IRS To Conservatives: "Provide Details Regarding All Of Your Facebook Or Twitter Activity"

It has become difficult to keep track of all the different "-gates" the Obama administration has suddenly found itself embroiled in: perhaps an appropriate name would be Gate-r-gate? And with the just concluded farce in which Jay Carney passed off all AP-related questions to Eric Holder, who in turn recused himself and told the media to please crucify the Deputy AG instead, it is unlikely that any material new information will be disclosed any time soon. However, courtesy of The Hill, we at least have some insight into the first gross offense by the administration revealed last week: the targeting of one political group over another by the supposedly impartial IRS. Specifically, attached below is the full 7 page questionnaire sent by the IRS to the Liberty Township Tea Party containing a list of 35 questions. 

Listed here one can find such pearls as "provide details regarding all of your activity on Facebook and Twitter", "Provide a list of all issues that are important to your organization", "do you or will you rate candidates", "you have conducted polls of of your membership to determine which candidates and issues they are supporting. Provide details on this process", "Do you conduct media advertisements lobbying for or against legislation?", "Do you directly or indirectly communicate with members of legislative bodies? If so, explain the amount and nature of the communication", and finally "provide details regarding your relationship with Justin-Bink(sic) Thomas." It appears Justin is someone who according to the Daily Kos, "claims that the government is bailing out too many people who don't want to work." Surely, for the IRS, this is "need to know" information.

Good on you man! I cut my hours to part time the last two years and am so much happier for it. Ends don't meet the same way they did (didn't really think about it then and still had extra) but I spend an assload of time with my young kids. In the end time is your  most meaningful and limited commodity.

PMs are for the next generation (I hope) but if crap hits the fan I will have something to bargain with. Precious and base metals, skills and a little good land.

Well said, Doc. And good luck. I did something similar at the end of last year - left a "ladder climber" position in my corporate main office for a "dead-end" field assignment in one of the corporate outposts where I can go back to being an engineer on a day-in day-out basis.

Turns out it didn't even cost me at all in salary (I expected at very least a 10% haircut) and only a bit in vig and scratch. Best decision I've made in years. I'm home more, far less travel, and I'm doing work I like opposed to doing work that will "get me connected". Win-win.

As painful as this is about to be, I'm going to defend the IRS, sort of....  This questionaire is obviously the product of someone in a political capacity.  A career IRS staffer would ask the questions differently and wouldn't think to ask others.  The political person's objective is obviously to gather information to be used to counter conservative grass roots organizing activites.  Remember that Team Obama was very threatened by the Tea Party et al in 2010.

Also interesting to note that in asking for the facebook and twitter data, the IRS is compelling the target to violate the terms of service with the websites, which I think for at least Facebook is asking them to violate federal law.

I had a friend write me a check so he could use my account with a printer I use all the time to get some flyers printed. I did him a favor so he could save about $1000. The check was to reimburse my expense, so I didn't declare the check as income.

Of course the bank reports the deposit and the IRS finds it. So they come after me for taxes owed. I show them the invoice from the printer matching the reimbursement exactly. I explain the payment, show the transaction paying for the flyers. Nope, the payment needed to be counted as income and I'm hit with $2300 in taxes, fees, and back interest.

Of course I could have hired a lawyer and probably won, but it would have cost me more than $2300 to fight. IRS wins.

FUCK THEM ALL.

They wonder why there is barely a single legitimate business left in the USA.

$2300 in taxes/fees for $1k sure doesn't make sense.  That would put you in a 200% tax bracket.

I had something similar happen and it wasn't nearly in that capacity and was a honest mistake on my part

I saved my friend $1k. The total job was $4800.

It was counted as self employed income so I owed FICA taxes on top of the income tax.

That doesn't make any sense...  if you didn't make any money on the deal (he just paid you what you paid the printer), then you wouldn't owe any taxes...  (you'd still need to file an informational return).  Also, I presume that you filed your own taxes?  If not, then your accountant could have likely responded to the IRS for much cheaper than your cost guestimates...  although this depends on your location.  Needless to say, it makes no sense why you would get nailed for tax on the $4,800 if you actually paid for the printing service and made nothing on the transaction.

I have no doubt that tax authorities make errors and/or incorrect arguments all the time...  I've even been subject to them...  but their allegations aren't dispositive of the matter...  I can't fathom why he didn't have a successful response to their allegations based upon the facts he presented to us.

Also, he might think about amending his return, presuming that option is still available.

For anyone who has ever been audited, this is exactly how it works.  Threatening letters with tons of questions that must be handled by a deadline, usually 10 - 60 days.  Then, once you get it back to them within the deadline, you can wait 10 months before hearing back.  This goes back and forth multiple times unless you are fortunate enough to bump up against a statute of limitations.

My dad was audited because a company he worked for cut back on the travel budget so he had far less expenses to declare. He paid the IRS a higher percentage of his income which triggered the audit. It took over a year for the audit to run its course.

Thanks knukles.  That's a high compliment.  My story is a little different however.  I knew the sex thing was drawing to a close for me when Mrs. M and I started having serious financial discussions or discussions on other such topics during intercourse.  Are we discussing finance, what pulley is squeaking on the Town and Country van or having sex?  Sex life took a real turn for the worse for me when I started blogging while having sex and that did not go over well.  That's why internet porn is so great.  We don't have time to fast forward.  I think IR would agree.

The IRS took the time to scrutinize my measly 30k income two years after the fact and decide I owed them 2.2k.  It was 'legitimate' and an oversight on my part, but I'm a stone you can't squeeze much more blood from.

And notice on page one that the IRS demands that the person responding certify their answers. What is not said is that a misstatement of facts is a felony under 18 USC 1001. It is felony to lie to an employee of the federal government, but not any crime at all for them to lie to you. Keep that in mind the next time you interact with any federal employee.

I watched "Real Housewives of Atlanta" once, as its filmed in my hometown. In the episode I saw, one of the regular cast was going on about her tax exempt "foundation" and how "we all have them." I wonder how many of those ladies received questionnaires from the IRS.
