As we noted yesterday, the IRS' head of exempt organizations who started the whole IRS targeting scandal, is testifying this morning and is expected to plead the Fifth. One wonders why, if as the IRS claims, there was no illegal or illicit activity involved. Watch her plead "da Fif" live here...

Why is that when the IRS invoices a group of right-leaning protesters for legitimately owed taxes, that the right immediately assumes that they are being 'targeted'? The IRS is not going after right-leaning protesters for 'legitimately owed taxes', they're going after right-leaning protesters... because they're right-leaning protesters. And this is not something the IRS has the right to do. Additionally, the nature of the IRS leaning on the right has shown that they are completely out of control. Finally, this story is not about right-leaning protesters, overall. It's about the IRS and their abuse of power as they are being used as muscle against opponents of this administration.

I think it is charming when individuals in law enforcement, and the IRS is largely that, hide under the fifth amendment to protect their own hides (and the hides of valuable connections) from exposure for crimes against non-governmental entities, i.e. taxpaying citizens. The fifth amendment is designed as a check against governmental overreach, not as a shield for governmental overreaching. Nice inversion there. 

Also, who doesn't love the feigned outrage of the miscreant as she angrily and contemptuously obstructs Congress in its only too rare efforts to actually protect the people from the damned government? Da noive of dese people!

For the most part, the force held fixed posts and performed duties that would be considered safety functions today, such as: eliminating fire and safety hazards, patrolling buildings, detecting fires, and providing the first line of defense in fighting fires; and answering visitor questions, assisting citizens, rendering first aid, and directing traffic when necessary. By 1960, the mission of FPS became the first line of defense against bomb threats, bombings, vandalism, mass demonstrations, and violence against Federal buildings.

Am I mistaken but isn't intimidation which is what the IRS basically did, along the same lines of boycotting, shunning, shutting down the businesses of; and eventual extermination of the Judens in Germany during WWII? Not saying being black is/was same struggle as being gay in Amerika ...but ....isn't it like this or at least the "beginnings" of such a terrible path? IRS = KGB?

You can not pass an Amendment to the Constitution that violates the Constitution itself, PERIOD!!!

The sixteenth amendment doesn't authorize the taxation of "whatever source" but the "income, from whatever source derived." The use of the word "income" in that amendment is what prevents the Congress from defining income because there is no legislative enabling clause.

That would seem to mean that the congress also would be precluded from defining "whatever source." Since the net effect of the sixteenth amendment is solely to remove the "income" tax from the area of direct taxation, the principle on which the Pollock case was decided, thus removing the need for apportionment among the several states, that leaves the income tax in the area of excise taxes

This, then, leaves the congress in the position of being able to tax only that which was taxable prior to the passage of the sixteenth amendment, Duties, Imposts and Excises.

"... [the 16th Amendment] conferred no new power of taxation... [and]... prohibited the ... power of income taxation possessed by Congress from the be ginning from being taken out of the category of indirect taxation to which it inherently belonged...".

FACT: In briefs and argument before the Supreme Court in the case of Brushaber v. Union Pacific Railroad, both Brushaber and the Government claimed that the 16th Amendment provided for a direct tax exempted from the Constitutional apportionment rule. The High Court called this claim an "erroneous assumption...wholly without foundation."

FACT; Just weeks after the Brushaber Case was decided, Mr. Stanton, in the case of Stanton v. Baltic Mining Co. again claimed (35 times) that the 16th Amendment created a new class of constitutional tax, that being a direct tax exempted from the apportionment rule. The High Court said in this case that the 16th Amendment created "no new tax

FACT: In the Stanton and Brushaber Cases, the Supreme Court ruled correctly by excluding direct taxes from the 16th Amendment. The intent of the American People and that of Congress was never to directly tax the American People, but only to tax income severed from accumulated wealth

All income tax acts under Subtitle A of the Internal Revenue Code are based on the above, and are classified by the Supreme Court in Stanton v. Baltic Mining Co., 240 U.S. 103 (1916) as indirect taxes, which means they can only be excise taxes on privileges and may only fall on businesses and not directly on citizens:
