The NSA Spy Scandal Debate: Obama 2013 Vs Biden 2006

Tyler Durden's picture

Several days ago, in the damage control aftermath of Snowden's NSA espionage conspiracy fact confirmation, Barack Obama took to the TV pulpit where he appealed to the nation, as he always does in times of strife, explaining that one can't have 100% security and 100% privacy. He said some other things, all of which as usual wrapped in rhetorical brilliance, if holding little of pragmatic and realistic value. So who better the debate the president's attempts at damage control than the vice president himself. Here, for your viewing pleasure, is Joe Biden, circa 2013 debating Barack Obama, circa 2013.

As for the false dichotomy between security and personal privacy and liberty, old Ben said it best.

And now this..."someone" hacked into Sharyl Attkisson’s computer(s)...

“A cyber security firm hired by CBS News has determined through forensic analysis that Sharyl Attkisson’s computer was accessed by an unauthorized, external, unknown party on multiple occasions late in 2012. Evidence suggests this party performed all access remotely using Attkisson’s accounts. While no malicious code was found, forensic analysis revealed an intruder had executed commands that appeared to involve search and exfiltration of data.

This party also used sophisticated methods to remove all possible indications of unauthorized activity, and alter system times to cause further confusion.

CBS News is taking steps to identify the responsible party and their method of access.”

There is LITTLE the Founding Fathers missed. They fought the same shit way back then and crafted a Constitution that they thought would cover the bases..... and it did.  Unfortunately, the sheeple have strayed far and away from it. There is likley not a single politician alive today who could justifiably wipe the ass of Washington, Jefferson, Franklin or any of the other 53 brave men who stepped up to make the USA happen.   It is truely sad.

.

There is LITTLE the Founding Fathers missed.

Most of what they missed was probably considered common sense at the time and thus presumed to fall under the ninth and tenth amendments.

They made one critical misjudgement, though, in their endeavors to shackle those powers a central government would be tempted to abuse. They needed to contemplate the behavior of a central government run by the most criminally corrupt members of society, with legislation sold to the highest bidders and interpreted by courts functioning not as a justice system, but a legal system.

A few suggestions for improvement off the top of my head:

No executive orders. The president cannot legislate.

No relegation of powers to other branches. Example: congress must declare war against an enemy nation before the president can order military deployments.

Laws cannot exempt or give special treatment to legislators, law enforcement, government employees, agents or contractors of the government, or the military.

The relationship between the states and the central government is voluntary. Secession is explicitly permitted.

Interstate commerce means exactly that - tangible, demonstrable commerce, not potential or theoretical commerce or effects.

Modified stare decisis: court decisions which increase the scope or power of centralized government may not be used to establish case law or binding precedent.

That's a start, anyway.

You're a good philosopher but a poor student of history.

You're correct that many rights were so ordinary and common back in the day they weren't even considered necessary to specifically enumerate in the Bill of Rights.  One glaring example is the right to travel.  It is abundantly clear from literally hundreds of high court cases over time, particularly since the advent of the automobile, and the right to travel has been reiterated time and again as a fundamental, unalienable right of the people.  The people also own the streets, roads and highways.  Yet these days, try getting in an non-registered car to travel.  You'll get stopped for not having registration (which is not required to use one's property on public roads) and then probably either ticketed or arrested for not having a driver's license (again, not required to travel, only to drive).  Search the web for "right to travel" and marvel at the spectacle.

Now, as for the rest of your complaint, I think you are misinterpreting what the Founding Fathers gave us.  First of all, the federal (central) government was initially so weak, the only way it could fund itself was to collect various excise taxes, normally on the various venues of commerce that the Federal government is delegated to regulate.  But it was enough to performs its intended delegated functions, and it did so just fine.  In fact, today, the Federal government is well-funded, so well in fact that it gives billions of dollars in foreign aid yearly to those paragons of democracy, Israel and Egypt, among other US satraps of the world.  And if you think it comes from income taxes, you're wrong.  It still comes from excise taxes.  Your voluntary income taxes go towards paying off the debt from the Revolutionary War (oh, the rabbit hole goes deep, my friends),  a perpetual debt that was never intended to be extinguished, just like student loans and credit cards.  You think this trick is new, this debt enslavement?  First They perfected it on nations, now they are employing it on each man and woman.  But I digress.  The federal government we have today is an unmanageable leviathan that was never meant to be and must ultimately be slain to be overcome.  I don't believe there's any way to repair it.  It's Rome 2000 for us.

Lincoln issued the first "Executive Order".  Before that, an executive order was an internal affair, directed at the agency that the president was commanding.  But Lincoln's order of October 20, 1862, which was an extra-constitutional usurpation of power (requires time to argue properly), was retroactively labeled as EO #1 in 1907 when the Executive Order was codified and enumerated as US (i.e. District of Columbia) corporate policy.  It's interesting they chose to begin numbering the EOs from Lincoln's order of 10/10/1862, which was perhaps the first extra-constitutional usurpation of the (then) modern presidency.  So, no need to do away with a power not already delegated: executive orders to legislate the nation's laws are not constitutional, but they are perfectly fine to instruct the employees of the federal government, for which they are truly intended.

The same is true of the power to declare war and the air (and reality) of total immunity government servants want to afford themselves these days.  Its a total perversion of the Constitution, but perfectly acceptable for a corporation to employ as its private policy.  So the corollary is, if you don't want to be affected by their policy, don't be an employee (subject) of US Inc.

The relationship between the states and the federal government is not the problem.  The delegation of authority is specific and explicit: it emanates from the people to the states, which then further delegate their authority to the federal government by agency of the people.  Secession is unnecessary as a remedy for grievance if the federal government were checked and relegated back to its proper role.  The reason secession is not a right inherent in the Constitution ready to be employed willy-nilly is because the people want a stable government over which they are always master.  They want stability in their lines of trade and commerce between Union states.  If a state could secede anytime over some nit-picky shit then--guaranteed--the united States of America would never have gotten off the ground because there would have been so many secessions caused over petty differences and squabbles between states that it would have soon proved imprudent to allow such a policy if one were interested in a stable union.

So you got the right idea, you just don't need to re-invent the wheel.  Everything we need is already there to fix our problems.  The real problem is ignorance ("My people perish for lack of knowledge" - Hosea 4:6).

I am Chumbawamba.

One approach to cutting through this ongoing, sickening, devious, tyrannical, manipulative so-called-presidential 'talk' is to look for the inarticulate major premise, in this case, "you all asked for 100% security, didn't you, know what I'm sayin' ", and then find the fallacy, in this instance, when did I for one ever ask for that, and when did the arrogantly and presumptuously asserted public "you" ever ask for that degree of security?

So none of us now or ever asked for such security, and you want us to sacrifice and give up exactly what?

The people of Bahston seem to want 100% safety. They were happy, no, DELERIOUSLY HAPPY, to be ousted from their homes at gunpoint, so do you think that they would object to just a little tyranny from their saviours? Keep Fighting.

They have everything of your life. Your only mistake is to be ashamed about any of it and let them use it as leverage. You have skeletons? Out them, own them, repent for them, and there is no power left. Their power is based on your internal shame / guilt / fear. You have secrets? Tell them to the people who might be hurt by them, explain, and ask forgiveness. An open and loving heart gives them no power.

This is why the little kids are used. For them, for those who cannot come clean, sadly: not our juridiction. Run, run, run. And the Church is at the centre of that. The Angels are not amused. We will hunt them until the ends of their existence.

They're on your side, you muppets, and got fucked over so badly it's not even funny. They were fighting this fight before you even knew it existed. If you need a translation: playing by the rules lead to them getting fucked: so they played the inverse card and copied the tactics used against them. Learn Irony, ffs. Of course, it got polluted later on, but never think this is a static revolution.

I genuinely don't think its a long shot. I don't think the guys at the top are stupid, i think they know there is something terribly wrong with the way things are. I read somewhere that 80% of the military supported ron paul in 2012. I do think however we will see a military coup sometime in the near future. This will coincide with a natural return to a gold standard and a collapse of the currency. I think.

The "Dudes at the top" didn't get to flag rank by being bold, independent thinkers. You don't get a star on your epaulet without being a "yes" man, a genius at political infighting, and major skills in working a public bureaucracy for personal gain. These guys have all the moral principles of your typical rattlesnake. They will NOT be leading a revolution.

There is a reason that most coups are led by Colonels.

My guess is, if anyone in the military is going to take action against this thoroughly corrupt and decrepit white house, congress, and supreme court, it will be the Special Forces. And if I'm smart enough to figure that out, as sure as Joe Biden fucks 6-year old boys, the White House has figured it out too.

Why do you think they assassinated a good chunk of Seal Team 6?

Way too many idiots around here. Revolution? In the US? Seriously, how dumb can you be? When other countries fight with their lives to save a park, the Americans keep watching their dr House, NCSI, Kardashians and other similarly enlightning shows. A revolution is not something you wait for. If you are really fed up with something, you go on the streets and adjust things. Revolution? Special forces? I am surely younger than most of you here, but your naïveté is astonishing.

It's sort of like how women gravitate to arrogance and personal aggrandisement, not realizing that a sensible confident person doesn't need to project such false images.

It leads to horrible outcomes however. As those who willingly project themselves in such a manner often harbor deep resentment for actual talent, or the free expression thereof.

Good analysis.

Women want structured secure environment bottom line.  If a corp provides it and a guy doesn't, she'll keep the corp ahead of the guy, maybe get rid of the guy.

Love, intimacy, children, family, all sacrificed for her corp "boyfriend".  That's how strong her need for structure and security is.

But it's not entirely her fault.  Maybe she can't find a man structured and secure like her corp "boyfriend".  Nope, great at video games doesn't impess her.  Shitty go-nowhere career doesn't impress he even if it pays well.  Other signs of drifting thru life / no goals / no drive / no determination frighten her away from him and toward her corp "boyfriend" displaying none of those negative signs.  She's not looking for achievement per se.  Achivement means security in her mind.

Yep, guys have to compete with a corporation now for a woman's attention and loyalty.  Wasn't that way 50 - 60 yrs ago.  Back then a guy WAS the corp and security and all that.

This is the average woman.  There are extremes on both ends of the spectrum.

The majority of Americans want every flavor of near absolute security they can get -- that would be the problem.

Econcomic security (welfare, health care, Social Security (soon to be welfare for the elderly), loan subsidies, loan forgiveness, etc) and physical security.   Look at the many billions we spend (in time and money) just to make sure another airplane does not go down -- absurd cost / benefit (and I fly a lot).

I disagree.  I don't think we're close to a tipping point.  To be close presumes the people are informed of what's going on, yet easily 50% of Americans probably could not name the current Vice President.  It's a nation of stupid sheep.

So I don't think people will be forced into a choice, rather I think they'll get up one morning and not have any funds, bank cards dead, credit cards frozen.  Until that time, the idiot masses will continue to follow STUPID shit.  Eg, Paris Hilton's new movie review over on Yahoo has 20 times the number of visitors than this thread.

And those are the same people are going to be crying like little girls the day the rules change on a government whim and they DO have something to hide.

The fourth amendment isn't about hiding illegal activity. It's about making sure the government doesn't pass laws creating its own authority to be Orwellian today or ever because you may not like the Orwellian government next year, and it will be too god damn late to do anything about it then.

THAT is what pushed Snowden over the edge. He realized how close the government was to giving themselves irrevocable powers to violate the fourth amendment before citizens noticed and could stop it. We're forced to rely on dim-witted Congress and the NSA-friendly Justice Department to be our constitutional watchdogs, and they will sell us out at the drop of a hat.
