoline, I think you call it over there) required to neutralise the problem could be had for free. It was a simple matter of economics, and "authority" folded like a wet paper towel...

You guys have firearms, should be a piece of cake...

Here in AZ a guy walked up to one of those camera vans they park on the side of the road and shot a bunch of holes in it. Unfortunately, one of the tech guys was in it at the time and ended up dead.

After that they passed a bunch of laws requiring the death penalty for anyone who fucks with a camera. It was widely hailed as a huge leap forward for mankind.

It is very easy to beat people who expect free (lol) access to the best cancer treatment money can by, government assisted child care, the social safety net, college tuition assistance, etc. It is very easy to beat people with rationed luxuries as long as you comply sold as being free (lol) and a false promise to take the risk out of life.

Look at our education system, by my count we have at last since the 30s entire generations almost completely co-opted by the education system implicit threat to conform or lose access to high paying jobs. Write a philosophy paper about how free (lol) contraception is a woman's human right, and you are guaranteed an A no matter how poorly written. Write a paper about how income taxation is legalized partial slavery, and you better not have a single grammar error, have lyrical prose, and an ironclad argument that anticipates any objection or you fail out. Not start out the indoctrination at a young age and people won't even realize how they bend over backward to conform.

What if he died?  Does that mean that, if you might make a mistake doing something, that the government can tell you how to do it?  To prevent a mistake that may cause injury or loss of life?  Is the government so omniscient that it never makes mistakes or causes injury or loss of life?  Are we so in capable and irresponsible that we need the government to make decisions for us, in order that we may never fail?  Are we children who need to be told how to raise our kids?  Because the government always does the right thing?  And the government can never faily?  And our government never kills kids?

This I really don't get, and I think is the root of our problem.

Life is life; somehow we have all bought into life being this journey that will last at minimum 80 years.

There are no guarantees in life.  People die "before their time" every single day of the week.

I certainly do not want the power of the medical community to be backed by the power of the state.

It is MY life, is it not?  If I have kids, am I not morally responsible for their care until they can care for themselves?

Yet we happily cede this responsibility of life to some social construct?

Courts need to revist the notion of qualified immunity so that we can start to sue "public servants" personally for violation of constituional rights.  A couple of these assholes loosing all of their assets and pensions will make them think twice.  Additionally, courts need to acknowledge that the family courts and CPS are subject to the Constitution just like everyone else.

Don't know about the situation in the US Armed Forces, but in the UK, the Chaplaincy (Military) were the only service that did not bear arms, and did not undergo any form of weapons training. They were not required to undergo Basic Fitness Assessments either (although all the Chaplains I knew were just as fit as all the rest).

What was the diagnosis from the first hospital? Likely there was something therin that raised concern in regards to the childrens safety, hence the call to police.  Sounds like the typical victim story my kids tell me when they are in trouble and I ask them what part they had in it.  Usually the answer is "nothing, I did't do anything.  We be missing some facts and someone sounds like they are playing too much the victim here.

second opnion said all clear. what the story does not say is the red flag was the parents took the child without a formal discharge and the judge put the kid back into a hospital run by the same company as the original hospital. of course, no one looks at whether the family had first class insurance and the hospital was gouging the policy for all it could get because that is the incentive for profit medicine.

As a homeschooling family this is a real and perpetual threat -- all it takes is an anonymous "tip" from anyone, and the SWAT team could descend on my home for any reason whatsoever and potentially invade my home to take my kids. 

We buy private legal insurance for this every year to defend ourselves from this very thing, even though legal representation would be after the fact a few of my teeth got knocked loose because the 'roid rage cop body-slammed me on my front porch and put their jackboot on my face.  Just because I moved too slow, or I verbally protested the legality of their actions, or because he just felt like it.

My wife and I talk through this scenario of our rights (hah!) and how to respond whenever we hear of similar stories like this.

Time to have that conversation again.  Sucks.
